    2018 Year-End Checklist

    _____ 1. Enter tax rate and interest rate for tax year 2019. (See instructions later in this document.)

    _____ 2. Process all December activities (including refunds and closing the month). If you need to continue to make entries for December after December 31, 2018, you will need to set the tax subsystem date back to December 2018 each day until you are ready to close December 2018. The subsystem date is set by navigating to INCOME TAX | Subsystem Setup | Subsystem Parameters | General Tab. The IT System Date is the first field on the screen.

    _____ 3. Backup the Income Tax System to a location on your server or to removable media like a tape. This needs to be a full backup – the Temporary Subsystem Backup (eGov Professional users only) is not sufficient for year-end purposes. Contact your network administrator if you need assistance performing this backup.

    _____ 4. Navigate to INCOME TAX | Month End Processing | Print Cash Report. Enter a Report Date of 12312018 and save this report for your year-end records.

    _____ 5. Navigate to INCOME TAX | 1099 G Processing | 1099G Listing for 1099G Year 2018. Review the list for any issues such as reversed refunds for taxpayers (positive and negative amount for the same refund). If you locate any issues, use 1099 G File Maintenance to make corrections and then keep rerunning the 1099G Listing until the list appears correct.

    _____ 6. Navigate to INCOME TAX | 1099 G Processing | Print 1099G to prepare the paper 1099G forms to mail to taxpayers (no later than January 31, 2019) and if appropriate for your municipality, an electronic file to send to the IRS (no later than April 1, 2019). It is strongly recommended that you print the 1099 forms to paper first to proof the information and placement of data without wasting forms. (See instructions later in this document.)

    Instructions Setting up Tax Rates and Interest Rates for Tax Year 2019 For July 2018, the Annual Short-term AFR is 2.38% so the annual interest rate for tax year 2019 tax obligations will be 7% annually or 0.583% per month (or part thereof) of the tax not paid by the due date. This interest rate of 0.583% per month (or part thereof) will be in effect for income taxes due for tax year 2019 not paid by the due date. REMINDER – Per the Ohio Revised Code you were required to post the 2019 interest rate on your website by October 15, 2018. Tax rates should be entered for both 2018 and 2019 (2019 is required for withholding interest). Navigate to INCOME TAX | SUBSYSTEM SETUP | Yearly Tax Rate Setup and a screen like this will be displayed:

    • Year o Enter the 4 digit tax year.

    • Rate o Enter the tax rate for this tax year in the format “.022500” (for a rate of 2.25%).

    • Interest (Monthly Rate) o Enter the monthly interest rate for this tax year in the format “.005000” (for a monthly

    interest rate of 0.5%).

    • Apply Interest to Q1 o Check this box if you wish to apply interest to estimated amounts unpaid. This is in addition

    any underpayment of estimated taxes penalty you have set-up under INCOME TAX | SUBSYSTEM SETUP | Subsystem Parameters. The ORC does not provide specifics on how the interest should be calculated just that you may charge interest on underpayment of estimated taxes. If you check this box, the interest will be applied in increments of 3 months to each period that was underpaid.

    Printing 1099s and/or Preparing an Electronic 1099 File for Submission It is strongly recommended that you print the 1099 forms to paper first to proof the information and placement of data without wasting forms. Navigate to INCOME TAX | 1099 G Processing | Print 1099G and a screen like this will be displayed:

    • Are these Laser Forms? o If you are printing on a laser printer, enter ‘Y’. o If you are printing on a dot matrix printer, enter ‘N’.

    NOTE: This tells the system how many copies of the 1099Gs to print.

    • Refund Year (4 digit) o Enter the 4-digit tax year for the 1099G forms.

    • Is Last Name First? o If your accounts are entered with last name first (e.g. JONES, MIKE), enter ‘Y’. Individual

    taxpayer names MUST be entered in this format for the 1099s to print properly. • Is This a Test File?

    o If you are creating a test electronic file, enter ‘Y’. o If you are creating the actual electronic file to be sent to the IRS, enter ‘N’.

    • Federal EIN (no dashes) o Enter your municipalities’ Federal ID number with no dashes.

    • Transmitter Cont Code o If you file an electronic file with the IRS, enter the transmitter control code provided by the

    IRS. o If you do not file an electronic file with the IRS, leave this field blank.

    • Payer Name Control o If you file an electronic file with the IRS, enter the payer name code provided by the IRS. o If you do not file magnetically with the IRS, leave this field blank.

    • Enter City Name, Enter City Address, City, State and Zip o Enter the name and address of your municipality as you wish it to appear on the 1099Gs.

