외국인근로자 취업 가이드북

외국인 고용허가제도란 한국정부와 인력송출에 관한협정을 체결한 국가의 근로자가 외국인 고용허가를받은 한국의 사업체에 취업하여 합법적으로 일할 수있도록 하는 제도입니다.

Ⅰ. 외국인근로자의법적지위

① 고용허가제도를 통해 취업하는 외국인근로자는 합법적인근로자의 신분(체류자격 : E-9)으로 한국인과 동등하게 근로기준법 등 노동관계법의 보호를 받습니다.

② 외국인근로자도 산재보험, 국민건강보험, 국민연금 등 사회보험에 가입하여야 하며 그에 따른 혜택을 받을 수 있습니다.

③ 외국인근로자라는 이유로 근로계약 위반, 부당해고 등차별대우를받지않으나, 외국인근로자도법에정한의무를당연히 준수해야 하며 위반시에는 처벌을 받게 됩니다.

④ 외국인근로자가 한국에서 취업할 수 있는 기간은 3년이며취업기간 후에는 반드시 출국하여야 합니다.

⑤ 외국인근로자는 한국에 취업하고 있는 기간 중에 가족을동반할 수 없습니다.

The Employment Permit System for foreign workersenables workers from countries with which the Koreangovernment has concluded an MOU on sendingworkers to be legally employed by companies in Koreawhich have obtained a permit to employ foreignworkers.

Ⅰ. Legal Status of Foreign Workers

① Foreign workers employed by companies in Korea under the EPSenjoy legal employment status (sojourn status: E-9) and are thusprotected just as Koreans are under the Labor Standards Act andother labor laws.

② Foreign workers are required to join the Industrial AccidentCompensation Insurance, National Health Insurance, andNational Pension, and are eligible to receive benefits from suchsystems.

③ It is illegal for employers to discriminate against foreign workersby, for example, violating employment contracts or dismissingthem without justifiable cause. At the same time, foreign workersmust abide by all Korean laws related to their employment andactions and will face punishment for any violation of the law.

④ Foreign workers may work in Korea for up to three years. At theexpiry of their sojourn period , they must leave Korea.

⑤ Foreign workers may not be accompanied by any members oftheir family while they are employed in Korea.

Ⅱ. 외국인근로자가반드시지켜야할사항

입국후사업장배치전에반드시지켜야할사항

①외국인취업교육이수외국인근로자는 입국 직후 외국인취업교육기관에 입소하여 외국인취업교육을 이수하여야 합니다.취업교육기관은 한국산업인력공단(외국국적동포), 국제노동협력원(베트남, 몽골, 태국, 중국), 중소기업 중앙회(스리

랑카, 필리핀, 인도네시아, 우즈벡, 파키스탄, 캄보디아, 네팔, 방

라데시, 미얀마, 키르키즈, 동티모르)입니다.(제조업)

※농축산업(농협중앙회), 건설업(건설협회), 어업(수협중앙회)은 업종별

특성을고려하여업종별취업교육기관에서담당

취업교육은 합숙교육(20시간 이상)으로 진행되며, 교과내용은 한국의 이해, 관련 법령, 산업안전 및 취업에필수적인 업종별 기초기능 등입니다.

②건강진단

외국인근로자는 취업교육기간 중 건강진단을 받아야

합니다.※건강진단 불합격자는 2차 정 검사를 실시하며, 2차 정 검사결과

건강이상이확정될경우출국해야합니다.

Ⅱ. Matters to be Observed by Foreign Workers

Before being placed in workplace after entry into Korea

① Completing employment training designed for foreign workersA foreign worker must go to a designated employmenttraining institute upon his/her entry into Korea and completean employment training course for foreign workers.The training institutes for foreign workers who applied formanufacturing job are : the Human Resources DevelopmentService of Korea(for ethnic Korean foreign workers), the KoreaInternational Labor Foundation(for workers from Vietnam,Mongolia, Thailand and China), and the Korea Federation of Smalland Medium Business(for workers from Sri Lanka, the Philippines,Indonesia, Uzbekistan, Pakistan, Cambodia, Nepal, Bangladesh, Myanmar,Kyrgyzstan and Timor Leste) (Manufacturing)

※ Training Institutes for Non-manufacturing Jobs : - agricultural·livestock → (NationalAgricultural Cooperatives Federation) - construction → (Construction Association of Korea)- fisheries → (National Federation of Cooperatives Fisheries)

Employment training will last 20 hours or more (between 2nights-3 days and 3 nights-4 days) and cover the understandingof Korea, related laws and basic knowledge essential to theiremployment.

