Thank you for your response dated February 1,2002, to our notice that this well construction permit will expire on February 21,2002. We understand that this project is subject to determinations yet to be made in negotiations between State and County concerning a roadway right-of-way, and thus it is not possible to estimate when the project may be able to proceed. Therefore, your permits will expire on February 21, 2002 and be cancelled.
We understand that you will file a new application when ready, without any prejudice or penalty. If filing fees are due to increase at some time in the future, we will give you advance notice about that.

Enclosed are two (2) copies of your approved Well Construction Permit for the captioned well(s) that authorizes well construction activities but excludes installation work for your permanent pump. As part of the Chairperson's approval, the following special conditions were added and are part of your permit under Permit Condition 13:
Special Conditions
1. Attached for your infonnation is a copy of the Department of Health's (DOH) review comments. Please note DOH's requirements related to discharge of effluent from well drilling and testing activities.
This permit does not authorize work for your permanent pump installation. Approval and issuance of your pump installation permit is contingent upon information provided to and aCcepted by Commission staff as required in the Well Construction & Pump Installation Standards (1123/97) and any special conditions performed under this permit. However, a permanent pump may be installed prior to the permanent pump installation permit issuance in accordance with the Commission's April 15, 1998 Declaratory Ruling No. DEC-ADM98-G5, which states:
·Permanent pump installation for capacities between 0-70 gpm and where the proposed use is for private individual needs in non-ground-water management areas may be allowed prior to the final pump mtallation permit issuance. When required as a condition 01 the well construction permit, subsequent pumping tests shall validate the acceptability of the pennanent pump. The permanent pump mtalled prior to final pump installation permit issuance is subject to removal if the testing shows that a smaller pump is required to reduce the potential of affecting neighboring weIs and localized upconing at the applicanfs well .•

If you qualify and wish to take advantage of this ruling, please include a written request to install the permanent pump prior to final pump installation permit issuance when you return to us your validated well construction permit.
Please sign and have the contractor sign both permit originals and return one for our files. Also, copies of the aquifer pump test worksheet and the well completion report form are enclosed for your use.
IMPORTANT - Drilling work may not proceed without a validated pennit returned to the Commission. Please provide all the infonnation in this packet to your well drilling contractor. The pennittee, well operator, and/or well owner are responsible for all conditions of the pennit This includes ensuring that the well construction contractor, or other party who constructs the well(s), submits a completed Part I of the Well Completion Report fonn (enclosed) within sixty (60) days after the well construction work is completed. Be advised that you may be subject to fines of up to $1000 per day for any violations of your pennit conditions, starting from the date of this pennit approval.

construction and testing of Pulehunul-MEO Fireflow Wells (Wei Nos. 4928-03 & 4) at Pulehunul, Wailuku, Maui, TMK 3-8-8:1, subject to the Hawaii Well Construction & Pump In~IIation Standards (1123 97) which include but are not limited to the following conditions:

