Every provider knows that even in the best-run setting, accidents can happen and problems may arise. Childcare settings of all kinds need insurance to protect them if:

paid or volunteer staff make a claim for injury against them a child is hurt someone else’s property is damaged the setting’s own equipment is damaged the setting or its staff are victims of theft a setting can’t open following a loss such a fire or flood a claim is made against a setting’s director the setting is investigated by a body like HMRC, OFSTED or the HSE

What kind of cover do I need?The Early Years Alliance insurance scheme underwritten by Royal & Sun Alliance Insurance plc includes cover in respect of legal liabilities and offers protection against physical losses to equipment.

Overleaf simply look down the left-hand column to find the kind of setting you run, then look across to establish the package available, the protection you will receive and the premium you will pay.

This policy is annually renewable and underwritten by Royal & Sun Alliance plc. The information below and enclosed Policy Summary booklet provides a summary of cover provided but is not exhaustive. Some specific losses will be excluded and some cover will be subject to specific limits. For full terms and conditions please refer to the Policy Wording, a copy which is available on request or in the members area of the early years alliance website.

insurance that works for youBecause the early years is our business, we know what you do and what your insurance needs to cover. The Early Years Alliance insurance scheme includes as standard:

Baby and toddler groups run as a direct activity of the group. These should be included in the number of sessions the group holds.

Opening up and clearing away times. Our insurance is not restricted to the normal hours of the setting or to term-time so necessary out-of-session work is protected.

Children with special needs. Our insurance cover automatically includes special needs children and there are no restrictions/exclusions on this cover. Many insurance policies regard any special need as a ‘pre-disposing condition’, and limit the protection for children with special needs in case of accidents. Under this insurance, children with special needs have normal protection, on condition of course that they receive the appropriate support in the setting, and that the setting, where applicable, complies with the current DfE’s Special Educational Needs Code of Practice.

Outings and fundraising. The public liability, employers’ liability and personal accident sections of this insurance cover include activities and fundraising events held on or away from the setting’s premises. Such activities and events may include outings, fetes, jumble sales, sponsored walks, discos, open days, doorstep courses, bonfire parties (for which safety guidelines are available), visits to swimming pools and market stalls subject to prior agreement by Insurers.

Accidental damage to fixed glass. This only applies to glass the group is responsible for, under their lease terms.

Replacement as new cover for equipment/contents.

Free Risk Assessment form.

Home-based pre-schools.

Bouncy castles and other purpose-designed bounce-on apparatus. Public Liability cover can be considered. Safety guidelines are available on page 12.

Medication. The authorised administration of medication is covered under the public liability section for no extra charge.

Theft of keys following forced entry/exit, up to £500.

Loss or damage to tenant’s improvements, up to £1,000.

Physical damage to computer equipment. Computers can be insured as part of a group’s general equipment, assuming the total sum insured is adequate. For wider protection, extended computer insurance should be purchased.

Loss or damage to sheds, up to £500.

Contents of sheds, up to £2,500 in respect of cover 5 and £1,000 for covers 1-4, 6, 8 and 9.

Theft of outside play equipment, up to £1,000.

Equipment in transit, other than computers, up to £1,000.

Babysitting by Childminders Children up to the age of 12 are covered, subject to registration requirements.

Volunteers, helpers, students and trainees working in the setting as employees of the setting. Work experience students are also included.

Holiday clubs run by the group at the usual premises in place of the usual pre-school or nursery sessions.

Occasional late collection of children. This insurance provides cover whilst the setting cares for a child when the parent/carer is occasionally late in collecting his/her child at the end of the session.

Christmas uplift. For the period 1 to 31 Dec, an additional 10% to the equipment sum insured will apply to provide protection for the additional items on the premises over the festive season (£1,000 maximum).

Loss of registration. Assuming the loss was not due to any criminal activity or for a breach of registration requirements, cover is provided for the loss of income experienced (limit £50,000).

Forest Schools. Cover is extended to include this activity subject to the completion of the relevant risk assessments and the sessions being supervised by a member of staff holding a minimum qualification of Forest School Level 3.

Professional Indemnity insurance. Where you notify us during the Period of Insurance of circumstances that might reasonably be expected to produce a claim, we cover a subsequent claim arising from such circumstances as though it were made in the Period of Insurance.

IMPORTANT – Please take care when setting the sum insured. If, in the event of a claim, the equipment is found to be valued more than the sum insured on the policy, the Underinsurance provision may come into effect.UNDER-INSURANCE – This is an insurance term used to explain what happens if full insurance cover is not taken out. If a setting’s equipment cover or loss of revenue cover is under insured the insurance company may not pay out the full value of any loss in the event of a claim. The amount paid in settlement of a claim will be reduced proportionally by the amount of under insurance.

Change of venueTemporary or permanent change of premises for setting or equipment storage should be advised in writing to the insurance team at the Early Years Alliance before the change takes place.

Additional venuePlease notify us in writing of any additional venues which you are using, as extra insurance may be required. We will need to know whether the additional venue session is held at the same time as your main venue, whether equipment is stored there and the full address.

