    caution light at camp entrance to slow down

    traffic (set to flash only at certain times

    when the facility is typically in use),

    reduction of the speed limit, construction of

    a dedicated right turn lane into the main

    camp entrance, street lighting that would

    not adversely impact the camp experience,

    wide median openings at two locations, and

    dedicated left turn lanes at one location;

    additionally, the Girl Scouts would like to see

    the water drainage plan due to concerns

    about increased erosion on the property and

    the lighting plan due to concerns about the

    intrusion of light into the camp property.

    The Texas Department of Transportation (TxDOT), Houston District, will hold a public meeting regarding

    the proposed widening of State Highway (SH) 75 from Farm-to-Market (FM) 3083 to FM 2432, in

    Montgomery County, Texas. The meeting will be held on Thursday, February 16, 2017, at the Willis High

    School Cafeteria, 1201 FM 830, Willis, Texas 77378. The meeting will be held in an open house format

    from 5:30 p.m. to 7:30 p.m. No formal presentation will be made.

    The purpose of the Public Meeting is to present the proposed project to the public and receive comments.

    TxDOT, Houston District, proposes to widen SH 75 from a two-lane roadway with open ditches to a

    four-lane divided roadway with curb and gutter and a swale to convey stormwater between FM 3083 and

    FM 2432 in Montgomery County, Texas. Five-foot sidewalks would be constructed on both sides of the

    roadway. The purpose of the project is to facilitate mobility in central Montgomery County for the

    traveling public. The proposed improvements would potentially require approximately 9.0 acres of

    additional right-of-way. No buildings would be displaced as a result of the proposed project.

    Maps showing the proposed projects location and design drawings will be available for review at the

    Public Meeting. This information will also be available by appointment for review Monday through Friday

    between the hours of 8:00 a.m. and 5:00 p.m., excluding state holidays, at the TxDOT Houston District

    Office, located at 7600 Washington Avenue, Houston, Texas 77007, and at TxDOTs Montgomery County

    Area Office, located at 901 N. FM 3083 East, Conroe, TX 77303. To schedule an appointment at the

    Houston District please contact Ms. Sharon Xu, at (713) 802-5265.

    All interested citizens are invited to attend this public meeting. Written comments from the public

    regarding this project are requested and may be presented for a period of 15 calendar days following

    the meeting. Written comments may be submitted either in person or by mail to the TxDOT District

    Office, Director of Project Development, P.O. Box 1386, Houston, Texas 77251. Written comments must

    be postmarked or emailed to [email protected] by March 3, 2017, to be included in the Public

  • 2432, and Powell Street, Willis, TX, I have seen theMontgomery County Proposed thoroughfare for the Energy Corridor coming within the next years, and I am concerned the taxpayers and citizens have not been notified so they canBe made aware of the impact of this proposal.Even though you say no buildings will be affected, it is leading up to the fact that the Energy Corridor is to be built next, which indeed will affect businesses.

    Please make it very clear this is only the preliminary plan, and it is preparing the way for the Energy Corridor to come through our area, which will affect many businesses and landowners.Please make it known at the public hearingI am a concerned citizen, and I saw East Montgomery County almost lose millions of dollars in businesses and public park area for a mere renumeration for the land that was going to beDeclared unfit for public habitation (condemned). East Montgomery County went to court and won the right to keep the land where the Veterinarians business was located, as well as the park near East Montgomery County Park, so the public has a place for families and community to meet and build their community.Please give our citizens the whole truth, and your plans to widen and prepare for the Energy Corridor is coming, and it will affect many people, and the Tolls we will eventually be required to pay just to go shopping and travel near the Energy Corridor. (I realize it isnt built yet, but this is just the beginning to the preliminary plans to do so).

