Introduction

The Early Graduation statute and regulation are a result of Senate Bill 61 (2013) and are a companion regulation to Senate Bill 97 (2013). To summarize the regulation; beginning in 2014-2015, Early Graduation will be possible for students who intend to move on an accelerated timeline through high school and graduate college ready in three academic years or less. Early Graduation is a deliberate pathway for students that wish to complete high school early, receive a diploma from the district and be eligible for acceptance into a two-or four- year Kentucky SACS accredited, public or non-profit institution without remediation. The regulation provides a financial incentive, known as the Early Graduation Certificate, for the student to support this action.

This regulation, as well as SB 97, represents a change in thinking at KDE and our schools around alternative programs for students. The Kentucky Department of Education is committed to meeting the unique needs of all students and having them leave our schools being college and career ready. If a family and their student decide that Early Graduation is the appropriate path, a visit should be made to the college of choice for a discussion with the admissions counselor about college pre-admission requirements. Then, together with the parents and student, school counselors should begin the process of mapping a possible proposed timeline and sample schedule for both completions of the criteria and to have the necessary college admissions requirements. These conversations should begin as early as middle school. We encourage middle and high schools and districts to have these pathways in mind before families request a meeting to discuss Early Graduation. The pathway and timeline will look different for each student, as this is an individualized and accelerated plan for student success. We also encourage schools and families to fully utilize the Individualized Learning Plan (ILP) as a method of monitoring and tracking student progress.

This document provides guidelines for schools and districts to assist with the implementation of the Early Graduation regulation, as amended in 704 KAR 3:305 (2013).

PART 1: Definitions

704 KAR 3:305- Statute number for Minimum requirements for high school graduation, the Early Graduation regulation is an amendment to that existing statute.

Academic Year-Also known as the school year that starts approximately in August and ending in June.

Accelerated path-An accelerated path is defined as a pathway in which a student who meets the required proficiency and benchmarks for college readiness and does so in three years or less in a non-traditional manner.

ACT-The ACT® test is a curriculum- and standards-based educational and career planning tool that assesses students' academic readiness for college. The ACT is given to all Kentucky juniors as part of the state accountability system and as a measure of college readiness. Minimum benchmarks on the ACT, set by CPE, determine readiness of students entering college. Early Graduation participants will be able to take the ACT early as allowed by the regulation.

Alternative Education-A program that exists to meet the needs of students that cannot be addressed in a traditional schedule or timeline but through a unique pathway that allows students to move on when ready.

Average statewide per pupil guaranteed base funding level-as defined in KRS 157.320, shall be computed by dividing the amount appropriated for this purpose by the prior year's statewide average daily attendance. The amount the 2015-2016 school year is $3981.00, the early Graduation Certificate (scholarship) will be approximately $1990.50.

College readiness-Most definitions of college readiness include some predictive statement about how well students will do in relevant courses based on national assessments, such as the ACT or SAT. “Success” is defined by ACT as 50 percent or higher probability of a student earning a B or higher in the corresponding college course or courses and 75 percent or higher probability of earning a C or higher in the corresponding college course or courses.

College readiness exams- The ACT test, given to every Kentucky junior, is preferred for college admissions. Counselors should be aware that students who cannot pass CPE set benchmarks may indicate that the student is not ready for college.

Counselor-Designated and EPSB (Educational Professional Standards Board) certified school guidance counselor.

CPE-Kentucky Council on Post-Secondary Education- The Council on Postsecondary Education coordinates change and improvement in Kentucky's postsecondary education system as directed by the Kentucky Postsecondary Education Improvement Act of 1997. CPE sets the system-wide standards and benchmarks for college readiness.

Credit bearing courses- for colleges this is defined as a course that will transfer to another institution as college transfer credit. Remediation courses are typically non-credit bearing but may be required for a student to advance to a credit bearing course.

Credit Recovery-Courses offered allowing students to make up credit for a class they have failed to pass or to help bring students up to grade level. Credit recovery classes are generally shorter in duration and often self- guided with assistance through online programs. Credit Recovery courses are not acceptable replacements for courses requiring End-of-Course exams.

Digital Learning-Digital learning involves the use of instructional technology in the learning environment to increase student engagement, achievement, and differentiation.

Early Graduation-Defined as meeting the competency-based criteria as stated in 704 KAR 3:305 and doing so in three academic years or less. The competency-based criteria is to a) score proficient on the end of course exams required by the Kentucky Board of Education and b) meet the college readiness exam benchmarks as set by the Council on Postsecondary Education for placement in credit-bearing courses without the need for remediation.

Early Graduation Certificate- means a certificate, awarded by KHEAA, validated by the district, that shall make the recipient eligible for a scholarship award equal to one-half (1/2) of the state portion of the average statewide per pupil guaranteed base funding level, to be used at a Kentucky public two year community or technical college or a Kentucky four year public or non-profit independent institution accredited by the Southern Association of Colleges and Schools.

Exit-(Withdraw)- Term used to describe a student who has entered the Early Graduation pathway who, for documented reasons, chooses to exit the Early Graduation and resume a general high school track.

Family- defined as student’s parent or legally appointed guardian, whether biological, foster or adoptive. See “Parent” as defined by 707 KAR 1:002 (43).

High school- means any Kentucky public high school, the Gatton Academy and Mathematics and Science in Kentucky, and any private, parochial, or church school located in Kentucky that has been certified by the Kentucky Board of Education as voluntarily complying with curriculum, certification, and textbook standards established by the Kentucky Board of Education under KRS 156.160.

Infinite Campus (IC)-Software that manages student educational records in all school districts across the state.

Individual Learning Plan (ILP)- A computer-based comprehensive framework for advising students in grades six (6) through twelve (12) to engage in coursework and activities that will best prepare them to both realize college and career success and become contributing members of their communities. The ILP is available free of charge to all Kentucky students as a tool to promote student success and college and career readiness.

