Purpose The purpose of this document is to provide and explain procedures for the dissemination of emergency information by the appropriate broadcast, cable, and government officials during threatened or actual emergencies.

Authority

Title 47 of the Code of Federal Regulations (CFR) deals with the Federal Communication Commission (FCC) Rules and Regulations. Part 11 of CFR Title 47 gives the authority for and regulates the operation of the Emergency Alert System.

Introduction This plan was developed by the Kansas State Emergency Communications Committee, in cooperation with the Kansas Division of Emergency Management, the Federal Communication Commission, the National Weather Service in Dodge City, Goodland, Topeka, Wichita, Hastings, NE, Pleasant Hill, MO, Springfield, MO, state and local officials, and the broadcasters and cable operators of Kansas. It provides background data and prescribes specific procedures for the broadcast and cable media to issue emergency information and warning to the general public in Kansas. Acceptance of, or participation in this plan shall not be deemed to prohibit a licensee or cable operator from exercising independent discretion and responsibility in any given situation. The concept of management of each broadcast station or cable system to exercise discretion regarding the transmission of emergency messages and instructions to the general public as provided by the FCC Rules and Regulation, Part 11. Broadcast stations and cable systems originating emergency communications under this section have conferred rebroadcast authority of the other participating broadcast stations and cable systems that receive their emergency communication, as specified in Section § 11.54 (d) of FCC Part 11. EAS Local Operational Area Plans will detail local EAS procedures agreed upon by the broadcasters, cable systems, and local governments. These local EAS plans will be included as Annexes to this plan.

General Considerations

The listening and viewing habits of the general public are inherent factors of consideration and are conducive to the positive effectiveness of the Kansas EAS. The instinctive reaction of the average person is to turn on his/her radio or television set in time of emergency. However, continued public education is required to increase public awareness of the Kansas EAS network as an established medium for the receipt and/or distribution of emergency information to the general public at the local, state, and national levels.

Definitions Designated Government Officials: The person or persons designated as government signatory to this procedure to request activation of the EAS and to make emergency announcements (see Annex A).

Emergency: A situation posing an extraordinary threat to the safety of life and property. Examples are, but not limited to, natural situations such as tornadoes, flash floods, icing conditions, heavy snows, widespread fires; and manmade situations such as discharge of toxic gases, widespread power failures, industrial explosions, civil disorders, and nuclear incidents.

Local Primary (LP): The local area broadcast station which provides the National, State, and local EAS message to the other broadcast stations and cable systems within its local area.

National Primary (NP): Broadcast station that provides the Presidential or other national EAS activations and programming, including broadcast stations involved with the PEP system and EAN Networks. Participating National (PN): Broadcast stations and cable systems which monitor either national, state, or local EAS message inputs and directly feed National EAS messages to the public. Primary Entry Point: Key broadcast stations throughout the U.S. which together can provide national emergency information in the event that the primary national alerting methods are inoperable.

Severe Weather Warning: A severe weather WARNING indicates that a particular severe weather storm has actually been sighted in an area or indicated by radar, and serves notice to the public that severe weather conditions are almost certain to occur. Severe Weather Watch: A watch is issued when weather conditions are favorable for the development of severe thunderstorms that are capable of producing large hail, damaging winds or tornadoes. A watch does not mean that the severe weather is actually occurring; only that conditions have created a significant risk for it. If severe weather is imminent, a warning will be issued. State Primary (SP): The primary broadcast station which transmits State of Kansas and National EAS messages. These messages can originate from the Governor or a designated representative or the National Weather Service. The EAS messages can be initiated in the State Emergency Operation Center (SEOC) or from WIBW-FM radio station. Messages are sent via the Kansas Information Network (satellite) or the State Relay Network to the LP stations for further rebroadcast in the Local EAS Operational Area.

State Relay: An entity which receives and retransmits EAS activations. The entity serves as a link in the State Relay Network and assists transmitting a state activation to all local EAS areas.

