NOTICE INVITING TENDER

PRESS NOTICE

Short Notice Inviting Tender

Sealed item rate tenders are invited on behalf of EPFO for the work of

Designing, Manufacturing, Supplying and Installation of Modular and Standard

Furniture (Workstation, Pedestal Units, Keyboard Trays, Compactors, Tables,

Chairs, sofa, Partitions and other items) at E.P.F.O, S.R.O, Tinsukia. The

estimated cost of tender is 38 lakhs (approx). Time allowed for supply and

Installation of all items will be 30 days. The Complete Tender Document shall be

submitted up to 02.09.2015. All other details like EMD, Cost of tender Document,

terms and conditions, eligibility, last date for submission of Technical and

Financial bids etc may be seen on the EPFO website www.epfindia.nic.in or can

be obtained from this office.

TENDER -NOTICE No:

Sealed bids in two packet systems are invited from experienced technically and financially

sound reputed Manufactures of Modular Office Furniture / Compactors on Rate contract for

supplying and fixing of Modular Furniture / Compactors at S R O, Tinsukia. The rate contract

shall remain valid for one year from the date of the Rate Contract.

A) Eligibility Conditions:

Manufactures who will be able to meet the following criteria are only eligible to apply:

a. Manufactures should have at least Five years experience in manufacturing of Modular

Furniture (Supply orders should be enclosed).

b. Manufactures should have average annual gross turnover of Rs. Eight Crores per annum

in last three complete financial years in the field of Modular Office Furniture (Audited

Balance Sheet to be enclosed)

c. Manufactures should be a profit-making firm and should not have made loss in the last 2

years or any three out of last 5 financial years.

d. Bidders should have carried out three similar works of Modular Office Furniture of

value not less than one crores EACH in last 04 years ending 31th March 2015. At least

two completed work should have been carried out in Govt. /Semi Govt. /Autonomous

Organizations/PSUs and authenticated by officer not below the rank of Executive

Engineer. Private Sector work experience should be supported with copy of relevant

TDS certificate.

e. Manufactures will agree/undertake for comprehensive warranty for Supplied / Fixed

items for one year and three years post warranty service and maintenance under AMC.

f. The tender shall clearly specify whenever the tender is submitted on his own or on

behalf of partnership concern. In later case, the certified copy of partnership deed be

submitted along with technical bid.

g. Supply of material will be 30 days from the date of placing the order by EPFO office.

The bidder must note that the successful bidder should give a performance guarantee in

the form of bank guarantee amounts to 5% of the order. The performance guarantee

should be furnished after order for supply is placed, and should be valid up to expiry of

the maintenance period.

h. Successful bidder shall be required to make layout plan of Office and would be required

to supply the material as per the plan.

B) Sale of Bid Documents:

A complete set of Non-transferable Bid documents can be downloaded from EPFO/SRO

website www.epfindia.nic.in, www.epfindia.com . In case tender form is downloaded from

website, the technical bid must be accompanied by a non-refundable DD/Pay Order for Rs.

5000 as bid processing cost and it should be kept in separate third cover mentioning on top as

'Bid Processing Cost'.

Last date of Submission of Tender: Complete bid (a single sealed envelop contained two

separate such sealed envelopes of technical bid & price bid quoted on top of Envelope) must be

submitted in the tender box to the above referred address on/or before 02.09.2015 at 4:00 PM.

Any Bid received after the prescribed deadline in a sealed box kept at the above mentioned

address will be returned unopened/rejected. Late received bids offer, down loaded bid without

bid-processing fee will be rejected unopened.

Bids in sealed condition shall also be received by Post/Courier, provided that the bid (Tenders)

is received/ delivered, before stipulated date and time (as per above mentioned conditions) in

Tender box. EPFO shall not be held responsible for the delay in delivery of the bid to the above

mentioned EPFO office or in case of non-receipt of the bid.

The technical bid must accompany following mandatory requirements: EPFO.

a. EMD of Rs. 76000 in the form of DD/Pay Order in favour of 'The Regional Provident

Fund Commissioner, payable at Tinsukia in the envelope containing Technical Bid b. Documents evidence of execution of work and turnover as mentioned above. c. Factory act registration certificate. d. EPF/ESIC Registration certificate. e. Excise Registration certificate f. Submitted Income Tax Return for the year 2014-15 and 2013-14. g. Document confirming that bidder is Certified with ISO 9001 : 2000 , ISO: 14001:2004 &

OHSAS 18001: 2007 h. Supported documents (mere affidavit shall not be treated as proof of possession) to

confirm following plant & machinery to execute the work (like CA's Certificate along with

Financial Statement & Photograph.

(i) Computer controlled multi stationed through feed edge banding machine capable of

gluing, flush trimming, scrapping end trimming in one feed Operation.

(ii) Hot press for laminated pressing.

(iii) CNC controlled press from brake for Sheet Metal Bending.

(iv) Conveyorised Powder Coating Plant with pre treatment.

i. Company Profile and Form A to F as supplied with tender/documents Bid. j. Demonstration of the quoted items will be the part of the technical bid. Bidders shall have to

erect one sample of full height Partition. Workstation and Module of compactor, chairs each

as per BOQ/drawing specifications at the site as makes up/sample item. The price bid of

only those bidders will be opened whose mock up/sample items are found as per BOQ

item/drawing/specification and approval by

Validity Period:-

Tenders / bids shall remain valid and open for a period of 4 months from the date of opening

of technical bid. Offers/Price bids or rates if offered valid and open for acceptance for a

period less than 4 months from the date of opening of tender will be rejected and EMD will

be forfeited.

Technical Bid:-

The cover containing 'Technical Bid' will be opened at the office of “The Employees Provident

Fund Organization, Sub Regional Office, Amar complex, hijiguri, Tinsukia - 786192.” in the

presence of the bidders present. Representatives if any, of the bidder (s) seeking to be present shall

submit a letter of Authority issued by the bidder on printed letter head. Any bid without any of the

above mentioned mandatory requirement if deposit and opened it shall be deemed disqualified and

thus summarily rejected. If the bid contains any such conditions or deviations from the bid

conditions, the bid will be rejected.

Financial Bid:-

It will be opened on 03.09.2015 at 3.00 pm at the office of 'The Employees Provident Fund

Organization, Sub Regional Office, Amar complex, hijiguri, Tinsukia - 786192.in the presence of

those bidders who are declared eligible in technical bid. In case any of the above mentioned dates,

becoming a non-working day, the tender shall be received / opened on the next working day at the

same venue and time. The rights to reject any item or entire tenders / bids at any stage or to cancel

the tender in process shall be reserved with the Regional P.F. Commissioner, EPFO without

assigning any reasons thereof.

Sir,

SUB: ACCEPTANCE OF EPFO TENDER CONDITIONS

(A) The tender document for the work of Designing, Manufacturing, Supplying and Installation of

Workstation, Pedestal Units, Keyboard Trays, Compactors, Tables, Chairs, Sofa, Partitions and

other items at S.R.O, Tinsukia, have been sold to me/us by EPFO. I/We have read and examined

the following documents relating to the work.

(a) Notice inviting tender

(b) General Conditions of Contract including Contractor's Labour Regulations, Model Rules

For Labour Welfare and Safety Code and forms of different deeds appended to these

Conditions. Amendments, Guidance to tenders.

(c) Special Conditions

(d) Special Technical Specifications / Supplementary Condition

(e) Drawings / List of Approved makes

(f) Instructions

(B) In consideration of I/We being invited to tender and promise by EPFO to consider the award of

work if I/We are found to be the lowest responsive bidder as stipulated in the conditions of

contract, I We agree to keep the tender open for acceptance for four months from the due date of

submission thereof and not to make any modifications is its terms and conditions which are not

acceptable to Employees Provident Fund Organisation. If the work is awarded the item rates will

remain valid for one year from the date of award by EPFO.

(C) A sum of Rs 76000 is hereby forwarded in the form of Demand Draft/Pay order is in favour of 'The

Regional Provident Fund Commissioner, Tinsukia EPFO as earnest money. If I/We fail to keep the

tender open as aforesaid or make any modifications in the terms and conditions of the tender which

are not acceptable to EPFO. I/We agree that EPFO shall, without prejudice to any other right or

remedy, be at liberty to forfeit the fully said earnest money absolutely and I/We shall not be

considered as unsuccessful tenderer for the purpose of return of earnest money as provided in the

Notice Inviting Tender. Should this tender be accepted, I/We hereby agree to abide by and fulfill all

the terms, conditions and provisions of the aforesaid documents. If, after the tender accepted, I/We

fail to commence the execution of the Works as provided in the Conditions. I/We agree the EPFO

shall without prejudice to any other right or remedy, be at Liberty to forfeit the said earnest money

absolutely and take suitable actions against me/us as deemed fit under the terms and conditions of

the contract.

I/We agree that should EPFO decide to forfeit earnest money as aforesaid unless a sum equal to

the earnest money mentioned above is paid by me/us forthwith, EPFO may at its option recover

it out of the deposit and in the event of deficiency, from any other moneys due to me/us or

otherwise.

If the tender is accepted, I/We agree that 10% security deposit shall be paid by me/us or EPFO

shall collect the same by deductions from my/our running bills as per conditions of contract.

After unconditionally accepting the tender conditions in it's entirely, it is not permissible to put any

remarks/conditions (except unconditional rebate on quoted prices if any) in / along with the tender

enclosed in "Cover No.2" and the same has been followed in the present case. In case, the provision

of the tender is found violated after opening "cover no.2", I/We agree that the tender shall be liable

to be rejected and EPFO shall without prejudice to any other right or remedy be at liberty to forfeit

the full said earnest money absolutely. The offer is valid for 04 months and I/We have been

awarded the works, the item rate contract will remain valid for one year from the date of acceptance

of award by E.P.F.O.

I/We hereby unconditionally accept the tender conditions of EPFO tender documents in it are

entirely for the above work unconditionally.

TECHNICAL BID DOCUMENT INSTRUCTIONS

1. All information called for in the enclosed forms should be furnished against the relevant

columns in the forms. If for any reason, information is furnished on a separate sheet, this fact

should be mentioned against the relevant column. Even if no information is to be provided in a

column, a "nil "or "no such case" entry should be mentioned/made in that column. If any

particulars/query is not applicable in case of the applicant, it should be stated as not applicable".

The applicants are cautioned that not giving complete information called for in the technical

document or not giving it in clear terms or making any change in the prescribed forms or

deliberately suppressing the information may result in the applicant being summarily

disqualified. Applications made by telegram or Fax and those received late will not be

entertained. 2. The application should be type written. The applicant should sign each page of the tender

Document. 3. Over writing should be avoided. Correction, if any, should be made by neatly crossing out,

initiating, dating and rewriting. Pages of the technical bid documents are numbered. Additional

sheets, if any added by the contractor, should also be numbered by him. They should be

submitted as a package with signed letter of transmittal. 4. References information and certificates from the respective clients certifying suitability,

technical know-how or capability of the applicant should be signed by an officer not below the

rank of Executive Engineer or equivalent. 5. The applicant may furnish any additional information, which he thinks is necessary to establish

his capabilities to successfully complete the envisaged work. He is however, advised not to

furnish superfluous information. No information shall be entertained after submission of tender

documents unless it is called for by the EPFO. 6. Any information furnished by the applicant found to be incorrect either immediately or at a later

date, would render him liable to be debarred from tendering/taking up of work in EPFO. If such

applicant happens to be enlisted contractor of any class in EPFO, his name shall also be

removed from the approved list of contractors. 7. The technical bid document in prescribed form duly completed and signed should be submitted

in a sealed cover and as prescribed in NIT. 8. The traders have to return the tender documents in original. The rates shall be quoted against

each item in the Performa of the schedule of quantities. 9. The rate quoted shall be firm throughout the contract period without any change.

10. The staff to be engaged on this work shall have full knowledge and experience of the work

in which they are engaged. The electrical/foreman shall have valid licenses for

corresponding trades. 11. The successful tenderer is responsible to provide the required manpower with qualified

persons to meet the requirements of the maintenance of the installation. The contractor shall

provide any cleaning materials required. Tools required for the maintenance shall be arranged

by the contractor (spanner set, cutting pliers pipe wrenches etc.). 12. Tenders with any incomplete/ambiguous details are liable to be rejected without seeking any

further clarification. 13. Any variation in the terms and conditions of the general/special conditions for payment,

security deposit, penalty (for not providing the staff) is not acceptable to Employees

Provident Fund Organization. 14. Tenderer is requested to submit their offer along with the following:

a. Tender documents received in original duly filled up with rates offered and duly signed.

b. Tender documents shall be submitted, in a sealed envelope addressed to 'The Regional

Provident Fund Commissioner, Employees Provident Fund Organisation, Tinsukia.

Superscripting the name of work, due date of opening etc before the closing time and date.

15. Tenders shall be valid for acceptance for a period of one hundred and twenty days from the

date of opening. 16. Employees Provident Fund Organisation reserves the right to award the work in full or part

as per the decision of the competent authority. 17. Employees Provident Fund Organisation is not responsible for any postal delay in receipt of

the application/receipt of tender documents etc. It is the responsibility of tender to make sure

the tender is received in time.

18. The tender shall be submitted in two-cover system. In cover No.1 (The earnest money deposit

has to be enclosed in the form of Demand Draft payable at Tinsukia in favour of the RPFC,

and acceptance letter duly signed along with all other document). In cover No.2 theprice bid

has to be enclosed. In case if EMD and acceptance letter is not submitted in cover No.1 the

Cover No.2 i.e the price bid cover will not be opened. 19. The contractor has to inform contact Telephone no. and the person to be contacted in case of

contingency / emergency. 20. The antecedents of the staff shall be got verified before engaging them for the work. 21. Prospective applicants may request clarification or the tender requirements &technical bid

documents. For guidance, A checklist is provided which should be returned duly marked, in

sealed envelop no.1

TECHNICAL BID DOCUMENT

GENERAL CONDITIONS

1. Singular & Plural: Where the context so requires, words importing the singular only also

include the plural and vice-versa. Headings and marginal notes to these General Conditions shall

not be deemed to form part thereof or be taken into consideration in the interpretation or

constructions thereof or of the contract.

2. Sufficiency of Tender: The contractor shall be deemed to have satisfied himself before

tendering as to the correctness and sufficiency of his tender for the works and of the rates and

prices quoted in the Schedule of Quantities which rates and prices shall, except as otherwise

provided, cover all his obligations under the contract and all maters and things necessary for the

proper completion and maintenance of the Works.

a. The several documents forming the Contract are to be taken as mutually explanatory of one

another, detailed drawing being followed in preference to small-scale drawing and figured

dimensions in preference to scale and Special conditions in preference to General Conditions.

b. In the case of discrepancies between Schedule of Quantities, the Specifications and/or the

Drawings, the following order of preference shall be observed. (a) Description in Schedule of Quantities

(b) Particular Specification and Special Conditions if any

(c) Drawings

(d) General specifications.

c. If there are varying or conflicting provisions made in any one document forming part of the

Contract, the accepting Authority shall be deciding authority with regard to the intention of the

document.

d. Any error in description, quantity or rate in Schedule of Quantities or any omission therefore

shall not vitiate the Contract or release the Contract from the execution of the whole or any part

of the Works comprised there in according to drawings and specifications or from any of his

bligations under the Contract.

e. If on check there are found to be differences between the rates given by the Contractor in

works and figures or in the amount worked out by him in the schedule of quantities and general

summary, the same shall be adjusted in accordance with the following rules:

(a) In the event of a discrepancy between description in words and figures quoted by a tenderer,

the description in words shall prevail.