    NOTE: Do not enter any dashes in the Zip field. • Contact’s Name

    o Enter the name of the person (or department) who should be contacted about the 1099G forms/files.

    • Contact’s Phone o Enter the phone number of the person (or department) who should be contacted about

    1099G forms/files. • Contact’s Email

    o Enter the email address of the person (or department) who should be contacted about 1099G forms/files.

    • Starting Account o Enter the starting account number or leave blank for all account.

    • Ending Account o Enter ending account number or enter all ‘z(s)’ or ‘9(s)’ for all accounts.

    • Print Business Accts o If you wish business accounts to receive 1099Gs, enter ‘Y’. o If you do not wish business accounts to receive 1099Gs, enter ‘N’.

    After completing the screen, click . After you print the 1099G forms, if you are filing with the IRS magnetically, the file is automatically generated through the print process. A screen like this is displayed:

    Click and you will be prompted for printing based on the type of printer you indicated (laser or dot matrix).

    Note: If you are using a laser printer, please look at the prompts carefully to make sure you insert the correct forms for each of the prints (Federal Copy A, Recipients Copy B, Payer/State Copy C).

    Magnetic Filing Notes: It is your responsibility to determine if you are required to file magnetically. If you are not certain whether you must file magnetically, consult the current IRS publication for information on how requirements may change year to year. General Rules Regarding Magnetic Filing

    • Taxpayer names must be entered as Last, First. Last and First names must be separated with a comma for the forms to print properly.

    • Business names must not begin with THE unless there are only two words in the name. For example, “The First Bank” should be “First Bank” while “The Landing” should be “The Landing.

    • Because the Print 1099G program produces an ASCII file, you must process the Print 1099G program from start to finish. If you restart the process, only the portion included in the restart will be included in the magnetic file. If you need to restart to complete the printing of the 1099G forms, be sure to process all accounts on paper from start to finish afterwards so your magnetic file is complete.

    • The file used for magnetic reporting is located under: o For eGovProfessional users – eGovPro/Itd/IRS o For eGovRelational users –eGovPro/Itd/IRS

    • The file will need to be renamed to IRSTAX before you transmit it to the IRS. NOTE: Because this is an IRS requirement that may change from year to year, be certain you check with the IRS for the most current file name.

    Loss Carryforwards Per ORC 718.01

    (B) "Income" means the following:

    (1)

    (a) For residents, all income, salaries, qualifying wages, commissions, and other compensation from whatever source earned or received by the resident, including the resident's distributive share of the net profit of pass-through entities owned directly or indirectly by the resident and any net profit of the resident, except as provided in division (D)(5) of this section.

    (b) For the purposes of division (B)(1)(a) of this section:

    (i) Any net operating loss of the resident incurred in the taxable year and the resident's distributive share of any net operating loss generated in the same taxable year and attributable to the resident's ownership interest in a pass-through entity shall be allowed as a deduction, for that taxable year and the following five taxable years, against any other net profit of the resident or the resident's distributive share of any net profit attributable to the resident's ownership interest in a pass-through entity until fully utilized, subject to division (B)(1)(d) of this section;

    (ii) The resident's distributive share of the net profit of each pass-through entity owned directly or indirectly by the resident shall be calculated without regard to any net operating loss that is carried forward by that entity from a prior taxable year and applied to reduce the entity's net profit for the current taxable year.

    (c) Division (B)(1)(b) of this section does not apply with respect to any net profit or net operating loss attributable to an ownership interest in an S corporation unless shareholders' distributive shares of net profits from S corporations are subject to tax in the municipal corporation as provided in division (C)(14)(b) or (c) of this section.

    (d) Any amount of a net operating loss used to reduce a taxpayer's net profit for a taxable year shall reduce the amount of net operating loss that may be carried forward to any subsequent year for use by that taxpayer. In no event shall the cumulative deductions for all taxable years with respect to a taxpayer's net operating loss exceed the original amount of that net operating loss available to that taxpayer.

    (1)

    "Net profit" for a person who is an individual means the individual's net profit required to be reported on schedule C, schedule E, or schedule F reduced by any net operating loss carried forward. For the purposes of division (D)(1) of this section, the net operating loss carried forward shall be calculated and deducted in the same manner as provided in division (D)(3) of this section.

    (2) "Net profit" for a person other than an individual means adjusted federal taxable income reduced by any net operating loss incurred by the person in a taxable year beginning on or after January 1, 2017, subject to the limitations of division (D)(3) of this section.