Concept of Operation A. Kansas EAS system uses the Kansas Information Network (KIN) satellite network to

simultaneously communicate the National and/or State EAS message to the Local Primary stations. The KIN network is operated by WIBW-FM, the State Primary.

B. The State Relay (SR) network serves as a backup to the satellite network (see Annex D). The

relay network is a web structure initiating from WIBW-FM and KTPK-FM stations. The network fans out across the state in four tiers or hops from one State Relay station to the next. Each SR station monitors at least one of the upper tier stations and rebroadcasts the EAS message. The State Relay or KIN supplies the National and State EAS messages to Local Primary Stations.

Methods of Access for System Activation

A. State Activation Kansas EAS is activated by a request from authorized officials to the State’s EAS State Primary (SP). The State Emergency Operation Center (SEOC) and WIBW in Topeka are key with respect to activation of the EAS at the State level. State Relay stations monitor the SP in accordance to the Kansas EAS State Relay Network Plan (see Annex H). The functioning of this network of state relay station is key to the successful dissemination of State level EAS emergency information.

B. Federal Activation Access to the nationwide EAS network by Federal authorities is achieved by Federal interface with radio stations, television networks, participating subject cable systems, communications common carriers, wire services, and other participating organizations. The Federal EAS message is sent to WHB-AM, a Primary Entry Point (PEP) station, which is monitored by WIBW-FM (SP) and KTPK-FM (SP-1). The Federal EAS message is then relayed to the Kansas public via the Kansas EAS Relay System.

C. County/Local Activation Operational area and/or individual Counties’ EAS activation procedures are defined in Local EAS plans. Each Local Operational Area is encouraged to establish a Local EAS Plan for use of the broadcast and cable media for distribution of emergency information to the general public. The procedures contained in this document do not pertain to county or local governmental operations.

The Kansas Planning Standards outlines requirements for county emergency operations plans Emergency public warning and notification is the responsibility of local governments, with requirements for county emergency operations plans outlined in the Kansas Planning Standards in the ESF 2 – Communications annex. The planning standard requires counties to identify an agency responsible for notifying the public in their respective county emergency operations plans. Typically, county emergency operations plans indicate that local officials will go door-to-door or use an alerting system that provides notifications in multiple languages to assure that individuals with access and functional needs are notified. If a county needs assistance with conducting door-to-door notification or other alternative notification methods as the result of an emergency or disaster, assistance may be requested from the state, as outlined in the Kansas Response Plan.

D. National Weather Service Activation

Standard Operating Procedures (SOP) prescribe that the NWS notify KDEM of any watch or warning which affects all or part of the State of Kansas. This is accomplished by dissemination through the National Weather Wire Service, the state-side of the National Warning System (NAWAS), and/or via the state’s 800 MHz radio system. Although the likelihood of a statewide watch or warning may be slim, there may be occasions when a weather watch or warning would affect more than one EAS operating area.

Communication Links between Kansas Division of Emergency Management

B. The National Weather Service is authorized to make state-level activations to disseminate severe weather alerts.

C. The Kansas Bureau of Investigation is authorized to make state-level activations to disseminate AMBER Alerts. Additional information about the Kansas AMBER Plan may be found online at http://www.ksamber.org.

Activation Procedures for Governor Designee

I. Procedures for State Activation

1. Request activation of the EAS facilities through Kansas Division of Emergency Management or the State Emergency Operations Center, using prearranged authentication procedures (see Annex C) as soon as possible.

2. Identify program details (i.e. live or recorded, immediate or delayed) with State

Primary.

3. Authorized officials use the following format when delivering the emergency announcement.

a. “This is ______________ of __________________ with a request to activate

the (name/title) (jurisdiction)

Kansas Emergency Alert System. I authenticate as follows: ____________________________________.”

b. Situation summary (describe the nature of the emergency). Tell the operator, the areas of the state to be alerted. (Note: Unless otherwise instructed, the EAS message will be sent statewide.)

c. Instructions or message to the public. Read the warning message which may be up to 90 seconds. Indicate the time period the message is valid using

increments of 15 minutes. Indicate the time period between replaying the message in 15 minute increments. (Note: The State Primary records these messages to be replayed).

d. Indicate actions being taken by state and/or local governments. If the message is longer than 90 seconds, a press conference can/should be scheduled to explain response actions. This should be articulated in a brief 90 second summary as to where and when residents can tune in emergency information on actions being taken by state and/or local government(s). Note: Use channel frequency, avoid call letters. It is understood that more than one EAS Message may be necessary in large disasters.

