YOU MAY APPLY FOR THE OPPORTUNITY TO PURCHASE UP TO FOUR (4) $30 TICKETS TO DISNEY’SNEWSIES AT THE NORTHERN ALBERTA JUBILEE AUDITORIUM IN EDMONTON, ALBERTA FOR ANY ONE OF THE FOLLOWING PERFORMANCES THAT ARE AVAILABLE AT THE TIME OF APPLICATION: TUESDAY, JULY 12, 2016 AT 7:30PM WEDNESDAY, JULY 13, 2016 AT 7:30PM THURSDAY, JULY 14, 2016 AT 7:30PM FRIDAY, JULY 15, 2016 AT 7:30PM SATURDAY, JULY 16, 2016 AT 2PM AND 7:30PM SUNDAY, JULY 17, 2016 AT 2PM AND 7:30PM (each a “Performance” and collectively, the “Performances”).

SPONSOR INFORMATION. Disney’s Newsies Digital Rush is sponsored by Jujamcyn Theaters LLC (the “Sponsor”), having its principal place of business at 246 West 44th Street, New York, NY 10036.

ELIGIBILITY: Must be 18 years or older to apply with a valid credit card. Maximum four (4) Digital Rush tickets per person permitted during the sale.

VOID WHERE PROHIBITED OR RESTRICTED BY LAW.

HOW TO APPLY:

(1) VIA WEBSITE: Apply through the web page http://edmonton.broadway.com/digitalrush (“Site”). Applicants may apply for an individual Performance, or for up to two Performance dates. Applications for each requested Performance will be accepted until 11:59 pm MDT on July 10, 2016 for all Performances.

There is a limit of one (1) application per person per Performance, (up to two Performance dates), and

each successful applicant shall receive the right to purchase up to four (4) tickets for the requested

Performance(s) for which the applicant submitted and was successful (“Digital Rush”). Digital Rush

Tickets are available as of July 7, 2016 at 10:00 am MDT. Use of automated devices or programs to

participate is prohibited. Proof of entering information on the Site page is not considered proof of

receipt by the Sponsor of the application. Digital Rush Tickets will be awarded on a first-come first-

serve basis for performances in which Digital Rush Tickets are available as of the Sale Date. No

applications will be acknowledged or returned. Multiple applications by the same applicant for the

same Performance are not permitted and applicants submitting multiple applications for the same

Performance will be disqualified. Incomplete applications not including name and email address will be

disqualified. The total number of Digital Rush Tickets available for purchase through the Site for each

Performance may vary, but in no event shall there be fewer than four (4) tickets available for purchase

per Performance (the “Minimum”). The number of Digital Rush Tickets to be sold through the Site for

each Performance in excess of such Minimum shall be at the sole discretion of the Sponsor, in

consultation with the presenter of the Show (as defined below).

Each successful applicant shall be entitled to purchase up to four (4) tickets (at the price of $30 per ticket) to Disney’s Newsies (the “Show”) in Edmonton, Alberta at the Northern Alberta Jubilee Auditorium (the “Auditorium”) for the Performance for which the applicant submitted an application and was the first eligible applicant to apply for the available Digital Rush Tickets. No substitutions or cash redemption is permitted. Digital Rush Tickets are not assignable or transferable. The seat locations of Digital Rush Tickets may be anywhere in the Auditorium and may have a partial, restricted, and/or obstructed view of the stage. A successful applicant purchasing Digital Rush Tickets may not necessarily receive seats that are next to one another. Seats may be located anywhere in the Auditorium. Once Digital Rush Tickets are purchased, there are no refunds or exchanges.

CLAIMING TICKETS: The potential successful applicant will be notified via email notification. If a successful applicant provided a valid Canadian mobile phone number on the entry form, s/he will also receive a one-time notification via SMS text message to confirm the successful application and provide details on how to complete the purchase of Digital Rush Tickets. Notifications for Performances will be distributed no later than 5:00 pm MDT on July 11, 2016 for all Performances. Successful applicants must claim his/her Sale Tickets by purchasing them by no later than 1 hour prior to applicable Performance start time (“Sale Date”). Email notification will include instructions on how to purchase online with a valid credit card. Only the person who applied and was successful may claim Tickets. Identification may be required. Unclaimed Digital Rush Tickets will be released and made available to the next successful applicant, sold to the general public or used by Sponsor for any purpose. The Sponsor’s decision is final and binding on all aspects of this Sale.

Failure of an applicant to respond as referred to above may result in disqualification and the selection of another applicant. The Sponsor is not required to contact a potential successful applicant more than once.

CONDITIONS, DISCLAIMERS, AND LICENSE: By applying for Digital Rush, each applicant agrees to be bound by these Terms and Conditions and by all decisions of the Sponsor (whose decisions are final and binding on all matters relating to the Sale), and to comply with all federal, provincial/territorial and local laws and regulations. In the event of non-compliance for any reason, including the inability to purchase the Digital Rush Tickets for any reason, an alternate applicant may be selected in the Sponsor’s sole discretion. The decisions of the Sponsor are final on all matters of fact, interpretation, eligibility, procedure and fulfillment. Applications are void if unreadable, inaccurate, incomplete, forged, mechanically reproduced, irregular in any way, or otherwise not in compliance with these Terms and Conditions.

