BACKGROUND

The Board of Education authorized $5 million in funding in fiscal year 2014/2015 for the purpose of capital facility maintenance and construction projects. These dollars were combined with other available capital funds such as Deferred Maintenance funds which created an opportunity for major quality and quantity of work to be completed at our campuses this past summer.
These projects were completed on schedule while also performing the standard summer moves, routine maintenance, cleaning and required repairs.
REPORT
This summer, the Maintenance and Construction Department, led teams of District trades crews and managed outside contractors to complete the following important capital facilities projects at District sites.
1. Modesto High School, H-Street parking lot replacement: existing lot had heaving asphalt due to tree roots; $200,000 project, completed November 2014.
2. Downey High School, varsity baseball backstop replacement: Replacement of existing backstop and infield; $125,000 project, completed March 2015.
3. Modesto High School, walk-in box replacement: cooler and freezer replacement required due to county health concerns; $120,000 project, complete August 2015.
4. Davis High School, Enslen Elementary, Fremont Elementary and Roosevelt Jr. High paving and playground asphalt replacement; $2.5 million project, completed August 2015.
5. Beard Elementary, EI Vista Elementary and Sonoma Elementary School play structure replacements: replacement of play equipment, including containment pit with ADA ramps; $338,000 project, completed June 2015.
6. Marshall Elementary, Exterior painting: repaint entire exterior of campus; $160,000 project, completed August 2015.
7. Transportation Yard, Paving replacement and office renovation: replace asphalt with reinforced concrete and front office renovation; $2 million project, completed September 2015.

11. Bret Harte Elementary, Hanshaw Junior High and Johansen High School, Roofing replacement: replacement of various classrooms and hallway roofing systems, as well as the gym at Johansen; $500,000 project, completed August 2015.
SUMMARY
As with many California schools, due to budget constraints and other priorities, aging sites have not received the maximum deferred maintenance and needed attention to upgrade. The Modesto City Schools Governing Board, however, has recognized the facilities needs of the District and provided available resources to address high priority issues resulting in the large number of 2015 capital project accomplishments.
District staff, vendors and contractors worked tirelessly for months to problem-solve and meet deadlines so that students could start school with upgraded facilities.
Focus and attention on the facility needs is an ongoing process.

SUBJECT: Approval of Resolution No. 15/16-10 Certifying to the State Allocation Board that Certain Trailers on School Sites are No Longer Used for School Purposes
BACKGROUND

Senate Bill 1324, Chapter 308, was enacted into law effective September of 2006, now placed in Education Code Section 17292 (c). This law requires that trailers, approved or not approved by the California Department of Housing and Community Development (HCD), can no longer be used as a school building on public school property.
In the 1980's, 1990's and early 2,000's, Modesto City Schools placed HCD trailers on school sites to accommodate the rapid growth of enrollment, programs and functions in the District. Over the past ten years, the District has made efforts to remove these trailers and provide permanent or other appropriate relocatable buildings for school purposes.
The District's list originally included 47 trailers across 19 sites. Over the past five years, 26 trailers have been removed. The remaining 21 trailers are located across 10 sites, primarily elementary schools. Most of the remaining trailers are vacant, used for storage or nonclassroom uses and past their useful lives.
ISSUE
Education Code Section 17292 (c) requires the Board to certify to the State Allocation Board of the State of California that trailers have been removed from use as school buildings as of September 30, 2015.
PROPOSAL
In order to comply with Education Code Section 17292 (c), the Board is certifying, by resolution, to the State that certain trailers on school campuses are no longer being used for school purposes. The District has 21 trailers still physically on school campuses. These trailers are vacant, used for storage or non-classroom uses and past their useful lives.
Replacement of trailers with portable buildings for functions that cannot be absorbed into existing school sites will be prioritized as part of the Facilities Needs Assessment.

The District will incur some cost at such time as the remaining vacant trailers are demolished or removed. In the event the trailers are sold via public auction, there will be no cost for removal to the District. If new portables must be placed due to space constraints, the cost of replacement of one (1) portable classroom is estimated to be approximately $125,000.
RECOMMENDATION
It is recommended that the Board of Education approve Resolution No. 15116-10, certifying to the State Allocation Board that certain trailers on school sites are no longer used for school purposes.