4. Keep line open if necessary.

5. Issue End of Message (EOM).

II. Procedures for the State Primary (SP) Station, EAS Broadcast Stations and Cable Systems. 1. Upon receipt of a request to activate EAS at the state level, the duty operator at

WIBW-FM (State Primary source) will authenticate (see Annex C), record the emergency message, verify that the message is for statewide distribution, enter proper header codes in the EAS encoder and proceed as follows:

a. Transmit the following announcement:

“WE INTERRUPT THIS PROGRAM TO ACTIVATE THE KANSAS EMERGENCY ALERT SYSTEM AT THE REQUEST OF _____________ AT __________________.” (authority and time)

b. Transmit the Emergency Alert System header codes and Attention signal: (FCC Regulations, Section § 11.51).

c. Transmit the following announcement:

“WE INTERRUPT THIS PROGRAM TO ACTIVATE THE KANSAS EMERGENCY ALERT SYSTEM AT THE REQUEST OF _____________ AT ________________”. (authority) and time)

d. Make the emergency announcement. Repeat as necessary and include the source of information and the time received.

e. Transmit the EAS End of Message (EOM) code (See FCC Regulations, Section § 11.31). Note: the EOM is placed automatically after the two minute audio message.

2. Each broadcast station and cable system, upon receipt of a State level emergency

action notification will, at the discretion of management perform the same procedures as outlined in B1 above, including recording all emergency messages.

3. To avoid unnecessary escalation of public confusion, all broadcast stations and cable

systems must be cautious in providing information and news pertaining to the emergency. All messages must be based on definite and confirmed facts. The public must not be left to decide what is or is not factual.

4. Upon completion of the above transmission procedures resume normal programming.

Appropriate notations should be made in station and cable records and logs of all significant events. These records should be carefully preserved in the event they are required at some later date (FCC Regulations, Section § 11.55). Stations and cable systems may send a very brief summary to the FCC for informational purposes.

5. If operations were not concluded as specified in B.1.e. above, upon receipt of the

termination notice from the activating official, make the following announcement and transmit the EOM code:

“THIS CONCLUDES OPERATIONS UNDER THE KANSAS EMERGENCY ALERT SYSTEM. ALL BROADCAST STATIONS AND CABLE SYSTEMS MAY NOW RESUME NORMAL OPERATIONS.” (Repeat announcement).

III. Delivery of EAS Messages by Cable Operators 1. The FCC requires all wired cable systems that serve 10,000 or more subscribers to

install EAS equipment and provide EAS audio and video messages on all channels by December 31, 1998.

2. The FCC requires all wired cable systems that serve 5,000 or more subscribers, but

fewer than 10,000 subscribers to install EAS equipment and provide EAS audio and video messages on all channels by October 1, 2002.

3. The FCC requires all wired cable systems that serve fewer than 5,000 subscribers either to provide the national level EAS message on all programmed channels – including the required testing – or to install EAS equipment and provide a video

interrupt and audio alert on all programmed channels and EAS audio and video messages on at least one programmed channel by October 1, 2002.

4. The FCC requires that wireless cable systems participate in the EAS on the same

basis as wired cable systems.

5. The FCC declines, however, to require participation by Satellite Master Antenna Television (SMATV) and Open Video Systems (OVS) in the EAS at this time.

IV. Monthly Test 1. Statewide test of the Kansas Emergency Alert System:

The Required Monthly Test (RMT) is designed to check the State EAS Web links. The Kansas Emergency Communication Committee has set forth that the RMT will be a statewide test. The RMT is prescheduled and will be initiated from WIBW-FM, the SP. All stations need to rebroadcast the RMT as soon as possible but not later than 15 minutes after receipt. In Kansas, all broadcasters are at most only one station away from a WIBW-FM/or a “KIN” affiliate.

