A No. Q Does the plan cover courses to obtain an MBA? A Yes. Q Is the reimbursement taxable? A The reimbursement will be taxable to a spouse or eligible dependent. It is not taxable when paid for the member. Under any plans offered by the Fund, it is illegal to willfully and knowingly misrepresent any fact for securing benefits under a sponsored plan. Any member found by the Board of Trustees to have committed such a misrepresentation may immediately become ineligi- ble for any future benefits and will be required to reimburse the Fund for any benefits obtained fraudu- lently. The Fund Office will cooperate with law enforcement agencies investigating and prosecuting criminal complaint, including fraud or larceny. The National Association of Government Employees and the Commonwealth of Massachusetts have implemented an Education Assistance Program (EAP) beginning with the Fall 2018 Semester. The benefits under the plan will assist members of Bargaining Units One, Three and Six and their eligible dependents to pursue and/or further their educational career. Who Is Eligible to Participate? All active members of NAGE Bargaining Units One, Three and Six who have completed six months of employment are eligible to partici- pate. The member is limited to one reimburse- ment per academic year. The student can be the member, the member’s eligible spouse or eligible dependent. What Is the Maximum Reimbursable Amount? The maximum reimbursement is $500.00 per family per year. Reimbursement will be issued twice per year in April and August. The member and his or her household is limited to one claim per academic year. Please note reimbursement issued for a spouse or eligible dependent is considered taxable income to the member. For Spouse or Dependents Spouse or Dependents can receive up to a $500.00 maximum reimbursement (limited to one reimbursement per household) for under- graduate, graduate or post graduate education. (Certificate and/or professional/trade licensing training is not eligible for reimbursement). The member, not the educational institution, is solely responsible for filing the application. If for reasons beyond the member’s control, some of the information is not available for transmittal within 60 days after the last day of the applica- ble course/program, the member must send the materials that are available along with a letter of explanation to the Education Program Adminis- trator that sets forth what information is missing and when it can reasonably be expected to be available. If all the relevant information is avail- able and all documents are in order, the applica- tion will be processed provided all procedures have been followed. What If My Claim Is Denied? If your claim for education assistance is denied, you will be notified in writing as to the reason(s) for the denial. If any additional information is required for the claim to be eligible for reim- bursement this information will be requested. If you wish to appeal any denial you must submit in writing to the Fund Administrator the reason(s) why the course(s) or program should be considered eligible for reimbursement. The appeal will be reviewed, and you will be notified in writing on the determination of the appeal within 30 days of the receipt of the appeal. Either the Board or the Administrator, acting on behalf of the Board of Trustees’ determination concerning the administration, application and interpretation of the terms of the plan shall be conclusive and binding on all person subject to the terms of the plan. What Are Non-Reimbursable Classes? For Members The following are some examples of classes that do not qualify for reimbursement under the Educational Assistance Plan: Certificate program that is not related to any NAGE represented job in the Executive Branch of the Commonwealth of Massachusetts.