CERTIFYING TO THE STATE ALLOCATION BOARD THAT CERTAIN TRAILERS ON SCHOOL SITES
ARE NO LONGER USED FOR SCHOOL PURPOSES
WHEREAS, Senate Bill 1324 was enacted into law on September 18, 2006, and requires that commencing September 30, 2015, any Housing and Community Development (HCD) approved relocatable buildings outlined in Education Code Section 17292 (c) be removed from use as a school building; and
WHEREAS, a resolution must be approved by the School District Governing Board by October 30,2015, certifying that any HCD relocatable buildings as outlined in Section 17292 (c) of the Education Code have been removed from use as a school building commencing September 30,2015;
NOW, THEREFORE, BE IT RESOLVED that the Governing Board of Modesto City Schools certifies to the State Allocation Board that certain HCD relocatable buildings as outline in Section 17292 (c) of the Education Code have been removed from use as a school building.

City Schools' Managers for the 2015-16 School Year
BACKGROUND
Discussions were held with the Modesto City Schools' Managers board representative regarding the compensation for Managers commensurate with the agreements of other employee groups.
ISSUE
The Board of Education must approve the Letter of Agreement with the Modesto City Schools' Managers for the 2015-16 school year.
PROPOSAL
The Modesto City Schools' Managers approved the attached Letter of Agreement on September 25, 2015. The Agreement includes a combination of increased contribution to Health and Welfare benefits and an increase to the salary schedule. The Agreement must be approved by the Modesto City Schools Board of Education.
FISCAL IMPACT
The Agreement with the Modesto City Schools' Managers will result in a cost of approximately $794,680 for a total of 4% compensation.
RECOMMENDATION
In accordance with Government Code Section 3547.5, and following consideration of certification that the costs incurred by the school district can be met during the agreement's term, it is recommended that the Board of Education approve the Letter of Agreement between Modesto City Schools District and Modesto City Schools' Managers for the 2015-16 School Year.

LETTER OF AGREEMENT between
MODESTO CITY SCHOOLS and
MCS MANAGERS
RE: 2015/16 Compensation Package
This Agreement is entered into by and between Modesto City Schools District and the MCS Managers. The District and MCS Managers agre~ to the following:
1. The District agrees to a 4% total compensation package to MCS Managers beginning July 1,2015, as follows:
1.1. Beginning with July 1,2015, a 3.4% increase will be applied to the Management Salary Schedule.
1.2. Beginning with July 1, 2015, the District shall contribute $278 per month, per eligible manager, towards the purchase of a health and welfare package from the District's health care providers. A manager is only eligible to receive this monthly contribution if they enroll in a District health insurance plan. District managers who are married (or registered domestic partners) to a District employee will each be given their respective unit's negotiated amount per month, if they enroll in a District approved health insurance plan that includes both District employees.
2. The District agrees to make both the increased monthly contribution and salary percentage increase retroactive to July 1, 2015.
3. If the certificated bargaining unit and/or the classified bargaining unit receive a higher total compensation increase in salary and/or benefits for 2015116, the District and MCS Managers agree to reopen discussions in these areas.
4. This agreement is subject to approval by the Modesto City Schools Board of Education.

BACKGROUND
When an employing agency finds there is an insufficient number of qualified certificated persons who meet the specified employment criteria for a position, a Provisional Internship Permit provides employing agencies an option to fill an assignment with an individual who qualifies under one of the available assignment options.
ISSUE
In order for Nicole Weber to be compliant with the Single Subject Mathematics Credential authorization requirement, a Provisional Internship Permit must be procured from the California Commission on Teacher Credentialing.
PROPOSAL
It is proposed that the Board of Education review and approve the request for Provisional Internship Permit.
FISCAL IMPACT
There will be no cost to the District.
RECOMMENDATION
It is recommended that the Board of Education approve submission of Provisional Internship Permit to the California Commission on Teacher Credentialing.