    (3)

    (a) The amount of such net operating loss shall be deducted from net profit to the extent necessary to reduce municipal taxable income to zero, with any remaining unused portion of the net operating loss carried forward to not more than five consecutive taxable years following the taxable year in which the loss was incurred, but in no case for more years than necessary for the deduction to be fully utilized.

    (b) No person shall use the deduction allowed by division (D)(3) of this section to offset qualifying wages.

    (c)

    (i) For taxable years beginning in 2018, 2019, 2020, 2021, or 2022, a person may not deduct, for purposes of an income tax levied by a municipal corporation that levies an income tax before January 1, 2016, more than fifty per cent of the amount of the deduction otherwise allowed by division (D)(3) of this section.

    (ii) For taxable years beginning in 2023 or thereafter, a person may deduct, for purposes of an income tax levied by a municipal corporation that levies an income tax before January 1, 2016, the full amount allowed by division (D)(3) of this section without regard to the limitation of division (D)(3)(b)(i) of this section.

    (d) Any pre-2017 net operating loss carryforward deduction that is available may be utilized before a taxpayer may deduct any amount pursuant to division (D)(3) of this section.

    (e) Nothing in division (D)(3)(c)(i) of this section precludes a person from carrying forward, for use with respect to any return filed for a taxable year beginning after 2018, any amount of net operating loss that was not fully utilized by operation of division (D)(3)(c)(i) of this section. To the extent that an amount of net operating loss that was not fully utilized in one or more taxable years by operation of division (D)(3)(c)(i) of this section is carried forward for use with respect to a return filed for a taxable year beginning in 2019, 2020, 2021, or 2022, the limitation described in division (D)(3)(c)(i) of this section shall apply to the amount carried forward.

    Tracking Loss Carryforwards When a final return is entered, there are two fields related to losses:

    Most customers reduce the Other Income by the amount of any loss carryforward being used but the loss carryforward being used to reduce this tax year’s taxable income may also be entered as a negative Income Adjustment which will also reduce the taxable income. As loss carryforwards are used, the amount used to reduce taxable income should be entered as a negative amount in the Loss C.F. field to reduce the loss carryforward amount available for future tax years. As loss carryforwards are added, the amount of the loss carryforward should be entered as a positive amount in the Loss C.F. field to increase the loss carryforward amount available for future tax years. The entries you make in the Loss C.F. field build a loss carryforward history that is available via Display Option | Loss Carry Forward. The history display shows the loss carryforward balances by tax year. You will need to review the history to determine what losses are still available for use based on the tax year of the year (there is a 5-year limitation on using a loss carryforward) and the 50% limitation in effect for tax years 2018, 2019, 2020, 2021, or 2022. For tax years 2018, 2019, 2020, 2021, or 2022, the un-used 50% is not lost. It carries forward and like all loss carryforwards, the loss is available for use for the next 5 consecutive tax years. After 5 years, the loss can no longer be used to reduce taxable income.

    To obtain payment amounts that do not include penalty and or interest, navigate to INCOME TAX | Miscellaneous Reports | Payment Transactions by Date or Batch:

    • Enter Starting Account and Enter Ending Account o Enter the account range for the first set of direct accounts (individual or business).

    • Enter Starting Trans Type and Enter Ending Trans Type o Enter the first transaction type to report (e.g., ‘ESTIM’) in both fields.

    • Enter Starting Post Date and Enter Ending Post Date o Enter the range of dates for the year to be reported.

    • Enter Starting Batch and End Ending Batch o This should be batch ‘0’ to batch ‘99’

    • Sort By (B)atch (A)cct o Enter ‘B’ to sort by batch. o Enter ‘A’ to sort by account.

    Continue this process for the first set of direct accounts for each of the other payment transaction types – FINAL and MISCL. Once you have all the payment information that does not include penalty and interest for the first set of direct accounts, continue this process for the second set of direct accounts. When the data for the direct accounts has been obtained, continue this process for withholding accounts using payment transaction types MISCL and W1RET.

    Filter the PaidAmt column to exclude 0 (zero) values. Filter the AccountNumber field by the first two digits to reduce the list to just the type of accounts you want (direct individual, direct business or withholding). Then filter by TransactionType to include only payments on tax (not penalty and/or interest). For withholding accounts, filter the TransactionType to MISCL and W1RET only. For direct accounts, filter the TransactionType to ESTIM, FINAL and MISCL only. Source 3 This information will not reside on the SSI Income Tax system since it is not filed on a municipal income tax return. This refers to the payments received from the State of Ohio related to these businesses. This information may be kept in either the Income Tax office or in the Finance office.