Kentucky Educational Excellence Scholarships (KEES)-The KEES program provides scholarships to students who earn at least a 2.5 GPA each year they attend a certified Kentucky high school. KEES is administered by KHEAA, for more information: https://www.kheaa.com/website/kheaa/kees?main=1

Kentucky Higher Education Assistance Authority (KHEAA) - KHEAA is a public corporation and governmental agency and instrument of the Commonwealth established in 1966 to improve student’s access to higher education. To that end, KHEAA administers several financial aid programs and disseminates information about higher education opportunities.

Letter of Intent-This letter functions as the application and acceptance of the Early Graduation pathway. The letter contains guidance for families and students and the required signatures. The Letter of intent must be complete and student status flagged in IC by October 1st of the academic year in which the student intends to graduate. In 2015-16 students entering Early Graduation were asked to take an online survey.

Middle school-Middle school means a school consisting of grades five (5) through eight (8) or any appropriate combination of grades as determined by the plan of organization for schools authorized by the district board.

Performance based criteria-A high school graduation credit may be awarded in either of two ways: Carnegie Units (defined as at least 120 hours of instructional time in one subject) OR performance-based credits. Students must show proficiency in a subject by demonstrating they know the subject through an End-of-Course exam. Performance based criteria are standards-based and aligned with expectations for all students to be college and career ready.

Remediation- Remediation refers to programs or educational interventions designed to bring students up to the level of accepted proficiency. Most commonly, remedial education comes up in postsecondary education when high school graduates must bring up their standards to college level before beginning credit bearing courses.

Southern Association of Colleges and Schools (SACS) - SACS is the regional body for the accreditation of degree-granting higher education institutions in the Southern states.

Student- person under the age of 18 who is enrolled in the Kentucky public school system.

Student Success Survey- an online survey, begun in 2015-16 to be taken by students entering Early Graduation. Results will be used to develop school level information and supports for the program.

PART 2: Financial Incentives

A student who meets the Early Graduation requirements in 704 KAR 3:305 shall earn an Early Graduation Certificate and be eligible for a one-time scholarship award to be used at a SACS accredited public or private Kentucky college or university the academic year immediately following early high school graduation. This financial incentive is to promote early college readiness.

The award shall be equal to one-half (1/2) of the state portion of the average statewide per pupil guarantee for one year.

This award amount is determined in the biennial budget for each fiscal year. For the academic year 2015-2016, the statewide per pupil guarantee is $3981 (half of that would be approximately $1990 ).

The Kentucky Higher Education Assistance Authority (KHEAA) will administer the scholarship; funds will be forwarded directly to the institute of higher education.

Early Graduation Certificate funds shall be available only during the academic year following graduation. Early Graduates may apply for funds from KHEAA to either fall or spring semester the academic year following their graduation from high school.

In order to predict and process these funds, 1) the student must complete the Letter of Intent, and be flagged in Infinite Campus no later than October 1st the academic year the student plans to graduate. Complete the student survey.

The other half (1/2) of the state portion of the average statewide per pupil guarantee will remain at the student’s high school to be applied the year after they leave, whether the student attends college or not.

Regardless of when the student graduates early during the academic year, the amount of the scholarship does not change.

Students who exit from Early Graduation forfeit any Early Graduation Certificate funds (they may remain eligible for KEES funds).

Students who complete Early Graduation and do not attend college do not receive the Early Graduation Certificate funds

Effective with the Class of 2015, students who are eligible for the Kentucky Educational Excellence Scholarship (KEES) program and graduate from a Kentucky high school in three years may be eligible for a KEES award that is the equivalent of four years of high school.

The KEES award amount is based on the average of GPA awards, AP and ACT scores. The Kentucky Higher Education Assistance Authority (KHEAA) should be contacted for additional

Students who participate in Early Graduation may be eligible for Pell grants, college scholarships and need-based funding. Students should contact their college of choice and speak to a financial aid counselor.

PART 3: Academic Requirements for Early Graduation

Meet proficiency benchmarks on Kentucky required end-of-course exams o Currently those classes are ENGLISH II, ALGEBRA II, BIOLOGY, US HISTORY

Students in the Early Graduation pathway DO NOT have to meet the minimum 22 credits; the regulation waives those requirements for this pathway.

Section 6. (1) A student who satisfactorily completes the requirements of this administrative regulation and additional requirements as may be imposed by a local board of education or meets the requirements for early graduation as outlined in Section 9 of this administrative regulation shall be awarded a graduation diploma.

Students in Early Graduation do not have to take English 4 or any courses other than the four outlined above. Sample district pathways have been provided as suggestions only - each district and student will be unique.

o As required in (703 KAR 5:240) Section 8; students must complete courses before taking the corresponding End of Course (EOC)exams

o Proficiency benchmarks on the EOC are set by the Kentucky Board of Educationo An EG candidate may repeat a course and EOC exam HOWEVER, repeated attempts to

meet proficiency might indicate that the student is not academically prepared for the rigors of Early Graduation or college-level work.

o The appeal process after a failed EOC exam is found in the DAC manual.o Student schedules must reflect the accelerated pace of Early Graduation, for example,

you may have sophomores may take US History (a course usually taken by juniors). o Students in middle school may take courses and exams prior to entering high school.o Regularly set counseling sessions with the student and family and use the ILP to monitor

student progress while attempting Early Graduation are essential, students who are unable or unwilling to meet the Early Graduation criteria should be counseled regarding other options.

o It is highly recommended that counselors record all meeting notes, grades and ongoing contact with students and families using the ILP as they make progress toward Early Graduation.

o Districts should set clearly defined parameters for students who fail to meet critical points on the pathway and plans for transitioning students out of Early Graduation should the student fail to meet the benchmarks.