(b) In the event of an error occurring in the amount column of Schedule of Quantities as a result

of wrong extension of the unit rate and quantity the unit rate shall be regarded, as firm and

extension shall be amended on the basis of the rate.

(c) All errors in totaling in the amount column and in carrying forward totals shall be corrected.

(d) The total of various sections of Schedule of Quantities amended shall be carried over to the

General Summary and the tendered sum amended accordingly. The tendered sum so altered

shall, for the purpose of the tenderer, be substituted for the sum originally tendered and

considered for acceptance instead of the original sum quoted by the tenderer. Any rounding

off of Quantities or in sections of Schedule of Quantities or in General Summary, by the

tenderer, shall be ignored.

SCOPE OF WORK

3. The work of Designing, Manufacturing, Supplying and Installation of Workstation, Pedestal

Units, Keyboard Trays, Compactors, Tables, Chairs, sofa, partitions and other items at S.R.O,

Tinsukia

4. Salient details of the work for which tenders are invited.

5. The scope of work involves provision of Modular furniture and other furniture items. The

Tenderer has to provide their three layout plans while supply orders are places.

6. The Item Rates offered should state VAT/Sales Taxes and transportation charges for state

capitals and places up to 100 Km from capital town all over India. However for places away

beyond 100 Km may be paid in bracket of 50 km distance if quoted in initially submitted

financial bid and if it is accepted by EPFO. No representation will be accepted and EPFO

decision will be binding for all.

7. On the basis of lowest bidder for various items, EPFO will decide without assigning any

reasons, the number of bidders to be listed under lowest bidders and a chance may be given to all

such bidders or reject few and offer to others for submitting rebate on their offer. EPFO decision

will be final and binding to all bidders.

8. Site Location: The furniture is to be provided at Sub Regional Office, Amar Complex,

Hijiguri, Tinsukia. The office will try to provide a vacant space as for as possible and in the

event of not providing a vacant working space, the contractor should prepare to work after office

hours and on Saturdays and Sundays.

DEFINITIONS 9. In this document the following words and expressions have the meaning hereby assigned to

them.

a. Employer :-Means the EPFO

b. Applicant:-Means the individual proprietary firm, firm in partnership limited company, private

or public or corporation.

c. Year" means "Financial Year" unless stated otherwise

d. "Similar Work" means work of Modular furniture in Commercial, Corporate, and Hotel, Bank,

Institutional and other buildings.

e. "Main Tenderer" means the person / firm specializing in executing the work of component

bearing the highest estimated cost in respect to other components in the group and who shall sign

the single agreement considering all components in the group.

10. METHOD OF APPLICATION: a. If the applicant is an individual, the application shall be signed by him above his full

typewritten name and current address.

b. If the applicant is a proprietary firm, the application shall be signed by the proprietor above his

full typewritten name and the full name of his firm with its current address.

c. If the applicant is a firm in partnership, the application shall be signed by all the partners of the

firm above their full typewritten name and current addresses or alternatively by a Partner

holding power of attorney for the firm. In the latter case a certified copy of the Power of

Attorney should accompany the application. In both cases a certified copy of the partnership

deed and current address of all the partners of the firm should accompany the application.

d. If the applicant is a limited company or a corporation, the application shall be signed by a duly

authorized persons holding power of attorney for signing the application accompanied by a

copy of the power of attorney. The applicant should also furnish a copy of the memorandum

and Articles of Association duly attested by a Public Notary/Gazetted Officer.

11. FINANCIAL DECISION MAKING AUTHORITY The employer reserves the right to accept or reject any application and to annul the tender

process and reject all applications at any time, without assigning any reasons or incurring

any liability to the applicants.

12. SITE VISIT

All prospective applicant are advised to visit the present premise Sub Regional Office, Amar

Complex, Hijiguri, Tinsukia at his own cost, and examine it and its surroundings to himself

collect all information that he consider necessary for proper assessment of the prospective

assignment. 13. INITIAL CRITERIA FOR ELIGIBILITY FOR TECHNICAL BID

The criteria of eligibility of experienced, technically and financially sound, reputed manufactures

of modular office furniture, compactors shall be as under:-

Initial eligibility. (A) The applicant should have experience of having successfully completed works during the last

five years ending last day of the month previous to the one in which applications are invited:

(Supply orders be enclosed).

Three similar completed works of modular office furniture (at least Two of them should be in

Central Government/ Central Autonomous Bodies/ Central Public Sector Undertakings)

costing not less than one crores each Private Sector work experience should be supported

with copy of recent TDS certificate. For this purpose, 'cost of work' shall mean gross value of the completed work including the

cost of materials supplied by the Govt./ Client, but excluding those supplied free of cost. An

officer not below the rank of Executive Engineer/ Project Manager or Equivalent should

certify this. (B) The applicant should have had average annual financial turnover (gross) of Rs. Eight crores

per annum during the last three financial years in the field of modular office furniture.

(Audited Balance sheet to be enclosed). (C) The applicant should not have incurred any loss in last two financial years or any 03 out of

last 05 financial years and it shall be duly supported by audited financial statement.

(D) The applicant should have a solvency of 40% of total estimated cost put to tender certified

by his Bankers. (E) The applicant should own equipment as follows required for the proper and timely execution

of the work, for rest, he should certify that the would be able to manage the equipment by

hiring etc. and submit the list of firms from whom he proposes to hire. (Supported documents

to confirm like CA's certificate along with financial statements and photographs.)

(i) Computer controlled multi station edge through feed edge binding machine capacity of

gluing, flush trimming, scrap ply and trimming is one feed operation.

(ii) Hot presser laminate pressing

(iii) CNC controlled press form brake for sheet metal binding.

(iv) Conveyorised powder coating plant with pretreatment

(F) The applicant should have sufficient number of Technical and Administrative employees for

the proper execution of the contract. The applicant should submit a list these employees

stating clearly how these would be involved in this work. The company profile to be

submitted.

(G) The applicant's performance for each work completed in the last 5 years and in hand should

be certified by an officer not below the rank of Executive Engineer or equivalent /relevant

TDS certificate and should be contained in sealed cover.

(H) The applicant shall clearly specify whenever the bid is submitted on his own or on behalf of

partnership concern. In later case, the certificate copies partnership deed be submitted along

with bid.

(I) The applicant will agree/undertake for comprehensive warranty for supplied/fixed items for

one year and three years post warranty services and maintenance under AMC.

(J) Supply of material will be within 30 days from the date of placing the order by E.P.F.O office.

The bidder must note that successful bidder should give a performance guarantee in The form

of bank guarantee amounts to 5% of the order. The performance guarantee should be

furnished after order for supply is placed and shall be valid upto expiry of the maintenance

period.

14. EVALUATION CRITERIA FOR TECHNICAL BID 1. All criteria are mandatory to qualify. The employer reserves the right, without being liable for

any damages or obligation to inform the applicant to;

a) Amend the scope and value of contract to the applicant.

b) Reject any or all of the applications without assigning any reasons.

c) Restrict the list of qualified contractors to any number deemed suitable by it.

1. Any effort on the part of the applicant or his agent to exercise influence or to pressurize the

employer would result in rejection of his application. Canvassing of any kind is prohibited.

2. Even though an applicant may satisfy the above requirements, he would be liable to

disqualification if he has:

a) Made misleading or false representation or deliberately suppressed the information in the

forms, statements and enclosures required in the prequalification document.

b) Record of poor performance such as abandoning work, not properly completing the

contract, or financial failures/weaknesses etc.

15. FINANCIAL INFORMATION Applicant should furnish the following financial information:

a) List of all works of similar class successfully completed during the last five years (in

by an office not below the rank of Executive Engineer or equivalent TDS certificates should

be furnished separately for each work completed or in progress (in Form "D")

17. ORGANISATION INFORMATION

Applicant is required to submit the following information in respect of his organization (in

Form "E" & "E".1")

a) Name & Postal Address, i/c Telephone, Fax & Telex Number etc. b) Copies of original documents defining the legal status, place of Registration and principal

places of business. c) Names & Title of Directors and Officers concerned with the work, with designation of

individuals authorized to act for the organization. d) Information on any litigation in which the applicant was involved during the last five years,

including any current litigation. e) Authorization for employer to seek detailed references. f) Number of Technical &b Administrative Employees in parent company, Subsidiary company

and how these would be involved in this work (in form "E.1")

18. PLANT & EQUIPMENT Applicant should furnish the list of plant and equipment likely to be used in carrying out the

work (in Form "F"). Details of any other plant & equipment required for the work (not include in

Form "F") and available with the applicant may also be indicated (Duly supported by

documents).

19. LETTER OF TRANSMITTAL The applicant should submit the letter of transmittal attached with technical bid document.

20. WATER & ELECTRICITY. The contractor shall make his own arrangement for supply of required water and electricity for

construction purpose at his own cost.

21. The contractor shall have to maintain desired progress of work as planned from the time to

time. In the event of his failure to maintain the required progress of work, the Engineer-incharge

shall have the right to cancel his contract and / or engage a parallel agency for completion of

work at the risk and cost of the contractor as deemed fit. 22. All tools and plants, machinery and fuel etc. required for the execution of work will be

arranged by the contractor at his own cost. Nothing extra would be payable for transport, octroi,

entry tax, local tax etc. 23. The contractor shall not sublet any portion of the work without prior written permission of

the Competent Authority.

24. The contractor shall provide for approval a set of three alternate proposals required for

execution of work like architectural, structural, all service plans and other detailed drawings in a

phased manner.

25. Contractor shall submit the complete programme of execution along with BAR Chart

proposed to be followed for completion of work within 7 days of award of work.

26. Security Deposit: Security deposit @ 10% of the tendered value of the work shall be deducted from each running

account bill and same shall be refunded after successful completion of the defect liability period

and rectification of the defects observed, if any and getting necessary clearness as per clause No.

45 of general condition of contract.

27. TAXATION: Recovery on account of Income Tax shall be made as per the provisions of the Income Tax Act.

1961 and rules made there under.

28. LIQUIDITY DAMAGES: If the contractor fails to maintain the required speed and the work is not completed during the

stipulated time period. EPFO shall recover liquidated damages at the rate of 1/4% (one quarter

percent) of the total cost of the work per week of delay subject to a maximum of 5% (Five

percent) of the total cost of work, or such smaller amount as may be fixed by the competent

Authority.

29 After the completion of work the contractor shall hand over the work after proper site

clearance as directed by the Engineer-in-charge.

30. The rates quoted by the contractor shall be inclusive of all taxes i.e VAT, WCT, Service tax,

Cess and other etc.

31. MAINTENANCE PERIOD: The contractor shall be fully responsible for the quality, workmanship and structural safety of the

construction work Contractor shall be fully responsible for liability of defects in the Work

executed by him for a period of one year from the date of successful handing over of the work of

EPFO. The contractor at his own cost and expenses shall rectify all defects observed during the

defects liability period. In the event of failure on the part of the contractor to rectify the defects

the same way, without prejudice to any other right available to it in law, be rectified by EPFO for

and on behalf of contractor. EPFO shall have the right to deduct or set off the expenses incurred

by it in rectifying the defects as aforesaid from/against any amount due and payable or becoming

due and payable by EPFO to the contractor under this agreement or any other contractor what-so-

ever.

32. The contractor will be responsible for obtaining "contractor all risk Policy" toward entire cost

of the work and will obtain workmen compensation policy at his own cost. 33. The decision of the EPFO, regarding the quantum of reduction as well as justification thereof

in respect of rates for substandard work which may be decided to be accepted will be final and

would not be open to arbitration. 34. The work may be inspected by Central Vigilance Commission and any deductions/

compensation proposed by CVC or EPFO in regard to defective work or not confirming to

specification, loss of time, amount shall be deducted from their bill or by sale of their properties

at site. 35. The contractor shall have to make his own arrangements for the space required for storing &

stacking of the material, T &P etc. at site. 36. The contractor shall employ the specialized agency who has experience in the relevant fields

to carry out the works. However, approval of the Engineer-in-Charge shall be obtained before

finaliztion / employing the Agencies.

37. The Contractor shall permit EPFO at the time of making any payment to him for work done

under the Contract to deduct towards Security Deposit such sums as will along with the amount

of Earnest Money already deposited amount to 10% on the first Rs. 1 lakhs plus 7.5% on the next

Rs. 1 lakh and 5% on the balance of the gross amount of bill till the sums so deducted amount to

the figure shown at serial No. 12 in Schedule E, unless he has already deposited the amount of

the security as mentioned at Serial No. 12 in Schedule E in cash or in the form of Government

Securities of Fixed Deposit receipts or Bank guarantees furnished by any of the Scheduled Banks

under the revised Bank guarantee scheme or Reserve Bank of India and certified by the Reserve

Bank of India that the Bank guarantee may be accepted.

38. Provided that the security deposit reaches a limit of Rs. 1 lakh, the contractor, if he so desires

may convert the amount into one of the Government securities or Bank Guarantees as aforesaid.

Provided that, if at the time of payment of the final bill, the deductions so made together with the

earnest Money already deposited, fall short of the security deposit mentioned at serial No. 12 in

Schedule E, the recovery of the balance amount of security deposit shall be deemed to have been

waived. 39 In case a Fixed Deposit Receipt of any bank is furnished by the Contractor to EPFO as part of

the security deposit and the bank goes into liquidation or for any other reason is unable to make

payment against the said Fixed Deposit Receipt, the loss caused thereby shall be borne by the

Contractor and the contractor shall forth with or on demand furnish additional security to EPFO

to make good the deficit.

40. Time and Extension for Delay: The time allowed for execution of the Works as specified or the extended time in accordance

with these Conditions shall be the essence of the Contract. The execution of the Works shall

commence from the 15th day after the date on which the Engineer-in-Charge issues written orders

to commence the work or from the date of handing over of the Site whichever is later. If the

Contractor commits default in commencing the execution of the work as aforesaid, EPFO shall

without prejudice to any other right or remedy be at liberty to forfeit the earnest money

absolutely. 1. Request for the extension of time, to be eligible for consideration, shall be made by the

Contractor in writing within fourteen days of the happening of the event causing delay. The

Contractor may also, if practicable, indicate in such a request the period for which extension is

desired. 2. In any such case the authority may give a fair and reasonable extension of time for completion

of the work, such extension shall be communicated to the Contractor by the Engineer-in-Charge.

41. Contractor’s Supervision: The Contractor shall either himself supervise the execution of the Works or shall appoint a

competent agent approved by the Engineer-in-Charge. If the Contractor has himself not sufficient

knowledge and experience to be capable of receiving instructions or cannot give his full attention

to the Works, the Contractor shall at his own expense, employ as his accredited agent an engineer

approved by the Engineer-in-charge. Orders given to the Contractor’s agent shall be considered

to have the same force if these had not been given to the Contractor himself. If the Contractor

fails to appoint a suitable agent as directed by the Engineer-in-charge, the Engineer-in-charge

shall have full powers to suspend the execution of the Works until such date as a suitable agent

is appointed and the Contractor shall be held responsible for the delay so caused to the Works. 42 Inspection and approval: All works embracing more that one process shall be subject to examine and approval at each

stage thereof and the Contractor shall give due notice of the Engineer-in-charge or his authorized

representative when each stage is ready. In default of such notice, the Engineer-in- charge shall

be entitled to appraise the quality and extent thereof. 43. Department officers concerned with the Contract shall have powers at any time to inspect and

examine any part of the works and the Contractor shall give such facilities as may be required for

such inspection and examination.

