Apartment PleaCont'd, from x«ige 1, this section
to build the structure at the cor-ner of Gilbert street and SouthOcean avenue in April , AttorneyScovell appealed the verdict tothe Supreme court.
Here»too, he won a victory. Thehigh tribunal ruled that the peti-tioners had not produced sufficientevidence at the hearing and an-nulled the board's vote. SupremeCourt Justice David Kusnetz or-dered a rehearing- on the request.
At the July 18 hearing, after anear six-hour session, the boardvoted to adjourn and resumetestimony last Wednesday. Onboth occasions the meeting- roomwas jammed with proponents andopponents of the project. About)50 supporters of Mr. Scovell'san ti-apartment cause attended lastweek's session while about 30 peo-ple appeared in favor of thepetitioners.
Milton Wiggins, II , Francis L.Marran and John Gearity votedagainst the apartment while Dan-iel M. Berke and Nicholas Menikosboth voted in favor of it. Mr.Berk and Mr. Menikos said they
were in favor of the project withstipulations that apartments notbe leased on an overnight orweekly basis but on a monthly oryearly basis. The stipulationswould have eliminated the pos-sibility of often-criticized tran-sient dwellers.
The board members votingagainst the applica n ts' request re-portedly based their opinions oncriticism of the project 's specifi-cations.
Mr. Wiggins, Mr. Marran , Mr.Berke and Mr. Gearity previouslyhad voted in favor of approvingthe application at the first voteback in April. Mr. Menikos wasnot on the board at that time.
ThQ three-month old battle, although apparently settled in theeyes of Mr. Scovell and the Zon-ing Board of Appeals, still hasanother chapter to be written, according to Mr. Ashare. If thisis so, it looks like some additionalshort-sleep nights for the twoattorneys, the board and peti-tioners Nicholas J. DuBatto, An-thony Prudenti and the CrownSurgical Instrument corporation.

Drama Now at Gateway
Seen from the bridge, the Brooklyn waterfront offers a sprawlingappearance where individuals are unnoticed to those who pass highabove the human anthill.
It takes a master's pen to poke the anthill and delve deeplyinto a waterfront tragedy: Arthur Miller shows a penetrating: insightin his "View From The Bridge,"currently featured at the Gatewaytheatre in Bellport.
Ranking with modern theatre'smost distinguished achievements,"View From The Bridge" tells thestory of a longshoreman's ill-re-pressed love for his niece, the storyof the violent turmoil inside him,and of the repercussions of thisconflict on those near to him. Theexpanded version, adding newscenes to the original one-act play, dissects to the bone the complexanatomy of the characters ' hiddenselves.
Even where there is violence,Mr. Miller shows that there neednot necessarily be guilty "I gottahave my respect ," says Eddie Car-bone, who, in his struggle withhis own values, is neither a vil-lain nor a hero, but one of thevictims of the stubborn forcesmotivating him not to act for hisown benefit but leading him to aviolent end.
Robert Duvall gives an outstand-ing performance and rates severalcurtain calls as Eddie. He hassomething of a Brando-ish stagepersonality, a distinct waterfrontelocution and mannerism, and heexcellently adapts himself to thepart of Hhe sullen , hard-working,tunnel-eyed longshoreman. Mr. Du-vall is supported by an able castof professional actors. The play isdirected by Ulu Grosbard in hisfirst assignment at the Gatewaythis season.
Enid Bagnol's "The Chalk Gar-den" will be presented at theGateway next Tuesday, co-starr-ing Libbv Glenn and Milt Com-mons. "View From The Bridge"will remain at the theatre untilSaturday.
