    Artic le II. Basis of Disc ipline

    The University of the Philipp ines Dilima n p romulga tes the se rules to

    c ultiva te va lues and enc ourag e virtues tha t make the Filipino p roud . These

    va lues aim to streng then c ha rac ter and nurture a n intellec tua l elite.

    Ide ally, while virtue c anno t be legislate d , the c harac ter that ma y be

    streng thened ha s d imensions of c onc ern for othe rs, a d eg ree of selflessness, the

    pursuit of lea rning a nd wisdom , a sense of justice and fairness, the c ourag e to

    stand for mo ral princ ip les, and the enc ourage ment of a n environme nt whe re

    persons can flourish.

    The University respec ts and upho lds the stud ents right of assoc iation . The

    University supports student organizations and activities as initiatives of students to

    show their c ap ac ity for auto nomo us go vernanc e a nd lea de rship .

    This Co de is ne ither intend ed to restric t nor unne c essarily limit stud entac tivities but ra ther to p rovide the institutiona l pa rame ters within which student

    ac tivities c an flourish. Certa in primary institutiona l or soc ial benefits a re

    ge nera ted by the d ue ob servation of these p aram eters, among w hic h are

    c onvivia lity and sec urity, the p rom otion o f valuab le initiatives, soc ial co op eration

    and c ollec tive welfare.

    Article IV. Definitions

    For purposes of this Co de, the following terms sha ll be d efined thus:

    1. Aca dem ic ac tivity any a ctivity that will enhance ac ad emicperforma nc e suc h a s c lasses, tuto rials, sem inars, c on ferenc es, lec tures,

    etc.

    2. Acad emic yearas determined by the University.3. Actual damag es as defined by law.4. Adm onition/ reprimand a written , forma l rep roo f.5. Alte rnative Dispute Resolution (ADR) any p roc ess to amica b ly sett le a

    d ispute involving less serious misc onduc t b y which the d ispute is resolved

    by the parties themselves with the assistance of a third party.

    6. Apology a verified e xpression of contrition or remo rse fo r wrong d one.7. Clearance a w ritten c ertific a tion from the University tha t the student is

    c lea red of a ll ac c ounta bilities.

    8. College a ll ac adem ic un its suc h as Co lleg e, Sc hool, Institute o r Ce nte r.9. Com munity service any ac tivity as p rovide d by the d isc iplina ry authority

    designed to p rovide for the pub lic go od in keeping w ith the ove rall go als

    of the c om munity, suc h a s c om munity-wide bea utific ation o r publicsa fety, provided tha t it should no t d isp lac e regular em p loyees, supp lant

    employment opportunitiesordinarily ava ilab le, or imp a ir c ont rac ts for

    services. Formula to c onvert suspension to c om munity service :

    Using fifteen (15) units and two (2) hours as the average leng th o f time

    spent per unit p er week, thirty (30) hours per we ek o f c om munity servic e

    will be d ee med eq uiva lent to a suspension of every five (5) sc hoo lda ys.

    Henc e, a fifteen-sc hoo lday suspension m ay be c onve rted into ninety (90)

    hours of c om munity servic e. Co mm unity servic e ma y be rendered w ithin

    a period that is not mo re tha n two and a half (2 ) times the length o f the

    suspension.

    not limited to:

    a . Cop ying or providing the means to c op y a c lassma te s examanswe rs, hom ew ork, laborato ry experime nts, etc .;

    b . Allow ing a c lassma te to c op y from one s ow n exam a nswe rs,hom ew ork, laborato ry experiments, etc .;c . Possession and / or use o f c hea t d evices during a n examination;d . Distortion and/or destruction of data;e. Plag iarism, which sha ll be d efined as the taking and use o f anothe r

    person s ideas, writings, inventions and simila r intellec tua l prod uc ts

    as one s ow n without know led ge , c onsent and / or ac c red itation;

    f. Submission of the same wo rk to tw o or more c ourses for ac adem icc red it without the knowled ge and / or consent of the teac hers

    concerned;

    g . Dec ep tion, whic h sha ll be d efined as p roviding fa lse informa tionc onc erning an a c ad emic ac tivity;

    h. Allow ing ano ther person to take a n examination in one s nam e,and/ or imp ersona ting ano ther stude nt or allow ing som eone to

    i. Manipulating a co rrec ted e xam pa pe r; andj. Any othe r form of c hea ting or any ac t of d ishonesty in relation to

    academic activity.

    16. Intellectual Property as defined by the University Inte llec tua lProp erty Rights Polic y.

    17. Less serious misconduct - all ac ts of m isc ond uc t no t c lassified asserious misc onduc t und er these rules.

    18. Offic ial Rep ort include s any rep ort duly submitted in writing to anyprop er autho rity in the University by a fac ulty me mb er, me mb er of theUniversity sec urity force , any o ffic er of a c olleg e or unit, or any office r of

    the University administration.