44 Removal of Workmen The Contractor shall employ in and about the execution of the works only such persons as are

skilled and experienced in their several trades and the Engineer-in-charge shall be at liberty to

object to and require the Contractor to remove from the works any person employed by the

contractor in or about the execution of the works who in the opinion of the Engineer-in-Charge

misconducts himself or incompetent or negligent in the proper performance of his duties and

such person shall not be again employed upon the Works without permission of the Engineer-in-

charge.

45 Completion Certificate: As soon as the work is completed, the contractor shall give notice of such completion to the

Engineer-in-charge and within thirty days of receipt of such notice the Engineer-in-charge shall

inspect the work and shall furnish the contractor with a certificate of completion indicating (a)

the date of completion, (b) defects to be rectified by the Contractor and / or (c) items for which

payment shall be made at reduced rates. When separate periods of completion have such been

specified for items or group of items, the Engineer-in-Charge shall issue separate completion

certificate for such item or groups of item. No certificate of completion shall be issued, nor shall

the work be considered to be complete till the Contractor shall have removed from the premises

on which the work has been executed all scaffolding, sheds and surplus materials, except such as

are required for rectification of defects, rubbish and all huts and sanitary arrangements required

for his workmen on the site in connection with the execution of the work, as shall have been

erected by the Contractor or the workmen and cleaned all dirt from the parts of building(s) in

upon or about which the work has been executed or of which he may have had possession for the

purpose of the execution thereof and cleaned floors, gutters and drains, eased doors and sashes,

oiled locks and fastening labeled keys clearly and handed them over to the Engineer-in-Charge or

his Representative and made the whole premises fit for immediate occupation or use to the

satisfaction of the Engineer-in-Charge. If the Contractor shall fail to comply with any of the

requirement of this Conditions as aforesaid, on or before the date of completion of the Works, the

Engineer-in-charge may at the expense of the Contractor fulfill such requirements and dispose of

the scaffoldings, surplus materials and rubbish etc., as he thinks fit and the Contractor shall have

no claim in respect of any such scaffolding or surplus materials except for any sum actually

realized by the sale thereof less the cost of fulfilling the requirements and any other amount that

may be due from the Contractor. If the expenses of fulfilling the requirements and any other

amount that may be due from the Contractor shall forthwith on demand pay such excess.

46 Contractor’s Liability and Insurance: From commencement to completion of the works, the Contractor shall take full responsibility for

the case thereof and for taking precautions of prevent loss or damage and to minimize loss or

damage to the greatest extent possible and shall be liable for any damage or loss that may happen

to the Works or any part thereof and all EPFO T & P from any cause whatsoever (save and

except the Excepted Risks) and shall at his own cost repair and make good the same so that at

completion, the works and all EPFO T&P shall be in good order and condition and in conformity

in every respect with the requirements of the Contract and instructions of the Engineer-in-

Charge.

47. Notices to Local Bodies: The Contractor shall comply with and give all notice required under any Government authority,

instrument, rule or order made under any Act of Parliament, State laws or any regulation or bye-

law of any local authority relating to the works. He shall before making any variation from the

contract drawings necessitated by such compliance give to the Engineer-in-Charge a written

notice giving reasons for the proposed variation and obtain the Engineer-in-Charge’s instructions

thereon. 48. The Contractor shall pay and indemnify EPFO against any liability in respect of any fees or

charges payable under any Act of Parliament, State laws or any Government instrument, rule or

order and any regulations or bye-laws of any local authority in respect of the Works. 49. Sub Contracts: The Contractor shall not sublet any contract without the prior written approval of the Accepting

Authority.

50 Foreclosure of Contract in Full or in Part due to abandonment or Reduction in

Scope of Work: If at any time after acceptance of the tender EPFO shall decide to abandon or reduce the scope of

the works for any reason whatsoever and hence not require the whole or any part of the works to

be carried out, the Engineer-in-Charge shall give notice in writing to that effect to the Contractor

and the Contractor shall have no claim to any payment of compensation or other wise

whatsoever, on account of any profit or advantage which he might have derived from the

execution of the works in full but which he did not derive in consequence of the foreclosure of

the whole or part of the works. 51. Termination of Contract on Death: If the Contractor is an individual or a proprietary concern and the individual or the proprietor dies

and if the Contractor is a partnership concern and one of the partners dies then unless the

Accepting Authority is satisfied that the legal representative of the individual Contractor or of the

proprietor of the Proprietary concern and in the case of partnership, the surviving partners are not

capable for and completing the Contract, the Accepting Authority shall be entitled to cancel the

Contract as to its uncompleted part without EPFO being in any way liable to payment of any

compensation to the estate of the deceased Contractor and/or to the surviving partners of the

Contractor’s firm on account of the cancellation of the Contract. The decision of the Accepting Authority that the legal representatives of the deceased Contractor of the Surviving partners of

the Contractor’s firm cannot carry out and complete the Contract shall be final and binding on the

parties. In the event of such cancellation EPFO shall not hold the estate of the deceased Contract

or and/or the surviving partners of the Contractor’s firm liable in damages for not completing the

Contract.

52. Cancellation of Contract In full or in part: If the Contractor:

(a) At any time makes default in proceeding with the works with due diligence and continues to

do so after a notice in writing of 7 days from the Engineer-in-Charge; or (b) Commits default in complying with any of the terms and conditions the Contract and does not

remedy it or take effective steps to remedy it within days after a notice in writing is given to him

in that behalf by the Engineer-in-Charge; or (c) Fails to complete the works or items of work with individual dates completion, on or before

the date(s) of completion and does not complete the with in period of specified notice given in

writing in that behalf by the Engineer-in-Charge; or (d) Shall offer or give or agree to give to any person in EPFO service or to any other person on

his behalf any gift or consideration of any kind as a inducement or reward for doing or forbearing

to do or for having done or forborne to do any act in relation to the obtaining or execution of this

or any other Contra for EPFO; or 53. Liability for Damage, Defects or imperfections and Rectification thereof: If the Contractor or his workman or employees shall injure or destroy any part of the building in

which he may be working or any building, road, fence etc., contiguous to the premises on which

the work or any part of it is being executed, or if any damage shall happen to them while in

progress the Contractor shall upon receipt of a notice in writing in that behalf make the same

good at his own expense. If it shall appear to the Engineer-in- Charge or his Representative at

any time during construction or reconstruction or prior to the expiration of the Defects Liability

Period, that any work had been executed with unsound, imperfect or unskilled workmanship or

that any material or articles provided by the Contractor for execution of the work are unsound or

of a quality inferior to that contract for, or otherwise not of defective or improper materials or

workmanship, the Contractor shall, upon receipt of a notice in writing in that behalf from the

Engineer-in-Charge, forth with rectify or remove and reconstruct the work so specified in whole

or in part, as the case may require or as the case may be, and/or remove the materials or articles

and provide other proper and suitable materials or articles at his own expense, notwithstanding

that the same may have been inadvertently passed, certified in his notice aforesaid, the Engineer-

in- Charge may rectify or remove and re-execute the work and/or remove and replace with others

the materials or articles complained or, as the case may be, by other means at the risk and

expense of the contractor.

54. In case of repairs and maintenance works, splashes and droppings from white washing,

painting, etc shall be removed and surfaces cleaned simultaneously with completion of these

items of work in individual rooms quarters or premises, etc. where the work is done, without

waiting for completion of all other items of work in the Contract. In case the Contractor fails to

comply with requirements of his condition, the Engineer-in-Charge shall have the right to get the

work done by other means at the cost of Contractor. Before taking such action, however, the

Engineer-in-Charges shall give three day notice in writing to the Contractor.

55 Urgent Works: If any work (in respect whereof the decision of the Engineer-in-Charge shall be final and

binding) becomes necessary and the Contractor is unable or unwilling at once to carry it out, the

Engineer-in-Charge may by his own or other work people carry it out as he may consider

necessary. If the Urgent Work shall be such as the Contractor is liable under the Contract to

carryout at his expense, all expense incurred on it by EPFO shall be recoverable from the

Contractor and be adjusted or set off against any sum payable to him. 56. Change in Constitution: Where the Contractor is a partnership firm, prior approval in writing of the Accepting Authority

shall be obtained before any change is made in the constitution of the firm. Where the Contractor

is an individual or a Hindu Undivided Family business concern such approval as aforesaid shall

likewise be obtained before the Contractor enters in to any partnership agreement where under

the partnership firm would have the right to carry out the work hereby undertaken by the

Contractor. If prior approval as aforesaid is not obtained, the Contractor shall be deemed to have

been assigned contravention of provisions of contract and the same action may be taken and the

same consequences shall ensue. 57. Training of Apprentices: The contractor shall comply with the provisions of the Apprentices Act 1961 and the Rules and

orders issued there under from time to time. The contractor shall be liable for any pecuniary

liability arising on account of any violation by him of the provisions of this Act. 58. Contractors Representatives, Agents and Workmen: The contractor shall employ only Indian Nationals and verify their antecedents and loyalty before

employing them on the work. He shall ensure that no person of doubtful antecedent and

nationality is in any way associated with the work.

59. VALUATION AND PAYMENT A. Payment on Account: a. The Contractor shall submit interim bills at intervals fixed by the Engineer-in-Charge for the

work executed. The Engineer-in-Charge shall then manage to have the bill verified by taking or

causing to be taken, where necessary the requisite measurements of the work Payment on account

for admissible shall be made on the Engineer-in-Charge certifying the sum to which the

contractor is considered entitled by way of interim payment for the following. All work executed

after deducting there from the amounts already paid, the security deposit and such other amounts

as may be deductible or recoverable in terms of the Contract. 75 per cent of the cost (as assessed

by the Engineer In Charge) of any material which are in the opinion of the Engineer In Charge

reasonably required in accordance with the Contract and have been brought to Site for

incorporation in the Work and are safeguarded against loss due to any cause whatsoever to

satisfaction of the Engineer-in-Charge, but have not been so incorporated provided the contractor

provides an insurance cover for the full cost of perishable materials. The advance payments shall

adjusted as and when materials are utilized in the Works. The amount admissible for interim bills

shall be normally paid within a month from the date of receipt of the bill by the Engineer-in-

Charge after such verification as is considered necessary. Any interim certificate given relating to

work done or materials delivered, maybe modified or corrected by any subsequent interim

certificate or by the final certificate. No certificate of the Engineer-in-Charge supporting an

interim payment shall of itself be conclusive evidence that nay work materials to which it relates

is/are in accordance with the contract Pending consideration of extension of date of completion

interim payments shall continue to be made as interim provided. b. Time Limit For Payment Of Final Bill: The Contractor shall submit the final bill within three

months of physical completion of the Works. No further claims shall be made by the Contractor

after submission of the final bill and these shall be deemed to have been waived and

extinguished. Payment of the items of the bill in respect of which there is no dispute and of items

in dispute, for quantities and at rates as approved by engineer-in-Charge, shall be made within the

period specified hereunder, the period being reckoned from the date of receipt of the bill by the

Engineer-in-Charge: (a) Contract amount exceeding Rs.5lacs 15 days. (b) Contract amount exceeding Rs.15lacs two months After payment of the amount of the final bill payable as aforesaid has been made, the Contractor,

if he so desired, reconsider his position in respect of the disputed portion of the final bill and if he

fails to do so within 50 days, his disputed claim shall be dealt with as provided in the Contract.

c. Advances: Advances will, subject to availability of funds and if required by the Contractor, be

given as under within six weeks of submission of application by him subject to other conditions

being fulfilled and the Engineer-in-Charge certifying the sum to which the Contract is entitled by

way of advance.

a. In case of contract valued at over Rs.50 lacs: For plant and equipment specifically acquired for

the work and brought to Site at 75% of the purchase price of new machinery against production

of documents in support thereof and subject to the conditions that the Engineer-in- Charge

considers the price reasonable and that such plant and equipment are necessary for the and not in

excess of requirements and are hypothecated in favour of EPFO in the form required by EPFO,

interest on the sum outstanding shall be levied at the % mentioned. Advance against plant and

equipment shall in any case exceeds 6% of the Contract Sum. b. In the case of contracts valued lower Rs.50 lakhs: a lumpsum advance not exceeding 4 percent

of the contract sum against a guarantee acceptable to EPFO @ interest. The advance shall be

utilized for the purpose of this contract only and for no other purpose Provided that if a request

for advance is made by the Contractor against the aforementioned provisions, the total sum be

given as advance shall not exceed 8% of the Contract Sum.

c. Recovery of the sums advanced against (a) and (b) above and of interest thereof shall be made

by deduction from the on account payments referred to in condition/I in suitable percentage in

relation to the progress, as fixed by the Engineer-in-Charge, so that all the sum/advanced with

interest thereon shall be fully recovered by the time work amounting to nearly 80% of the

contract sums is completed if the amount payable under any interim bill is not sufficient to cover

all deductions to be made for sums advanced and others sums deductable there from, the balance

outstanding shall be, deducted from subsequent bill/bills as may be necessary, failing that, as

otherwise provided for in the contract. d. If for any reason, except a default, the work under the Contract is suspended or is to be

suspended for more than 15 days, the contractor shall be at a liberty to remove the plant and

equipment or any part thereof hypothecated to EPFO above to any other Works site of the

Contractor for carrying on his other Works, on his furnishing prior to such removal a bank

guarantee acceptable to EPFO for the amount of the outstanding advance granted above with

interest and undertaking to bring back to the site, before expiry of the period of suspension, the

plant and Equipment as may be necessary for completion of the Works if such plant and, are not

brought back, the Contractor shall forthwith repay the amount of advance outstanding with

interest.

d. Income Tax Recovery: Before releasing payment to the Contractor, tax recovery shall made from the contractor’s bill at

the rate as applicable during that time. For payment towards advances, income tax recovery shall

made and advances shall be recovered as per terms and conditions provided in conditions.

e. Overpayments and Underpayments (a) Wherever any claim for the payment of a sum of money to EPFO arises or of under this

Contract against the Contractor the same may be deducted by EPFO from any sum then due or

which at any time thereafter may become due to the contractor under Contract and failing that

under any other Contract with EPFO from any other sum due to the contractor from EPFO which

may be available with EPFO or from his security deposit or he shall pay the claim on demand. (b) EPFO reserve the right to carry out post-payment audit a technical examination of the final

bill including all support vouchers, abstracts, etc, EPFO further reserve the right to enforce

recovery of any other when detected notwithstanding the fact that the amount of the final bill

may be included by one of the part as an item of dispute before an arbitrator appointed, of this

Contract and notwithstanding the fact that the amount of the final bill figures in the arbitration

award. (c) If as a result of such audit and technical examination any overpayment is discovered in

respect of any work done by the Contractor or alleged to have been done by him under the

contract, it shall be recovered by EPFO from the Contractor by any or all of the methods

prescribed above or if any under payment is discovered the amount shall be duly paid to the

Contractor by EPFO.