Box 1386 Houston, Texas 77251 Sent Via Email Dear Director of Project Development: RE: Public Meeting Comments -- SH 75 (from FM 3083 to FM 2432) Girl Scouts of San Jacinto Council owns a 917 acre tract of land located in Montgomery County, Texas that borders the proposed widening of State Highway (SH) 75 from Farm-to-Market (FM) 3083 to FM 2432. Our organization operates 3 Girl Scout camps within the boundaries of this property. We understand this $57 million project has not been approved for funding and the actual construction may not commence for another 3 years. We appreciate the opportunity to offer comments at this time and want to begin thoughtful discussion regarding how this roadway and walkways will affect our Girl Scout camps. Thank you for the invitation to attend the Public Meeting held on Thursday, February 16, 2017 at the Willis High School Cafeteria in Willis, Texas. The Chair of our Properties Committee and 3 staff members attended this meeting. We have a number of comments regarding the proposed project. Our comments focus on the safety and security of our girls and adult volunteers which are a top priority. I have attached a copy of your Comment Form along with our comments which are due March 3, 2017. Additionally, last October we received a request from the Texas Department of Transportation (TxDOT) to gain access and entry into 3 property tracts. We reviewed the Right-of-Entry agreement and understand we are not required to grant TxDOT right-of-entry at this time. We want to be cooperative, but can only allow access into our property under the terms and conditions expressed in a Limited Right-of-Entry agreement we sent via email to Mr. Jeff Allen from Cox/McLain Environmental Consulting, Inc. in December. Mr. Allen forwarded the information to TxDOT and as of this date, we have received no response from your office. I have attached a copy of the Limited Right-of-Entry agreement for your review. We look forward to continuing our communication as this project progresses so that we can work together to ensure safety for both those traveling along SH75 as well as those attending Girl Scout camp activities.     StreetlightingalongtheimprovedSH75roadwaytobekeptatlowlevelstoreducethebrightnessofthelights:Weareconcernedthatroadwaylightingmaypenetratetoofarintoourcampandnegativelyaffectthecampenvironment.

    Awidemedianopeningwithdedicatedleftturnlanesatourmaincampentrance(#1)and

    anotherwidemedianopeningatanotherentry/exitroad(#2)toallowtraffictosafelyenterandexitourcamponthenorthandsouthboundsidesofSH75:WhilestudyingtheprojectmapwenoticedtherewasnomedianopeninginthedividedSH75atourmaincampentrancenoratanotherentry/exitroad(TxDOTmapmarkedwithredarrows,#1and#2).Therearemedianopeningsatthemainentrancesofseveralsubdivisions,butnotattheaforementionedcampentrances/exits.

    Waterdrainageplanforthisproject:Weweretoldthisplanwasstillindevelopment.Weare

    specificallyconcernedabouttheareaaroundStewartsCreekwhichentersourcamppropertyatSH75.StewartsCreekpassesunderSH75viaabridgeasitentersthecampproperty.Thebridgeisapproximately55.5longby55wide.Thebridgerestrictsandcontrolstheflowofwaterintocampespeciallyduringandafterahardrain.Weareconcernedwemayencounter

    Roadwaylightingplan:Weweretoldthisplanwasstillindevelopment.WhilewewanttheSH75roadwaytobeadequatelylitfortrafficandpedestriansafety,wedontwantthelightingtobesobrightastodetractfromthecampingexperiencewearetryingtodelivertoourmembers.

    2) ProjectmanagementcommentsGirlScoutsofSanJacintoCouncilownsa7acretractoflandonthesouthsideofthenewlyconstructedLeagueLineRoadextensionnearSH75.Thisundevelopedpropertycouldbeusedforstagingandstoringheavyequipment.Weareopentoleasingthispropertytobeusedinthismannerduringthisproject.PleasenotifyusimmediatelyregardinganyeminentdomainclaimsbyTxDOTtopurchaselandfromthisGirlScoutsofSanJacintoCouncilcamppropertyduetorequiringadditionalrightofway.Landtakenmayresultinsignificantcoststocureresultingfrom:movingourfence,reconstructinganinteriorroadalongtheinsidefenceperimeter,replacingmaturetreesandpotentiallycreatingaphysicalbermorotherbarriertomaintainoursecurityplanonbehalfofourmembers.Thesephysicalbarriersalongourcampperimetermaintainahighlevelofsecurityandprivacyforourgirlandadultvolunteermembersandserveasabuffertoreducenoiseandlightintrusion.

    3) LimitedRightofEntryConditionsGirlScoutsofSanJacintoCouncilsentaLimitedRightofEntryagreementtoJeffAllenfromCox/McLainEnvironmentalConsulting,Inc.onDecember20,2016.Mr.AllenforwardedthisagreementtoTxDOTonthesamedate.NoresponsehasbeenreceivedfromTxDOT.Insummaryourrequirementsare:Entranceintopropertyforvisualinspection,observation,andconductingalinealsurveyandappraisalofthesurfaceonly.Noenvironmental,geological,orotherassessmentwhichrequiresdisturbanceofthesurfaceofthepropertyshallbepermitted.Noboring,trenchingordigginguponthepropertyshallbepermitted.Notlessthanfortyeight(48)hourswrittennoticefromTxDOTtoGirlScoutspriortoentryuponthepropertytoperformtheactivitiespermittedinthisagreement.TxDOTshallcoordinatethetimingofactivitiestoaccommodateanyreasonablerequestsbyGirlScouts,andshallpermitarepresentativeofGirlScoutstobepresentduringallsuchpermittedactivities.Noaccesstothepropertyafter4p.m.onFridayafternoon,onweekendsoratanyothertimewhenGirlScoutsandadultvolunteersmaybepresent.TxDOTguaranteesthatrepresentativesenteringthepropertyhavecompletedandbeenclearedbyacriminalbackgroundcheckattheexpenseofTxDOT.