    19. Partisan political activity - refers to a ny ac t d esigned to p rom otethe election or defea t of a pa rticular ca ndidate or ca ndidates to a pub lic

    office during the elec tion a nd ca mp aign pe riod of a given yea r.

    20. Reparation app rop riate c om pe nsa tion to the ag grieved pa rty fordam ag e a nd or loss.

    21. Restitutionreturn o f p rop erty to reve rse unjust e nrichm ent.22. Retention co ntinuing sta tus as stud ent o f the University by

    sa tisfying rete ntion req uirem ents suc h as goo d ac adem ic stand ing or

    retention grades.

    23. Serious misconduc t a ll ac ts of m isc onduc t no t c lassified as lessserious misc ond uc t und er these rules, and other ana log ous ac ts.

    24. Semester ac adem ic period as dete rmined by the University.25. Student any person a dm itted to a nd registered in a d eg ree o r

    non-deg ree p rogram, or c ross-reg iste red in any c ourse o f the University on

    a reg ular or pa rt-time basis, inc lud ing one w ho is officially on lea ve of

    ab senc e; and who has not yet be en sep arated from the University

    forma lly throug h either transfer, grad uation, honorab le o r dishono rab le

    d ismissa l or expulsion or expiration o f the p eriod a llow ed for ma ximum

    residenc e, a t the time o f the c om mission o f the m isc ond uc t, reg ard less of

    whe ther or not he/ she is enrolled in a ny unit of the University at the time of

    26. Stude nt organization a group of stud ents who sha re g oa ls andinterests.

    27. Suspension an involuntary, temp orary lea ve from the Universitywhe rein a stud ent sha ll not b e a llowed to enroll even for residenc y and

    ma y not:

    a . Attend c lasses and ac ad emic ac tivities;b . Live in University stud ent housing;c . Use c amp us fac ilities, inc lud ing but no t limited to a thletic

    facilities, libraries and computer laboratories;

    d . Enter ac adem ic b uild ings and their premises;e. Participate in student activities within University premises;f. Have student jobs;g . Take e xam s; andh. To ava il of any othe r privileg e a ttendant to be ing a UP

    student.

    28. Suspe nsion o f rec og nition suspension o f recog nition of a stud entorganization.

    29. Tam ba yan - a spac e within the University whic h the memb ers of astude nt o rga nization o ffic ially oc c upy in order to c ond uc t o rga nization

    activities.

    30. University Official includ es all University em p loyees, suc h a stea c hing a nd non-teac hing staff, and inde pe nde nt c ontrac tors assignedto the University.

    31. University premises as defined by the Universitys c ertific a tes oftitle, includ ing those o f the UP Extension Prog ram in Pamp anga .

    32. University-recognized student organization a g roup of stude ntswhose members and officers comprise at least 0.5% of the eligible student

    po pula tion, who have c om pleted at least one yea r of residenc y in the

    University, who sha re goa ls and interests supportive of a hea lthy University

    life, a nd has been rec og nized by the University.

    Sec tion 3.1. Ap plic ation for, or renewa l of, University rec og nition of

    student organizations

    a . A stud ent orga niza tion see king University rec ognition m ust ha ve amemb ership o f at lea st 0.5% of the eligib le student pop ulation,

    inc luding o ffic ers, who ha ve c om pleted at lea st one (1) year of

    residenc y in the University and who a re c urrently enrolled , with no

    mo re tha n 49% of the mem bers c om ing from one c olleg e. The

    organization m ust subm it in hard a nd electronic form a c op y of its

    Constitution and by-laws to the Offic e of Student Ac tivities (OSA).

    b . A student organization seeking University recognition or renewalthereof m ust a pp ly with the O SA.

    c . Rec og nition sha ll be fo r one yea r, effec tive upon issuanc e o f theCertifica te o f Rec og nition. The p eriod for app lic a tion for

    rec og nition sha ll be the first fifteen (15) days from the first day of

    c lasses of every sem ester. No a pp lic a tions w ill be p roc essed

    Sec tion 4. Genera l guid elines on the g rant of use o f University prem ises and

    facilities

    Sec tion 4.1. Tam ba yan

    The University d esires to rat iona lize the use of University fa c ilities

    and p remises, and to eq uitab ly distribute University resources for use of

    student o rga niza tions to p rom ote their ob jec tives. A tambayanfacilitates

    the ac tivities of student orga nizat ions, and p rovide s spac es for group

    stud y and soc ializa tion. Sinc e there a re finite ava ilab le spac es for

    tambayan, the d istribution is based on me rit a nd selec ted c riteria.

    The use of a tambayanis c onsidered a gran t.

    Sec tion 4.1.1.Grant of tambayan

    Sub jec t to c ertain c riteria a nd req uirem ents, the tambayan

    ma y be granted by e ither the Co lleg e o r the University, de pe nding

    on its loc a tion.