The Sponsor makes no warranties, and hereby disclaims any and all warranties, express or implied, concerning any Digital Rush Tickets furnished or made available in connection with the Sale. Although the Sponsor attempts to ensure the integrity of the Sale, the Sponsor is not responsible for the actions of applicants or other individuals in connection with the Sale, including applicants’ or other individuals’ attempts to circumvent the Terms and Conditions or otherwise interfere with the administration, security, fairness, integrity, or proper conduct of the Sale. The Sponsor is not responsible for injury or damage to applicant’s or to any other person’s computer(s), mobile device(s), or other equipment, related to or resulting from participation in the Sale or downloading materials from or using the Sale

Site. If, for any reason, the Sale is not capable of running as planned for any reason including by reason of damage by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical limitations or failures, strikes, industry conditions, bankruptcy or liquidation, marketplace demands, applicable law, unforeseen obstacles, or any other causes that, in the sole opinion of the Sponsor, could corrupt, compromise, undermine, or otherwise affect the administration, security, fairness, integrity, viability, or proper conduct of the Sale, the Sponsor reserves the right, in its sole and absolute discretion, to modify these Terms and Conditions and/or to cancel, terminate, modify, or suspend all or any part of the Sale, and in its sole discretion to select any applicants from among all eligible applications received up to the time of such cancellation, termination, modification, or suspension, as applicable. In the event that there are typographical errors that obscure the original intent of the Sale, the Sponsor reserves the right to cancel or modify the Sale appropriately. Notwithstanding anything to the contrary in these Terms and Conditions, Sponsor reserves the right to discontinue or suspend the Sale at any time for any reason or no reason. By participating in this Digital Rush and unless prohibited by law, each Successful Applicant and guest(s) hereby consent to use of his/her name, voice, photograph and/or likeness for advertising or publicity purposes for this Digital Rush and similar sales without compensation and the successful applicant and guest(s) may be required to provide a signed release acknowledging such consent, unless restricted by law. Moreover, by participating in this Digital Rush, unless prohibited by law, each Successful Applicant and guest(s) agree to grant to the Sponsor, and its licensees, affiliates, and assigns, the right to print, publish, broadcast, and use, worldwide in any media now known or hereafter developed, including without limitation the World Wide Web, at any time or times, the Successful Applicant’s and guest(s)’ name, likeness (actual or simulated), voice (actual or simulated), and biographical information as news or information and for advertising and/or promotional purposes without any compensation; and further without any compensation, each Successful Applicant and guest(s) agree to appear in, or provide biographical information for use in, any presentation or other activity, which may include filming and/or audio, video, electronic or other recordings and/or interviews, as may be determined from time to time by the Sponsor in its sole discretion.

By applying and voluntarily providing your personal information, each applicant consents and agrees to the Sponsor’s collection and use of the applicant’s information for the administration of this Sale and agrees to Sponsor’s use of applicant’s information for the purpose of contacting applicant in relation to this Sale. For the avoidance of doubt, applicants are providing information to the Sponsor for purposes of the administration of this Sale. Broadway Across Canada as the presenter of the event for which Digital Rush Tickets are being made available through this Sale and its affiliate Broadway Across America may send promotional communications to applicant’s email address after entry, if the applicant expressly agrees.

RELEASE AND INDEMNIFICATION: By participating in this Sale, each applicant releases and holds the Sponsor, Auditorium, Show, Eagle Eye Entertainment, Inc. dba Broadway Across Canada and Key Brand Theatrical Group, Inc. dba Broadway Across America, and each of their respective affiliates, parents, subsidiaries, advertisers, promotional agencies, directors, members, successors, sponsors, partners, licensees, officers, agents, employees, artists, advisors, and assignees, and each individual or entity associated with the development and execution of the Sale, harmless from and against any and all losses, damages, rights, claims, and actions of any kind arising in whole or in part, directly or indirectly, from the Sale or participation in any Sale-related activity, or resulting directly or indirectly, from acceptance, possession, use, or misuse of any Tickets sold in connection with the Sale, including without limitation claims based on negligence, breach of contract or liability for physical injury, death,

or property damage.

LIMITATION OF LIABILITY: The Sale, all Digital Rush Tickets, and all materials provided on the Site or through the Sale are provided “as is” without warranty of any kind, either express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

WITHOUT LIMITING THE RELEASE GRANTED BY APPLICANTS HEREIN, BY APPLYING, EACH APPLICANT AGREES THAT TO THE EXTENT PERMITTED BY APPLICABLE LAW: (1) ANY AND ALL DISPUTES, CLAIMS AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THE SALE, OR ANY TICKETS SOLD, WILL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION; (2)UNDER NO CIRCUMSTANCES WILL ANY APPLICANT BE PERMITTED TO OBTAIN ANY AWARD FOR, AND APPLICANT HEREBY KNOWINGLY AND EXPRESSLY WAIVES ALL RIGHTS TO SEEK, PUNITIVE, INCIDENTAL, EXEMPLARY, CONSEQUENTIAL OR SPECIAL DAMAGES; LOST REVENUES; AND/OR LOST PROFITS, AND UNDER NO CIRCUMSTANCES WILL ANY APPLICANT HAVE ANY RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED; AND (3) APPLICANT IRREVOCABLY WAIVES ANY RIGHT TO SEEK INJUNCTIVE OR EQUITABLE RELIEF. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY, SO THE ABOVE MAY NOT APPLY TO YOU.

GOVERNING LAW: These Terms and Conditions are governed by and shall be construed in accordance with the laws of the Province of Alberta (without regard to conflicts of law principles). MISCELLANEOUS: If any provision of these Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. Headings and captions are used in these Terms and Conditions solely for convenience of reference, and shall not be deemed to affect in any manner the meaning or intent of these Terms and Conditions or any provision hereof.