Work experience students, trainees, helpers and volunteersThese are automatically covered in the setting’s insurance - you do not need to notify us.

Changes in session timesProvided that these changes do not alter your setting’s Cover Level, changes in session times will be automatically included.

Changes in number of childrenYour settings’s registration details will determine how many children can attend your setting’s sessions. Provided that the change does not alter your settings’s Cover Level, changes in the age range of children

attending your group are automatically covered. The maximum age of children under this insurance is 12 years old, unless specifically agreed with insurers.

You do not need to notify us of changes to the number of children provided that it complies with the terms of the setting’s registration.

For those settings which are exempt from registration, fire regulations at the premises and the number of adults present will help you decide on the number of children who can attend the session.

Change in ownership, contact name, session, opening hours or premises addressThe following changes must be notified immediately in writing to the insurance team at the Early Years Alliance:

a) i) A change in the name and address that the Early Years Alliance has on record for

committee-run settings.ii) Change in ownership of a

privately-run setting. The insurance can be transferred providing that written permission is obtained from the current owner and the new owners submit a new application.

iii) Change in responsibility for a non-committee run baby and toddler group. Written permission must be obtained from the current person(s) responsible for the group.

b) A change in session type which no longer falls into the original Cover Level selected.

Cancellation of insurance

Please provide us with written confirmation if you need to cancel your Insurance and also the cancellation date required. A refund of 50% of the insurance premium will be allowed where a cancellation occurs due to sale or closure of the setting within the first six months of the period of insurance, on condition that there have been no claims and that the annual premium has been paid in full. This is subject to a £15 administration fee. Please include the reason for cancellation and to whom the refund should be made payable within your written confirmation. No refund is available for Cover Level 7, 7a or 10a.

Ofsted regulationA change to the setting such as a reduction in session times which means that Ofsted no longer regulates the setting must be notified to us immediately.

Please note: Activities of an inherently

dangerous nature that do not form part of normal or typical setting’s activities such as assault courses, parachuting and animal rides must be referred to the insurance team in advance to check whether cover can be provided.

claims procedure

All incidents which might give rise to a claim must be notified to the insurance team at the Early Years Alliance. Please be ready to quote your membership number.

All theft and vandalism claims must be notified to the police within seven days of discovery and a crime reference number obtained.

Please then contact the insurance team at the Early Years Alliance for a claim form.

If the claim is likely to be £2000 or more you must contact us immediately with the name and telephone number of a local contact person as it is usual for insurers to appoint a loss adjuster to visit the scene.

If possible the remains should be left untouched and/or photographs taken.

2. Accident/injury to employees/volunteers/children/visitors/members of the public and incidents causing damage to other people’s property

If an incident occurs please notify us immediately. LIABILITY MUST NOT BE ADMITTED. Please do not discuss the incident.

Accidents must be recorded in your group’s Accident and Incident book; the Health and Safety Executive may need notification depending on the nature of the accident. If your setting is registered under the Children Act, the registering authority must be informed of any serious accident.

It is essential that where a person (this includes a child) requires GP/hospital treatment following an accident, a claim form is completed for the Insurer’s records. This can be obtained from the insurance team at the Early Years Alliance.

If you receive correspondence from employees, solicitors and/or third parties, please acknowledge it and forward it otherwise unanswered to the insurance team at the Early Years Alliance.

3. Management Protection/ Professional Indemnity

Please contact legal advisers for advice immediately if you suspect that a situation requiring legal assistance has arisen. The Law-Call telephone number is on your membership card or in the member area of the early years alliance website.

4. Legal Expenses Claims Procedures

Non-employment claimsShould your setting wish to notify a potential claim under the policy you must:

1. Immediately telephone the Early Years Alliance Insurance team on 020 7697 2585 and provide them with:

• your membership number

• details of the dispute

2. A claims form will then be sent to you for completion. This should be returned with any relevant supporting documentation.

3. On receipt of the claims form, the claim handler will contact you and inform you of the next steps to take.

Note:This policy will not pay any legal costs which have been incurred without their consent.

Employment claimsIf you have a potential employment problem you must:

1. Contact Law-Call and follow the advice given.

Note:Notifying Law-Call does not amount to notification of a claim.

2. If the matter is not resolved and you receive Employment Tribunal papers you must contact us immediately to provide full information. Strict statutory time limits apply to employment claims and failure to comply will prejudice your claim.

3. These details will be forwarded to employment consultants for consideration.

Note:This policy will not pay any legal costs which have been incurred without the Insurer’s consent.

5. Personal AccidentYou must give us any information or help that we may reasonably ask for. You must not settle, reject, negotiate or agree to pay any claim without our written permission. Full details of how to claim are included in the policy document.

6. ExcessPlease check this insurance booklet for the excess level. The policy excess on claims for loss or damage, including theft of money/equipment, is £50 for each claim. For theft of outside play equipment or accidental loss/damage claims, the excess is £100 for each claim. A £250 excess applies to Professional Indemnity and Management Protection claims. A £500 excess applies to Fidelity Insurance claims.