Meet Council of Post-Secondary Education (CPE) defined college readiness benchmarks on THE ACT ONLY

o Current benchmarks for the ACT as set by CPE in 13 KAR 2:020. ACT (English = 18, Reading = 20, Mathematics = 19)

o Most definitions of college readiness include a predictive statement about how well students will do in relevant courses based on national assessments, such as the ACT or SAT. “Success” is defined by ACT as 50 percent or higher probability of a student earning a B or higher in the corresponding college course or courses and 75 percent or higher probability of earning a C or higher in the corresponding college course or courses.

o The Kentucky system-wide standards of readiness guarantee students access to credit-bearing coursework without the need for transitional, developmental education, or supplemental courses or programs.

o Students participating in Early Graduation may take their state administered ACT exam early, as stated in Section 9 (3) of the regulation.

o ACT accountability will apply for accountability the year the Early Graduate takes the state administered test.

o Students may take other college readiness exams, however, Early Graduation is an accelerated path to higher education and the ACT is typically required for eligibility for college level courses. The state provides one administration of the ACT for all Kentucky students; Early Graduate candidates take their ACT earlier than the junior year.

o The cost of any subsequent administrations of the ACT shall be the responsibility of the student.

o Meeting Early Graduation does not ensure acceptance to a two or four year post-secondary institution. Students, along with families and counselors are encouraged to have preliminary talks, BEFORE ENTERING EARLY GRADUATION with the admissions counselors at the institutions of their choice to determine all pre-admission requirements for acceptance.

PART 4: Identification of Early Graduate participants

Signed Letter of Intent is placed in the student’s Cummulative Folder and the student is flagged in Infinite Campus as being in an accelerated program (see Appendix D for further instructions).

o Schools must enter status as an Early Graduate into Infinite Campus no later than October 1st of the year in which the student makes the declaration as stated in Section 9 of 704 KAR 3:305.

Students must take the online Student Success Survey. Student Individualized Learning Plan (ILP) is used to review and update the student plan

on a regular schedule. Notes from regularly scheduled counseling meetings including family and student are

recorded to ensure progress on Early Graduation pathway. Student End of Course exam and ACT exam results should be included in the Intent form

as they occur to serve as a record of all student scores in one location.

College Readiness Exam Testing : ACT

o It is the responsibility of the school testing counselors to contact the ACT test supervisor in the district by December to order test booklets and materials for the Early Graduates.

o The school should ensure that for Early Graduates, student information will be bubbled by hand on the day of testing since pre-printed labels will not be available for them.

o If students take the ACT outside of the state administered test, they should report scores to the high school.

Students exiting from Early Graduation pathway

Should a student be unable or unwilling to complete either the proficiency criteria or do so within the three year timeline and are counseling to return to general graduation expectations- reasons for exiting are provided below. Appendix D offers more detailed information.

o In IC - follow instructions for Counselors to remove flag and correctly record the reason for exiting. THIS IS CRUCIAL FOR REMOVING NON PARTICIPATING STUDENTS FROM STATE RECORDS,

REASONS FOR EXITING EARLY GRADUATION- Please follow the guidance for IC entry and put one of the reasons below if the student should no longer be considered an Early Graduate.

Voluntary academic o Student is meeting blueprint for success but voluntarily chooses to remain in

high school longer than three years to complete a career track, certification or accelerated/advanced courses such as AP, IB or dual credit.

Voluntary Financial/Scholarshipso Student is meeting blueprint for success but voluntarily chooses to remain in

high school longer than three years to be eligible for college scholarships and financial benefit.

Involuntary academic o Student is not meeting academic benchmarks on End-of-Course exams or

proficiency benchmarks on the ACT. Student and family are counseled and advised against continuing on an Early Graduation pathway.

Health o Student health issues that prevent student from accomplishing Early Graduation

criteria. Athletics

o Students choose to stay the full four years in high school to take advantage of programs in sports in high school.

Senate Bill 61, passed during the 2013 Kentucky General Assembly, provides a pathway to early graduation for students who intend to complete high school in three academic years or less. Beginning with the 2014-2015 academic year, students who complete the Early Graduation requirements (see below) may receive a diploma from their district. Students who graduate in three years or less are also eligible for an Early Graduation Certificate, (a one-time scholarship) which they may use the year immediately following high school graduation when enrolling in an SACS accredited Kentucky two- or four- year institute of higher education.

Clarifying Points:

The statutory changes and regulation went into effect in the 2014-2015 academic year. Early Graduation is defined as a student meeting the performance criteria outlined in 704 KAR 3:305

Section 9 (2) and doing so in three years or less from the date of first enrolling in grade nine. Students must have been in high school three years or less- according to COHORT YEAR, not grade level. To meet the criteria, students that intend to graduate early must meet minimum proficiency benchmarks

for the four End of Course exams required for state accountability and meet college ready benchmarks for the ACT exam.

A student who wishes to graduate early must complete a Letter of Intent to Apply for Early Graduation within the first 30 days of the academic year in which they want to graduate and the information must be entered into Infinite Campus no later than October 1st of the academic year they intend to graduate.

Students should complete the online Survey for Student Success as part of application process Students may take their one state supported college readiness exam, ONLY the ACT, earlier than their

junior or senior year, as provided by the regulation in section 9 (3). Early Graduation students require consistent monitoring and counseling to ensure they are on track to

complete the early graduation requirement. The ILP should be completed and regular meetings between the student, family and counselor should monitor and update student progress as required in Section 4 of 704 KAR 3:305.

The Letter of Intent is not binding; students may revert to regular student enrollment with the knowledge they have to meet the District’s minimum requirements and that they will not be eligible for the Early Graduation Certificate.

Incentives:

1) A student who meets the Early Graduation requirements in 704 KAR 3:305 shall earn an Early Graduation Certificate (provided by KHEAA) to be eligible for a one time scholarship award to be used at a Kentucky two- or four-year public or independent non-profit SAC’s accredited college or university the year immediately following high school graduation. The award shall be equal to one-half (1/2) of the SEEK statewide per pupil guarantee for one year.

2) Students who graduate from high school in three years may also receive a Kentucky Educational Excellence Scholarship (KEES) award equivalent to completing high school in four years. For more information regarding KHEAA: https://www.kheaa.com/website/kheaa/kees?main=1

APPENDIX B: Suggested steps for districts

IN THE FIRST YEAR 26% of students who applied exited without meeting the criteria. Careful counseling and monitoring is crucial to the pathway’s success.