② Medical CheckupA foreign worker is required to undergo a medical checkupduring the employment training period. ※ A foreign worker who fails to pass the initial medical checkup will receive a second

checkup which is more rigorous than the first one. The foreign worker must depart Koreashould the results of the second checkup confirm abnormalities.

③보험가입외국인근로자는 근로계약 효력발생일로부터 15일 이내에 상해보험에, 80일 이내에 귀국비용보험에 가입하여야 합니다.(취업교육기간중취업교육기관에서보험약정서체결)

- 상해보험 : 취업교육기간 중 보험료를 납입하며, 업무상 재해이외의 사망·질병 등에 대비한 보험

- 귀국비용보험 : 출국시 필요한 비용에 충당하기 위한 보험으로 입국 후 80일 이내에 본인 통장(취업교육시 통장 개설)에서 자동 납부처리

※ 급여가 직접 근로자에게 지급된 경우 반드시 귀국비용보험료 이상의금액을입국후55일부터80일사이에본인통장에입금해두어야함.

사업장배치후취업기간중에반드시지켜야할사항

①외국인등록(90일 이내)사업장에 배치된 외국인근로자는 입국일로부터 90일이내에 체류지 관할 출입국관리사무소 및 출장소에외국인 등록을 해야 합니다.※ 준비물 : 외국인등록신청서, 여권, 사진(3×4cm) 2매, 수수료

②사업장이동제한반드시 입국 전 근로계약을 체결한 사업장에서 근로를해야 하며, 정당한 사유 없이 최초 근로를 개시한 사업장을 이탈하여 다른 사업장에서 근로해서는 안 됩니다.

③ Joining InsurancesA foreign worker must join the Casualty Insurance and theReturn Cost Insurance within 15 days and 80 days,respectively, from the effective date of the employmentcontract. (Workers are, in theory, supposed to sign theinsurance agreement during the employment training period)- Casualty Insurance : Insurance against death or disability of

a foreign worker other than occupational accidents (a foreignworker is required to sign this insurance agreement duringthe employment training period).

- Return Cost Insurance : This insurance is designed to buildup savings to cover going-home expenses (air fare) of foreignworkers. The insurance premium will be depositedautomatically to the insurance company from his/her bankaccount within 80days after entry. The bank account will beopened during the employment training in Korea.※ Should salary be paid in cash directly to a foreign worker at least the amount

of money equivalent to that of Return Cost Insurance premium must bedeposited in the worker’s account from 55days to 80days from entry intoKorea.

During the period of employment after placement at workplace

① Foreigner Registration (within 90 days)A foreign worker placed at a workplace is required to apply forand receive an foreigner registration at an immigration office ora branch office with jurisdiction for the region in which he/sheresides within 90 days from entry into Korea. ※ An Foreigner Registration form, passport, and two photos (3×4cm) are

required and a service charge is imposed.

② Restrictions on changing workplacesA foreign worker must work at the workplace, where he/shehas concluded an employment contract with before enteringKorea and must not leave the workplace to work at a differentworkplace without justifiable reason.

다만, 정상적인 근로관계를 지속하기 곤란한 사유가 발생하 을 경우에 한해 관할지역 노동부 고용지원센터를통하여예외적으로사업장이동이 가능합니다.

사업장이동(변경) 사유

a. 사용자가정당한사유로근로계약을해지하거나근로계약갱신을거절한경우

b. 휴업, 폐업등외국인근로자의책임이아닌사유로그사업장에서근로를계속할수없게된경우

c. 폭행 등 인권침해, 임금체불, 근로조건 저하 등으로 외국인고용허가의 취소또는고용제한조치가행해진경우

d. 상해 등으로 해당 사업장에서 계속 일하기는 어렵지만 다른사업장에서일하는것이가능한경우등

사업장이동시유의사항

a. 사업장 이동은 허용 업종 내에서만 가능하며, 다른 업종으로의이동은할수없습니다.

