1. GENERAL INTRODUCTION The Second Rural energy project of additional financing (hereinafter called "the REII

Project) focus on rehabilitating and increasing the capacity of existing distribution lines and substations and standardizing them to 35 and 22k V to meet growing demand on electricity more efficiently, provide better quality and quantity of electric power for production uses, and reduce power system loss.

The Second Rural energy project of additional financing is carried out in 28 communes of 8 districts of Yen Bai province

Yen Bai has 9 district, city and township (the Yen Bai city, Nghia Lo Township and 7 districts of Luc Yen, Mu Cang Trai, Tram Tau, Tran Yen, Van Chan, Van Yen and Yen Binh) with 180 communes. In which 70 highland communes and 62 communes with special difficulties are making investments in development programs - economic and social state, two districts have the highest Tram Tau and Mu Cang Chai (Mong compatriots than 80 %) in 61 poor districts, particularly the difficulties of the country.

2.3 PLANS FOR ELECTRIC POWER LINE ADJUSTMENT CHE TAO COMMUNE

Dossiers EMP Second Rural Energy Project Yen Bai province - Medium voltage has been consulting unit completed and sent PMU in November 2009. From the date 9/3/2010 to 3114/2010 Missions (including the WB, Ministry of Industry and Commerce, PCl) examined the route and work with the province of Yen Bai, Yen Bai Electricity, Sevice of Industry and Commerce, CPC Mu Cang Chai district on the progress of project RE2. The mission found that the 35 kV power supply lines for Che Tao commune, specifically substation located at the CPC Che Tao and Ta Dong village, 35kV power line cut through some areas of primary forest, will hardly be approved by WB and requirements PCl and PMU has other plans for the power supply.

After obtaining informed content - the working results of the inspection team, the PMU has requested the consulting unit deployed surveys its options to supply electricity to Che Tao commune avoid cutting through the forest . Consulting unit has conducted a survey and make plans for power supply Che Tao commune (substation CPC Che Tao and Ta Dong village) from a column of 35 kV power supply line 83-59/8 Hua Trai commune, Muong La district, Son La Province. Accordingly lines along the road from Hua Trai commune to Che Tao commune and not cut through the primary forest or other protected areas. 35kV power line to supply electricity to Hang Gang village and Ta Cho ofChe Tao commune remains the old plan.

2.4. Descriptions of major pre-construction and construction activities according to sequence of implementation • Land clearance:

Ground clearance is mainly on removing of vegetation cover or cut down of trees,

obstruction located in foundation locations, trees above 4 m on and houses on ROW

• Houses on ROW would not be affected so no clearance is needed

• Trees of poles locations are mainly cropes (rice, Maize and sweet potato, orchards),

bamboo, betel, District of People's of Committee, Provincial People's Committee

project area are unanimous in our support for implementation of compensation and

ground clearance according to stipulation in order to ensure implementation

construction implementation right after crop harvest.

Cutting trees above 4 m on RO W may be implemented prior to wire pUlling.

• Compensation is implemented by electricity of Yen Bai.

So that, Provincial People's Committee is required to complete procedure for land

recover and allocation to handover ground to construction units.

• Construction of temporary tents:

To ensure maintenance of materials, equipment, accomodation. for workers. The

temporary structures are constructed include:

+ Close warehouse for cement, electric materials and fittings, cubicles, swiches: 30m2x28

sub project = 840 m2

+ Open warehouse with fence for transformers, medium voltage conductor, construction

tools, arms supports, pull tight,: 40 m2 x28 subproject= 1120 m2.

+ Temporary tents for workers during construction time: 20 m2 x28 subproject=660 m2

+ Glose warehouse and temporary tents are made of bamboo frames, roofs, oil paper.

• Construction materials and transformers, power lines etc are transported to

the site:

Types of equipments, materials such as: Conductor, insulators bought in Ha Noi and

transported by Lorries to central of ROW of each project component (site pens).

Commodities are transported from Ha Noi to construction site such as:

+ Protection, swithing, equipment, insulators, electric cable with small packing,

commodities are collected and transported by car to construction site and unloaded

by hand.

+ Conductors, of large volume are transported by car of 5 tons to construction site

and unloaded or load by crane of 5 tons.

+ Concrete poles bought in Ha Noi or Yen Bai are transported by specialized

KMA T of 7,5 tons to construction site and unloaded/load by crane of 5 tons, one

trip carried 6 pole section, unloaded or load by crane of 5 tons. Poles are located

gathered to~ether in ROWand transported along ROW by hand and motorcycle.