Before students apply

With a committee including middle and high school counselors and administration, gifted/talented staff or CCR coordinators and SBDM members:

o Develop communication and criteria to identify Early Graduation candidates (see samples on main webpage)

o Develop possible schedules and pathways to complete criteria (see samples on main webpage)

o Develop clear and consistent progress monitoring schedules and ILP sessions for students on Early Graduation pathway

o Outline clearly, what senior events, perks and awards would be available to the Early Graduate. (Senior trips, lunch spots, events, parking, homerooms and awards such as Salutatorian, Valedictorian and GPA rankings within the school)

o Communicate to feeder middle schools and ninth grade students about availability of Early Graduation

o Develop blueprint with clear indicators and steps for students when they fail to meet criteria

o Develop a transition plan for students who exit Early Graduation

During pathway

o With committee, update and revise plans as needed on an annual basiso Use progress monitoring schedule to track student progress, include student and family

in meetingso Utilize regular updates to the ILP to support student successo Ensure student will take the ACT exam when appropriate for this pathwayo Monitor when students take EOC exams and college readiness exams to allow for

possibility of them not meeting benchmark and still be able to meet Early Graduation requirements.

o Develop a school system of tracking and notifying students not marked 12 th grade in IC about graduation issues. This includes placement in senior homerooms, ordering caps and gowns, creation of a process of information sharing that includes Early Graduates.

o Coordinate and facilitate conversations between family/student and anticipated post-secondary institution on entrance requirements, deadlines and financial expectations.

o Continue to communicate to feeder middle schools and ninth grade students about availability of Early Graduation

o The district supplies the diploma for the Early Graduate. There is not a state template; rather this is a district decision which could mean the creation of another diploma or the use of the existing diploma for seniors who graduate having met district graduation requirements.

APPENDIX C: Dispositions of Early Graduation candidates

1. The decision to commit to graduating early is based on thoughtful conversations with families, school counselors and students, reviewing all the issues which surround accelerating high school graduation.

2. Students intend to begin and stay on this pathway, beginning in middle school or ninth grade.

3. Students have a clear academic or career goal in mind and therefore a reason to demonstrate proficiency in high school and move on.

4. Student is persistent, self-motivated and can set and achieve goals independently.5. Student is emotionally and academically mature, can deal with their schedule and

classes being “out of step” with same-age peers.6. Student shows indications of being on or surpassing benchmarks for College and Career

Readiness goals through standardized test scores. High grades alone do not determine a successful early graduate; some students will see leaving early as motivation to do well in required courses and exams.

7. Student may be identified as Gifted/Talented; this is also not a sole indicator of readiness.

8. Students have a desire to succeed and “move on when ready.”9. Students do not have excessive absences, tardiness or truancies.10. Students do not have excessive behavior issues. This is a pathway for those students

who want to accomplish a goal. Students who cannot reliably accomplish the class and homework without prodding or support are not good candidates for Early Graduation.

11. Students are not concerned with attaining senior status or honors based on GPA rankings. It is a district decision which “senior” events, activates and perks Early Graduates may be part of. These limitations should be clearly articulated before students enter Early Graduation.

Early Graduation is based on the student’s cohort year, rather than accumulated credits.

The data pulled from IC directly by KHEAA for the student scholarship MUST say 9 th , 10 th or 11 th grade – or they will not get their scholarship as 12 th graders are ineligible.

Students who have been in high school MORE than three years are not eligible.

Students and counselors concerned with class rank can compare the EG student to the cohort year they will graduate in rather than their actual cohort year.

GPA is affected by Early Graduation because there are fewer courses overall, but the student still has a GPA to report.

Early Graduates must be tracked using another system rather than as 12 th grader in IC.

Appendix E: Amended Regulation 704 KAR 3:305

Filed December 13, 2014 704 KAR 3:305. Minimum requirements for high school graduation.

RELATES TO: KRS 156.160(1)(a), (d), 158.142, 158.645, 158.6451STATUTORY AUTHORITY: KRS 156.070, 156.160(1)(a), (d), 158.142NECESSITY, FUNCTION, AND CONFORMITY: KRS 156.160 requires the Kentucky Board of Education to promulgate

administrative regulations relating to the courses of study for the different grades and the minimum requirements for high school graduation. KRS 158.142(3)(b) requires the board to promulgateadministrative regulations establishing requirements for early graduation from high school. The content standards for the courses of study are established in the Kentucky core academic standards incorporated by reference in 704 KAR 3:303. This administrative regulation establishes the minimum requirements necessary for entitlement to a high school diploma.

Section 1. Definitions. (1) “Early graduation” means meeting the competency-based criteria outlined in this administrative regulation and doing so in three (3) academic years or less.

(2) “Early Graduation Certificate” means a certificate, awarded by the district and signed by the principal and superintendent, that shall make the recipient eligible for a scholarship award equal to one-half (1/2) of the state portion of the average statewide per pupil guaranteed base funding level, to be used at a Kentucky public two (2) year community and technical college or a Kentucky four (4) year public or non-profit independent institution accredited by the Southern Association of Colleges and Schools.

Section 2. Each student in a common school shall have a total of at least twenty-two (22) credits for high school graduation. Those credits shall include the content standards as provided in the Kentucky core academic standards, incorporated by reference in 704 KAR 3:303. Additional standards-based learning experiences shall align to the student’s individual learning plan and shall consist of standards-based content. The required credits and demonstrated competencies shall include the following minimum requirements:

(1) Language arts - four (4) credits (English I, II, III, and IV) to include the content contained in the Kentucky core academic standards for English and language arts and comply with the following:

(a) Language arts shall be taken each year of high school; and(b) If a student does not meet the college readiness benchmarks for English and language arts as established by the Council

on Postsecondary Education in 13 KAR 2:020, the student shall take an English and language arts transitional course or intervention, which is monitored to address remediation needs, before exiting high school;

(2) Social studies - three (3) credits to include the content contained in the Kentucky core academic standards for social studies;

(3) Mathematics - three (3) credits to include the content contained in the Kentucky core academic standards for mathematics and include the following minimum requirements:

(a) Algebra I, Geometry, and Algebra II. An integrated, applied, interdisciplinary, occupational, or technical course that prepares a student for a career path based on the student's individual learning plan may be substituted for a traditional Algebra I, Geometry, or Algebra II course on an individual student basis if the course meets the content standards in the Kentucky core academic standards, incorporated by reference in 704 KAR 3:303;