※다만, 국내체류중인 근로자 중 사업장변경 사유가 발생한 제조업 근로자가 농축산업, 건설업, 어업으로 변경을 원하는 경우 업종변경가능

b. 다음과 같은 경우에는 불법체류자로 출입국관리사무소에 통보되며, 즉시출국조치를당하게됩니다.근로계약종료 후 1개월 이내에 관할지역 고용지원센터에 사업장이동신청(구직신청)을 하지않은경우

Changing workplace is allowed only through the districtJob Center of the MOL in exceptional cases where the currentemployment relations cannot be continued due to such reasonsas follows:

Justifiable reasons for changing workplaces

a. In the event the employer terminates the employment contract underjustifiable cause or refuses to renew it;

b. In the event a foreign worker cannot continue to work at aworkplace due to the suspension of business, closure of business orother reasons for which the worker is not responsible;

c. In the event an employer is restricted from hiring foreign workers orcancelled the employment permit for foreign workers under the EPSdue to a violation of human rights such as physical assault, delayedpayment of wages and deterioration of working conditions; or

d. In the event a foreign worker is not fit to continue work at theworkplace due to an injury but is able to work at another workplaceand other events.

Matters to be observed when changing workplaces

a. Changing workplaces may be permitted within the allowed scope ofbusiness types but is not allowed from one business type to another.

※ However, those with manufacturing job who are forced to changeworkplace due to unforeseen circumstances (e.g., employerdeclares bankruptcy) and wish to get a job in agricultural·livestock,construction, fisheries industry will be allowed to do so.

b. A foreign worker shall be reported to the Immigration Office as anillegal resident and repatriated immediately if he/shefails to apply for a workplace change(job application) at the districtJob Center within one month after termination of his/her previousemployment contract;

•leaves his/her workplace without permission from the employer;

•fails to find a job within two months from the time the application fora workplace change(job application) is filed and thus, has not beenable to receive a permit for a workplace change; or

•finds a job him/herself or through friends, co-workers and private jobplacement agencies, instead of through Job Center.

•In principle, changing workplace shall be restricted to a total ofthree times. But in the event the three changes were made dueto grounds solely accountable to the employer, an additionalchange may be allowed.

•A foreign worker shall renew his/her labor contract with theemployer every year during the period of employment. Whenhe/she has renewed the labor contract, he/she must obtain apermit to extend the sojourn period from the ImmigrationOffice with jurisdiction over the workplace.

•The period of employment in Korea for a foreign worker islimited to a maximum of three years. After the lapse of threeyears, he/she must leave Korea. A foreign worker may not beaccompanied by his/her family during the employment period.

⑤ 3년취업기간종료후재입국3년 취업기간 종료 후 자진출국 시 출국일로부터 6개월경과 후 고용허가제 절차에 따라 재입국 가능합니다.단, 출국 전 사용주의 요청이 있는 경우 1개월 경과 후재입국이 가능합니다.고용허가제 일원화로 체류자격이 전환(E-8 → E-9) 되는 MOU 체결 국가의 연수취업자(E-8)도 고용허가제외국인근로자와 동일 혜택 부여

⑥각종보험금신청과수령방법

외국인근로자의 출국 또는 사업장변경, 업무상재해 이외의 사망 또는 질병, 임금체불 등의 경우에 법령에서 규정한 각종 보험의혜택을받을수있습니다.

출국만기보험(사용자가입)

- 사업장 이탈 없이 상시근로자 5인 이상 사업장에서 1년이상 근무한 외국인근로자가 사업장 변경 또는 출국시한국산업인력공단 또는 삼성화재에 보험금 신청을 하면보험사업자가 외국인근로자 본인명의의 계좌로 직접보험금을 지급합니다.