+ Other materials such as : spare parts, transverse beams ... are exploited and

transported from Ha Noi by truck of 5 tons to construction site and unloaded or

loaded by hand.

+ Cement is bought in districts, transported by truck of 5 ton to construction site

and unloaded or load by hand.

+ Sands and stones are bought in involved districts, 20 km away, transported by

truck of 5 ton to construction site and unloaded or loaded by hand.

2.6. Methods estimates of transportation equipments, materials to construction site

+ Cement and electric materials, equipment are transported to construction site

from close stores along ROW with average interval transportation distance:

750 m ofMV lines.

+ Centrifugal concrete poles are transported by improved cart and by hand to

construction site with average interval transportation equal to that for cement.

3. INSTITUTIONAL AND LEGAL FRAMEWORK The report on environment impact are prepared basing on:

The Government of Viet Nam promulgates laws and regulations on environment

protection. These include:

- The constitution of Viet Nam on April, 1992 confirms that state -owned

company, GOV's bodies, cooperations, national defense units have responsible for

implementing policies on environment protection to ensure reasonal use natural

resources and protect environment protection.

• The Environment protection Law on 29 November 2005, revised and adopted by the

National Assembly and replaced for 1993 law, which clearly specifY the

responsibility of central governments, organizations, individuals to prevent

environment recession, meanwhile carry out specific functions of environment

protection.

• The Law of Forest Protection (1992) regulates management; protection development,

exploitation of forest, prevention of trees cuttin , forest destruction.

• GOV's Degree No 80/2006 ND-CP dated 9th, August, 2006 stipulates in detail on

implementation guiding of The Protect Environment Law replaced on 2005.

• GOV's Degree No 21/2008 ND-CP dated 28 th, February, 2008 of the Government on amending and supplementing some articles of Decree 80/2006/ND-CP dated 9th

The TlLs would go through plain with rice and crops. The hydrography network is mainly Ditch irrigation canal in area. The annual flow scheme is divided in to 2 seasons: rainy and dry season. • In dry season, streams have little water. • In flood season (rainy season): Because of high rainfall and flood there

are plenty of waters in streams. Sometimes erosion/landslide happens. Rainy season are in May, June, July, August.

In project area, underground water is plentiful. Depth of underground is from 0,5 1,0 m. However, in project area a clay stratum is thick, so

During construction, quantity of land digged to set up site of MIV poles is: 732 m3

• The areas spilled are allowed by local authorities. The soil excavation is carried out in dry season and is not implemented on rainy season to avoid erosion. Depth ofMIV poles foundation is minor (under 1,5 m) and soil grade of this area is 3-4. Thus risks of land are not considered. It is meant that lands are not eroded.

There are no impacts. Design is in compliant with technical design sti£ulations

Project location is not near any airports. And construction of the column height is less than 50 meters, so it will not affect the aircraft.

Some trees should be cut. But these trees common category such as industrial crops and fruit trees.

Some species of insects and small animals will lose habitat the species is common. Loss of ecological regions small compared to the entire ecosystem is affected. The main ecosystems affected by the Project is agricultural, industrial plantation forests, bushes along the way... i

The figures given in the table above also helps us envision the potential for soil erosion and surface water turbidity caused by erosion. The impact of the project to plant include the impact of temporary and permanent. No portion of the grid through good forest areas, some of the grid can pass through forested areas of poverty, regeneration, sparse. 4.2. Impact on protected areas

4.2.1 Impact Cultural- history Thac Ba

General information about the culture - History Thac Ba

Conservation status

Thac Ba lake has an area of 19.050 hectares large and includes many small islands. Thac Ba is fonned after the Chay River dam built in 1970 (Anon. 1998). Thac Ba is recognized as historical national scenic by Decision No. 2410 - QD NH on 27/911996

Cultural - History Thac Ba is SUF Decision No. 194/CT, on 09108/1986, chainnan of the Council of Ministers (MARD 1997), with an area of 5,000 ha. Establish the purpose of Cultural - History is to protect the lake basin and the natural habitats of birds. Until now the cultural - historical Thac Ba may have an investment project. In the list of proposed system of special use forests in 2010, cultural - historical Thac Ba is an area of 20,000 ha, including 10,594 ha of forest

Topographic and hydrographic

That Ba lake is located on the Chay river, running parallel to the Red River to the east. The difference in elevation between the river upstream and downstream of the lake is 130 m (Scott 1989). Lake over 80 km in length and width to 8 km, though the lake level has many prominent nose, small pool for the width of the lake shrunk considerably. Ho has many

small islands and is surrounded by steep slopes.