    The numbers to the left of the ACCOUNT column are the account type (individual, business, withholding, etc.).

    Highlight the row with the column names and turn on the filters (Data | Filter). Add a subtotal in the row above the REFUND column to add up the filtered values in this column ‘=Subtotal(9,M9:M60000)’.

    Delete the blank row (8) that appears between the column headers and the data. Also delete the row that contains the TOTALS. If you filter the column with the account type to ‘20’, only the refunds for the individual accounts will be displayed and the total above the REFUND column will be changed to reflect the filtered amounts…

    OBG Direct Filers (Last Updated August 27, 2018)

    All municipalities will receive their distribution of payments based on this section of the Ohio Revised Code:

    718.83 Certification of amounts to be paid municipal corporations.

    (A) On or before the last day of each month, the tax commissioner shall certify to the director of budget and management the amount to be paid to each municipal corporation, based on amounts reported on annual returns and declarations of estimated tax under sections 718.85 and 718.88 of the Revised Code, less any amounts previously distributed and net of any audit adjustments made or refunds granted by the commissioner, for the calendar month preceding the month in which the certification is made. Not later than the fifth day of each month, the director shall provide for payment of the amount certified to each municipal corporation from the municipal income tax fund, plus a pro rata share of any investment earnings accruing to the fund since the previous payment under this section. Each municipal corporation's share of such earnings shall equal the proportion that the municipal corporation's certified tax payment is of the total taxes certified to all municipal corporations in that quarter. All investment earnings on money in the municipal income tax fund shall be credited to that fund.

    (B) If the tax commissioner determines that the amount of tax paid by a taxpayer and distributed to a municipal corporation under this section for a taxable year exceeds the amount payable to that municipal corporation under sections 718.80 to 718.95 of the Revised Code after accounting for amounts remitted with the annual return and as estimated taxes, the commissioner shall proceed according to divisions (A) and (B) of section 5703.77 of the Revised Code.

    The payments distributed to municipalities will be reduced by .05% which represents a fee to the State of Ohio based on this section of the Ohio Revised Code:

    718.85 Filing of annual return; remittance; disposition of funds.

    (B) The tax commissioner shall immediately forward to the treasurer of state all amounts the commissioner receives pursuant to sections 718.80 to 718.95 of the Revised Code. The treasurer shall credit ninety-nine and one-half per cent of such amounts to the municipal income tax fund and the remainder to the municipal income tax administrative fund established under section5745.03 of the Revised Code.

    How you handle these OBG accounts within your municipality is your decision but we have some suggestions that you might find helpful.

    1) Complete and return to the State of Ohio the required MNP TTI form within 90 days of receiving notice that a business has signed up as an OBG only filer. Failure to submit these forms in a timely manner may result in 50% of your payments from the State being withheld until the forms have been submitted. There is a fill-in PDF available on the State’s website at this link -- https://www.tax.ohio.gov/portals/0/forms/Municipal-Net-Profit/2017/MNP_Transfer_of_Info_FI.pdf 2) You may wish to renumber the OBG only filers to a new set of account numbers so that they are

    immediately recognizable. For example, if you currently use 31 + Federal ID Number and 41 + Federal ID Number for business accounts, you may wish to change the OBG only filers to 32 + Federal ID Number and 41 + Federal ID Number or any other numbering scheme that works for you.

    3) Create a new account status under INCOME TAX | Subsystem Setup | Account Status Code Maintenance for the OBG filers. A screen like this will be displayed:

    • Status Code o Create a new status code with a number greater than 50 (since these are active

    accounts). As explained later in this document, this new status code can be used to stop the application on monthly penalty and interest for OBG only filers.

    • Description o Enter a description such as “OBG only filer” or “OBG filer”.

    • Print on Delinquent Letters o You will need to un-check this box since your municipality cannot send any non-filing or

    other delinquent letters to these OBG only filers.

    As the first tax year for the OBG only filer begins (and this date may vary based on the taxpayer’s fiscal year), check the account for delinquencies. Once all delinquencies for prior years have had delinquent letters sent, change the Status Code on the account in INCOME TAX | File Maintenance | Direct Accounts | File Maintenance to the new status code you created for OBG filers. You also should un-check Send Forms so that the account is not included in any future year-end mailings related to final returns.

    4) Since your municipality cannot charge the OBG only filers any penalty or interest at the local level, you may wish to un-check the Penalty checkbox for the first year they will be filing with OBG under INCOME TAX | Adjustments Processing | Direct Accounts | Enter Adjustments. You may wish to un-check the Penalty checkbox for multiple years since the taxpayer must continue to file via OBG until they notify State tax commissioner and your municipality that they are terminating their election to only only via OBG. As explained later in this document, there is an option to stop monthly penalty and interest for OBG only filers based on their special status code.