(d) Provided that the aforesaid right of EPFO to adjust overpayment against amount due to the

Contractor under any other Contractor with EPFO shall not extend beyond the period of two

years from the date of payment of the final bill or in case the final bill is a MINUS bill, from the

date the amount payable by the contractor under the MINUS final bill is communicated to the

Contractor. (e) Any amount due to the Contractor under this Contract for under payment may be adjusted

against any amount then due or which may at any time thereafter become due before payment is

made to the contractor, from him to EPFO on any other Contract account whatsoever. 6.1 ARBITRATION AND LAWS. a. Arbitration: a. Expect where otherwise provided for in the contract all questions and disputes relating to the

meaning of the specification designs, drawings and instructions herein before mentioned and as

to the quality of workmanship or materials used on the work or as to any other question, claim,

right, matter or thing whatsoever in any way arising out of or relating to the contract, designs,

drawings, specification estimates, instructions, orders or these conditions or otherwise concerning

the works, or the execution or failure to execute the same whether arising during the progress of

the work or after the completion or abandonment thereof shall be referred to the sole arbitrator as

may be appointed by the authority of EPFO. There will be no objection if the arbitrator so

appointed is an employee of EPFO and that he had no deal with the matters to which the contract

relates and that in the course of his duties as such he had expressed views on all or any of the

matters of dispute or difference. The arbitrator to whom the matter is originally referred being transferred or vacating his office or being to act for any reason, the appointing authority for

arbitrator, as afore said at the time of such an office or inability to act, shall appoint another

person to act as arbitrator in accordance with the terms of the contract. Such person shall be

entitled to proceed with the reference from the stage at which it was left by his predecessor. It is

also a term of this contract that no person, other than a person appointed by the authority

mentioned in schedule E, should act as arbitrator and if for any reason that is not possible, the

matter is not to be referred to arbitration at all.

(a) Cases where the amount of the claim in dispute is Rs.50,000 (Rupees fifty thousand) and

above, the Arbitrator shall give Reasons for the award.

(b) Subject as aforesaid the provision of the Arbitration Act. 1940 or any statutory modification

or re-enactment thereof and the rules made there under and for the time being in force shall apply

to the arbitration proceeding under this clause. In case of disputed arising between two

Government of India Undertaking, provisions as content in Bureau of Public Enterprises Letter

No. BPE/GL-001/16/MAN-2 (100-75-BPE (GM-) dated 01-01-1976 and as may be amended

from time to time shall apply. It is a term of the contract that the party invoking arbitration shall.

(c) specify the dispute or disputes to be referred to arbitration under this clause together with the

amount or amounts claimed in Respect of each such dispute. The arbitrator (s) may from time to

time with consent of the parties enlarge the time, for making and Publishing the award.

(d) The work under the Contract shall, if reasonably possible continue during the arbitration

proceedings and no payment due or payable to the Contractor shall be withheld on account of

such proceedings.

(e) The Arbitrator shall be deemed to have entered on the reference on the date he issues notice to

both the parties fixing the date of the first hearing.

(f) The Arbitrator shall give a separate award in respect of each dispute or difference referred to

him. The venue of arbitration shall be such place as may be fixed by the Arbitrator in his sole

discretion. The award of the arbitrator shall be final conclusive and binding to all parties to this

contract.

6.2 CONTRACTORS, LABOUR REGULATIONS a. Definition: In the regulations, unless otherwise expressed or indicated the following words

and expression shall have the meaning hereby assigned to them.

b. “Labour” means workers employed by contractor directly, or indirectly through a sub

contractor, or by an agent on his behalf on a payment not exceeding Rs.500/-per month.

c. “Fair Wages” means wages, which shall include wages for weekly they of rest and other

allowances, whether for time or piece work after taking into consideration prevailing market rates

for similar employments in the neighborhood but shall not be less than minimum rates of wages

fixed under the Minimum Wages Act.

d. “Contractor” for the purpose of these Regulation shall include agent or sub contractor

employing labour on the work taken on contractor.

e. “Inspecting Officer” means any Labour Enforcement Officer, Assistant Labour

Commissioner of the Chief Labour Commissioner Organisation.

f. Notice of Commencement: The Contractor shall, within SEVEN days of commencement of

the work, furnish in writing the inspecting Officer of the area concerned the following

information.

g. “Form” means a form appended to these Regulations.

i. Particulars of the Department for which the work is undertaken.

j. Name and address of subcontractors as and when they appointed.

k. commencement and probable duration of the work.

l. number of workers employed and likely to be employed.

m. ‘fair wages’ for different categories of workers.

i) Number of hours of work which shall constitute a normal working day: The-number of

hours which shall constitute normal working day for an adult shall be NINE hours. The working

day for an adult shall be NINE hours. The working of an adult worker shall be so arranged that

inclusive of intervals, if any, for it shall not spread over more than twelve hours on any day.

When an adult worker is made to work for more than nine hours on any day or for more than 48

hours in any week he shall respect of overtime work paid wages at double the ordinary rate of

wages. ii) Weekly day of rest: Every worker shall be given a week day of rest which shall be fixed and

notified at least TEN days in advance. A worker shall not be required or allowed to work on the

weekly rest day or will have substituted rest day, on one of the five days immediately before or

after the rest day. Provide that no substitution shall be made which will result in the worker

working more than ten days continuously without a rest day for whole day. Where in accordance

with the foregoing provisions a worker works on the rest day and has been given a substituted

rest day he shall be paid wages for the work done on the weekly rest at the overtime rate of

wages. NOTE: The expression of ‘ordinary rate of wages’ means the fair wage worker. iii). Display of notice regarding Wages, Weekly Day of Rest etc.: The Contractor shall when

he commences his work on contract, display and correctly maintain and continue to display in

clean and legible condition in conspicuous places on the work notice in English and in the local

Indian language, spoken by the majority of workers giving the rate of fair wages, the hours of

work for which such wages are payable, weekly rest days, the Workers are entitled to and name

and address of Inspecting Officer. The Contractor shall send copy of each of such notices to the

Inspecting Officers. iv). Fixation of Wage Period. The Contractors shall fix wage period in respect of which wages

shall be payable. No wage period shall normally exceed one week. v). ‘Payment of Wages’: (i) Wages due to every worker shall be paid to him direct. All wages shall be paid in current

coins or currency or in both.

(ii) Wages of every worker employed on the contract shall be paid where the wage period is one

week, within THREE days from the end of Wage period, and in any other case before the expiry

of the 7th day or 10th day from the end of the wage period according as the number of workers

doesn’t exceed 1,000

or

Exceeds 1,000. (iii) When employment of any worker is terminated by or on behalf of contractor, the wages

earned by him shall be paid before expiry of the day succeeding the one on which his

employment is terminated. (iv) Payment of wages shall be made at the work site on a working day expect when the work is

completed before expiry of the wage period in which case final payment shall be made at the

work site within 48 hours of the last working day and during normal working time. NOTE:-The term “working day” means a day on which the work on which labour is employed,

is in progress.

vi. Register of Workmen: A register of WO shall be maintained in the form appended to these

regulations and kept at the work site or as near to it as possible, and the relevant particulars of

every workman shall be entered there in within THREE days. vii. Employment Card: The contractor shall issue an employment card in the Form appended to

these regulations to each worker on the day of work or entry into IUS employment. If a worker

has already any such card with him issued by the previous employer Card with relevant entries.

On termination of Employment the Employment card shall again be endorsed by the contractor

and returned to the work. viii. Register of Wages, etc. A register of wages-cum-Muster roll in the form appended to these

regulations shall be maintained and kept at the work site or as near to it as possible. A wages slip

in the form appended to these regulations shall be issued to every worker Employed by contractor

at least a day prior to disbursement of wages. ix. Deduction which may be made from Wage.: (i) Wages of a worker shall be paid to him

without any deductions of any kind except the followings deductions for absence from duty, i.e.

from the place or the places where by the terms of him employment he is required to work The

amount of deduction shall be in proportion to the period for which he was absent. Deduction for

damage to or loss of goods expressly entrusted to the employed person for custody, or for loss

which he is required to account for, Where such damage or loss is directly attributable to his

neglect or default. Deduction for recovery of advances or for adjustment of overpayment of

wages. Advance granted shall be entered in a register and any other deduction which EPFO may

from time to time allow. No fine shall be imposed on any Worker save in respect of such acts and

commissions on his part as have been approved by the Chief Labour Commissioner. No fine shall

imposed on a worker and no deductions for damage or loss shall be made from his wages until

the worker had been given an opportunity of showing cause against such fines or deductions. The

total amount of fines which may be imposed any one wage period on a worker shall not exceed

an amount equal to three paise in a rupee of the wages payable to him in respect of that wage

period. No fine imposed on the worker shall be recovered from him in installment, or after expiry

of Sixty(60) days from the date on which it was imposed. Every fine shall be deemed to have

been imposed on the day of the act or in respect of which it was imposed. The contractor shall

maintain both in English and the local Indian language a list, approved by the Chief Labour

Commissioner, clearly stating the acts and omissions for which penalty or fine may be imposed

and display it in good condition in a conspicuous place on the work site. The Contractor shall

maintain a register of fines and the register deductions for damage or loss in the form appended

to these regulations which should be kept at the place of work.

x. Register of Accidents: The Contractor shall maintain a register accidents in such form as may

convenient at the work place but the same shall include the particulars like full particulars of the

labourers who met with accident, Rate of Wages, Sex, Age, Nature of Accident and Cause of

Accident, Time and date of accident, Date and time when admitted in hospital, Date of discharge

from the hospital, period of treatment and result of treatment, percentage of loss of earning

capacity and disability as assessed by Medical Officer, Claim required to be paid tinder

Workmen’s Compensation Act, Date of payment of compensation Amount paid with details of

the person to whom the same was paid and Authority by whom the compensation was assessed,

etc. xi. Preservation of Registers: The Register of workmen and the Register of Wages-cum-Muster

roll to be maintained under these Regulations shall be preserved for 3 years after the date on

which the last made therein. xii. Enforcement: The Inspecting Officer shall either on his own or on a complaint received by

carry out investigations, and send a report Engineer-in-charge specifying the amounts

representing worker dues and amount of penalty to be imposed on the contractor for breach of

these Regulations, that have to be covered from the contractor, indicating full details of the

recoveries proposed and the reasons therefore. It shall be obligatory on the part of the Engineer-

in Charge on receipt of such report to deduct such amounts from payment due to the contractor. xiii. Disposal of amounts recovered from the contractor: The Engineer-in-charge shall arrange

payment to workers concerned with FORTY FIVE days from receipt of a report from the

Inspection Office except in cases where the contractor had made an appeal under Regulation 16

of these Regulations. In cases where there is an appeal, payment of workers’ dues would be

arranged by the Engineer-in-charge wherever such payments arise within THIRTY days from the

date of receipt of the decision of the Regional Labour Commissioner (RLC). xiv. Welfare Fund: All moneys that are recovered by the Engineer-in-Charge by way of workers

dues which could not be disbursed to workers within the time limit prescribed above, due to

reasons such whereabouts of workers not being known, death of a worker, etc and also amounts

recovered as penalty shall be credited to and be kept under the custody of EPFO for such benefit

and welfare of workmen employed by contractor.

xv. Appeal against decision of Inspecting Officer: Any person aggrieved by a decision of the

Inspecting Officer may appeal against such decision to the Regional Labour Commissioner

concerned within THIRTY Days from the date of the decision, forwarding simultaneously a copy

of his appeal to the Engineer-in-Charge. The decision of the Regional Labour Commissioner

shall be final and binding upon the contractor at the workmen.

xvi. Representation of parties: (i) A workmen shall be entitled to be represented in any investigation or enquiry under these

Regulations by an officer of a registered trade union of which he is a member or by an officer of

a Federation of Trade unions to which the said trade union is affiliated or where the workman is

not member of any registered trade union by an officer of a registered trade union, connected

with, or by any other workman employed in, the industry in which the worker is employed. (ii) A contractor shall be entitled to be represented in any investigation or enquiry under these

Regulations by an officer of an association of contractors of which he is a member or by an

officer of Federation associations of contractors to which the said association is affiliated or

where the contractor is not a member of any association of contractors, by an officer of

association of employers, connected with, or by any other employer engaged in the industry in

which the contractor is engaged. (iii) No party shall be entitled to be represented by a legal practitioner any investigation or

enquiry under these Regulations. xvii. Inspection of Books and other Documents: The Contractor shall allow inspection of the

Registers and other documents prescribed under these Regulations by inspecting Office and the

Engineer-in-Charge or his authorised representative at anytime and by the worker or his agent on

receipt of due notice at a convenient time. xviii. Interpretation: etc.: On any question as to the application interpretation or effect of these

Regulations, the decision of the Chief Labour Commissioner or Deputy Chief Labour

Commissioner (Central shall be final and binding. xix. Amendments: Central Government may, from time to time, add to or amend these

Regulations and issue such directions, as it may consider necessary for the proper

implementation of these Regulations or for the purpose of removing any difficulty, which may

arise in the administration thereof. 6.3 MODEL RULES FOR LABOUR WELFARE 1. Definitions:

(a) ‘Workplace’ means a place at which on an average twenty or more workers are employed.

(b) ‘Large Workplace’ means a place at which, on an average, 500 or more workers are

employed.

2. First Aid: At every workplace, there shall be maintained in a readily accessible place firstaid

application including an adequate supply of sterilized dressings and sterilized cotton wool as

prescribed in the Factory Rules of the State in which the work is carried on. The appliances, they

shall be kept in good order and, in large workplaces, they shall be placed under the charge of a

responsible person who shall be readily available during working hours. At large workplaces,

where hospital facilities are not available within easy distances of the Works, First Aid posts

shall be established and be run by a trained compounder. Where large workplace are remotely situated and far away from regular hospitals, an indoor ward shall be provided with one bed for

every 250 employees. Where large workplaces are situated in cities, towns or in their suburbs and

no bed are considered necessary owing to proximity of city or town hospitals suitable transport

shall be provided to facilitate removal of urgent cases to these hospitals At other workplaces,

some conveyance facilities shall be kept readily available to take injured person or persons

suddenly taken seriously ill, to the nearest hospital. At large workplaces there shall be provided

and maintained an ambulance room of the prescribed sizes containing the prescribed equipment

and in the charge of such medical and nursing staff as may be prescribed. For this purpose the

relevant provisions of the Factory Rules of the State Government of the area where the work is

carried on may be taken as the prescribed standard.

3. Accommodation for Labour: The Contractor shall during the progress of the works provide

erect and maintain necessary temporary living accommodation and ancillary facilities for labour

at his own expenses to standards and scales as approved by the Engineer–in–charge.

4. Drinking Water: In every workplace, there shall be provided and maintained at suitable place

easily accessible labour, a sufficient supply cold water fit for drinking. Where drinking water is

obtained from intermittent public water supply each workplace shall be provided with storage

where drinking water shall be stored. Every water supply storage shall be at a distance of not less

than 15 meters front any latrine dram or other source of pollution where water has to be drawn

from an existing well, which is within such proximately of latrine drain or any other source of

pollution, the well shall be properly chlorinated before water is drawn from it for drinking. All

such wells shall be entirely closed in and be provided with a trap door which shall be dust and

waterproof. A reliable pump shall be fitted to each covered well, the trap door shall be kept

locked and made open only for cleaning or inspection which shall be done at least once a month.