    LIMITED RIGHT OF ENTRY AGREEMENT

    Whereas, Texas Department of Transportation (TxDOT) on behalf of the State of Texas, desires to conduct a lineal survey and appraisal on Parcels R39195, R39196 and R39198 for the proposed project to widen SH 75 from a two lane roadway with open ditches to a four lane divided roadway with curb and gutter and a swale to convey stormwater (Project), which is located at Camps Silver Springs and Agnes Arnold, Montgomery County, Texas (the Property); and

    Whereas, TxDOT has requested the Property owner, Girl Scouts of San Jacinto, Texas (Girl Scouts) to grant permission to enter the Property for purposes of conducting a lineal survey and appraisal; and

    Whereas, TxDOT and Girl Scouts wish to enter into this Right of Entry Agreement (the Agreement) to allow the State to conduct lineal survey and appraisal on the Property;

    Now, therefore, in consideration of the mutual promises, rights, and obligations set forth in this Agreement, Girl Scouts grants to TxDOT, and the TxDOT accepts with all the obligations set forth in this Agreement, the right to enter upon the Property for the limited purpose of visual inspection, observation, and conducting a lineal survey and appraisal of the surface. However, nothing in this agreement shall be construed to grant permission for any other type of activity to be conducted on that portion of the Property designated in Exhibit A only. No environmental, geological, or other assessment which requires disturbance of the surface of the Property shall be permitted. Neither States employees, nor its agents or independent contractors will bore, trench, or dig upon the Property for any reason.

    TxDOT shall provide Girl Scouts not less than forty-eight (48) hours written notice to Girl Scouts prior to entry upon the Property to perform the activities permitted by this Agreement. TxDOT shall coordinate the timing of activities permitted by this Agreement to accommodate any reasonable requests by Girl Scouts, and as part of such coordination shall permit a representative of Girl Scouts to be present during all such permitted activity, at Girl Scouts option. Girl Scouts shall not grant access to the Property after 4 p.m. on Friday afternoon, on weekends or at any other time when Girl Scouts and adult volunteers may be present. TxDOT will guarantee that representatives entering the Property have completed a criminal background check, at the expense of TxDOT, and meet the standards set out by Girl Scouts.

    The rights granted to TxDOT under the terms of this Agreement shall commence on the date that this Agreement is executed by Girl Scouts and shall terminate upon completion of the survey, but in no event more than ninety (90) days from the date this Agreement is executed by Girl Scouts.

    AS A CONDITION OF THIS AGREEMENT, TXDOT AGREES TO INDEMNIFY, DEFEND, AND HOLD GIRL SCOUTS HARMLESS FROM AND AGAINST ANY AND ALL INJURY, LOSS, DAMAGE, OR LIABILITY (OR ANY CLAIMS IN RESPECT TO THE FOREGOING), AND COSTS OR EXPENSES (INCLUDING REASONABLE ATTORNEY'S FEES AND COURT COSTS) WHICH ARISE FROM THE LINEAL SURVEY OR APPRAISAL OF THE PROPERTY, EXCEPT TO THE EXTENT ATTRIBUTABLE TO THE GROSSLY NEGLIGENT OR INTENTIONAL ACT OR OMISSION OF GIRL SCOUTS. WITHOUT LIMITING THE FOREGOING, IT IS EXPRESSLY AGREED AND UNDERSTOOD THAT TXDOT SHALL DEFEND AND INDEMNIFY GIRL SCOUTS FOR ANY CLAIMS AGAINST IT FOR ANY DAMAGE TO THIRD PARTIES, TXDOT, OR ITS EMPLOYEES, AGENTS, OR CONTRACTORS, INCLUDING DAMAGE TO EQUIPMENT OR FOR BODILY INJURY OR DEATH TO THIRD PARTIES OR ANY OF TXDOTS EMPLOYEES, AGENTS, OR

    TxDOT agrees to comply with all federal, state, and local laws, orders, rules, and regulations applicable to its activities permitted by this Agreement.

    TxDOT shall provide Girl Scouts with a copy of any survey or appraisal of the Property, at TxDOTs expense, within thirty (30) days of completion of same.

    This Agreement is made without any warranty of title to the Property, either express or implied.

    This Agreement may be executed in two (2) or more counterparts, all of which shall be considered one and the same agreement. All parties need not sign the same counterpart. The signatories to this Agreement represent and warrant that they are duly authorized to execute it on behalf of their respective parties.