(b) A mathematics course or its equivalent as determined by the district shall be taken each year of high school to ensure readiness for postsecondary education or the workforce;

(c) Any mathematics course other than Algebra I, Geometry, or Algebra II shall be counted as an elective; and(d) If a student does not meet the college readiness benchmarks for mathematics as established by the Council on

Postsecondary Education in 13 KAR 2:020, the student shall take a mathematics transitional course or intervention, which is monitored to address remediation needs, before exiting high school;

(4) Science - three (3) credits that shall incorporate lab-based scientific investigation experiences and include the content contained in the Kentucky core academic standards for science;

(5) Health - one-half (1/2) credit to include the content contained in the Kentucky core academic standards for health;(6) Physical education - one-half (1/2) credit to include the content contained in the Kentucky core academic standards for

physical education;(7) History and appreciation of visual and performing arts (or another arts course which incorporates this content) - one (1)

credit to include the content contained in the Kentucky core academic standards for arts and humanities or a standards-based specialized arts course based on the student’s individual learning plan;

(8) Academic and career interest standards-based learning experiences - seven (7) credits including four (4) standards-based learning experiences in an academic or career interest based on the student’s individual learning plan; and

(9) Demonstrated performance-based competency in technology.

Section 3. (1) A local board of education may substitute an integrated, applied, interdisciplinary, occupational, technical, or higher level course for a required course if the alternative course provides rigorous content and addresses the same applicable components of 703 KAR 4:060.

(2) For students with disabilities, a local board of education may substitute a functional, integrated, applied, interdisciplinary, occupational, technical, or higher level course for a required course if the alternative course provides rigorous content and addresses the same applicable components of 703 KAR 4:060. These shall be based on grade-level content standards and may be modified to allow for a narrower breadth, depth, or complexity of the general grade-level content standards.

Section 4. (1) A district shall implement an advising and guidance process throughout the middle and high schools to provide support for the development and implementation of an individual learning plan for each student. The plan shall include career development and awareness and specifically address Vocational Studies Academic Expectations 2.36-2.38 as established in Academic expectations, 703 KAR 4:060.

(2) A district shall develop a method to evaluate the effectiveness and results of the individual learning plan process. The evaluation method shall include input from students, parents, and school staff. As part of the evaluation criteria, the district shall include indicators related to the status of the student in the twelve (12) months following the date of graduation.

(3) A feeder middle school and a high school shall work cooperatively to ensure that each student and parent receives information and advising regarding the relationship between education and career opportunities. Advising and guidance shall include information about financial planning for postsecondary education.

(4) A school shall maintain each student’s individual learning plan. The individual learning plan shall be readily available to the student and parent and reviewed and approved at least annually by the student, parents, and school officials.

(5) Beginning with a student’s eighth grade year, the individual learning plan shall set learning goals for the student based on academic and career interests and shall identify required academic courses, electives, and extracurricular opportunities aligned to the student’s postsecondary goals. The school shall use information from the individual learning plans about student needs for academic and elective courses to plan academic and elective offerings.

(6) Beginning with the graduating class of 2013, the development of the individual learning plan for each student shall begin by the end of the sixth grade year and shall be focused on career exploration and related postsecondary education and training needs.

Section 5. (1) A board of education may award credit toward high school graduation for satisfactory demonstration of learning based on content standards described in the Kentucky core academic standards, incorporated by reference in 704 KAR 3:303, and a rigorous performance standards policy established by the board of education. A school shall establish performance descriptors and evaluation procedures to determine if the content and performance standards have been met.

(2) A board of education shall award credit toward high school graduation based on:(a) A standards-based Carnegie unit credit that shall consist of at least 120 hours of instructional time in one (1) subject; or(b) A standards-based performance-based credit, regardless of the number of instructional hours in one (1) subject.(3) A local board of education which has chosen to award standards-based performance-based credit shall award a standards-

based credit earned by a student enrolled in grade 5, 6, 7, or 8 if:(a) The content of the course is the same that is established in the Kentucky core academic standards, incorporated by

reference in 704 KAR 3:303; and(b) The district has criteria in place to make a reasonable determination that the middle level student is capable of success in

the high school course.(4) A board of education which has chosen to award standards-based performance-based credit shall establish a policy for a

performance-based credit system that includes:(a) The procedures for developing performance-based credit systems and for amending the system;(b) The conditions under which each high school may grant performance-based credits and the related performance

descriptors and assessments;(c) Objective grading and reporting procedures;(d) Content standards as addressed in 704 KAR 3:303, Required core academic standards, and 703 KAR 4:060, Academic

expectations;(e) The extent to which state-provided assessments will be used in the local performance-based credit system;(f) The ability for students to demonstrate proficiency and earn credit for learning acquired outside of school or in prior learning;

and(g) Criteria to ensure that internships, cooperative learning experiences, and other learning experiences in the school and

community are:1. Designed to further student progress towards the individual learning plan;2. Supervised by qualified instructors; and3. Aligned with state and local content and performance standards.(5) A board of education may award standards-based, performance-based credit toward high school graduation for:(a) Standards-based course work that constitutes satisfactory demonstration of learning in any high school course, consistent

with Section 1 of this administrative regulation;(b) Standards-based course work that constitutes satisfactory demonstration of learning in a course for which the student failed

to earn credit when the course was taken previously;(c) Standards-based portfolios, senior year, or capstone projects;(d) Standards-based online or other technology mediated courses;(e) Standards-based dual credit or other equivalency courses; or(f) Standards-based internship, cooperative learning experience, or other supervised experience in the school or the

community.(6) Each local board of education shall maintain a copy of its policy on high school graduation requirements. This policy shall

include a description of how the requirements address KRS 158.6451(1)(b) and 703 KAR 4:060.

Section 6. (1) A student who satisfactorily completes the requirements of this administrative regulation and additional requirements as may be imposed by a local board of education or meets the requirements for early graduation as outlined in Section 9 of this administrative regulation shall be awarded a graduation diploma.