The Chairperson of the Commission on Water Resource Manager-ent (Commission).!. P.O. Box 621, Honolulu, HI 96809, shaD be notified, in wrting, at least two (2) weeks before any work authorized by this permi{ canmences and starr shal be allowed to inspect installation activities i'I accordanCe with § 13-168-15, Hawaii Administrative Rules.
The well construction permit shall be for construction and testing cf the well only. A minint.nl one-inch diameter monitor tube shaD be permanently i'lstalled, in a manner acceptable to the Chairperson, to accural!ly record water levels. The permittee, well operator, and/or wei owner shalt coordinate with the Chairperson and condud a pumping test in accordance with the Standards (a pumJ) testing worbheet is atIaChed). The permittee, well operator, and/or well owner shal submit to the Chairperson the test results as a l)asis for SUppclrting an application to instal a perr1)anent pump and withdraw water for use. No permanent purrp may be installed until a pump installation permit is approved and issued by the ChaltJ)erson.
In basal ground water, the depth of the well may not exceed one-burth (1/4) of the theoretical thickness (41 times initial head) of the basal ground water unless othelWise authonzed by the Chairperson.
The permittee, weft operator, and/or wen owner shall incorporale mitigation measures to prevent construction debris from entering the aquatic environment, to schedule work to avoid periods of high rainfan, aoc: to reVegetate any cleared areas as soon as possible.
In the event that subsurface cuHural remains such as artifacts, blJials or concentrations (;A shells or charcoal are encountered during construdion, the permittee, well operator, and/or well owner shaD stop work and contad the Departmenfs Historic Preservation immediately.
The propQsed well c:onstrudion shall not adversely affect existing cr Mure leQal uses of water in the area, induding any surface water or established instream flow standards. This permit or the authorization to constrJCt the weft'shall not constitute a determination of correlative water rights.
The following shall be submitted to the Chairperson within sixty (W, days after completion of work: a. Well completion report, (attached - Part I, Well Construction Report). b. Elevation (referenced to mean sea level, msl) survey by a HawaiHicensed surveyor. c. As-buiH sectional drawing of the well. d. Plot plan and map shOwing the exact Iocati:n of the wen. e. Complete pumping test records, including tine, pumping rate, drB'Mlown, chloride content, and other data.
The permitt~l wen operator, and/or well owner shaD comply with all appflCable laws, rules, and ordinances; norH:Ompiiance may be grounds for revocation of mis permit.
The weD construction permit application is incorporated into this permit by reference and is subject to the Hawati WeD Construction & ~ Installation Standards (January 23, 1997; HWCPIS). If the HWCPlS are not followed and as a consequence water is wasted or contamilated, a Iiei1 on the property may I1ISUIt

The permittee, its successors, and assigns shall indemnify, defend. and hold the State of Hawaii harmless from and against any loss, iability, cIain, or demand for property damage, personal injury, or death arisng out of any ad or omission of the applicant, assigns, officeIs, employees, contractors, and agents under tfiis permit or relating to or conneded With the granting of this permit.

You reviewed this application in July 1998 and responded (copy attached), but we have only now received notice that the project has complied with Chapter 343, HRS. As conditions may have changed, we offer this new opportunity to review and respond.

1. For Well-Drilling Activities
Any discharge to state waters of treated process wastewater effluent associated with well drilling activities is regulated by Hawaii Administrative Rules, Chapter 11-55, Appendix I, effective September 22, 1997. Treated process wastewater effluent covered by this general permit includes well drilling slurries, lubricating fluids wastewaters, and well purge wastewaters. This general permit does not cover well pump testing. The applicable Notice of Intent Forms and filing fee shall be submitted at least thirty (30) days before the start of discharge to the Department of Health, Clean Water Branch at 919 Ala Moana Boulevard, Room 301, Honolulu, Hawaii 96814-4920 or P.O. Box 3378, Honolulu, Hawaii 96801-3378. Inquiries may be directed to the Clean Water Branch at (808) 586-4309 or by fax at (808) 586-4352.
2. For Well Pump Testing
The discharger shall take all measures necessary to prevent the discharge of pollutants from entering state waters. Such measures shall include, if necessary, containment of the initial discharge until the discharge is essentially free of pollutants. If the discharge is entering a stream or river bed, best management practices shall be implemented to prevent the discharge from disturbing the clarity of the receiving water. If the discharge is entering a storm drain, the discharger must obtain written permission from the owner of that storm drain prior to discharge. Furthermore, best management practices shall be implemented to prevent the discharge from collecting sediments and other pollutants prior to entering the storm drain.

The proposed. project is located in Omaopio, Maui, Hawaii. The Pulehu Road Improvements, extending from Omaopio Road to Holopuni Road, will include widening the existing road, improving drainage, and improving sight distances. The proposed. project will improve hazardous driving conditions existing as a result of a narrow roadway, poor drainage, and limited sight distances.
The project is located on the western slopes of Haleakala in Mani, Hawaii. The new roadway will be constructed over the existing Pulehu Road from Omaopio Road to Holopuni road. The location of the existing roadway is within the Puu 0 Ka1i Quadrangle.
The project involves improvements within the existing road right-of-way along the four-mile section ofPulehu Road from Omaopio Road to Holopuni Road, for a comfortable two-1ane (24-foot wide lanes + 3-foot wide shoulders where
practical) roadway. The project will include road widening and paved shoulders, mjnjmal drainage improvemen~ (small culverts where practical and paved shoulder swales With "tum-outs" into natural drainage ways and fields), warning and regulatory signs, guardrails, and other related work.
The project consists mainly of road widening and will be constructed over the existing roadway, Pulehu Road, owned by the County ofMaui. The project route is through county-owned lands and is surrounded by pri~ly-own~ lands. The land uses surrounding the project SIte are agncultural consisting of sugar cane fields, pineapple fields, _land, and Kula Agricul1:!ual Park. ~getation along the roadway consists mainly of haole koa, kiawe, cactus, and grasses.