Law Applicable Both you and we may choose the law which applies to this contract. However, unless you and we agree otherwise, the law which applies is the law applicable in the part of the United Kingdom, Channel Islands or the Isle of Man in which you are based. Full details will be provided in your policy documentation.

Financial or Trade SanctionsRoyal & Sun Alliance Insurance plc is unable to provide insurance in circumstances where to do so would be in breach of any financial or trade sanctions imposed by the United Nations or any government, governmental or judicial body orregulatory agency. Full details will be provided in your policy documentation.

Complaints ProcedureWe aim to provide you with a first class service. If we have not delivered the service that you expect or you are concerned with the service provided, we would like the opportunity to put things right.

Our complaints processIf you believe that we have not delivered the service you expected, we want to hear from you so that we can try to put things right. If you have cause for complaint you should initially contact the person who arranged the policy for you or the Early Years Alliance Team or the manager of RSA at the address shown on your quotation or schedule, as appropriate. In the unlikely event that they are unable to resolve your concerns, your complaint will be referred to our Customer Relations Team who will arrange for an investigation on behalf of our Chief Executive.

The Department of Education Guidelines state that “Parents should provide the school with sufficient and up to date information about their child’s medical needs.” (page 13 Supporting pupils at school with medical conditions)

Administration of medicineThe Public Liability section of thisinsurance includes cover for administration of medication provided that your setting is fully compliant with the Safeguarding and Welfare requirements of the Early Years Foundation Stage in relation to administering medicines.

Oral Medication:Details do not need to be forwarded to the Early Years Alliance, provided that a) it is prescribed by the child’s GP or

has the manufacturer’s instructions clearly written on it and

b) the setting has the parent’s/ guardian’s written consent and clear instructions on how to administer such medication.

Asthma inhalers and nebulisers aretreated as “oral medication” for thepurposes of this insurance. Life Saving or Invasive Medication(e.g. rectal diazepam or Buccal Midozolam for epilepsy or adrenaline injections/Epipens/Anapens and Jext Pens for anaphylactic shock caused by reaction to substances such as nuts and Injections such as Insulin for Diabetes)

To extend your setting’s cover you will need to confirm in writing to the insurance team at the Early Years Alliance that, for each applicable child, you have received the following and can provide evidence if so required : a) A letter or care plan from the child’s

GP/consultant stating the child’s condition and the treatment required.

b) Parent’s/guardian’s written consent to allow staff to administer medication.

c) Proof of staff training in the administration of such medication by a qualified nurse or doctor. In the case of children requiring adrenalin injections for anaphylaxis, the AllergyWise online training provided at www.anaphylaxis.org.uk has been approved.

Assistance with Everyday LivingWhen a child requires help with everyday living e.g. breathing apparatus, colostomy bags or feeding tubes, and has a keyworker, you will need to confirm in writing to the insurance team at the Early Years Alliance that, for each applicable child, you have received the following and can provide evidence if so required : a) A letter from the child’s GP/

consultant stating the child’s condition and the treatment required.

b) Parent’s/guardian’s written consent to administer treatment.

c) Written confirmation that the keyworker has the relevant medical training or experience to administer the treatment. This can include training by the parents.

Adult:child ratioThis insurance does not specify adult:child ratios. However at all times children in the setting’s care must be supervised in accordance with registration requirements.

Carnival/motorised floatsIt is not necessary to advise the Early Years Alliance of the use of motorised floats. (See Contingent Motor Liability Cover section.) However, you need to ensure that the vehicle owner has motor insurance in place for this activity. The setting’s public liability insurance will provide cover for accidents which do not involve a vehicle and for which the setting are legally liable.

Using carsIf the setting’s owners, pre-school leaders, employees or volunteers use their cars for setting outings or activities, they must inform their motor insurers of this use as this could be considered “business use”. Failure to do so could make their motor insurance invalid.

People within a setting must not drive each other’s cars unless their insurance is appropriate.

Volunteers’ childrenYou will need to comply with any registration requirements or local guidelines on volunteers’ children for these to be included within the setting insurance cover.

Bouncy castlesFor child users of bouncy castles to be covered under the Public Liability section of the insurance, the apparatus must be under the control and supervision of an adult member of the setting at all times. The equipment must have a valid test certificate and suitable safety matting must be used. (Further guidelines can be found at www.pipa.org.uk.)

Setting moneyMoney should be banked daily but if this is not possible then setting money should be divided between setting members and removed from the premises.

We do not recommend that you leave money on the premises overnight.

Accidents, including motor accidentsSettings must not admit liability and must forward to the Insurers all correspondence relating to the incident. Please refer to the claims procedure in this book for further guidance.

SecurityPlease remember that all locks, bolts and other security devices which you have in place at your premises must be put into full operation whenever the premises are left unattended. Keys must be removed from the premises. Alternatively, keys can be placed within a locked safe or strongroom, the keys of which must be removed from the premises.

We strongly recommend that a closed shackle padlock is used on sheds.