귀국비용보험(외국인근로자가입)

- 외국인근로자의출국시(일시출국제외) 고용지원센터에

⑤ Reentry after the three-year work period hasendedForeign workers who voluntarily leave Korea upon expirationof the three-year work permit will be allowed to reenter thecountry under the EPS six months after their departure date.However, a worker whose employer made request to theMinistry of Labor to employ the worker again before he/sheleaves for his/her home country can return to Korea only onemonth after leaving the country.E-8 visa holders (i.e., foreign workers who entered Korea underthe Industrial Trainee System and whose visa status will bechanged to E-9 with the implementation the EPS) fromcountries that have signed a MOU with Korea are treated thesame as those entering Korea under the EPS.

⑤ How to receive insurance benefitsIn the event of a foreign worker's departure, change of workplace,death or disease other than occupational accidents, as well asdelayed payment of wages, a foreign worker may receive insurancebenefits as stated in related laws.

Departure Guarantee Insurance (purchased by employers)- When a foreign worker, who has continuously worked for one

year or more at a workplace with five or more full-timeemployees, moves to another workplace or leaves Korea andapplies for insurance benefits to the HRD-Korea or SamsungFire & Marine Insurance the insurer will directly send theinsurance benefits to the worker's account.

Return Cost Insurance (purchased by foreign workers)- When a foreign worker is planning to leave Korea (excluding a

temporary departure) he/she shall submit a "DepartureSchedule Notification Form" to an Job Center and file claim

‘출국예정신고서’를 제출한 후 한국산업인력공단 또는삼성화재에 보험금 신청을 하면 보험사업자가 직접 일시금으로 외국인근로자 본인 명의의 계좌로 보험금을지급합니다.

상해보험(외국인근로자가입)

- 외국인근로자가 업무상재해 이외의 상해(질병)사망·후유장해를 당할 경우 한국산업인력공단 또는 삼성화재에 보험금 신청을 하면 보험사업자의 사고조사를거쳐 본인명의의 계좌로 보험금을 지급합니다.

※외국인근로자가 사망한 경우에는 한국산업인력공단에서 유족확인(송출국가와 협의) 후 보험금 신청을 하면 보험사업자가 유족명의의 계좌로 해외송금 합니다.(출국만기보험, 귀국비용보험금도 동시 송금)

Casualty Insurance (purchased by foreign workers)- When a foreign worker suffers from death or permanent

impairment other than an occupational accident and file claimwith the HRD-Korea or Samsung Fire & Marine Insurance forbenefits, the insurer will investigate the accident report andsend the insurance benefits to the worker's account.

※ In the event a foreign worker dies and a bereaved family member applies toHRD-Korea for insurance benefits, the HRD-Korea will check whether theperson is a bona fide member of the bereaved family (in cooperation with thesending country). After the verification of such information, the insurer will sendthe insurance benefits to the account of the bereaved family member. (Alongwith said insurance benefits, other insurance benefits such as DepartureGuarantee Insurance and Return Cost Insurance will be sent at the same time.)

Guarantee Insurance (purchased by employers)- In the event an employer of a workplace, with less than 300

full-time workers or a workplace not covered by the WageClaim Guarantee Act, delays payment of wages, the workermay file claim with the HRD-Korea or Seoul GuaranteeInsurance for benefits. The insurer will then examine the caseto determine whether payment of wages has been actuallydelayed and if so, send the insurance benefits to the worker'saccount.

Strict observance of Korean laws

While a foreign worker stays in Korea, he/she must abide by all

Korean laws. Any violation shall be subject to punishment.

① Observance of the Act on Foreign Workers’Employmenta. In the event a foreign worker has not used the standard labor

contract when concluding an labor contract; or [Article 9]b. In the event a foreign worker has not subscribed to an

Casualty Insurance, [Article 23]☞ he/she shall be subject to a fine not to exceed five (5) million won.