The proposed action involves the development of a bus and van transportation baseyard and maintenance 1acility for Maui Economic Opportunity. Inc. (MEO) at Puunene, island ofMaui. The MEO maintains its existing transportation facility at 189 Kaahumanu Avenue in Kahului and must relocate its operations in order to make way for a planned State Civic project. MEO is the only provider ofttansportation services in Maui County for residents with special needs (i.e. persons with disabilities. elderly persons, etc.).
The new MEO Transportation Facility will be situated on approximately 7.5 acre portion of the old Puunene Airport, which is located between Kahului and Kihei and in the vicinity of the Mokulele Highway. The subject site is classified State Agricultural District and designated by the County ofMaui for future industrial uses (Project District No. 10) in the Kihei-Makena Community Plan. The current County zoning is Agricultural District The site is not located within the Special Management Area boundaIy. pursuant to HRS Chapter 205A. The subject site is located over a mile from existing residential developments in Centra1 MaW.
Proposed improvements will include a one-stoty administration/dispatch building (6,342 sq.:ft.) with wheel chair ramps and lanai area (1,120 sq. :ft.)~ a one-stoty vehicle stoxage and maintenance structure (17,496 sq. :ft.) with mezzanine (1,274 sq. :ft.)~ wash facility building; fueling station~ an above-ground fuel stoxage tank; water reclamation tank to reuse wash water; a 300,000 gallon fire protection water tank~ fire protection wells; and pump. The proposed parking lot will accommodate 113 buseslvans and 148 cars.
The subject site, which is at the end of a runway of a former airport, is currently level and paved. Additional site grading worle will be veJY minimal. The proposed project will not contribute to increased storm water runo1[ During construction, short-term construction-related impacts (i.e. traffic, dust) are expected and will be mitigated by dust control and traffic safety measures. The subject site is not in sugar cane cultivation, and impacts of the proposed transportation facility on agricultural operations will be minimal. To mitigate the increased volume ofvUicular traffic; from the proposed project, improvements will be constructed at Mokulele Highway and its intersection with the access road to the project site and Maui Raceway Parle, iocluding turn lanes and accelexationldeceleration lanes. The proposed action will not adversely affect any known significant archaeological, historic or cultuIal sites or wildlife habitat areas.

1. For Well-Drilling Activities
Any discharge to state waters of treated process wastewater effluent associated with well drilling activities is regulated by Hawaii Administrative Rules, Chapter 11-55, Appendix I, effective September 22, 1997. Treated process wastewater effluent covered by this general permit includes well drilling slurries, lubricating fluids wastewaters, and well purge wastewaters. This general permit does not cover well pump testing. The applicable Notice of Intent Forms and filing fee shall be submitted at least thirty (30) days before the start of discharge to the Department of Health, Clean Water Branch at 919 Ala Moana Boulevard, Room 301, Honolulu, Hawaii 96814-4920 or P.O. Box 3378, Honolulu, Hawaii 96801-3378. Inquiries may be directed to the Clean Water Branch at (808) 586-4309 or by fax at (808) 586-4352.
2. For Well Pump Testing
The discharger shall take all measures necessary to prevent the discharge of pollutants from entering state waters. such measures shall include, if necessary, containment of the initial discharge until the discharge is essentially free of pollutants. If the discharge is entering a stream or river bed, best management practices shall be implemented to prevent the discharge from disturbing the clarity of the receiving water. If the discharge is entering a storm drain, the discharger must obtain written permission from the owner of that storm drain prior to discharge. Furthermore, best management practices shall be implemented to prevent the discharge from collecting sediments and other pollutants prior to entering the storm drain.

The applicant further understands that approval of the proposed permit shall not constitute a determination of correlative water rights and shall not guarantee the pump capacity or future use up to the permitted pump capacity.