5. Washing and Bathing Places: Adequate washing and bathing places shall be provided

separately for men and women Such places shall be kept clean and in drained condition

6. Scale of Accommodation in Latrines and Urinals: There shall be provided within the

precincts of every workplace latrines and urinals in an accessible place, and the accommodation,

separately for each of these shall not be less than at the following scales–

7 Latrines and Urinals: Except in workplaces provided with water flushed latrines connected

with a waterborne sewage system, all latrines shall be provided with receptacles on dry–earth

system which shall be cleaned at least four times daily and at least twice during working hours

and kept in a strictly sanitary condition. Receptacles shall be tarred inside and outside at least

once a year. If women are employed, separate latrines and urinals screened from those for men

and marked in the vernaculars conspicuous letters “For Women Only” shall be provided on the

scale laid down in Rule 6 those for men shall be similarly marked for “Men Only” poster

showing the figure of a man and of a woman shall also be exhibited at the entrance to latrines–for

each sex. There shall be adequate supply of water close to latrines and urinals. 8. Construction of Latrines: Inside wells shall be constructed of masonary or other non–

absorbent materials and shall be cement–washed inside and outside at least once a year. The

dates of cement washing shall be noted in a register maintained for the purpose and kept

available for inspection Latrines shall have atleast–thatched roof. 9. Disposal of Excreta: Unless otherwise arranged for by the local sanitary authority

arrangement for proper disposal of excreta by incineration at the work place shall be made by

means of a suitable incinerator approved by the local medical, health and Municipal or

cantonment authorities. Alternatively excreta may be disposed off by putting a layer of night soil

at the Bottom of pucca tank prepared for the purpose and covering it with a 15 cm layer of waste

or refused and that covering it with a layer of earth for a fortnight (when it will turn in to

manure). The Contractor shall, at his own expense, carry out all instructions issued to him by the

Engineer–in–Charge to effect proper disposal of soil and other conservancy work in respect of

Contractors work people or employees on the Site. The Contractor shall be responsible for

payment of any charges which may be levied by municipal or cantonment authority for execution

of such work on his behalf. 10. Provision of shelters during rest: At every workplace there shall be provided, free of cost,

four suitable sheds, two for meals and two other for rest, separately for use of men and women

Labour. Height of each shelter shall not be less than 3 meters from floor–level to lowest part of

roof. Sheds shall be kept clean and the space provided shall be on the basis of at least 0.5 sq.m.

Per head. 11. Creches: At a place at which 20 or more women workers are ordinarily employed, there shall

be provided at least one hut for use of children under the age of 6 years, of such women. Huts

shall not be constructed to a standard lower than of thatched roof, mud floor and walls with

wooden planks spread over mud floor covered with matting. Huts shall be provided with suitable

and sufficient openings, for light and ventilation. There shall be adequate provision of sweepers

to keep the places clean. There shall be two ‘dais’ in attendance. Sanitary utensils shall be

attendance. Sanitary utensils shall be provided to the satisfaction of local medical, health and

municipal or cantonment authorities. Use of huts shall be restricted to children, their attendants

and mothers of children. Where the number of women workers is more than 25 but less than 50,

the Contractor shall provide at least on hut and one Day to look after children of women workers.

Size of creche(s) shall vary according to the number of women worker employed. Creche(s) shall

be properly maintained and necessary equipment like toys, etc., provided.

12. Canteen: A cooked food canteen on a moderate scale shall be provided for the benefit of

workers wherever it is considered necessary. 13. Planning, sitting and erection of the above mentioned structure shall be approved by the

Engineer-in-Charge, and the whole of such temporary accommodation shall at all times during

the progress of the Works be kept tidy and in a clean and sanitary condition to the satisfaction of

the Engineer-in – Charge and at the Contractor’s expense. The Contractor shall conform

generally to sanitary requirements of local medical, health and municipal or cantonment

authorities and at all times adopt such precaution as may be necessary to prevent soil pollution of

the Site. On completion of the Works the whole of such temporary structure shall be cleared

away, all rubbish burnt, excreta or other disposal pits or trenched filled in and effectively sealed

off and the whole of Site left clean and tidy to the entire satisfaction of the Engineer-in-Charge

and at the Contractor’s expense. 14. Anti Malarial precautions: The contractor shall at his own expense conform to all anti

malarial instructions given to him by the Engineer-in-Charge, including filling up of any borrow

pits which may have been by him. 15. Enforcement: The Inspecting Officer mentioned in the Contractor's Labour Regulation or

any other nominated in this behalf by Engineer-in-charge shall report to the Engineer-in Charge

all cases of failure to comply with the provisions of these Rules either wholly or in part and the

Engineer-in-Charge shall impose such fines and other penalties are prescribed in the conditions. 16. Interpretations, etc. On any question as to the application interpretation or effect of these

Rules the decision of the Chief Labour Commissioner or Deputy Chief Labour Commissioner

(Central) shall be final and binding. 17. Amendments: Governments may from time to time, add to or amend these Rules and issue

such directions as it may consider necessary for the proper implementation of these Rules or for

the purpose of removing any difficulty which may administration thereof. 64. SAFETY CODE

1. Suitable scaffolds shall be provided for workmen for all work that cannot safely be done from

the ground, or from solid construction except such short period work as can be done safely from

ladders. When a ladder is used an extra mazdoor shall be engaged for holding the ladder and the

ladder is used for carrying materials as well, suitable footholds and hand holds shall be provided

on the ladder and the ladder shall be given an inclination not steeper than 1/4 to 1(1/4 horizontal

and vertical)

2 Scaffolding or staging more than 3.25 meters above the ground or floor, swing or suspended

from an overhead support or erected with stationary support, shall have a guard rail properly

attached bolted, braced and otherwise, secured at least 1 meter high above the floor or platform

of such scaffolding or staging and extending along The entire length of the outside and ends

thereof with only such openings as may be necessary for the delivery of materials. Such

scaffolding or staging shall be of fastened as to prevent it from swaying from the building or

structure.

3. Working platform, gangways stairways shall be so constructed that they do not sag unduly or

unequally, and if height of platform or gangway or stairway is more than 3.25 meters above

ground level or floor level, it shall be closely boarded, have adequate width and be suitably

fenced, as described in 2 above. 4. Every opening in floor of a building or in a working platform shall be provided with suitable

means to prevent fall of persons or materials by providing suitable fencing or railing with a

minimum height of 1 meter. 5. Safe means of access shall be provided to all working platform and other working places.

Every ladder shall be securely fixed. No portable single ladder shall be over 9 meters in length,

width between rails in a rung ladder shall in no case be less than 30 cm for address up and

including 3 meters in length. For longer ladders this width shall increased at least 6mm for each

additional 30 cm of length. Uniform step spacing shall not exceed 30cm Adequate precautions

shall be taken to prevent danger from electric equipment No material on any of the sites shall be

so stacked or placed as to cause danger or inconvenience to any person or the public The

Contractor shall provide all necessary fencing and lights to protect public from accidents and

shall be bound to bear the expenses or defence of every suit action or other proceeding at law that

may be brought by any person for injury sustained owing to neglect of above precautions and to

pay any damages and costs which may be awarded in any such suit, action or proceedings to any

such person or which may with the consent of the Contractor be paid to compromise any claim

by any such person. 6. Excavation and Trenching. All trenches, 1.5 meters or more in depth shall at all times be

supplied with at least one ladder for each 20 meters length or fraction thereof. Ladder shall be

extended from bottom trench to at least 1 meter above surface of the ground. Sides of a trench

which is 1.5 meters of or more in depth shall be stepped back to give suitable slope, or security

held by timber bracing so as to avoid the danger of sites collapsing, Excavated material shall not

be places within 1.5m of edge of trench or half of depth of trench whichever is more. Cutting

shall be done from top to bottom. Under no circumstances shall undermining or undercutting be

done. 7. Demolition: Before any demolition work is commenced and also during the process or the

work. (a) All roads and open areas adjacent to the work Site shall either be closed or suitably protected. (b) No electric cable or apparatus which is ‘liable to be a source of danger over a cable or

apparatus used by operator shall remain electrically charged. (c) All practical steps shall be taken to prevent danger to person employed, from risk or fire or

explosion, or flooding. No floor, roof, or other part of a building shall be so overloaded with

debris or materials as to render it unsafe.

8. All necessary personal safety equipment as considered adequate by the Engineer-in-charge

shall available for use of person employed on the Site and maintained in a condition suitable for

immediate use and the contractor shall take adequate steps to ensure proper use of equipment by

those concerned. (a) Workers employed on mixing asphalted materials cement and lime mortars concrete shall be

provided with protective footwear and protective goggles. (b)Those engaged in handling any material which is injurious to eye shall be provided with

protective goggles. (c) Those engaged in welding works shall be provided with welders protective eye shield. (d) Stone breakers shall be provided with protective goggles and protective clothing and

sufficiently safe intervals. (e) When workers are employed in sewers and manholes, which are in use, the Contractor shall

ensure that manhole covers are paned and manholes are ventilated at least for an hour before

workers are allowed to get into them. Manholes so opened shall be cordoned off with suitable

railing and provided with warnings signals or boards to prevent accidents to public. (f) The contractor shall not employ, men below the age of 18 and women on the work of painting

with products containing lead in any form. Whenever men above the age of 18 are employed on

the work of lead painting, the following precautions shall be taken.

(i) No paint containing lead or lead products shall be used except the form of paste or readymade

paint. (ii) Suitable facemasks shall be supplied for use by workers when paint is applied in the form of

spray or a surface having lead paint dry rubbed and scraped.

9. When work is done near any place where there is risk or drown in all necessary equipment

shall be provided and kept ready for use and necessary steps taken for prompt rescue of any

person in danger and adequate provision made for prompt first aid treatment of all injuries likely

to be sustained during the course of the work. 10. Use of hoisting machines and tackle including their attachment anchorage and supports shall

conform to the following: 1. These shall be of good mechanical constructions, sound material and adequate strength and

free from patent defects and shall be kept in good repair and in good working order.

2. Every rope used in hoisting or lowering materials or as a means of suspension shall be of

durable quality and adequate strength and free from patent defects. 3. Every crane driver or hoisting appliance operator shall be properly qualified and no person

under the age of 21 years shall be in charge of any hoisting machine including any scaffolding

which or gives signals to operator.

4. In case of every hoisting machine and of every chain ring hock shackle swivel and pulley

block used in hoisting or lowering or as mean of suspension safe working load shall be

ascertained by adequate means Every hoisting machine and all gear referred to above shall be

plainly marked with safe working load. In case of a hoisting machine having a variable safe

working load, each safe working load and the conditions under which it is applicable shall be

clearly indicated. No part of any machine or of any gear referred to above in this paragraph shall

be loaded beyond safe working load except for the purpose of testing. 5. In case of a

departmental machine, safe working load shall be notified by the Engineer in charge. As regards

Contractor’s machines the contractor shall notify safe working load of each machine to the

Engineer-in-charge whenever he brings it to site of Work and get it verified by the Engineer-in-

Charge. 11. Motors gearing, transmission, electric wiring and other dangerous parts of hoisting appliances

shall be provided with efficient safeguards hoisting appliances shall be provided with such means

as will reduce to the minimum risk of accidental descent of load adequate precautions shall be

taken to reduce to the minimum risk of any part of a suspended load becoming accidentally

displaced. When workers are employed on electrical installations which are already energized

insulating mats working apparel such as gloves, sleeves and boots, as may be necessary shall be

provided. Workers shall not wear any rings, watches and carry keys or other materials, which are

good conductor of electricity. 12. All scaffolds, ladders and other safety devices mentioned or described herein shall be

maintained in a safe condition and no scaffold, ladders or equipment shall be altered or removed

while it is in use. Adequate washing facilities shall be provided at or near places of work.

13. These safety provisions shall be bought to the notice of all concerned by display on a notice

board at a prominent place at the work spot. Persons responsible for ensuring compliance with

the safety core shall be named therein by the Contractor.

14. To ensure effective enforcement of the rules and regulations relating to safety precautions,

arrangements made by the Contractor shall be open to inspection by the Engineer-in-charge or

his representative and the inspecting Officers as defined in the Contractors Labour Regulations.

15. Notwithstanding the above conditions 1 to 14 the contractor is not exempted from the

operation of any other Act or Rule in force.

FORM OF BANK GUARANTEE IN LIEUOF SECURITY DEPOSTI IN INDIVIDUAL

CONTRACT (On Non-Judicial Stamp Paper) To The EPFO In consideration of the Employees’ Provident Fund Organization having its head office at

New Delhi (hereinafter called the “EPFO” which expression shall unless repugnant to the subject

or context include its administrators, successors and assigns) having agreed under the terms and

whether the said Contractor has committed any breach or breaches of any of the terms and

decision of EPFO that the said Contractor has committed such breach or breaches and as to the

We, the said Bank, I agree that the Guarantee herein contained shall remain in full force and

effect during the period that would be taken for the performance of the said Contracts and till all

the dues of EPFO under the said Contract or by virtue of any of the terms and conditions

governing the said Contract have been fully paid and its claims satisfied or discharged and till the

Accepting Authority of the contract certifies that the terms and conditions of the said Contract

have been fully and properly earned out by the said Contractor and accordingly discharges this

guarantee subject, however that EPFO shall have no claim under this Guarantee after 90 (Ninety)

days from t date of expiry of the Defects Liability Period as provided in the said Contract, i.e,

(date) or from the date of cancellation of the said Contract as the case may be, unless a notice of

the claim under this Guarantee has been served on the Bank before the expiry of the said period

this Guarantee or indemnity from time to time to vary any of the terms and conditions of the said

contract or to extend time of performance by the said Contractor or to postpone for any time and

from time to time any of the powers exe by it against the said Contactor and to enforce or forbear

from enforcing any of terms and conditions governing the said Contract or securities available to

EPFO and the said Bank shall not be released from its liability under these presents by any

exercise by EPFO of any liberty with reference to the matters aforesaid or by reason of time

being given to the said Contractor or any other forbearance, act or omission on the part of EPFO

or any indulgence by EPFO to the said Contractor or any other matter or thing whatsoever which

under the law relating to sureties would but for this provisions have the effect of so releasing the

Bank from its such liability.

It shall not be necessary for EPFO to proceed against the Contractor before proceeding against

the Bank and the Guarantee herein Contained shall be enforceable against the Bank

notwithstanding and security which EPFO may have obtained or obtain from the Contractor at he

time when proceedings are taken against the Bank hereunder be outstanding or un-realized.

We, the said Bank, lastly undertake not to revoke this Guarantee during its currency expect with

TECHNICAL BID DOCUMENT SPECIAL CONDITIONS

1. 1. GENERAL

1.1 Special conditions of contract shall be read in conjunction with General Conditions of

contract, Technical Specifications, Drawings and any other documents forming part of this

contract wherever the context so requires.

1.2 Notwithstanding the sub-division of the documents into these separate sections and volume,

every part of each shall be deemed to be supplementary to and complementary of every other part

and shall be read with and into the CONTRACT so far as it may be practicable to do so.

1.3 Where any portion of the General Condition of Contract is repugnant to or at variance with

any provisions of the Special Conditions of contract, unless a different intention appears, the

provisions of the Special Conditions of Contract shall be deemed to over-ride the provisions of

the Genera Conditions of Contract and shall to the extent of such repugnancy, or variations,

prevail.

1.4 The rates for different items of works shall be for all heights and depths except where

otherwise specified in the items of work. Rates are also inclusive of pre-cautionary’ and – safety

measures for workmen and staff to work under said circumstances.