    Following these steps will do the following:

    • Identify OBG only filing accounts by changing their accounts numbers. • Stop OBG only filing accounts from receiving delinquent letters by changing them to a

    status code that does not have Print on Delinquent Letters checked. • Stop OBG only filing accounts from receiving final return forms or other year end notices

    about final returns by un-checking Send Forms ?. • Stop OBG only filing accounts from receiving penalty and/or interest by un-checking Penalty

    check box in Enter Adjustments for each applicable tax year.

    Payments received from OBG Only Filers The State will make an ACH deposit for the net due your entity (after refunds, fees and interest) and the State will provide a reconciliation form. The form will detail:

    o Payments must be entered in full on the Income Tax system on the taxpayer accounts. • Refunds

    o Refunds must be processed as normal on the Income Tax system to the taxpayer accounts. Once the income tax refunds are transferred to your accounting system, the refund payment requests that have already been provided by the State will need to be modified to not produce a check.

    • Fees o The fees charged by the State will be processed in your accounting system as either an

    expense or a reduction in revenue. • Interest

    o Any interest received from the State will be processed in your accounting system as a revenue.

    Example:

    o Deposit received of $2,703.26. o Gross Collections of $3,720.59 which have now been entered as payments in Income Tax. o Refunds of $1,000.00 which are processed as normal on the Income Tax system, but once

    the refund payment requests that have already been provided by the State will need to be modified to not produce a check.

    o Administrative Fee (0.5%) of $18.60 which must be recorded as either an expense or a revenue reduction in the accounting system.

    o Interest of $1.27 which must be recorded as revenue in the accounting system.

    If you have not done so, you should be reviewing the information your municipality is required to provide to the State of Ohio to assist them in the filing process. This information is included in the Ohio Revised Code under 718.80.     Refunds of Estimated Payments that should have been made to the State of Ohio Scenario: The business taxpayer has signed up to exclusively file their municipal income tax return via the State of Ohio, but sends the local municipality estimated payments in error. Since the local municipality is not permitted to contact a business taxpayer who has signed up for file exclusively via the State of Ohio, the estimated payment should be processed as normal. Here is an example:

    The taxpayer should contact the municipality and request a refund of this estimated payment since it should have been paid to the State of Ohio.

    Two adjustments will be required to correct this account: 1) One transaction to create a refund record. 2) One transaction to remove the estimated payment that has been paid in error.

    To set-up the refund, use INCOME TAX | Adjustments Processing | Direct Accounts | Enter Adjustments and enter a transaction similar to the following to generate a refund transaction for this account:

    When this adjustment is updated, it will create a refund record that is visible via INCOME TAX | 1099G Processing | 1099G File Maintenance:

    This refund will be displayed the next time an open refund list is generated (INCOME TAX | Check Processing | Print Refund List).

    To remove the estimated payment AFTER THE REFUND IS COMPLETE, use INCOME TAX | Adjustments Processing | Direct Accounts | Enter Adjustments and enter a transaction similar to the following to remove the estimated payment that has now been refunded:

    Now the account will appear as if no estimated payments were received for this tax year:

    When the State of Ohio forwards you the estimated payments in your monthly settlement, you can input the estimated payment as you normally would.

    Stopping Monthly Penalty and Interest for OBG Direct Filers A version of the PRINT PENALTY AND INTEREST REPORT is available that allows for accounts with one specific status code to be “skipped” for monthly penalty and interest. Since the local municipalities are not permitted to apply any penalty or interest to OBG only filers, the account status on these accounts can be used to keep them from receiving monthly penalty and interest.

    Note: This program change does not stop the application of penalty and/or interest when the return is filed so you will need to review this when you enter the OBG only filer’s final return and make any necessary corrections to have the final entered match what the State of Ohio processed.

    Once the new program is installed, when you run the program under INCOME TAX | Month End Processing | Direct Accounts | Print Penalty and Interest Report, a prompt like the following will be displayed:

    During the installation of the new program, the default account status to be skipped for monthly penalty and interest will be designated. There is set-up required for this new program, so please contact SSI Support at 1-800-686-9578 if you would like this program installed.

    718.83 Certification of amounts to be paid municipal corporations.The payments distributed to municipalities will be reduced by .05% which represents a fee to the State of Ohio based on this section of the Ohio Revised Code:718.85 Filing of annual return; remittance; disposition of funds.