Biodiversity

Chay river before dam construction, this area is covered by lowland evergreen forest, has resources of animal 1 vegetable rich. Since the dam was built, most of this forest area was lost, the current vegetation here is mainly planted. Thac Ba is a prominent type of habitat that is the reeds and grasslands grassland forests. Thac Ba is considered the place of wintering or stopover sites for many important species of migratory waterfowl (Scott 1989).

Conservation issues

Deforestation in the area of the lake basin has increased the current increased soil erosion. Estimated 535 million tons annually mud poured into the lake. Results of the sedimentation area of the lake is shrinking serious inability to provide water for hydroelectric power in the dry season. In an effort to reduce the phenomenon of sedimentation of the lake, planting activities have been conducted on an area of the lake to save polar (Scott 1989).

Other values

Thac Ba is an important economic functions, including regulating water flows for agriculture, power production. They also provide an important source of seafood for local communities (Scott 1989). Fish caught from the lake each year is 55 tons (Ann. 1998). Thac Ba is also potential for tourism activities, rest and recreation. Thac Ba is one of the SUF countries for 2010 (FPD).

The data outlined above description of the components, the project activities carried out in six communes in the Cultural - History Thac Ba. Environmental impacts of the project to this area is completely similar to the overall impact of the project are described in Table 4.2.1. Rural energy projects primarily construction and power lines along the roads to the commune. Number of trees being cut to create a safety corridor is the species mainly bamboo and fruit trees giang. The project does not occupy land or cut trees in the dense forest location or level of dense vegetation cover.

The total number of temporary and permanent land occupied by the project in the area of Thac Ba is 6463.8 m2. Compared with the total area of Culture - History Thac Ba is generally small (less than 0.003%). Such policies do not violate the OP 4:04 Safety of WB about the natural areas of residence.

The mitigation measures proposed in the environmental management plan are adequate to control and mitigate the impacts of the Project to the social environment in this sensitive area in terms of biodiversity. .

5. PUBLIC CONSULTATION AND INFORMATION ANNOUNCEMENT

In preparation for the project (2009), has implemented the following activities: Action 1: Learn and discuss with the Government and local authorities on construction sites Action 2: Investigation and Statistics of the effects Action 3: Hold meetings with affected households.

After completing the investigation, consulting firm for the project must be conducted to inform local people and villages affected by the project activities. Notice given by announcement widely among the people. The announcement must inform the following people especially in the communes of the project:

- Other general information: Name of the project, the investor, the scope of the project, names of districts and communes in the project;

- The environmental impact can be caused by the activities of the project; - The mitigation measures used to reduce the environmental impact; - Plan for project implementation. - Address to receive the contributions of individual communities on

environmental issues related to the project. This activity was done during June 2009 in all districts and communes of the

project. Representatives of the following organizations were invited to participate in meetings and public consultation:

• Households affected by the project; • Committee of the Fatherland Front • Women's Union; • Youth Union; • Farmers' Union • Veterans; • People's Committee; • The agencies artd other interested organizations.

The main comments received from the public consultation phase is summarized

- Rural electrification in the province is very poor quality, does not meet the needs of the people use electricity, so people very happy if the project is done. People will support the project owner and the best contractors to build the project implementation; - The project may cause some environmental impacts such as noise, dust, but the scale and extent of impact is generally small and can be acceptable; - Local people willing to join the project owners, construction contractors to manage environmental issues of the Project; - The construction contractors should be committed to cleaning up, returning to the land surface by borrowing for construction projects; - Measures minimize environmental impact proposed to avoid Noise, avoid dust should be strictly implementation during construction transported materials.

- List of priority issues final report

- List the progress of each problem solving done by the Contractor.

- List all issues not resolved in a satisfactory way, and make recommendations

Results of the environmental management activities during the reporting period:

- Report on the mitigation measures in environmental management plans at

construction sites (SEMP).

- Measures to reduce this to achieve the goals or not? If not, why not? The

explanation must be clear and complete.

The conclusions ofthe reporting period:

- List all priority issues discovered during this reporting period.

- Provide suggestions for each problem that contractors need to be addressed. For

issues that can not resolve the need to clearly explain Why ..