2. BRIEF SCOPE OF WORKS.

i) The Scope of Work shall consist of fabrication, assembling, providing Modular based

furniture.

ii) Preparation for design drawings and getting the drawing duly approved by Engineer In Charge

as ‘Related for construction’ (or Good for Construction) drawings with additions alteration and

modification made from time to time as required by Engineerin- charge during actual execution.

iii) Erecting one full size, complete in all respect, a sample piece for each item and obtains

approval thereof before undertaking mass production and placing in position at site.’

iv) All the test required for all material as desired by Engineer in Charge.

3. POWER SUPPLY Generally electricity required for the work, shall not be given by EPFO and same has to be

arranged by the contractor. In case EPFO electricity source is available near the work site and

electricity can be spared to contractor as per discretion of Engineer-in-Charge, the contractor may

draw electricity from the EPFO source as approved by Engineer-in-charge. Necessary meter and

connection from the source as approved by Engineer-In-charge shall be arranged by the

contractor. No extra payment towards meter and connection arrangement shall be paid by EPFO.

Wherever EPFO electricity source is used by the contractor, Rs.8 (Eight only) per unit of meter

reading or the charge as fixed by the local Electricity Board/Authority whichever is higher shall

be recovered from the contractor from the Running/Final Bill. The contractor has to make own

arrangement for lying appropriate cables keeping all the safety regulations as Instructed by

Engineer-In-charge. 4. RESTRICTED WORKING HOURS: 4.1 In case normal working hours are reduced due to operational / Security requirement etc.,

nothing extra shall be payable by EPFO on account of restricted working, period and in restricted

working condition. 5. DRAWINGS AND DOCUMENTS 5.1 The drawing accompanying the Tender Document are of indicative nature and issued for

Tendering purpose with the purpose to enable the Tenderer to make an offer in lines with the

requirements of the EPFO. 5.2 However, no extra claim whatsoever shall be entertained for variation, if any, during actual

execution of work. 6. TEMPORARY WORKS 6.1 All Temporary and ancillary works including enabling works connected with the work shall

be responsibility of the Contractor and the price quoted by them shall be deemed to have

included the cost of such works which shall be removed by the contractor at his cost,

Immediately after completion of the work. 7 CONTRACT AGREEMENT 7.1 The contract agreement shall be executed on a non-judicial stamp paper of value of Rs.100/-

(Rupees one hundred only) and cost of the stamp paper shall be borne by the contractor. 7.2 Contractor’s tender including the letters of clarifications between the contractor and the

EPFO prior to the award of contract shall form a part of the Contract agreement to the extent they

have been accepted by EPFO.

8. TURN OVER TAX/ CONTRACT TAX

Turn over Tax/ Works Contract Tax/ Sales Tax/ Cess on works contract and/or any other taxes,

cess etc., which are mandatory for deduction at source, shall be deducted at source at the rates

notified by Govt. of India or respective State Govt. and nothing will be paid by MI on these

accounts.

9. PERFORMANCE GUARANTEE

Within 15(Fifteen) days of issue of work order, the contractor shall submit to EPFO a Bank

Guarantee from any Nationalized Bank equivalent to 5% of the Contract value towards

performance guarantee. Bank Guarantee of 50% of the amount shall be released after satisfactory

completion of the work and balance 50% shall remain valid till satisfactory completion of defects

liability period of 12 months (The defects liability period of 12 months shall be reckoned from

the date of actual completion of work). If the aforesaid performance guarantee is not submitted

within the stipulated time period. Interest @ 10% per, annum will be charged till the date-of

submission of performance guarantee for delayed period of submission.

10. WORK EQUIPMENT

10.1 The contractor shall be responsible to arrange at his own cost all necessary tools and plants

required for execution of the work. 10.2 The contractor shall without prejudice to his overall responsibility to execute and complete

the work as per specifications and time schedule, progressively deploy adequate equipments and

tools and tackles and augment the same as decided by the Engineer-incharge depending on the

exigencies of the work so as to suit the construction schedule. 10.3 No equipment shall be supplied by EPFO.

11. SITE ORGANISATION

11.1 Subject to the provisions in the tender document and without prejudice to contractor’s

liabilities and responsibilities to provide adequate qualified and skilled personnel on the work,

contractor shall deploy site organization and augment the same as decided by the Engineer-in-

charge depending on the work. No personnel of the contractor deployed at site shall be removed

from the site without prior approval of the Engineer-in-charge.

12. LABOUR CAMPS 12.1 No Labour will be allowed to stay in the building/complex.

13. REGULATIONS 13.1 All men and vehicles will observe the regulations in force in the building complex and will

do nothing to pose any danger to the smooth operations of the building/complex. 13.2 All men and vehicles shall be permitted to the building premises only on possession of

security passes issued, by EPFO. The contractor shall apply in writing in advance of the

commencement of work for issue of security passes and shall submit a list of personnel

concerned with their addresses and photograph. Engineer-In-Charge who shall, at, his, discretion,

have the right to recommend the issue of passes to control the admission of contractor, his agents,

his staff and workmen. The contractor shall ensure that his men will work in areas/zones allotted

to them. Passes shall be deposited with Engineer-in-charge on demand and in any case

immediately after completion of work. The contractor, his ‘staff/workmen shall observe all the

rules promulgated, from time to time by the concerned authorities. Any person found violating

the security rules laid down by the Authority will be expelled from the area without assigning

any reason whatsoever and contractor shall have no claim on this account. Nothing extra shall be

payable by EPFO on account of working in restricted working conditions. 13.3 In case normal working, hours are reduced due to operational, security requirements, etc. no

extra payment shall be admissible to the contractor but suitable extension of time shall be granted

subject to verification of proper records of such restricted working hours maintained at site.

14. INSPECTION OF SITE AND TESTING 14.1 The Engineer-in-charge or his authorized representative shall have full power to inspect any

portion of the work, examine the materials and workmanship at the contractor’s works or at any

other place from where the material is obtained. Acceptance of any material shall in no way

relieve the contractor of his responsibility for meeting the requirement of the specifications. 14.2 All tests as directed by the Engineer-in-charge shall be done at the approved laboratory or

manufactures lab as decided by Engineer-in-charge. Testing charges if any shall be borne by the

Contractor. All other expenditure required to be incurred for taking the samples (inclusive of cost

of samples), conveyance, packing etc. shall also be borne by the Contractor. Authorized

representative of Contractor or contractor himself should be present during sampling and testing. 14.3 In case there is any discrepancy in frequency of testing as given in list of mandatory tests

and that in INDIVIDUAL sub-heads of work as per CPWD/BIS/BIFMA Specifications/Standard

or the practices recommended by relevant Indian manufacturer Specifications, the higher of the

two frequencies of testing shall be followed, and nothing extra shall be payable to the Contractor

on this account. 14.4 The contractor should make arrangement for factory inspection of the product bought to the

sites before delivery at site if desired by Engineer-in-charge

15. SITE FOR STACKING OF MATERIALS

15.1 The contractor shall stack materials at the site of work strictly as per instructions of

Engineer-in-Charge keeping in view the requirements of the EPFO. Nothing extra shall be

payable for any extra lead, Involved in stacking the material at a reasonable distance away from

the work place.

16. SITE PRECAUTIONS

i) Any materials or T & P etc. found lying outside the sites approved by the Engineerin-Charge

shall be removed by the Engineer-in-charge at the risk and cost of the contractor.

ii) With regard to construction safety measures the contractor shall adhere to various Indian

Standard Codes of Practice, requirements of provincial Government and local Municipal

Authority wherever the provisions of the latter two agencies shall be more stringent than the

provisions of the former. When these codes do not exist, the contractor shall adhere to such

safety measures as directed by the Engineer-incharge.

iii) The contractor shall be responsible for any damage, resulting from his operations, either to

buildings, structures, airport fixtures such as underground cable, contact lights, hard surface

areas, water mains, other operational Installation, Airport roads etc. The contractor shall restore,

replace or repair any such damage to the complete satisfaction of the Engineer-in-charge and in

default the Engineer-in-charge may cause the same to be made good by any other means and

deduct the expenses from any sums due to contractor.

17. No payment will be made to the contractor for damage caused by rains or other natural

calamities or any person during the execution of the works and no such claim on this account will

be entertained.

18. EMPLOYMENT OF STAFF

The contractor shall employ the following staff for proper supervision of the work, and to take

instructions etc.

a. One experienced supervisor. Above services is to be made available from the 15 day after

award of work. In the event of non-deployment of above staff, penalty at the rate given below

shall be levied and recovered through bills of the contractor.

b. For non-deployment of experienced supervisor Rs.250/-per day.

19. SUBMISSION OF PURCHASE VOUCHERS AND INSPECTION OF SITE BY

MANUFACTURER

19.1 Contractor has to submit purchase vouchers of all the products used in the work from the

manufacturer along with Certificate confirming therein that the product supplied are meeting the

Technical specification and schedule ‘A’ (BOQ) Technical Parameters of this NIT/work.

19.2 During execution of work, the contractor shall arrange the visits of manufacturer or his

authorized representatives to the site as and when required by Engineer-in-charge, for Inspection

of work and verify that the work is being executed as per Technical specifications & Schedule

19.3 After completion of work, the contractor-shall arrange visit of manufacturer or his

products used in the work are supplied/authorized by him and that all these products and quality

& workmanship of the work are strictly confirming to technical specifications and schedule A

TECHNICAL BID DOCUMENT SPECIAL TECHNICAL SPECIFICATIONS

SECTION A (WORK STATION)

Work station (Panel Based) with prelaminated Top

Providing & Fixing in position modular workstation having partition height from 1135 - 1200mm

having thickness of 54mm +/-4mm. Partition panel consists of frame work made of 1.5mm thick

aluminium and would be finished by Aluminium alloy extrusions of 1.2-21mm thickness 50-

58mm x 12-17mm of matching height of the panel and a top runner of powder coated aluminium

extrusions 54mm +/-4mm x 12-13mm x 1.2 to 2.1mm thick. Further the frame work should

consist of an infill structure of batten of size 40-50 x 25-40mm particle board honey comb inside.

The outer layer shall be made of MDF/PPB of 3-4mm thickness and finished with Decorative

laminated sheets of 0.6 -1.0mm thickness having one side bearing the decorative surface for

Bottom panel and Fabric for top panel. The total block thus would be of 44-54mm thickness.

This shall be attached to top panel by means of self tapping screws. All steel parts shall be

pretreated for seven stages anti corrosion treatment followed by epoxy powder coating. Height of

skirting shall be 85 to 150mm.

One intermediate raceway to be provided below or above the worktop as decided by the

Engineer-in-charge. Partition to be supported by stability brackets wherever required.

Workstation Consists of work surface of 25mm thick prelaminated particle board having

PVC edge lapping of 2mm thick on all exposed edges and 0.6mm on all butt edges and pressed at

200 Degree centigrade with hot melt glue on edge banding machines. The worktop shall be

supported by cantilever / brackets made of MS steel duly powder coated.

The work station shall be also be provided with name plate holder in acrylic of approx

size 230x75mm. The workstation to be made in following sizes and configuration as per sizes

and details given as per reference. Drawing & schedule of quantities.

a. Connectors

These are powder coats 1.8 mm thick aluminum alloy extrusions of 50-52 mm x12mm sections

and shall be available in height matching that of that panel. IS Code for aluminum is: 733: 1983.

Two adjacent connectors shall be connected by interlocking extrusions of 1.8 m thickness using

locking strip and grub screws. The partition blocks shall be directly fitted into these connector

extrusions

For cantilevered accessories like overhead storages, work surfaces, adequate slotted strips

with slots at 64 mm pitch shall be provided in the vertical connectors at required positions for

accepting the brackets of the unit/ accessory desired.

Each connector shall carry 5 holes of 15 diameter at 36 mm pitch at the intermediate

raceway level and one 117.5mm x15 mm cut-out at the button for passage of cables.

b. Junction

Junctions shall be 2 way 90 Deg, 2 way 180 Deg, 3 way 90 Deg, 4 way 90 Deg, 2 way 120 Deg.

And 3 way 120 Deg, 2 way 135 Deg and 3 way 135 Deg aluminum alloy extrusions with slots for

wire management as and wherever required.

c. End frames

Exposed vertical ends shall be covered by extruded aluminum section trim of size 50-52 mm x

1.8 mm.

d. Top Runners

Top runners shall be powder coated aluminum alloy extrusion, 50-52 mm x 1.5 mm thick. This

shall be attached to top of panel by means of PVC extrusion of 48 mm width. ABS end caps fit

below top runner.

e. Bottom Raceway Assembly

It shall consist of a 1.2 thick powder coated MS C Channel of size 49.5 mmx7mm. The raceway

fascia shall be of 1.0m thick powder coated MS, a part of bottom raceway assembly of size 85-15

mm x50-52 mm and located horizontally along with the width of the panel.

f. Glide Screw

Glide screw shall be inbuilt in Bottom Raceway Assembly. There shall be two glide screws per

panel. The material shall be of galvanized MS with glide base of ABS, diameter of the head of

the glide screw shall be 40 mm. The adjustment in height possible shall be around +10 mm.

g. Stability

The 50 –52 mm thick panel system shall be sufficiently rigid so that work surfaces and other

accessories can be supported by them at desired point without affecting the overall stability.

h. Cable Management

Cable wires shall be carried inside metal raceways located at the bottom of panels and also above

or below the work surfaces. Bottom wire carrier shall be provided as a standard feature in all the

partitions. Cable shall be carried on a continuous basis through slots at intermediate level by

providing intermediate raceways. Intermediate raceway shall be of height 85-150 mm

sandwiched between top and bottom block of panels. The vertical run to these raceways can be

through the triangular vertical columns or concealed between a double skin panel or any other

suitable vertical support. All external metal components are powder coated colour standard/

nonstandard.

i. Edge trims and Joiner Extrusions:

Edge trims for double skin panel system are made up of powder coated aluminum with PVC caps

at the end and the joineries. The colour of the power coating will be as per colour specified by

EPFO CONNECTORS should be of aluminum extrusions of angle configuration 90 deg .Etc.

Item No. 1.20 Providing & fixing in position the add on partition to increase the height of

workstation partitions from 1200 to 1650. The specification and partition system to be same as

low height partition as in Workstation (Panel Based) with prelaminated top.

Workstation (Tile Based) with post formed Top

Providing and fixing partition 60-70mm thick having inner clear space of 4052mm for electrical

wiring. The height of partition should be 1200-1250mm. All metallic parts shall undergo a seven

stage anti rust treatment and shall be powder coated in matt finish to a thickness of 40-60

microns. All the hardware items should be as per BIFMA/ANSI standards. All other items as per

IS standards.

Modular Partition -The modular partitions shall not be grouted in the floors. The modular

partitions shall be an assembly of the following parts.

Levelers -Each frame shall be provided with two 8-15mm leveling bolts which allow 10-25mm

adjustment for floor unevenness.

Frames Shall from the basic support structure for all other components. The vertical member of

the frame bearing the load of brackets and storages shall made of 1.5mm CRCA steel. The

horizontal members shall be made of 1. On CRCA steel. The thickness of the frame shall be 35-

45mm. Each individual module shall not be more than 1200mm in length. The frames shall also

have prefabricated slots for fixing brackets used to support worktops. Overhead hampers, gable

ends etc. All the verticals & horizontal frame shall be fixed with nut & bolts and shall not be

welded.