Maintenance and Operations needs to replace a dump truck that has reached the end of its useful and economically serviceable life.
The vehicle to be replaced is as follows:

ISSUE
The cost to replace this dump truck exceeds the current bid threshold of $86,000. Competitive bids must be sought or identified to meet formal bid requirements.
PROPOSAL
The National Joint Powers Alliance (NJPA) contract #102811-NAFG offers competitively bid contract pricing on vehicles. This contract is available to all California State and Local Government agencies allowing for greater cost savings.
FISCAL IMPACT
The estimated cost to purchase this dump truck is $149,567.28. Funding will come from the Vehicle Replacement Fund.
RECOMMENDATION
It is recommended that the Board of Education approve authorization to purchase a 12/14 yard dump truck for Maintenance and Operations.

BACKGROUND
The Reprographics Department has the need to purchase paper supplies during the course of each year.
ISSUE
Competitive bids must be sought or identified to meet formal bid requirements per Public Contract Code Section 20111(a).
PROPOSAL
Specifications were developed and bids were sent to nine (9) bidders and advertised as required by law. Three (3) bid responses were received. Bid No. 15-4606 was opened on September 30,2015. The bid award is for a one-year period, with a contract extension for up to two (2) additional one-year periods allowing for future District purchases of the same items. Amounts to be awarded to each vendor are as follows:

SUBJECT: Approval of Authorization to Award RFP No. 15-4604 Student Activity Transportation to Storer Coachways, Delta Charter Service, and VIA Trailways
BACKGROUND

Throughout the year, the District needs to hire contractors who furnish and operate school buses or School Pupil Activity Buses (SP AB) for the transportation of pupils and other persons as specified by the District. These trips occur when the District does not have sufficient drivers or buses available to meet the demand, or the trips are outside the District's range for servicing.
ISSUE
Formal bids must be sought or identified to meet formal bid requirements per Public Contract Code Section 20111(a).
PROPOSAL
Specifications were developed and formal proposals were sent to four (4) potential providers, and advertised as required by law. In response to RFP No. 15-4604, the District received three (3) proposals from the following contractors:
• Storer Coachways • Delta Charter Service • VIA Trailways
The RFP was structured to allow staff to first contact the lowest cost contractor, and then the other named contractors in rank order if and when the preceding lowest cost contractor is unable to provide such service. Staff has evaluated the proposal responses and determined that Storer Coachways is the lowest cost provider; Delta Charter Service is ranked second; and Via Trailways is ranked third.
FISCAL IMPACT
The estimated annual cost for Student Activity Transportation is $90,000. Funding will come from the General Fund and Associated Student Body (ASB) funds.

The Maintenance and Operations Department currently operates and maintains many types of field maintenance equipment. This equipment is required to service and repair the District's 600+ acres of play fields and grounds.
This renewed focus on reconditioning District fields has highlighted the fact that various pieces of field maintenance equipment are beyond their useful and serviceable life and need to be replaced. Additional equipment is also needed.
ISSUE
The cost of this equipment exceeds the current bid threshold for equipment purchases. Competitive bids must be sought or identified to meet formal bid requirements.
PROPOSAL
On November 27,2012, the City of Tucson, Arizona awarded a public bid (National IPA Contract #120535) to The Toro Company for the purchase of Parks and Golf Grounds Maintenance Equipment. Turf Star, Inc. is an authorized dealer for The Toro Company. The initial contract term was for a one-year period with the option to renew for four (4) additional one-year periods. On November 27,2014, the City of Tucson, Arizona exercised its option to renew the contract through November 26, 2015.
The City of Tucson's bid contains cooperative purchase language that allows for other agencies to utilize it as required by provision 20118 of the Public Contract Code. It is staffs determination that the District would derive more benefit by utilizing this cooperative bid contract than to seek separate bids to purchase the following items:
• Four (4) heavy-duty, field maintenance utility vehicles ($91,003.49 for all) • One (1) rotary mower ($21,152.70) • One (1) infield groomer ($20,429.65)
Total cost for these items, including tax and delivery, is $132,585.84.

District staff has negotiated with California Property Record Systems (CPRS) and agreed upon a price of $32,500. CPRS staff is specially trained and has experience working with the District to perform the services required.