(2) The local board of education shall award the diploma.

Section 7. This administrative regulation shall not be interpreted as prohibiting a local governing board, superintendent, principal, or teacher from awarding special recognition to a student.

Section 8. Beginning with the graduating class of 2013, if the severity of an exceptional student’s disability precludes a course of study that meets the high school graduation requirements established in Section 1 of this administrative regulation leading to receipt of a high school diploma, an alternative course of study shall be offered. (1) This course of study shall be based upon student needs and the provisions specified in 704 KAR 3:303, Required core academic standards, and shall be reviewed at least annually.

(2) A student who completes this course of study shall receive an alternative high school diploma to be awarded by the local board of education consistent with the graduation practices for all students.

(3) A local board of education may establish policies to award an alternative high school diploma to a former student who has received a certificate or certificate of attainment.

Section 9. (1) Beginning in the 2014 - 2015 academic year, only students who meet the criteria outlined in this section shall be eligible for early graduation. Those students who meet the criteria for early graduation shall receive from the school district a diploma and an Early Graduation Certificate. Students wishing to graduate early shall indicate that intent to the school principal at the beginning of grade 9 or as soon as the intent is known, but within the first thirty (30) school days of the academic year in which they wish to graduate.

(a) A student’s intent to graduate early shall be entered into the student information system by the school district by October 1 of the year in which the student makes the declaration.

(b) Students working toward early graduation and receipt of a corresponding Early Graduation Certificate shall be supported by development and monitoring of an individual learning plan to support their efforts.

(2) To graduate early and earn an Early Graduation Certificate, a student shall:(a) Score proficient on the end of course exams required by the Kentucky Board of Education in 703 KAR 5:200; and(b) Meet the college readiness exam benchmarks as set by the Council on Postsecondary Education in 13 KAR 2:020 for

placement in credit-bearing courses without the need for remediation.(3) A student who has indicated an intent to graduate early may participate in the student’s state administration of the college

readiness exam prior to the junior year, if needed. REVISED Letter of Intent to Apply for Early Graduation

October 19, 2015-2016

Senate Bill 61, passed during the 2013 Kentucky General Assembly, provides a pathway to early graduation for students who intend to complete high school in three academic years or less. Beginning with the 2014-2015 academic year, students who complete the Early Graduation requirements (see below) may receive a diploma from their district. Students who graduate in three years or less are also eligible for an Early Graduation Certificate, (a one-time scholarship) which they may use the year immediately following high school graduation when enrolling in an SACS accredited Kentucky two- or four- year institute of higher education.

Clarifying Points:

The statutory changes and regulation went into effect in the 2014-2015 academic year. Early Graduation is defined as a student meeting the performance criteria outlined in 704 KAR 3:305

Section 9 (2) and doing so in three years or less from the date of first enrolling in grade nine. To meet the criteria, students that intend to graduate early must meet minimum proficiency benchmarks

for the four End of Course exams required for state accountability and meet college ready benchmarks for the ACT. ONLY the ACT will met the requirements for Early Graduation.

Students must have been in high school three years or less- according to COHORT YEAR, not grade level. A student who wishes to graduate early must complete a Letter of Intent to Apply for Early Graduation

within the first 30 days of the academic year in which they want to graduate and the information must be entered into Infinite Campus no later than October 1st of the academic year they intend to graduate.

Students should complete the online Survey for Student Success as part of application process Students may take their one state supported college readiness exam, the ACT earlier than their junior or

senior year, as provided by the regulation in section 9 (3). Early Graduation students require consistent monitoring and counseling to ensure they are on track to

complete the early graduation requirement. The ILP should be completed and regular meetings between the student, family and counselor should monitor and update student progress as required in Section 4 of 704 KAR 3:305.

The Letter of Intent is not binding; students may revert to regular student enrollment with the knowledge they have to meet the District’s minimum requirements and that they will not be eligible for the Early Graduation Certificate.

Incentives:

A student who meets the Early Graduation requirements in 704 KAR 3:305 shall earn an Early Graduation Certificate (provided by KHEAA) to be eligible for a one time scholarship award to be used at a Kentucky two- or four-year public or independent non-profit SAC’s accredited college or university the year immediately following high school graduation. that are older?iii. Is the student one who has a plan for the future? iv. Does the student want to stay in high school to complete four years of activities,

sports or competitions? v. Would the student benefit from taking advanced level, AP, IB or dual credit

courses-gaining college credit while remaining in the high school environment? vi. Are you ready financially to send a student to college as a sophomore or junior?

Early Graduation does not require two years of world language for a diploma, but many four-year undergraduate programs require that for admission, does Early Graduation adequately prepare your student for their academic future? There are more questions but Early Graduation is a decision that should be agreed upon by the student and the family, after discussions with post-secondary admissions counselors and school counselors about criteria for success.

Lesson Learned from the first year of Early Graduation

Students are more successful and complete the program who truly have a career and college goal and are not trying the use Early Graduation as a way to leave school early. In some high schools, more than half the applicants exited after not being able to meet the benchmarks on the first EOC exam. Think about what your student will be able to do with a high school degree and no further education at 16 or 17. The world today demands highly qualified and skilled workers in most jobs. The one predictor of a lifetime of higher earnings is the number of years of schooling completed past high school. The greater the years in post-secondary attained, the higher salaries are over a longer period and the lower the levels of unemployment.

“Earning a four-year college degree remains a worthwhile investment for the average student. Data from U.S. workers show that the benefits of college in terms of higher earnings far outweigh the costs of a degree, measured as tuition plus wages lost while attending school. The average college graduate paying annual tuition of about $20,000 can recoup the costs of schooling by age 40. After that, the difference between earnings continues such that the average college graduate earns over $800,000 more than the average high school graduate by retirement age.” Is the Cost of College still Worth it?

If you are concerned with your son or daughter having “senior” status, being valedictorian or participating in any of the Governor’s programs the summer of their junior year – do not have your student do Early Graduation.

If you want your student to have full access to senior perks, parking, lunch spots, senior proms or pictures, special trips or privileges given to fourth year seniors at your school, speak first to your school leadership to get a clear picture of what is possible before doing Early Graduation.