Skirting : The frame shall have a skirting of 100-150mm height. The skirting shall be designed

so that switches can be provided at the skirting level. The skirting shall be snap fitted on both

sides with skirting plates made of 0.8mm thick CRCA steel. Wherever switches are provided on

the skirting plates shall have the necessary slots.

Post/Covers -The frames shall be connected at the junctions by aluminium connectors. The post

shall be made of aluminium extrusions of minimum 1.2m thickness. Trims-The exposed vertical and horizontal faces of the frames shall be snap fitted with curve

trims. The trims shall be made of aluminum extrusions of minimum 1.2mm thickness and 60-

70mm width.

Wire management-Partitions system shall have concealed wire management capabilities to meet

requirement and technical specifications and shall be engineered for responsive and fire safe

operations of power, telecommunications and data (LAN) and shall have the provision for

raceway at bottom and middle level. Separate components for electrical data and telephone

cables having adequate capability of both the vertical and horizontal wire movements. II Slots shall be provided on Frame to fix all electrical and data points. III Storage for excess wires in the partitions. IV Easy access for further maintenance and capacity for additional power, data Phone point to

the panels without the need to dismantle work surface. Title Finish-The partition shall have tiles made up of laminate/fabric/white maker as per

direction of engineer-in-charge with the following details. Laminated Tiles -The laminated tiles shall be made of min.9mm Pre laminate PLPB with

decorative laminate on one side and balancing lamination on other side Fabric Tiles -The fabric tiles shall be made of min 9mm soft board inside & covered with fabric

pasted on them by PVA glue. It should be possible to replace the fabric by peeling it off. Workstation consist of Work surface made of 25mm thick post formed particle board with

0.7mm decorative laminate on top & balancing laminate on unexposed face and having all

exposed edges sealed with PVC edge banding tape. The worktop shall be supported with

cantilever brackets made of MS steel duly powder coated. Work surface shall be provided with

wire manager to carry wires from the bottom complete as per salient features, specification,

drawing & directions of the Engineer-in-charge. The workstation shall also be provided with name plate holder in acrylic of approx size

230 x 75mm. The workstation to be made in following sizes and configuration as per sizes and

detail given in bill of quantities also (Refer Drawing) Add -On Partition

Providing & fixing in position the add-on partition to increase the height of workstation partitions

from 1200 to 1650. The specification and partition system to be same as low height partition as in

Workstation (Tile Based) with post formed Top

Desk Based Workstation

Providing & fixing Desk based system overall height 1150-1175mm with top in 25mm

prelaminated particle board in curvilinear/linear shape having main post & legs in CRCA steel

duly powder coated. The system shall have 25mm thick prelaminated particle board/soft board

between 2 worktops. Below the worktop runs the cable tray in steel duly powder coated to run

the cables. The screen shall have aluminium extruded end trims on both sides of screen. Height of

screen shall be 600mm & it shall be projected 400mm above worktop level of 750mm thereby

making overall height of workstation as 1150mm.

CRCA steel of 0.8mm thickness duly powder coated. It shall be covered with board at the top. Workstation consists of work surface of 25mm thick prelaminated particle board having

PVC edge lapping of 2mm thick on all exposed edges and 0.6mm on all butt edges & pressed at

200o C with hot melt glue on edge handing machines. The Workstation shall have side quarter round privacy screen made of 25mm thick

prelaminated particle board provided on both sides. The Workstation shall be supported with Drawer unit having overall size 380x500x725ht.

on one side Leg panel on the other side. Drawer unit shall be made of 18mm prelaminated

particle board with inner drawer in steel duly powder coated moving on nylon rollers. It consists

of one drawer and one open able shutter below with proper locking arrangement. The Workstation shall also be provided with name plate holder in acrylic of approx x size

Cashier Counter

Providing & fixing modular cashier counter 60-70mm thick made up of partition of height

(2900+/-300mm ht.) having CRCA section frame work having 12mm thick PLPB/SB/Glass,

panel having bottom and middle raceway in steel & covers in extruded aluminium section duly

powder coated and ABS plastic caps. The Front Cashier Panel shall be in glass with slit/hole for

paper/cash/voice interaction. One intermediate raceway to be provided below or above the worktop as decided by the

Engineer-in-charge. Partition to be supported by stability brackets wherever required. The Counter is provided with a Sharer top of size 450mm (D) & work surface top of 600

(D) in 25mm thick post formed finish. The worktop shall be supported on one vertical support in

18mm prelaminated particle board. The Workstation shall also be provided with name plate holder in acrylic of approx size

230 x 75mm. The Workstation to be made in following sizes and configuration as per sizes and

detail given in the bill if quantities and Refer drawing

CRCA steel. Wherever switches are provided on the skirting, the skirting plates shall have the

necessary slots Switched at the skirting level shall be mounted on the skirting. Post -The frames shall be connected at the junctions by aluminium connectors. The post shall be

Providing and fixing minimum 38mm thick factory made Flush Door shutters in the full height

partition made of machine cut seasoned hard wood battens held within a frame made of a strip of

25mm wide hard wood edge miter joined and then faced with 4mm commercial ply on both sides

pasted with suitable-resin glue. Hot pressed in machine to produce an accurate and warp free

plank. Further faced with 1mm laminate of approved shade to make the total thickness of flush

shutter of 40mm and providing and fixing first class teak wood lapping along the edges of the

shutters finished with melamine polish and including providing and fixing the following fixtures

in each door shutters.

ISI marked anodized aluminium but hinges (anodic coating not less than grade 10 as per

Providing & fixing table having an overall size of (3000x1200x750) with top made of 36mm

thick board pressed with 0.4mm thick membrane foil clad pressed with PU glue. The foil shall be

precoated with a layer of polyurethane for better scratch resistance. The table shall have 2 former

module supported on steel vertical post of 65mm dia duly powder coated. The main table shall

have understructure having verticals made of 36mm thick post formed legs supported with 32(D)

steel studs duly powder coated and modesty made of 18mm thick prelaminated particle board

having decorative laminate on both side.

Side Unit: Providing & Fixing side Unit having overall size (1850x500x750)x 600mm without

top & 1250mm with top made of 36mm thick board pressed with 0.4mm thick membrane foil

clad pressed with PU glue. The foil shall be precoated with a layer of polyurethane for better

scratch resistance. Side unit shall have understructure having verticals made of 25mm thick post

formed and made of 18mm thick prelaminated particle board having decorative laminate.The side

unit shall have a provision for keyboard, Openable space for CPU printer shelf and an open able

shutter in 18mm membrane finish as per diagram.

Back Unit : Providing & fixing Back Unit having overall size (3000x500x750) and top made of

36mm thick board pressed with 0.4mm thick membrane foil and pressed with PU glue. The foil

shall be precoated with a layer of polyurethane for better scratch resistance. Storage unit of size

2550 x 500 x 714 shall have understructure having verticals made of 18mm thick prelaminated

particle with 2 open able shutter storage and drawer fascia in membrane finish and glass as in

drawing (Refer Drawing)

Providing & Fixing angular table having an overall size of (2900 x 1050 x 750) with top made of

36mm thick board pressed with 0.4mm thick membrane foil clad pressed with PU glue. The foil

shall be precoated with a layer of polyurethane for better scratch resistance, in 2 angular pieces.

The main table shall have understructure having verticals made of 36mm thick post formed legs

with modesty made of 18mm thick prelaminated particle board having decorative laminate on

both sides. The table shall also have a Drawer Unit of Size 460 x 575 x 550 made up of 2 drawer

+ 1 Filling in 18mm prelaminated particle board with membrane facia in inner steel.

Side Unit: Providing & Fixing Side Unit having overall size (2250 x550x714)x 750mm without

top and 1500mm with top made of 35mm thick board pressed with 0.4mm thick membrane foil

clad pressed with PU glue. The foil shall be precoated with a layer of polyurethane for better

scratch resistance. Table shall have understructure made of 18mm thick prelaminated

particleboard having decorative laminate on both sides. The side unit shall have open able shutter

storage & 3 drawer unit, with facia in membrane finish. Back Unit : Providing & Fixing Back Unit having overall size (3000x550x1200mm (Ht)

(750+450) with top made of 36mm thick board pressed with 0.4mm thick membrane foil clad

pressed with PU glue. The foil shall be precoated with a layer of polyurethane for better scratch

resistance. Storage shall have understructure having verticals made of 18mm thick prelaminated

Providing & Fixing table having an overall size of (2300x900/1100x750) with top made of

36mm thick post formed particle board and former module made of 36mm thick board pressed

with 0.4mm thick membrane foil clad pressed with PU glue. The foil shall be precoated with a

layer of polyurethane for better scratch resistance. The table understructure shall have vertical leg

made of 25mm thick post formed particle board on one side and supported by three drawer unit

made of 18mm thick PLPB with 50(D) studs made of steel duly powder coated and modesty

interior furnishing and modular furniture work at S R O, Tinsukia of EPFO, and has by letter of

from Sub Regional Office, Tinsukia as per accepted tender submitted by the contractors for the

execution, completion and maintenance of such works.

NOW THIS AGREEMENT WITNESSETH as follows:-

1. In this Agreement, words and expressions shall have the same meaning as are respectively

assigned to them in the conditions of contract hereinafter referred to.

2. The following documents in conjunction with Addendum/Corrigendum to Tender Documents

shall be deemed to form and be read and constructed as part of the agreement viz:-

a) This form of agreement.

b) The Letter of Awards.

c) The Instructions to Tenderer.

d) The General Conditions of the Contract.

e) The special Conditions of the contract.

f) Safety Code.

g) Contract Labour Regulation.

h) The Technical specifications and drawings for furniture.

i) Priced bill of quantities.

3. The aforesaid documents shall be taken as complementary and mutually explanatory of one

another, but in the case of ambiguities or discrepancies, shall take precedence in the order set out

above.

4. Performance guarantee for a sum of equal to 5% (five percent) of tendered value shall be

provided by you as per clause of special contract. Performance Guarantee shall be released as per

clause 9 of special conditions of contract. 5. Work shall be executed as per conditions / specification given in the tender document. 6. Payment will be made as per the conditions stipulated in the tender document. 7. Supply of material will be 30 days from the date of placing the order by EPFO office. The

bidder must note that the successful bidder should give a performance guarantee in the form of

bank guarantee amounts to 5% of the order. The performance guarantee should be furnished after

order for supply is placed, and should be valid upto expiry of the maintenance period. 8. 10% security deposit shall be deducted from each running account bill and same shall be

refunded after successful completion of the defect liability period and rectification of the defects

observed, if any and getting necessary clearances as per clause No.45 of general condition of

contract. 9. TAXATION: Recovery on account of Income Tax shall be made as per the provisions of the

Income Tax Act. 1961 and rules made there under. 10. LIQUIDITY DAMAGES: If the contractor fails to maintain the required speed and the work

is not completed during the stipulated time period, EPFO shall recover liquidated damages at the

rate of ¼ % (one quarter percent) of the total cost of the work per week of delay subject to a

maximum of 5% (five Percent) of the total cost of work, or such smaller amount as may be fixed

by the competent Authority. 11. Time & Extension for Delay:-The time allowed for execution of the works as specified or

the extended time in accordance with these conditions shall be the essence of the contract. The

execution of the works shall commence from the 15th day after of the date on which the Regional

Provident Fund Commissioner, (Region) / Engineer – in charge issues written order to commence

the work or from the date of handing over of the site whichever is latter. If the contractor

commits default in commencing the execution of the work as aforesaid, EPFO shall without

prejudice to any other right or remedy be at liberty to forfeit the earnest money absolutely.

a) Request for extension of time, to be eligible for consideration, shall be made by the Contractor

in writing within fourteen days of the happening of the event causing delay. The contractor may

also, if practicable, indicate in such a request the period for which extension is desired.

b) In any such case the authority may give a fair and reasonable extension of time for completion

of the work, such extension shall be communicated to the Contractor by the Regional Provident

Fund Commissioner (Region) / Engineer-in-Charge.

Payment on Account: A. The Contractor shall submit interim bills at intervals fixed by the R.P.F.C (Region)/Engineer-

in-Charge for the work executed. The R.P.F.C(Region)/Engineer-incharge shall then manage to

have the bill verified by taking or causing to be taken, where necessary the requisite

measurements of the work. Payment on account for admissible shall be made on the

R.P.F.C(Region)/Engineer-in-charge certifying the sum to which the Contractor is considered

entitled by way of interim payment for the following. All work executed, after deducting there

from the amounts already paid, the security deposit and such other amounts as may be deductible

or recoverable in terms of the Contract. 75 per cent of the cost (as assessed by the

R.P.F.C.(Region) / Engineer-in-Charge) of any materials which are in the opinion of the R.P.F.C.

(Region) / Engineer in charge reasonably required in accordance with the Contract and have been

brought to site for incorporation in the Works and are safeguarded against loss due to any cause

whatsoever to the satisfaction of the R.P.F.C(Region)/Engineer-in-Charge, but have not been so

incorporated provided the contractor provides as insurance cover for the full cost of perishable

materials. The advance payments shall be adjusted as and when materials are utilized in the

Works. The amount admissible for interim bills shall be normally paid within a month from the

date of receipt of the bill by the R.P.F.C. (Region) / Engineer in charge after such verification as

is considered necessary. Any interim certificate given relating to work done or materials

delivered, maybe modified or corrected by any subsequent interim certificate or by the final

certificate. No certificate of the R.P.F.C(Region)/Engineer-in-Charge supporting an interim

payment shall of itself be conclusive evidence that nay work materials to which it relates is/are in

accordance with the contract. Pending consideration of extension of date of completion interim

payments shall continue to be made as interim provided. B Time Limit for Payment Of Final Bill: the Contractor shall submit the final bill within three

months of physical completion of the Works. No further claims shall be made by the Contractor

after submission of the final bill and these shall be deemed to have been waived and

extinguished. Payment of the items of the bill in respect of which there is no dispute and of items

in dispute, for quantities and at rates as approved by R.P.F.C(Region)/Engineer-in-Charge, shall

be made within the period specified hereunder, the period being reckoned from the date of receipt

of the bill by the R.P.F.C(Region)/Engineer-in-Charge:

(a) Contract amount not exceeding Rs.5lacs 15 days. (b) Contract amount exceeding Rs.15lacs two months.

After payment of the amount of the final bill payable as aforesaid has been made, the Contractor,

if he so desired, reconsider his position in respect of the disputed portion of the final bill and if he

fails to do so within 50 days, his disputed claim shall be dealt with as provided in the Contract.