BACKGROUND
Last year, the District upgraded 15 school sites with Cisco edge switches to support a maximum of 10 Gb uplinks (bandwidth) to the District datacenter. Thirteen school sites along with the District support sites have network equipment that is limited to 1 Gb bandwidth for the local area network at each site. Last year, wireless access points were implemented at 14 school sites to provide wireless access for teachers and student devices in carts. The remaining 20 school sites had wireless access points implemented in 2013-2014.
The District currently uses a Cisco VoIP (voice over IP) network telephone system at Enochs, Gregori, and all District support locations. All other school sites are using site based Atlas telephone systems that are 20-30 years old.
ISSUE
To support digital textbooks and a device for every student, additional wireless access points will be implemented at all school sites and the network equipment at 13 school sites will be replaced to support 10 Gb bandwidth. The new Cisco 2960 switches will be installed at the following locations:

The antiquated telephone systems at the 32 school sites continue to experience outages. Replacement parts are expensive and difficult to obtain. The District's plan is to implement the Cisco VoIP telephone system to the 32 school sites over a three year period. To support the implementation of a VoIP telephone system at the remaining 32 school sites, the District must convert the existing 4-digit dialing plan to a 5-digit dialing plan for internal calling along with converting to new telephone numbers. For this year, VoIP telephone systems will be installed at the following locations:

Due to the fact that the District now covers the cost of Outdoor Education, this Board Policy is obsolete and staff recommends it be deleted.
On September 28, 2015, the Board of Education approved the first reading of deletion of the BP.

Students receiving Special Education services or with 504 plans may have modifications on the CAHSEE if they are listed in their IEP's (Individualized Education Program) or 504 plans.
ISSUE
Modifications fundamentally alter what a test measures, which invalidates the test score.
PROPOSAL
State regulations allow for the parent/guardian of a student who earns the equivalent of a passing score (350) with the use of a modification to request a waiver from the District's Governing Board. Waivers have been submitted for one special education student at Downey, one speCial education student at Enochs, one special education student at Johansen, and one special education student at Elliott Alternative Education Center. No Child Left Behind (NCLB) was signed into law by President George Bush on January 8, 2002. This law set up an accountability system for measuring Adequate Yearly Progress (AYP). Under this system, schools that fail to make AYP goals for two consecutive years become Program Improvement schools. Schools in their second or higher year of Program Improvement must offer students extra tutoring called Supplemental Educational Services (SES).
ISSUE
Modesto City Schools is required to contract with California Department of Education (CDE)-approved providers for these Supplemental Educational Services. Parents have the right to choose a provider. A Board-approved master contract with Supplemental Educational Services providers must be in place before services can begin.
PROPOSAL

Dr. Anita Archer is an educational consultant to school districts on the design and delivery of effective instruction, behavior management, and literacy instruction. She has taught in elementary and middle schools. Dr. Archer has served on the faculties of San Diego State University, the University of Washington in Seattle, and the University of Oregon in Eugene. She is nationally known for her professional development activities, having presented in every state over the course of her 40-year career. Dr. Archer is co-author of numerous curriculum materials addressing reading, writing, and study skills.
ISSUE
District data indicates writing is an area in need of improvement. Modesto City Schools Local Control Accountability Plan set a goal of increasing by 10% the percentage of fourth grade students scoring proficient on District Benchmarks. Dr. Archer will offer professional development opportunities to our K-8 teachers, administrators, and instructional coaches to support staff in meeting this goal.
PROPOSAL
The District has identified Dr. Archer to provide staff development in the areas of literacy with a particular focus on writing instruction for K-8 teachers. Additionally, Dr. Archer will provide classroom demonstrations and work with district coaches to revise rubrics and writing prompts. The services agreement with Dr. Archer provides for a total of nine days of service during the time period from November, 2015 through January, 2016.

This site has seen an increase in its EL population and has three SDC classes for students with emotional disabilities. Rose Avenue's State assessment scores have shown a steady decline since 2009.
ISSUE
Modesto City Schools continues to look for intervention strategies and innovations to increase students' achievement with particular focus on at-risk students/sub-groups, low income, and special needs students.
PROPOSAL
The Site Leadership team has identified Dennis Parker to provide staff development services for five days throughout the 2015-2016 school year using the Strategic School Design Model. This theoretical framework uses research-based strategies that include:
• Deconstructing grade level standards • Interactive instruction with an emphasis on student collaboration, engagement, and voice • Academic vocabulary development • Critical thinking with an emphasis on text-dependent questions; writing to learn, with an
emphasis on summarizing.