It is a district decision what, if any, senior privileges will be granted. The state has no authority or leverage over individual schools and districts in these matters.

Early Graduation works on a different system or definition of high school completion than completion of course in order to mark them as a junior or senior. Early Graduation is based on performance based criteria, meeting the academic criteria outlined in the legislation and doing that in three years or less. The years are a student’s COHORT group. They are with that group when they enter 9 th grade of high school. If a student enters high school in 2015-2016. Their COHORT group is anticipated to graduate in four years or 2019. To be eligible for Early Graduation that same student would need to graduate a year or more before their COHORT group in 2017 or 2018.

GENERAL QUESTIONS2. When does the regulation go into effect?

The regulation took effect the academic year 2014-2015.3. Why is there an Early Graduation pathway?

The Early Graduation Certificate (SB 61) was enacted by the 2013 Kentucky General Assembly as a companion piece of legislation to Compulsory Attendance (SB 97). The intent of the statute is to create an accelerated pathway for students to be able to graduate in three years or less from high school, before age 18 and be college ready.

4. How is Early Graduation different? Early Graduation here is referring to the legislative action which was enacted in 204-2015. You must be a 9th-10th or 11th grader. This pathway and the guidance here (including flagging in IC) IS NOT REQUIRED FOR A 12th grader who leaves early in their fourth year.

4. What if I have moved to Kentucky from another state and want to graduate early (after October 1st)?

a. Students who apply to Early Graduation later than October 1st will not be able to graduate during that academic year, they will be able to graduate the next academic year.

b. Ex: A junior moves into state in November 2015, they will NOT be eligible for Early Graduation in spring 2016.

c. Ex: A sophomore moves into Kentucky in November 2015, they can enroll in Early Graduation to leave school spring of 2017.

5. What if I am homeschooled or in private school? Can I graduate early?a. This regulation establishes minimum requirements for a high school diploma in public

schools in Kentucky. This regulation does not apply to current home-schooled or private school students, they are not eligible for the Certificate.

6. What if I intend to graduate but change my mind and want to stay in high school?a. The Letter of Intent is not binding; a student may choose to stay four years in high

school. Once the student exits Early Graduation, the student must be transitioned back to regular minimum graduation requirements and understands that they are no longer eligible for the Early Graduation Certificate. The student should be unflagged in IC – see guidance on data entry.

8. I am in middle school, why should I worry about this now?If you are interested in Early Graduation, thinking ahead to possible high school schedules and making sure that you have or will take the requisite courses to complete Early Graduation as a sophomore or junior would be beneficial. Families of students may need to have discussions prior to high school about student academic and maturity factors as well as financial issues that go with a student entering college early.

9. I want to get out of high school early, who are potential candidates for Early Graduation?This regulation is targeted for students who have shown high achievement, accelerated levels of academic success and express a desire to complete high school early in three years or less. Districts are recommended to have screening criteria and data to aid students and parents in the decision-making process; however the decision is ultimately up to the student and their family. Students who have been in high school more than three years at the time they apply ARE NOT ELIGIBLE.

10. My parents don’t support me doing in graduating early; can I do it without their signature?The Letter of Intent requires student, parent/guardian, principal and superintendent signatures to be considered complete. Early Graduation participants and families are recommended to have an initial meeting with counselors to determine the likelihood of success. After starting the program, students, parents and counselors meet regularly to assess progress. Full use of the ILP is also recommended by the regulation. Difficulty in meeting any of the criteria would be an indication the student is not ready for college level work.

11. My counselor has discouraged me from trying early graduation, why?a. Early Graduation is not a “loop hole” or “short cut” to getting a diploma. The four

courses required; English II, Algebra II, Biology and US History have been determined as courses that prepare students for college success without remediation. The ACT college readiness exam has strong correlations with student success in college.

b. Students who wish to pursue Early Graduation who have not shown academic success in prior coursework or do not indicate the ability to self-regulate or study independently may not be good candidates for the program.

c. Students who have failed and have been in high school MORE THAN THREE YEARS at the time they apply ARE NOT ELIGIBLE. The legislation states EG must complete the criteria and do so in three years or less.

12. Do I get a diploma when I do Early Graduation?Yes, Early Graduates receive a diploma from their local board of education. If districts have multiple levels of diplomas (e.g. general, alternative or honors), it would be a local school board decision as to which diploma the student receives. The state does not provide a template.

13. I am a high school senior, can I be an Early Graduate?No, this regulation outlining the criteria and the financial “Certificate” are for high school freshman, sophomores and juniors only.

14. I am a high school senior who will complete their credits in December, aren’t I “graduating early?”Yes, you are leaving earlier than the rest of your cohort group but you are not part of the Early Graduate pathway, open to 9th, 10th and 11th graders only.

15. If I am in KSB, KSD or a special education student, or in alternative placement can I participate in Early Graduation?

a. Yes, students in those settings or placements can participate in Early Graduation and must meet the same criteria outlined in the regulation.

16. What if I finish Early Graduation and leave in December?a. The Early Graduation Certificate funds would not be available until the fall of the year

you graduate. You may attend college during the summer and wait for the Certificate to be applied during the fall term. If you graduate before you complete three full years of high school, you may not qualify for the KEES equivalent award. You should contact the Kentucky Higher Education Assistance Authority (KHEAA) to see how graduating in December would affect your KEES earnings.

17. What if I intend to graduate early and move to another school in the district before I finish?You should make sure that your new school receives and enters the Letter of Intent into Infinite Campus. Prior to moving schools, conversations should take place notifying the school of your alternative placement and conjointly work out an accelerated pathway for the student in the new school.

18. What if I am doing Early Graduation and I move out of the state?Early Graduation is a pathway for Kentucky students; it is not applicable in other states.

19. What if I complete Early Graduation, receive my diploma and then change my mind, can I return to high school?No, once you exit the system with a valid diploma you may not return to high school.