C. Advances: Advances will, subject to availability of funds and, if required by the Contractor,

be given as under within six weeks of submission of application by him subject to other

conditions being fulfilled and the R.P.F.C(Region)/Engineer-in-Charge certifying the sum to

which the Contract is entitled by way of advance: a. In case of contract valued at over Rs.50 lacs: For plant and equipment specifically acquired for

the work and brought to Site, at 75% of the purchase price of new machinery against production

of documents in support thereof and subject to the conditions that the R.P.F.C(Region)/Engineer-

in-Charge considers the price reasonable and that such plant and equipment are necessary for the

and not in excess of requirements and are hypothecated in favour of EPFO in the form required

by EPFO, interest on the sum outstanding shall be levied at the % age mentioned. Advance

against plant and equipment shall in nor case exceeds 6% of the Contract Sum. b. In the case of contracts valued lower Rs.50lakhs: a lumpsum advance not exceeding 4 percent

of the contract sum against a guarantee acceptable to EPFO @ interest. The advance shall be

utilized for the purpose of this contract only and for no other purpose. Provided that if a request

for advance is made by the Contractor again the aforementioned provisions, the total sum be

given as advance shall not exceed 8% of the Contract Sum. c. Recovery of the sums advanced against (a) and (b) above and of interest thereof shall be made

by deduction from the on account payments referred to in condition/I in suitable percentage in

relation to the progress, as fixed by the R.P.F.C(Region)/Engineer-in- Charge, so that all the

sum/advanced with interest thereon shall be fully recovered by the time work amounting to

nearly 80% of the contract sums is completed if the amount payable under any interim bill is not

sufficient to cover all deductions to be made for sums advanced and other sums deductible there

from, the balance outstanding shall be, deducted from subsequent bill/bills as may be necessary,

failing that, as otherwise provided for in the contract. d. If for any reason, except a default, the work under the Contract is suspended or is to be

suspended for more than 15 days, the contractor shall be at liberty to remove the plant and

equipment or any part thereof hypothecated to EPFO above to any other Works site of the

Contractor for carrying on his other Works, on his furnishing prior to such removal a bank

guarantee acceptable to EPFO for the amount of the outstanding advance granted above with

interest and undertaking to bring back to the site, before expiry of the period of suspension, the

plant and Equipment as may be necessary for completion of the Works if such plant and, are not

brought back, the Contractor shall forthwith repay the amount of advance outstanding with

interest.

D. Income Tax Recovery: Before releasing payment to the Contractor, tax recovery shall be

made from the contractor’s bill at the rate as applicable during that time. For payment towards

advances, income tax recovery shall be made and advances shall be recovered as per terms and

conditions provided in conditions.

E Overpayments and Underpayments

whenever any claim for the payment of a sum of money to EPFO arises of or under this Contract

against the Contractor the same may be deducted by EPFO from any sum then due or which at

any time thereafter may become due to the contractor under this Contract and failing that under

any other Contract with EPFO which may be available with EPFO or from his security deposit or

he shall pay the claim on demand. (a) EPFO reserve the right to carry out post-payment audit and technical examination of the final

bill including all supporting vouchers, abstracts, etc, EPFO further reserve the right to enforce

recovery of any other when detected notwithstanding the fact that the amount of the final bill

may be included by one of the part as an item of dispute before an arbitrator appointed, of this

Contract and notwithstanding the fact that the amount of the final bill figures in the arbitration

award. (b) If as a result of such audit and technical examination any overpayment is discovered in

respect of any work done by the Contractor or alleged to have been done by him under the

contract, it shall be recovered by EPFO from the Contractor by any or all of the methods

prescribed above or if any under payment is discovered the amount shall be duly paid to the

Contractor by EPFO. (c) Provided that the aforesaid right of EPFO to adjust overpayment against amount due to the

Contractor under any other Contract with EPFO shall not extend beyond the period of two years

from the date of payment of the final bill or In case the final bill is a MINUS bill, from the date

the amount payable by the contract under the MINUS final bill is communicated to the

Contractor under the MINUS final bill be communicated to the contractor. (d) Any amount due to the Contractor under this Contract for under payment may be adjusted

against any amount then due or which may at any time thereafter become due before payment is

made to the contractor, from him to EPFO on any other Contract or account whatsoever.

13. MAINTENANCE PERIOD: The contractor shall be fully responsible for the quality,

workmanship and structural safety of the construction work. Contractor shall be fully responsible

for liability of defects in the work executed by him for a period of one year from the date of

successful handing over of the work of EPFO. The contractor at his own cost and expenses shall

rectify all defects observed during the defects liability period. In the event of failure on the part

of the contractor to rectify the defects the same may, without prejudice to any other right

available to it in law, be rectified by EPFO for and on behalf of contractor. EPFO shall have the

right to deduct or set off the expenses incurred by it in rectifying the defects as aforesaid

from/against any amount due and payable or becoming due and payable by EPFO to the

contractor under this agreement or any other contractor what-so-ever.

14. Liability for Damage, Defects of Imperfections and Rectification thereof: If the Contractor or his workman or employees shall injure or destroy and part of the building in

which he may be working or any building, road, fence, etc. contiguous to the premises on which

the work or any part of it is being executed, or if any damage shall happen to them while in

progress the Contractor shall upon receipt of a notice in writing in that behalf make the same

good at his own expense. If it shall appear to the R.P.F.C. (Region)/Engineer-in-charge or his

representative at any time during construction or reconstruction or prior to the expiration of the

Defects Liability Period, that any work has been executed with unsound, imperfect or unskilled

workmanship or that any material or articles provided by the Contractor for execution of the

work are unsound or of a quality inferior to that contract for, or otherwise not of defective or

improper materials or workmanship, the Contractor shall, upon receipt of a notice in writing in

that behalf from the R.P.F.C. (Region)/Engineer-in-charge, forth with rectify or remove and

reconstructed the work so specified in whole or in part, as the case may require or as the case

may be, and /or remove the materials or articles and provide other proper and suitable materials

or articles at his own expense, notwithstanding that the same may have been inadvertently

passed, certified in his notice aforesaid, the R.P.F.C. (Region) / Engineer-in-charge may rectify

or remove and re-execute the work and/or remove and replace with others the materials or

articles complained so as the case may be, by other means at the risk and expense of the

contractor. 15. In consideration of the payments to be made by the Employer to the contractor as hereinafter

mentioned, the contractor hereby covenants with the employer to execute, complete and maintain

the works in conformity in all respects within the provisions of the contract.

16. The Employer hereby covenants to pay to the contractor in consideration of the execution,

completion and maintenance of the works at contract price at the time and in the manner

prescribed by the contract.

GUIDELINES FOR FILLING UP THE FINANCIAL BID DOCUMENT

1. The Financial Bid Document shall be read in conjunction with the Instructions to Tenderers,

General and Special Conditions of Contract Technical Specifications and Drawings.

2. The basis of payment will be the actual quantities of work ordered and carried out, as

measured by the Contractors and verified by the Engineer and valued at the rates and prices

tendered in the priced Bid Document where applicable and otherwise at such rates and prices as

the Engineer may fix within the terms of the Contract.

3. The rates and prices tendered in the financial price bid document shall, except in so far as it is

otherwise provide under the Contract, include all constructional plan, labour supervision,

material, erection, maintenance, insurance, profit, VAT, state sales taxes and duties, together with

general risks, liabilities and obligations set out or impelled in the Contract

4. Octori if paid, it will be re-imbursed maximum for one entry on production of actual

documents.

5. The tenderer should quote rate against each item in figure and as well as words.

6. Tendereres shall price the schedule of quantities in Indian Rupees only.

7. Rebate may be offered on rates for orders exceeding Rs 10 lacs for addl value of each Rs. 5

lacs.

8. Rate should be quoted for all items for which quantity given.

9. Rate may also be quoted for the items quantity not given as in case of necessity at site, the

same will be executed.

10. Any unfilled and incomplete financial bid will be summarily rejected.

1135 -1200mm having thickness of 54mm +/-4mm. Partition panel consists of

framework made of 1.5mm thick aluminum and would be finished by Aluminum

would be of 44-54mm thickness. This shall be attached to top panel by means of self

tapping screws. All steel parts shall be pretreated for seven stages anti corrosion

treatment followed by epoxy powder coating. Height of skirting shall be 85 to

150mm. One intermediate raceway to be provided below or above the worktop as

decided by the Engineer-in-charge. Partition to be supported by stability brackets

wherever required. Workstation consists of work surface of 25mm thick prelaminated

particle board having PVC edge lipping of 2mm thick on all exposed edges and

0.6mm on all butt edges & pressed at 200o C with hot melt glue on edge banding

machines. The worktop shall be supported by cantilever/ brackets made of MS steel

duly powder coated. The Workstation shall also be provided with name plate holder

in acrylic of approx size 230x75mm. The Workstation to be made in following sizes

2.1 Workstation (Tile Based) with Post formed Top

Providing and fixing partition 60-70mm thick having inner clear space of 40-52

mm for electrical wiring. The height of partition should be 1200-1250mm. All

metallic parts shall undergo a 7 stage antirust treatment and shall be powder

coated in matt finish to a thickness of 40-60 microns. All the hardware items

should be as per BIFMA/ANSI standards. All other items as per IS standards.

Modular Partition -The modular partitions shall not be grouted in the floors. The

modular partitions shall be an assembly of the following parts:-Levelers -Each

frame shall be provided with two 8-15mm leveling bolts which allow 10-25mm

adjustment for floor unevenness. Frames shall form the basic support structure for

all other components. The main vertical member of the frame bearing the load of

brackets and storages shall be made of 1.5mm CRCA steel. The horizontal

members shall be made of 1.0mm CRCA steel. The thickness of the frame shall be

35-45mm. Each individual module shall not be more than 1200mm in length. The

frames shall also have prefabricated slots for fixing brackets used to support

worktops. Overhead hampers, gable ends. Etc. All the verticals & horizontal frame

shall be fixed with nut & bolts and shall not be welded. Skirting: The frame shall

have a skirting of 100-150mm height. The skirting shall be designed so that

switches can be provided at the skirting level. The skirting shall be snap fitted on

both sides with skirting plates made of 0.8m thick CRCA steel. Wherever

switches are provided on the skirting plates shall have the necessary slots.

Post/Covers-The frames shall be connected at the junctions by aluminum

connectors. The post shall be made of aluminum extrusions of minimum 1.2m

thickness. Trims-The exposed vertical and horizontal faces of the frames shall be

snap fitted with curve trims. The trims shall be made of aluminum extrusions of

minimum 1.2mm thickness and 60-70mm width. Wire management -Partitions

system shall have concealed wire management capabilities to meet requirement

and technical specifications and shall be engineered for responsive and fire safe

operations of power, telecommunications and data (LAN) and shall have the

provision for raceway at bottom and middle level.

I. Separate components for electrical, data and telephone cables having adequate

capability of both the vertical and horizontal wire movements. II. Slots shall be

provided on Frame to fix all electrical and data points. III. Storage for excess

wires in the partitions. IV. Easy access for further maintenance and capacity for

additional power, data, phone point to the panels without the need to dismantle

work surface. Tile Finish -The partition shall have tiles made up of laminate/

fabric/ white maker as per direction of engineer-in-charge with the following

details: Laminated Tiles -The laminated tiles shall be made of min. 9mm Pre

laminate PLPB with decorative laminate on one side and balancing lamination on

other side. Fabric Tiles -The fabric tiles shall be made of min 9mm soft board

inside & covered with fabric pasted on them by PVA glue. It should be possible to

replace the fabric by peeling it off. Workstation consist of Work surface made of

25mm thick post formed particle board with 0.7mm decorative laminate on top &

balancing laminate on unexposed face and having all exposed edges sealed with

PVC edge banding tape. The worktop shall be supported with cantilever brackets

made of MS steel duly powder coated. Work surface shall be provided with wire

manager to carry wires from the bottom complete as per salient features,

specification, drawing & directions of the Engineer-In-Charge. The Workstation

shall also be provided with name plate holder in acrylic of approx size

230x75mm. The Workstation to be made in following sizes and configuration as

per sizes and detail given below (Refer Drawing No. 2)

legs in CRCA steel duly powder coated. The system shall have 25mm thick

prelaminated particle board/ soft board between 2 worktops. Below the worktop

runs the cable tray in steel duly powder coated to run the cables. The screen shall

have aluminum extruded end trims on both sides of screen. Height of screen shall

be 600mm & it shall be projected 400mm above worktop level of 750mm thereby

making overall height of workstation as 1150mm. The workstation shall have a

raceway beam panel made of CRCA steel in 0.8mm thickness duly powder coated

Providing and fixing Full height partition thickness 60-70mm thick and should have

clear space of 40-52 mm for electrical wiring. The height of partition should be

2700mm (approx) or upto false ceiling height. All metallic parts shall undergo a 7

stage antirust treatment and shall be powder coated in matt finish to a thickness of

40-60 microns. All the hardware items should be as per BIFMA/ANSI standards.

All other items as per IS standards. Front/ Side Full Ht. Partition Modular Partition

-The modular partitions shall not be grouted in the floors. The modular partitions

shall be an assembly of the following parts:-Levelers -Each frame shall be provided

with two 8-12mm leveling bolts which allow 10-25mm adjustment for floor

unevenness. Frames shall form the basic support structure for all other components.

The main vertical member of the frame bearing the load of brackets and storages

shall be made of 1.5mm CRCA steel. The horizontal members’ shall be made of

1.0mm CRCA steel. The thickness of the frame shall be 68-75mm. Each individual

frames shall be connected at the junctions by aluminum connectors. The post shall

be made of aluminum extrusions of minimum 1.2m thickness. Trims-The exposed

vertical and horizontal faces of the frames shall be snap fitted with curve trims. The

trims shall be made of aluminum extrusions of minimum 1.2mm thickness and 60-

70mm width. Wire management -Partitions system shall have concealed wire

management capabilities to meet requirement and technical specifications and shall

be engineered for responsive and file safe operations of power, telecommunications

and date (LAN) and shall have:-I. Separate components for electrical, data and

telephone cables having adequate capability of both the vertical and horizontal wire

alloy extrusions of 1.2-2.1mm thickness 50-58 mm x 12-17mm of matching height

of the panel and a top runner of powder coated aluminum extrusions 54mm +/4mm

structure of batten of size 40-50x25-40mm Particle board honey comb inside. The

34 Lounge Chair

The premium lounge chair is a flexing back lounge seating system standing on

beam with frame assemblies. SIDE FRAME ASSEMBLY: The side frame

assembly is fitted to the two ends of the connecting beam assembly to from the leg-

cum-armrest assembly; it is made of a MS. ERW. Tube dia 3.81cm. (1 1/2") x14

BG thk. And black powder coated. The ends are fitted with ABS molded end caps.

TIE MEMBERS: it is the connecting beam assy. Which holds the two side frames.

The tie -member is made of a MS. ERW. Tube dia 3.81cm. (1 1/2") x14 BG thk.

And black powder coated. The seat/back assemblies are mounted on one of the tie-

member which has 5cmx5.5cm longx0.5cm. thk MS. Std. angles welded to mount

the seat and back. SEATREST ASSEMBLY: the seat rest assembly consists of a

fabricated inner-frame assembly insitu-moulded with polyurethane foam having

density= 45+/-2 kg /cm3. The hardness of the p.u. form= 23-27 kgs. On hampden

m/c. for 25% compression of the form. The complete kgs. On hampden m/c for

25% compression of the foam. The complete molded seat rest assembly is covered

with a replaceable fabric upholstery cover. Seat Size: 52.0cm (W) x 50.0cm. (D) x

6.0cm (T) BACKREST ASSEMBLY: The backrest assembly is flexing type and

consists of a fabricated inner-frame assembly insitu-moulded with Polyurethane

foam having density = 45+/-2 Kg./cm3. The hardness of the PU foam = 16-20 Kgs

on Hampdem m/c. for 25% compression of the foam. The complete molded

backrest assembly is covered with a replaceable fabric upholstery cover. Back Size:

52.0cm (W) x 59.0cm (H) x 6.0cm. (T) ADJ. GLIDES: The adj. glide is injecting

molded in black nylon & fitted to the front end of side frame assembly along with

ABS molded adj. glide base to take care or unleveled floor surface.
