Disability Rights Council v. WMATA (D.D.C. 2005-08) - Defenseof former paratransit provider in class action lawsuit allegingsystematic violations of the Americans with Disabilities Act(ADA) and the Rehabilitation Act, where Sidley prevailedagainst a motion to implead our client into the class action.

AT&T v. Sprint (S.D.N.Y. 2004): Represented corporate plaintiffin unfair competition and trademark litigation.

City of New York v. Fifth Avenue Presbyterian Church (S.D.N.Y.,2d Cir., U.S., 2002-07) – Successfully represented the FifthAvenue Presbyterian Church in a dispute over its homelessministry.

Living Water Church of God v. Meridian Charter Township (6thCir. 2006) - Sidley represented a coalition of religiousinstitutions as amici curiae regarding issues under the ReligiousLand Use and Institutionalized Persons Act.

Sylvia’s Haven, Inc. v. Massachusetts Development FinanceAgency (D. Mass, 2005; 1st Cir. 2006) Represented Sylvia’sHaven, Inc. in appeal of base closure issues, ultimately to theU.S. Court of Appeals for the First Circuit. The action wasdismissed after a private resolution.

AT&T Corp. v. 2PrePaid Inc. (M.D. Fla. 2006) - Obtaineddamages and permanent injunction against unlawful Internetsales of counterfeit AT&T prepaid calling cards.

AT&T Corp. v. CyberTelecom, Inc. (S.D. Fla. 2004) - Obtainedpreliminary and permanent injunctions against Internetdistribution of counterfeit AT&T prepaid calling cards in a caseinvolving extensive Internet forensic evidence.

In re Microsoft Corp. Antitrust Litigation, MDL No. 1332 (D. Md.)- Represented Microsoft in competitor class actions includingthose brought by Netscape and Burst. These actions weredismissed with prejudice after the parties reached privateresolutions.

Physicians Interactive v. Lathian Systems, Inc. (E.D. Va. 2003) -Obtained preliminary injunction for plaintiffs alleging hacking ofcomputer systems in order to obtain trade secrets. The actionwas dismissed after the parties reached a private resolution.

Globalsantafe Corp. v. Globalsantafe.Com (E.D. Va. 2003) -Sidley developed and prevailed on a novel theory of in remjurisdiction that asserted U.S. jurisdiction to enforce itsresolution of an Internet domain name dispute regardless of adirectly contradictory order from a court in South Korea.

Cable News Network, LP, LLLP v. CNNews.com (4th Cir. 2003)- Sidley represented amicus AT&T Corp. on in rem issueregarding domain names under the AnticybersquattingConsumer Protection Act of 1999 (ACPA).

Bayer & Willis Inc. v. Republic of Gambia (D.D.C. 2003) -Successfully represented AT&T Corp. against claims related tothe Foreign Sovereign Immunities Act (FSIA).

Al-Abood v. El-Shamari (E.D. Va.; 4th Cir. 2000) - Affirming jurytrial verdict Sidley won in favor of plaintiff on a variety of fraud,fiduciary duty and conversion theories related to a complexinternational investment fraud.

For numerous telecommunication and Internet companiesproviding analysis, advice and regulatory counseling regardingcompliance with and the impact of all major U.S. andinternational privacy and data security laws and regulations,including ECPA, CFAA, COPPA, GLBA, FCRA, and nationalsecurity laws.

Prior to joining Sidley, Ed served as an Associate Counsel toPresident Clinton. In addition to serving as a global co-chair of Sidley’s Privacy, DataSecurity, and Information Law group, Ed is a national co-chair ofSidley’s Religious Institutions practice. He also serves as theChairman of the Board of Directors for the National Law Center onHomelessness and Poverty, and recently was admitted to theCosmos Club based on his recognition as being “distinguished inInformation Privacy law.” Previously, Ed has served on the boardof the Washington, DC lawyer’s chapter of the AmericanConstitution Society.

PRO BONO

Ed frequently advises organizations that combat homelessnessregarding complex constitutional issues at both the trial andappellate levels and before legislative bodies. His work for suchorganizations contributed substantially to the firm being awardedthe 2004 Counsel Pro Bono Award by the National Law Center onHomelessness and Poverty. Mr. McNicholas now serves as theChairman of the Board of Directors for the National Law Center onHomelessness and Poverty.

Ed also regularly represents churches and religiously-affiliatedinstitutions and related nonprofit organizations on constitutionaland other legal issues. He is a national co-chair of Sidley’sReligious Institutions Practice, which the New York Timesrecognized as representing “some of the country’s largestreligious organizations.” He was awarded the 2010 ThurgoodMarshall pro bono counsel prize by Muslim Advocates forinnovative litigation to protect civil liberties.