20. How does graduating early affect my KEES award?Students who graduate at the end of their third year at a Kentucky high school will be eligible for the equivalent of four years’ worth of KEES. Students who graduate in two years will get two years of KEES. Additional questions about KEES should be directed to the Kentucky Higher Education Assistance Authority at (800) 928-8926 ext. 67397.

21. What is the Certificate?a. The regulation provides a financial incentive for students who both sign an Intent and

successfully complete the proficiency criteria to graduate early. The term Certificate here means the financial scholarship attached to this regulation.

b. The “Early Graduation Certificate” or scholarship is awarded by the KHEAA and makes the recipient eligible for a scholarship award equal to one-half (½) of the state portion of the average statewide per pupil guaranteed base funding level. This scholarship is to be used at a Kentucky public two or four year public or non-profit independent colleges and universities.

22. How does the Early Graduation Certificate work?After completing the Early Graduation pathway, students receive the “Certificate” when they work with both their district, KHEAA and the Kentucky two- or four- year public or non-profit school they are entering. The Certificate funds are awarded directly to the institution for the student.

23. I completed Early Graduation- when do I get the scholarship? Do I have to do anything else?KHEAA is the agency which handles both the scholarship and KEES money. Early Graduation students MUST contact KHEAA to let them know of any address changes and let them know where you will be attending. Letters will be sent out in the summer from KHEAA.

24. Can I apply the certificate to out of state schools?No, The Certificate monies may only be used toward Kentucky public or non-profit independent colleges and universities.

Questions on testing and course credits25. Can I take high school courses in middle school?

Yes, KRS 158.622 states that each school district shall “Accept for credit toward graduation and completion of high school course requirements an advanced placement, a high school equivalent, or a Kentucky Virtual High School course taken by a student in grades 5, 6, 7, or 8 if that student attains performance levels expected of high school students in that district as determined by achieving a score of "3" or higher on a College Board Advanced Placement examination or a grade of "B" or better in a high school equivalent or a Kentucky Virtual High School course.” Make sure you have communicated with the high school before taking a course in middle school, online or in person, for which you want to earn high school credit.

26. Can I take End-of-Course exams in middle school?Yes, with the communication and acceptance of the sponsoring high school that the course given was:

1) taught by a teacher that was highly qualified and certified to teach high school level courses

2) the student had prior approval that any online course was acceptable to the high school for course credit

3) The End-of-Course exam is given either at the middle school or high school following the student having successfully taken the full and complete course prior to taking the exam.

27. What about the minimum required credits to graduate?a. Early Graduation is an amendment to 704 KAR 3:305, Minimum Requirements for

Graduation. In the amended regulation, Early Graduation is an alternative path to graduation that does not require the 22 minimum credits for graduation. (See Appendix E, Section 6 (1) of the Early Graduation Guidance Document)

b. This means there are NO required number of minimum credits to graduate as part of the Early Graduation pathway- the only requirements are the four courses attached to the EOC exams.

c. What about having to take English 4? (see answer to b. above, it is not required)28. Can my district add requirements?a. No, according to KRS 158.142, a local board of education shall not impose graduation

requirements that prohibit a student who is pursuing an Early Graduation program from finishing high school in less than four years.

b. Districts can recommend courses that will both strengthen the student’s academic content and skills and build on a learning progression to college. This schedule may be

different from most students because it is so differentiated. The counselor and student, based on needed pre-admission criteria and career goals WORK TOGETHER on a course load that is both targeted and necessary for student success. Districts, schools and counselors can only recommend, not insist, on a course of study.

29. Can I double up and take two of the same content courses at the same time?Yes, you will need to plan a schedule with your counselor to ensure the school can accommodate your plans for acceleration.

30. What if I took an EOC course (Eng. II, Alg. II, Biology or US History) in another state, do I have to take it again?No, if the high school you are entering has policies in place on performance credit, they can award credit based on previous course-work.

31. What is performance based criteria?a. A high school graduation credit may be awarded in either of two ways: Carnegie Units

(defined as at least 120 hours of instructional time in one subject) OR performance-based credits. Students must show proficiency in a subject by demonstrating they know the subject through an End-of-Course exam. Performance based criteria are standards-based and aligned with expectations for all students to be college and career ready.

32. What about taking the College Readiness Exams early?Students participating in Early Graduation may take their state administered ACT test in their freshman or sophomore years. If students wish to take the ACT independently, the student will be responsible for the cost of the test. It is the student’s responsibility to have the scores reported to the high school. According to the regulation, students may take their college readiness exam earlier than they are traditionally administered.

33. What if I can’t make benchmark on the ACT?a. A key piece to this legislation is the constant and continual monitoring of student

progress through counseling and use of the ILP. Students, families and counselors should review academic performance each grading period to make sure the student is on track. If a student is unable to reach proficiency in either the course or exams that is a strong indicator the student is not ready for college level work.

b. Students may re-take the ACT as often as they choose (only one school sponsored administration is provided, additional administrations must be funded by the student).

34. I want to see what I might make on the ACT before intending to graduate- can I do this?We want you to be as prepared and sure of this pathway as possible, taking the ACT early, at your expense, is your choice.

35. Can I take other college readiness exams other than the ACT?No, only the ACT is accepted as meeting the requirements by the statute.

36. What if I intend to graduate early but didn’t meet proficiency in the End-of-Course (EOC)

a. If an Early Graduate candidate successfully passes a course, but does not meet EOC benchmark, the student may complete an appeal process to the district board on the extenuating circumstances to re-take the EOC exam again. The DAC should keep the rationale for the retake on file. Refer to the District Assessment Coordinator’s Guide for more information.

b. Students may retake End-Of-Course exams but only after retaking the full and complete course itself (credit recovery is not an acceptable replacement) and may take the End-of-Course again (only once per course and only for Early Graduate candidates).

c. In extraordinary circumstances, the student may appeal to the district superintendent to retake the EOC exam. See the District Assessment Coordinator’s Guide for more detail. Without an approved appeal, students may not re-take an EOC exam unless they have taken the full course again. (See b above).

d. If the student fails to meet benchmark in the spring of their junior year, they have not successfully completed Early Graduation, they must by un-flagged and remain in HS until they reach the district minimum requirements.