    Sec tion 4.1.2. App lic ation for tambayanfor University-rec og nized

    student organizations

    The g rant o f the p rivilege o f use o f a tambayanfo rUniversity-rec ognized stud ent o rganiza tions is sub jec t to the

    following:

    a . Who may apply any University-recognized studentorganization

    1) rec og nized by the University for a t least o ne (1) year; and ,2) is not and has not been sub jec t to any disc ip linary

    proc ee d ings in the last five (5) yea rs.

    b . Where to ap ply w ith the Offic e o f Stud ent Ac tivities.Ap p lica tions with OSA sha ll be p roc essed by an ad hoc

    c om mittee, the c om po sition o f whic h shall be de termined b y the

    OVC SA. The Co mm ittee sha ll set the c riteria for the g rant. The

    c . A University-rec og nized stud ent orga niza tion g ranted the use of

    a tambayanshall not share the tambayanwith any other

    student o rganizat ion excep t with the written d irec tiveand/or

    app rova l of the OVCSA.

    d . The student o rganiza tion may introd uc e improveme nts in the

    tambayan, such as painting, cabinetry, partitions, and the like,

    only with the w ritten a pp rova l of the OVCSA, in c om plianc e

    with University reg ulations. Upon exp iry o f the grant, the

    University sha ll ow n a ll imp rovem ents introd uc ed unless the

    sam e a re rem oved by the stude nt o rga nization, without ha rm

    or dam age to the original c ond ition of the tambayan.

    e. A student orga niza tion gran ted the use of a tambayanshall

    use the tambayanin suc h a ma nner that it doe s not injure the

    rights of o the rs.

    f. A student orga niza tion g ranted the use of a tambayanshall

    keep it c lea n and tidy a t a ll times.

    g. A tambayanis sub jec t to inspec tion by University autho rities a t

    relationships amo ng o rga niza tions or if ac adem ic req uirem ents

    so require.

    Sec tion 4.1.5. Ground for revoc ation of grant of tambayanto

    University-recognized student organizations

    Non-c om plianc e w ith any of the c ond itions provided in

    Artic le VI Sec tion 4.1.4c to 4.1.4h sha ll be g round for revoc a tion o f

    the grant.

    Section 4.1.6. Permanent structure for tambayan

    A reco gnized stude nt orga nization m ay ap ply with the

    University throug h the approp riate office , for the use o f a portion o fUniversity p rem ises for the purpose of p utting up a perma nent

    structure to serve a s tambayanin compliance with University

    reg ula tions. The struc ture sha ll be c onsidered as a dona tion to the

    University. The p rivilege o f the use o f the struc ture a s a tambayan

    shall be g rante d to the stude nt orga nization tha t c aused its

    c onstruc tion, for two (2) yea rs. How ever, the stud ent orga nization is

    still sub jec t to the pertinent p rov isions of Article VI Sec tion 4.1.

    Sec tion 4.2. University p remises and other fac ilities

    A student o r a group of students ma y ap p ly for the limited use o fa portion o f University premises and / or fac ilities for lega l purposes; e.g.

    thea ter renta l. For area s under the jurisd ic tion of the Co lleg e, the

    ap p lic ation shall be filed with the Colleg e o ffic e c onc erned. For all other

    a rea s, the a pp lica tion sha ll be filed with the University through the

    ap propriate offic e.

    VII. Procedure

    The University has exclusive jurisd ict ion o ver ma tte rs of stud ent

    misc onduc t. The University has the right to define sta nd ards and norms of p rop er

    c ond uc t o f stud ents, and therefore c onsiders dep artures from sa id standards as

    ac ts of m isc ond uc t and as viola tions of this Code.

    The University presc ribes the p roc ed ure fo r ca ses of stud ent d isc ipline, du ly

    rec og nizing the rights o f stud ents to d ue p roc ess. The d isc iplina ry p roc ee d ings

    are a dministra tive in na ture, not o pen to the pub lic , and the Rules of Court sha ll

    not ap ply.

    This Co de p rovides three (3) sets of p roc ed ures: for inte llec tua l dishonesty

    (Artic le VII Sec tion 2), for other misc onduc t involving a stud ent (Article VII Sec tion

    3), and for stud ent organizations (Artic le VII Sec tion 4).

    Sec tion 1. Disc iplina ry Bod ies

    There a re three (3) disc iplina ry b od ies in the University: the Stud ent

    Disc iplina ry Co unc il (SDC), the Co lleg e Disc ip linary Com mittee (CDC) a nd the

    Inter-College Disciplinary Committee (ICDC).

    The m em bers of the ad hoc c om mittees under the three (3) disc iplina ry

    bod ies have the duty to d isc lose the ir relationships of a ny nature a nd to a ny

    extent w ith the p a rties involved .

