SHIPS AGENTThe shipsagent represents the shipowner/ master

at a particular seaport either on a permanent ortemporary basis.

This includes:

notification of arrival and departure of thevessel;

acceptance of vessel for loading, discharge,repairs and storing ;

arrangingberths, tugs, harbour pilots; ordering stevedores, cranes, equipment, etc;

and so on.

the needs of the Masterembracing bunkers stores, provisions,

crew mail and wages,

cash, laundry, engine and deck repairs, and crewrepatriation;

completion of customs, immigration and port healthformalities; hatch and cargo surveys;

collection of freight; collection of issuing of Bill of Lading; completion of manifests, Notarial and Consular

protests, and so on.

Bills of Lading (B/L) :

In most international sales transactionsthe goods are to be carried by sea,the seller of the goods promises to

do two things:1. Put the goods on board a ship

2. Provide the commercial documents

required by the contract, the centralone usually the B/L.

The B/L says a lot of things to those whocome into possession of it:

It helps to identify the owner of the goodsin this respect it is a document

It identifies the party who can receive thegoodsagain as a document of title

It is a means of transferring title from oneperson to another

It provides information on: - the description of goods

the condition of goods the quantity of goods the loading port and date of shipment

the discharge port the name of ship

whether freight has been paid

the terms of carriage under which the cargo is

being carried delivery instructions (eg. The notify or

consignee)

In this respect the B/L is both a receipt forthe goods shipped and evidence of the

contract of carriage.

Failure to ensure accuracy can give rise to

liability of the shipowner.

Clean bills of lading: is one which do notcast doubt on the condition of the time of

shipment. In order to issue a clean bill oflading a master not have to say that thegoods are in good condition. It is sufficientfor him to say that they are in apparent goodorder and condition. A clean bill of lading issimply saying that the external appearanceof the goods and/or packaging is good.

Claused bills of lading: a clean bill of lading can beissued when the master has no reason to doubt theapparent good and condition of the cargo when shipped.If he does have doubt about it, then he should issue aclaused bill of lading (sometimes called a foul or a

dirty bill of lading). Such a bill of lading may not be

acceptable to the buyer or may not be capable of passing

through the finance or letter of credit arrangementswhich have been made for the sale contract. This isessentially the shippers problem as discussed below.

Often referred to as common short form Bill

of Lading.

Delivery Orderzet beyan - ordino

A written authority to deliver goods etc. Toa named party in exchange for the bill of

lading usually at the port of destination. It isused at the port of destination and is subjectto all the terms and conditions of thecarriers bill of lading.

Delivery Order

It must not contain any reservationsorclauses other than those appearing in the billof lading except where increased

obligations or extra cost may be incurred ingiving delivery beyond the bill of lading.The document is issued at the port ofdestination in exchange for an original bill

of lading and legally is recognized as ataken of an authority to receive possession.

Manifest -zet beyan

A summary of cargo loaded on a ship. This would

include its weight measurement, freight detailsand total amount- whether prepaid or payable atthe destination, port departure and destination;nature of cargo and so on. Such a manifest is

usually termed a freight manifest.

A documentation provided by the shipper orhis agent\ freight forwarder to the berthoperator and\ or shipping company giving

information about export consignmentsoffered for shipment. It is a delivery orreceipt note.