Required Monthly Test Schedule Odd-numbered months: Second Tuesday of the month at 1:52 p.m. Even-numbered months: Second Tuesday of the month at 1:52 a.m.

2. The required monthly test audio must be aired as received and stored by your EAS

unit. Stations should not send their own tests generated by their EAS unit. This will cause additional messages to be re-sent by stations monitoring you. It is important that all stations broadcast the same message so it will have the same “Header Code”. Duplicates of a previous message having the same header code “Day-Date-Time”, will not be re-broadcast by the EAS equipment.

3. The following test script is recommended for use during required monthly test.

“THIS IS A COORDINATED MONTHLY TEST OF THE BROADCAST STATIONS OF YOUR AREA. EQUIPMENT THAT CAN QUICKLY WARN YOU DURING EMERGENCIES IS BEING TESTED. IF THIS HAD BEEN AN ACTUAL EMERGENCY SUCH AS (SEVERE WEATHER WARNINGS: INSERT TYPES OF EMERGENCIES THAT MAY OCCUR IN THE GEOGRAPHIC AREA), OFFICIAL MESSAGES WOULD HAVE FOLLOWED THE ALERT TONE. THIS CONCLUDES THIS TEST OF THE EMERGENCY ALERT SYSTEM. THIS STATION SERVES THE STATE OF KANSAS.”

4. Follow-up of a Failed Monthly Test

Upon discovering a failed test, you are required to call the transmitting station and discover the cause of the failed test. It is the responsibility of the stations on both ends of the link to ensure the EAS Monthly Test is transmitted and received successfully.

V. Weekly Test 1. The weekly test ensures that station to station links are up and running. Each station

is required to originate and log their weekly test. Each station is also required to monitor and log receipt of weekly tests from both of their monitoring assignments. The print out should be attached to your station log for that day. A weekly test should be sent at various times of the day or night and should be sent on various days of the week including weekends.

2. Follow-up of a Failed Weekly Test

Upon discovering a failed test (i.e. weekly test not received), you are required to contact your monitoring source and discover the cause of the failed test. It is the responsibility of stations on both ends of the links to ensure the Weekly EAS Test is transmitted and received successfully.

VI. Severe Weather Awareness Week Early in March, the National Weather Service and the County Emergency Management Coordinators gear up for Severe Weather Season. The Severe Weather Spotters attend training to review correct spotting techniques. The communication systems and warning system, such as the Tornado sirens and also the Emergency Alert System (EAS) are tested. The most assured way to check the EAS links is for the National Weather Service to send an agreed upon code during the state wide Tornado test. The National Weather Service is the lead agency for this test. The National Weather Service will coordinate with the Emergency Management Coordinator and broadcasters as to whether the test will be organized state wide or on a regional basis. Contact the National Weather Service Office that services your area for specific information.

Reporting EAS System Changes or Problems Any changes in the monitoring assignment need to be coordinated through the Kansas State Emergency Communication Committee. Problems receiving weekly and monthly test that are unable to be resolved need to be reported to the KSECC within 30 days of occurrence. The KSECC needs to know where the EAS links are incomplete and will work to coordinate a solution. These concerns can be forwarded to the Kansas Division of Emergency Management, attention the KSECC.

Plan Review Requirements This plan recognizes that the components of the EAS network are dynamic in nature. The KSECC conducts ongoing research and development of communications capabilities across the state in conjunction with the broadcasters, cable system operators, Kansas Division of Emergency Management (KDEM), Federal Emergency Management Agency (FEMA), Federal Communications Commission (FCC), and other interested parties. Needs, facilities, and technology all change with time – these changes require periodic review of this plan to ascertain the adequacy and appropriateness of the various system parameters. The Kansas State Emergency Communications Committee in conjunction with the broadcasters, cable system operators, KDEM, FEMA, FCC, and other interested parties will review this plan annually and revise the plan every 3 years. The KSECC in conjunction with the broadcasters, cable system operators, Kansas Division of Emergency Management (KDEM), Federal Emergency Management Agency (FEMA), Federal Communications Commission (FCC), and other interested parties will review this plan every three years. Changes to the network configuration and/or this plan will be coordinated by the KSECC. All participants of Kansas EAS network will be advised of these changes. Any entity participating in this plan is invited to provide written feedback as desired.