    Sec tion 1.1. The Student Disc iplinary Counc il (SDC)

    Sec tion 1.1.1. Compo sition of the Stude nt Disc iplina ry Counc il (SDC)

    The SDC is a bod y forme d by the C hanc ellor unde r the

    administrative sup ervision o f the VCSA, for the purpose of

    imp leme nting the p ertinent p rov isions of th is Co de. The SDC sha ll

    be c om posed of seventy-two (72) mem bers a ll of whom sha ll be

    tenured , reg ula r fac ulty, exc ep t fac ulty advisers of student

    organiza tions, nom inated by the ir respec tive Deans. Thirty-six (36)

    sha ll serve a te rm of three (3) yea rs while the othe r thirty-six (36)

    sha ll serve a term o f two (2) yea rs. Therea fter, upon the expiry ofthe three- and two-yea r terms, me mb ers sha ll serve fo r two yea rs.

    The C ha nc ellor sha ll appoint five (5) from the SDC as me mb ers of

    the SDC Exec utive Co mm ittee , one of w hom sha ll be the SDC

    Exec utive Co mm ittee C ha ir who sha ll a lso b e the SDC Cha ir. All

    the me mb ers of the SDC Exec utive Comm ittee sha ll serve a term o f

    one (1) yea r. The SDC sha ll have a n office a nd a pprop ria te sta ff.

    Sec tion 1.1.2. Jurisdic tion and Func tions of the SDC Student

    The SDC sha ll form c om mittees tha t w ill hea r and resolve

    cases involving serious misconduct, except intellectual dishonesty,

    and less serious misc ond uc t involving mo re than one c olleg e. If,

    how eve r, a c ase o f intellec tua l d ishone sty co nc erns two or more

    c olleg es who se Dea ns a re una b le to form an Inter-Co lleg e

    Disc iplina ry Co mmittee (See Artic le VII Sec tion 1.3.1), the SDC sha ll

    take jurisd ic tion of the c ase.

    Sec tion 1.1.2.1. Ad Hoc Disc iplina ry Hea ring Comm ittee

    (AHDHC)

    The Ad Hoc Disc iplina ry Hea ring Co mm ittee is

    c om posed of three (3) or five (5) memb ers of the SDC who

    are assigned by the SDC Exec utive Comm ittee .

    Sec tion 1.2. The Co llege Disc iplina ry Com mittee (CDC)

    Section 1.2.1. Composition of the College Disciplinary Committee

    (CDC)

    The CDC is an a d ho c c om mittee formed b y the Dea n for

    the p urpose o f imp lementing the pertinent p rovisions of this Code.

    The Dean ma y sit as a m em ber of the CDC. The C DC sha ll be

    c om posed of three (3) or five (5) members who m the Dean sha ll

    appoint from the reg ular fac ulty. The Comm ittee memb ers sha ll

    selec t a Cha ir from amo ng them selves.

    Sec tion 1.2.2. Jurisdic tion a nd Func tions of the College Disc iplina ry

    Committee (CDC)

    The C DC sha ll hea r and resolve c ases of inte llec tua l

    d ishonesty, less serious misc onduc t, and a ll other ca ses where the

    stude nts involved be long to the C olleg e a nd the incide nt oc c urred

    within Co lleg e p rem ises without p rejudic e to the d isc retion o f the

    Dean to refe r the latte r ca ses to the SDC.

    Sec tion 1.3. The Inter-Colleg e Disc iplina ry Com mittee (ICDC)

    Sec tion 1.3.1. Com position of the Inter-Co llege Disc iplina ry

    Com mittee (ICDC)

    The ICDC is an ad hoc c om mittee formed by the Deans of

    two (2) or more Co lleg es, for the p urpose o f imp lem enting the

    pertinent p rovisions of this Code, when a student o f a C olleg e is

    a lleg ed to ha ve c om mitted intellec tual dishonesty in another

    College.The Dea n of the Co lleg e w here the m isc ond uc t wa s

    c omm itted sha ll initiate the c onstitution of the ICDC. The ICDC

    sha ll be c om posed of three (3) or five (5) reg ula r fac ulty memb ers

    from the c olleg es c onc erned. If there is an e ven numb er of

    Co llege s c onc erned , the Dea ns sha ll agree o n the me mb ership in

    the ICDC of a third C olleg e. In ad d ition, the Deans of the

    c onc erned Co lleg es sha ll sit as ex-officio no n-voting m em bers of

    the Com mittee . They may vote o nly to b rea k a t ie. The ICDC

    me mb ers sha ll selec t a c ha ir from among them selves.

    Should the Deans involved be una b le to form the ICDC,

    ow ing to a funda mental difference in p osition o r som e o ther

    substa ntive c onstraint, they sha ll refe r the c ase to the
