ELECTRONIC HOME MONITORING
DEFINITION
• REVISED CODE OF WASHINGTON 9.94A.030 (28) “Home detention” means a program of partial confinement available to offenders wherein the offender is confined in a private residence subject to electronic surveillance”.
COST
• Rental of equipment (WASPC $5.75 - $20.00 per day depending on type of equipment)
• 2 Full time Probation Officers / staff ($66,565 average salary)
• 60 Offenders per day maximum (21,600 days per year of EHM)
• 21,600 days per year of jail at $120.00 per day for instance = $2,529,000.00
WHO?Misdemeanants: Low level offenders unlikely to reoffend
or interfere with administration of justice during the course of their confinement.
DOC: Use GPS (passive) monitoring of Level 3 Registered Sex offenders coming out of prison and into community for the first 30 days (can be extended with approval of supervisor). Also can be used for Level 2 / 3 sex offenders if unstable housing or unstable employment, lack of program / structure or activities in the community, or for extraordinary medical placement (ie elderly). Offenders can be charged for GPS if financially able. Not used for probation violation sanctions.

• To restrict their movements and hold accountable for criminal activity

DEFINITION
Day Reporting per RCW 9.94A.030 (16) "Day reporting" means a program of enhanced supervision designed to monitor the offender's daily
activities and compliance with sentence conditions, and in which the offender is required to report daily to a
specific location designated by the department or the sentencing court.

speakers and activities about life skills training for misdemeanant defendants
who are sentenced to one of the following:

COURT DATE NOTIFICATION
DEFINITION
• A notification system that reminds an individual of a pending court date including the location, date and time. A process much like a doctor’s or dentist’s office practices.
TYPES OF NOTIFICATION
• WRITTEN: Currently in Spokane, individuals are given a written notice of their court dates by mail or in person.
• PHONE CALL / EMAIL: In some jurisdictions, either a court employee, an automated system or a private vendor will call the individual a day or so prior to the Court hearing and remind them of their court date.
PURPOSE
• To reduce the number of individuals that miss their court dates, resulting in a delay of the process or resulting in a warrant where the individual is eventually arrested and incarcerated for missing the court hearing. Some jurisdictions boast a reduction of up to 52% in their failure to appear rate by using a court notification process.
COST
• Salary of personnel to make the call / email • Cost of contracting with a private vendor
(prices vary and cost could be charged to the individual)
LEGAL FINANCIAL OBLIGATIONS
DEFINITION
• RCW 9.94A.030 (30) “means a sum of money that is ordered by a Superior Court of the State of Washington for legal financial obligations which may include restitution to the victim, statutorily imposed crime victim’s compensation, fees as assessed pursuant to RCW 7.68.035, court costs, county or interlocal drug funds, court appointed attorneys fees…”
PURPOSE
• To hold the offender financially accountable for his / her crimes.
• To minimize the cost to the tax payers.• To be financially responsible for the cost to
the victims.
PRACTICE IN SPOKANE• Fees assessed by the Superior Court• Contact with the clerk’s office within 24 hours of release to complete a declaration
of financial information and establish a payment plan. • Review set for one year. If no payments or in arrears, a notice is sent to the
offender to contact the clerk’s office. If no appearance or the letter is returned, a warrant is issued. Delinquent accounts are not sent to collections.
• Can be sentenced up to 30 days for each violation. • Currently, there is an average of 19 inmates per day incarcerated for failing to pay
LFO’s (source: 2012 Spokane County Essential Public facilities presentation) • A large number of these inmates sign agreed modification of sentence without
having a hearing or having a Judge make a financial determination of ability to pay. • If seen by a Superior Court Judge, a decision is made to either impose jail as a
sanction or reset the offender back on a time payment plan. If the offender becomes immediately current with what is overdue, jail is suspended and they are put back on a time payment plan.
ALTERNATIVE OPTIONS
• Send fees to collections if unpaid.• Complete work crew, community service or some
other jail alternative in lieu of money owed. • Explore job placement coaching to gain
employment as means to begin paying LFO’s.• Hold administrative hearings before an offender
becomes too delinquent on their payments to review and reset time payments based on current circumstances, prior to the point of issuing warrants or holding violation hearings.