Annex C Authentication Procedures to Activate the Kansas EAS

This Annex and its Annex must be located and stored near the Access Control Operator (ACO) and be readily available for use. Purpose The procedures described herein are intended to:

1. Provide the State Primary with the means to identify the request officials authority to activate the statewide EAS network.

2. Provide the State Primary with a mechanism that safeguards the integrity of the EAS network.

Types of Authentication The three types of authentication are: 1) Personal acquaintance and/or recognition; 2) Authentication code; and 3) Encoded EAS message sent from the State EOC. Use of Authentication Procedures

A. “Personal recognition” authentication is appropriate and adequate:

1. When the official requesting activation is face to face with the ACO;

2. When the ACO readily recognizes the identity of the requesting official.

B. “Authentication Code” authentication is the default method of verifying the requesting official’s authority to activate the EAS Network. When the ACO is unable to verify the authority of the requesting official through the above method of authentication, the ACO must ask for (and receive) the correct authentication words (See Annex 1, Annex C). Should the ACO receive an incorrect authentication word, the requesting official will be denied access/activation of the EAS network.

C. If the EAS message is sent via the assigned monitoring station, (i.e. Kansas Emergency Operations Center via Remote Pick Up (RPU), National Weather Service or National Weather Service, or National Primary), it is assumed to be a closed system, no further authentication is necessary.

Termination Authentication procedures apply for both activation and termination of the EAS network.

Annex J Integrated Public Alert and Warning System (IPAWS)

During an emergency, alert and warning officials need to provide the public with life-saving information quickly. The Integrated Public Alert and Warning System (IPAWS) is a modernization and integration of the nation’s alert and warning infrastructure and will save time when time matters most, protecting life and property. All EAS participants are required to monitor IPAWS. Federal, State, territorial, tribal and local alerting authorities can use IPAWS and may also integrate local systems which use Common Alerting Protocol standards with the IPAWS infrastructure. IPAWS provides public safety officials with an effective way to alert and warn the public about serious emergencies using the Emergency Alert System, Wireless Emergency Alerts, NOAA Weather Radio, and other public alerting systems from a single interface. Additional information about IPAWS and how to apply for public alerting permissions can be accessed online at http://www.fema.gov/integrated-public-alert-warning-system. In addition, Kansas Division of Emergency Management has established an internal directive for vetting and approval of local IPAWS public alerting authorities.

Federal Communications Commission Regarding Multilingual EAS Practices in Kansas May 3, 2018 Gregory M. Cooke Deputy Chief, Policy and Licensing Division Public Safety and Homeland Security Bureau Federal Communications Commission 445 12th Street SW Washington, DC 20554 Dear Mr. Cooke, As requested, I am providing a summary of information received from EAS participants who responded last fall with information about multilingual EAS practices by stations in Kansas. This letter will serve as an amendment to our State EAS Plan. Of the stations that responded: 0.5% currently transmit alerts in both English and Spanish 1.0% have capability of text alerts in English or Spanish – depending on which is sent 1.0% plan to transmit multilingual alerts in the future 97.5% currently do not transmit multilingual alerts, nor have any plans to According to the U.S. Census Bureau, 2009-2013 American Community Survey, 5% of the Kansas population over 5 years of age speak English “less than very well.” I have also been informed that neither the Kansas Division of Emergency Management, nor the Kansas Bureau of Investigation (AMBER Alerts) nor the National Weather Service Field Offices in Topeka, Dodge City and Wichita issue alerts in languages other than English.
