REASON: In order to ensure compliance with the approved drawings. 5. If, during development, contamination not previously identified is found to be present at the site then no further development (unless otherwise agreed in writing with the Local Planning Authority) shall be carried out until the developer has submitted to, and obtained written approval from the Local Planning Authority for an investigation and risk assessment and, where necessary, a remediation strategy and verification plan detailing how this unsuspected contamination shall be dealt with. Development shall not thereafter proceed unless in strict accordance with the measures identified in the approved remediation strategy and verification plan. Prior to occupation of any part of the permitted development, a verification report demonstrating completion of the works set out in the approved remediation strategy and the effectiveness of the remediation shall be submitted to and approved, in writing, by the Local Planning Authority. REASON: To ensure that any unexpected contamination that is uncovered during remediation or other site works is dealt with appropriately. 6. The development shall not be carried out otherwise than in strict accordance with a Surface Water Drainage Scheme, to include details of the means of the disposal of surface water drainage from the site (preferably a sustainable drainage scheme), and details of the implementation and future management of the system, which shall be agreed in writing by the Local Planning Authority prior to the commencement of the development. REASON: To ensure a suitable method of surface water disposal to serve the development. 7. Prior to development commencing the applicant shall submit a scheme of works to prevent fugitive emissions of mud and dust beyond the boundary of the site to the satisfaction of the Local Planning Authority. REASON: To ensure that residential amenity and safety are not affected during construction. INFORMATIVES Nesting birds are legally protected from disturbance under the Wildlife & Countryside Act 1981 (as amended). If works are to involve any cutting or clearance of shrubs, hedges or other vegetation, which may form nesting sites for birds, such operations shall be carried out at a time other than in the bird breeding season (which lasts between 1 March-15 September inclusive in any year). If works must take place within the bird breeding season, appropriate measures must be taken, such as a suitable inspection or survey, to ensure that there is no threat of disturbance or harm to nesting birds. Depending on the results of such a survey, further measures or conditions may be required. The works, including any timber treatment, shall proceed following the precautions and measures described in the protected species survey report (Bat and Protected Species Survey Report, dated 18 May 2011). If bats are found, works shall cease immediately and further advice be obtained from Natural England and/or a licensed bat consultant. Works shall not resume until their advice has been followed. Nesting birds are also protected by law. If any nesting birds are discovered in the roof space, eaves or soffits during the course of the development, works shall cease until breeding has finished and fledglings have departed nests. In accordance with paragraphs 186 and 187 of the National Planning Policy Framework the Council has worked in a positive and pro-active way and has imposed planning conditions to enable the grant of planning permission.