② Observance of the Immigration Controls Acte. In the event a foreign worker has committed an act that he/she is

not allowed to in accordance with the rules that govern his/herstatus of sojourn or in case a foreign worker remains in Koreaafter the period of lawful stay is over, [Article 23, Article 25]☞ he/she shall be subject to penal servitude or imprisonment not to exceed

three (3) years, or a fine not to exceed 20 million won.f. In the event a foreign worker has left his/her designated

workplace without permission or has not obtained a permit tochange workplace or add workplace ; or [Article 18, Article 21]

g. In the event a foreign worker has not applied for and received anforeigner registration within a certain number of days asrequired by law, [Article 31]☞ he/she shall be subject to penal servitude or imprisonment not to exceed

one (1) year, or a fine not to exceed ten million won.h. In the event a foreign worker has not made a notification of

moving-in when changing the area of residence, [Article 36]☞ he/she shall be subject to a fine not to exceed one million won.

i. In the event a foreign worker has not duly reported a change inany matters related to the foreigner registration, [Article 35]☞ he/she shall be subject to a negligence fine not to exceed one million

won.j. In the event a foreign worker knowingly makes false entries in

various application forms or reports, [Article 100]☞ he/she shall be subject to a negligence fine not to exceed 500 thousand won.

③ In the event a foreign worker has been found to have takennarcotics or committed crimes such as an assault, murder, ortheft, he/she shall be subject to punishment according torelated laws.

Ⅲ. 외국인근로자의권익보호

법에의한권리보호

① 근로기준법에의한보호

근로시간은 1주 40(44)시간, 1일 8시간을 기준으로 하며, 당사자간 합의가 있으면 연장근로가 가능합니다.

※[부칙] 주40시간근무는사업장규모에따라단계적으로적용됨- 사업장규모: 50인~100인 (‘07.7.1부터적용)

20인~50인 (‘08.7.1부터적용)20인미만사업장 (‘2011년까지적용)

임금은 통장계좌 입금 또는 현금으로 매월 1회 이상근로 계약서에 명시한 날짜에 정기적으로 지불됩니다.※사업주는근로자의동의없이임금의일부또는전부를공제하거나

강제로저축할수없습니다.

연장근로, 야간근로(22:00-06:00), 휴일근로를 한 경우에는추가임금을 받을 수 있습니다.(4인 이하 사업장 적용제외)

근로자가 1년 이상 계속 근로한 경우에는 퇴직금을 받을 수 있습니다.(4인 이하 사업장 적용제외)

※출국만기보험에 가입한 사업장은 퇴직금을 출국만기보험으로대체·지급합니다.

- 다만, 보험금이 퇴직금보다 적을 경우 그 차액을 사업주가

근로자에게별도지급하여야합니다.

Ⅲ. Protection of the Rights and Interests of Foreign Workers

Legal protection of rights

① Protection under the Labor Standards ActStandard working hours are 40(44)hours a week (eight hours aday). Upon agreement between a foreign worker and theemployer, extended working hours are allowed.

※ 40-hour work : to be phased in according to the number of workers in a workplace

- No. of workers in the workplace :50~100 workers (applied from Jul. 1, ´07)20~50 workers (applied from Jul. 1, ´08)less than 20 workers (to be applied before year ´2011)

Wages are to be paid to the workers’ account or in cash at leastonce a month on the day stated on the labor contract.

※ Employers may not, without consent from workers, deduct or save anypart or all of workers' wages.

Foreign workers are entitled to receive additional wages forextended working hours, working at nights (22:00-06:00) or onholidays (except workplaces with less than 5 workers)

Foreign workers who have worked at a workplace for over one(1) year are eligible to receive severance pay. (except workplaces

with less than 5 workers) ※ A workplace covered by the Departure Guarantee Insurance can pay the

insurance benefits in lieu of the severance payment.

- Note : Should the amount of the benefits less than severance pay, employermust pay the difference to his/her employees.

② 최저임금법에의한보호외국인근로자는 법으로 정한 최저임금액 이상의 임금을받을수있습니다.※ 시간당3,770원, 일당 30,160원(1일8시간기준)

③산업재해보상보험법에의한보호외국인근로자는업무상부상또는질병에걸린경우에는요양·휴업·장해·유족급여 등을 받을 수 있습니다.

※작업장 내에서 일어난 모든 업무상 재해는 근로자의 잘못으로 인한귀책사유에상관없이산업재해보상보험법에의해보호받을수있습니다.

④ 임금채권보장법에의한보호사업주의도산등의사유로퇴직한근로자가임금, 퇴직금등을 지급받지 못한 경우에는 국가로부터 최종 3월분의임금, 최종 3년간의 퇴직금, 최종 3월분의 휴업수당을받을 수 있습니다.