BACKGROUND
Service agreements with non-district employees (non public agency) who provide services to the District are submitted throughout the year. The Special Education department contracts with outside providers to serve our Special Education students when we are unable to provide services. Students who are Deaf or Hard of Hearing and placed in a general education instructional setting require a certified interpreter. There is a statewide shortage of certified interpreters.
ISSUE
Modesto City Schools has been unable to hire a certified interpreter and, therefore, needs to expand the contract with an outside provider.
PROPOSAL
Eaton Interpreting Services, Inc., will provide individual and group interpreting services for our Deaf and Hard of Hearing students as required in their Individualized Education Programs beginning July 1, 2015 and ending no later than June 30,2016. The contract allows flexibility in the event the District is able to hire a certified interpreter. The amended contract is available for review in the Special Education office.
FISCAL IMPACT
On May 15, 2015, the Board approved a services agreement with Eaton Interpreting Services, Inc., not to exceed $80,000. The amendment to the services agreement will increase compensation to Eaton by $270,000, for a total compensation not to exceed $350,000. These costs will be incurred for the 2015-2016 school year.

BACKGROUND

School districts are responsible for providing all Educationally-Related Mental Health Services (ERMHS) for students with an Individualized Education Program (IEP) since AB3632 was eliminated by the Governor's Line Item Veto in October, 2010. ERMHS are defined in the Individuals with Disabilities Education Act (IDEA.) and include individual counseling, counseling and guidance, social work services, day treatment services, and residential services. Historically, these services were provided by County Mental Health Departments under AB3632 and relied heavily upon a medical definition of emotional disability rather than an educational model.
Modesto City Schools has received State and Federal funds to provide Educationally-Related Mental Health Services to the students within our District.
ISSUE
Modesto City Schools has developed a Memorandum of Understanding (MOU) with Aspiranet to provide Educationally-Related Mental Health Services to the students requiring these services as determined by their Individualized Education Program. A copy of the MOU can be reviewed in the Special Education office.
PROPOSAL
Aspiranet will provide Wrap Services to the students of Modesto City Schools.
FISCAL IMPACT
The fiscal impact for Wrap Services with Aspiranet will not exceed $20,000 and has been included in the Special Education Mental Health fund.
Modesto City Schools also contracts with Aspiranet on the following:
• Services agreement for 2015-2016 with Child Welfare and Attendance for risk evaluator and crisis team services. Amount: NTE $15,000
• Non Public Agency Master Contract (Stanislaus Academy) for 2015-2016 with Special Education Department. Amount: NTE $140,000

BACKGROUND
Regular Meeting
October 19, 2015
The 2015-16 Child Development school year calendar for classified employees has not been agreed upon between the District and the California School Employees Association (CSEA). Until a calendar has been finalized, it is necessary to establish a calendar on a monthly basis.
ISSUE
As the District and the Association continue to finalize the 2015-16 school year calendar, a tentative monthly calendar for November 2015 needs to be established for staff, students and the community.
PROPOSAL
In order to provide essential services to students and the District, it is proposed that the Board adopt the attached temporary calendar for the month of November 2015 (excluding holidays, vacation credit, non-responsibility days and weekends).
RECOMMENDATION
It is recommended that the Board of Education approve the November 2015 monthly calendar - Child Development Program Classified Staff.

OVERALL RESPONSIBILITY
Under general direction, provide technical support that includes analysis, design, development, configuration, testing, implementation, integration, operation and management of systems and applications that support the district's enterprise-wide technology infrastructure.

1. Administer, design, implement, and evaluate the applications and systems used to perform mass operating system deployments, application packaging, endpoint protection, and collection management. E

SYSTEMS AND APPLICATIONS MANAGER
OVERALL RESPONSIBILITY
Under general direction, provide leadership and assume management responsibilities for the operations, support and maintenance of the systems and applications that support the district's enterprise-wide technology infrastructure. Responsible for the coordination of all development activities including the analysis, design, development, configuration, testing, implementation, integration, operations and management of systems and applications projects.
SPECIFIC RESPONSIBILITIES
1. Provide leadership and assume management responsibilities for the operations, support and maintenance of district systems and applications. Coordinate development activities, installations, upgrades and system modifications. E
2. Evaluate, assess, and prioritize project requests in terms of feasibility, overall benefit, and development and support requirements. E
3. Provide development, test, and production environments for application development. E
4. Troubleshoot and resolve issues as assigned in call logging and defect tracking systems. Review, prioritize, and assign application support tasks from call logging and defect tracking systems to development staff. E
5. Supervise design, implementation, and evaluation of the applications and systems used to perform mass operating system deployments, application packaging, endpoint protection, and collection management. E
6. Administer, design, implement, and evaluate the applications and systems used to manage incidents and problems in support of the District Help Desk and other support departments. E
7. Supervise design, implementation and evaluation of mobile device management systems and applications. E
8. Supervise design, implementation and evaluation of the Microsoft Office 365 and Exchange systems and applications, and maintenance of the security of electronic mail and data. E
9. Supervise development and maintenance ofintemal Microsoft SharePoint web sites. E
10. Administer, evaluate, configure and maintain Microsoft Active Directory Group Policy and Login scripts. Develop effective and efficient programming scripts. E
11. Supervise development of SQL queries and performance of data exports to support District systems and applications. E
12. Supervise performance of complex technical, analytical and professional services to support District systems and applications.
13. Supervise the District's applications and systems for data integrity and proper operations and provide professional confidentiality of all information and data. E
14. Supervise cross-application issues related to applications and systems support.
15. Supervise collaboration with technology department staff in the development of test plans and end-user documentation.
16. Coordinate feasibility studies, system analysis and the evaluation and testing of new technology solutions that result in the continuous improvement of operations, systems and services. E E.S(1)

Knowledge/Ability Minimum Requirements:

Experience Minimum Requirements:
Three (3) years of experience in enterprise networking environments, computer systems and operations, computer programming and application analysis.
Experience with Windows, PowerS hell scripting and network environments. Experience with web page development. Web-related programming experience with one or more of the following technologies: ASP.NET, ASP,
JSP, Java Servlets, VB Script, XML, XHTML, CSS, CHTML, XSL. Database and query experience including any of the following: SQL Server, Oracle, Access. Experience in the development of on demand and automated end-user data reporting. Competency in the use of Microsoft Outlook, Word, Excel, Access and Office 365.

BACKGROUND
The Human Resources Department is responsible for proposing new job descriptions and maintaining up-to-date job descriptions through revisions, and placing employees appropriately on the respective salary schedules. The revised job description was approved by the Superintendent's Cabinet and the California School Employees Association.
ISSUE
The High School Bookkeeper job description has been revised in order to more clearly identify the specific responsibilities of the position.
PROPOSAL
The attached job description is proposed for the Board's consideration.
FISCAL IMPACT
The High School Bookkeeper position has increased from range 31 to range 33 on the Classified Unit Salary Schedule.

SUBJECT: Ratification of Agreement with California Occupational Physicians to Provide Tuberculosis (PPD) Testing for Modesto City Schools' Employees for the 2015-16 School Year
BACKGROUND

California Education Code Section 49406 requires all certificated and classified employees of a school district to have an examination and be determined free of active tuberculosis when initially employed and every four years thereafter.
ISSUE
Beginning with the 2012-13 school year, Modesto City Schools District contracted with California Occupational Physicians to provide tuberculosis clearance services for the District's employees. The Modesto City Schools District would like to continue its contract with California Occupational Physicians to provide tuberculosis clearance services for the District's employees.
PROPOSAL
California Occupational Physicians has agreed to provide this contracted service for the 2015-16 school year. The agreement is effective July 1, 2015 through June 30, 2016. The services agreement can be reviewed in the Human Resources department.
FISCAL IMPACT
The cost for providing this service will be $10.00 per person per review and certification of the Adult Tuberculosis (TB) Risk Assessment Questionnaire, $18.00 per person per skin test, and $70.00 per person per chest x-ray, not to exceed $18,000.00 in the 2015-16 school year.

State of California litigation settlement and as defined in Education Code 35186, Modesto City Schools posted in every classroom a statement that students have the right to a qualified teacher, adequate and current instructional materials, and a facility that is free from conditions that pose a threat to the health and safety of students or staff. On February 7, 2005, the Board of Education approved Administrative Regulation 1312.4, which addresses procedures for the complaint process.
ISSUE
Summaries of complaints must be publicly reported to the Board on a quarterly basis at a regularly scheduled meeting and forwarded to the county Superintendent of Schools.
