Important Instructions for Bidders regarding Online Payment

Chapter-II

INSTRUCTION AND TENDER CONDITIONS

1. Sealed offers under two envelop system in the prescribed forms are invited from eligible

tenderers for providing annual repair and maintenance services listed under scope of services in this bid document.

2. The interest bidders should submit the tender documents through online only at e-procurement portal https://esictenders.eproc.in from 13/02/2018 to 12/03/2018 upto 5-00pm. The rates quoted online are final & prevail.

3. The tender documents can be obtained in website : https://esictenders.eproc.in & www.eprocure.gov.in (publishing)

i. In addition to e-tender which has to be filled through online, the bidders also shall be

required to file hard copies of tender document duly completed along with Earnest Money (EMD) and supported by requisite document and the forms, as mentioned in the tender document which should be submitted with covering letter in a sealed envelope duly super-scribed with the name of work and should be dropped in the tender box latest by 02:00 pm on 13/03/2018

ii. Date and time of opening of tender is 13/03/2018 at 3-00pm. The tender shall be opened in presence of Tenderer/ Authorized.

4. The amount of earnest money deposit (EMD) is Rs. 35,652/- and should be paid in the form of

DD/Pay Order. Drawn in favour of ESI Fund A/c No-1 payable at Gulbarga. It should remain valid for a period of 90 days or bank Guarantee from the last date of submission of tender. In the absence of EMD, the tender shall be rejected summarily. The earnest money shall be refunded to the unsuccessful bidders after finalization of the contract. It shall be refunded to the successful bidder on receipt of performance security deposit. No interest is payable on the EMD.

5. Tender form shall be duly filled up and completed in all respects. Incomplete tenders or tenders without EMD shall be treated as invalid.

6. Each and every page of the tender documents should bear stamp and signature of the authorized representative/quoting firm. Format I & II enclosed shall be filled without exception. The tender shall also enclose the copies of documents in support of details about the firm besides latest Income Tax returns, ESI & EPF Registration, GST Registration, VAT & Service Tax Registration and work completion certificates etc. All these documents shall be kept inside the Technical Bid cover.

7. The rates for each and every item shall be quoted in Figure and words. In case of any

discrepancy in rates the rates written in words shall prevail.

8. Rates quoted through on line shall be firm, fixed and are inclusive of cost of manpower, material, machinery, tools & plant etc. all taxes (including Goods & service tax) duties & levies, insurance etc. No escalation of whatsoever shall be payable.

9. The period of this contract shall be for one year from the date of award of contract. The same shall be extendable only at the discretion of the ESIC subject to satisfactory completion of work during the contract period/extended contract period. The decision of the ESIC shall be final and binding on the contractor in this regard.

10. The GST is applicable.” However, the responsibility towards payment of GST lies with the contractor.

11. The envelope containing, scanned tender document shall be sealed and bear the name of work and the name and address of the tenderer.

12. Conditional tenders are liable to be rejected.

13. The tender for the work shall remain open for acceptance for a period as notified from the date of opening of tender.

14. The site for the work can be inspected on any working day during office hours by contacting the ESIC Engineers / Officials.

15. The Competent Authority of ESIC, reserves the right to accept or reject any tender or all tenders without assigning any reason.

16. The EMD of unsuccessful tenderer shall be refunded within one month after the award of work to the successful tenderer.

17. Contractor to whom the work is awarded shall execute the work himself/agency and they are not allowed to sublet the work to any other agency, In case of default if any comes to the notice of ESIC at any point of time during execution of work, then the contractor shall not be allowed to participate in any tender in ESIC of Karnataka region and also action will be taken for cancellation of existing contract.

18. Eligibility criteria:

1. Registered from State PWD/CPWD/Public sector and Government undertaking with current validity for both Civil and Electrical works with appropriate class.

2. The tenderer should have minimum two years experience in works of similar nature. The tenderer should have undertaken/completed the following work in the last 3 years.

a) The tenderer should have successfully completed the following value of similar nature of work in the last 7 years as on tender opening date.

i. One Special Repair/Annual repairs (Civil & Electrical) works of value not less than 80% of the estimated cost

ii. Two Special Repair /Annual repairs (Civil & Electrical) works of value each not less than 60% of the estimated cost

iii. Three Special Repair / Annual repairs (Civil & Electrical) work of value each not less than 40% of the estimated cost

b) The tenderer would be required to establish its office within the site of the work in the space provided by the ESIC.

3. Average Annual financial turnover during the last three financial (2014-15, 2015-16, 2016-

17) years should be at least Rs. 50,00,000./- and statement to be authenticated by Chartered

Accountant. 4. The tenderer must be registered in GST, ESI, and EPFO and also shall furnish the self

attested copies of remitted challan for latest six months as mentioned below.

i. ESI, EPFO, GST/ Service Tax &VAT. ii. Any other registration which is mandatory for such agencies stipulated by

concerned authorities from time to time.

5. The following documents must be submitted along with the Tender documents.

i. Income tax returns for last three financial years (2014-15, 2015-16, 2016-17). ii. Audited balance sheet of last three financial year (2014-15, 2015-16, 2016-17) along

with income and expenditure statements (P&L Account & Audit reports signed by chartered accountant to be submitted).

6. The tenderer would be required to establish its office within the site of the work in the space provided by the ESIC

19. Submission of bids:- Bidders should submit the tender through online at https://esictenders.eproc.in. Hard copy of the same proposals should be submitted in separate envelops namely, “EMD” and “Technical Bid” (Part A) and “Financial Bid” (Part B) are duly sealed in two separate envelops and these two envelops must be kept inside a separate big size third envelop and clearly super scribed as “Annual Repairs and Maintenance to ESIC

Dispensary, Branch office, Staff quarters at Gulbarga and Bellary”. The envelope should be clearly marked as “Technical Bid & EMD” (Envelop-1) and “Financial Bid” (Envelop-2).

20. Verification of EMD:- The technical bid dropped in the tender box will be opened first and Demand Draft of the EMD will be verified and after satisfying the EMD conditions the tender will be considered for evaluation Technical Bid.

21. Evaluation of Technical Bid:- Bid received and found valid will be evaluated by the ESIC to ascertain the best-evaluated bid for the complete work/services under the specifications and documents. The tenderer should take care to submit all the information sought by the ESIC in prescribed formats

22. Financial Bid:- The financial bid of the tenderer whose Technical Bid is qualified, the qualified tenderer as per eligibility criteria and same will be opened in the presence of the tenderer, who choose to attend the opening of financial bid. Minimum two days notice will be given to the tenderer for this purpose.

23. Dully filled scanned tender document should be dropped in the tender box available at following address on or before 13/03/2018 up-to 02:00 pm.

24. Delay/Late tenders for whatever the reason will be summarily rejected.

25. The following documents must be submitted along with the Tender documents.

i. The selection of the agency will be at the sole discretion of the ESIC who reserves its right to accept or reject any or all the proposals without assigning any reason.

ii. Upon evaluation of offers the notification on award of contract will be intimated the successful tenderer

26. This instruction shall form a part of the contract document.

DOCUMENTS TO BE UPLOADED Bidder firms who fulfill the above eligibility criteria may upload their technical bid & price bid along with the scanned copies of the following documents failing which their bids will be rejected.

Financial statement, Balance sheet and profit & loss account for last three financial years

Scanned copy of EMD/DD.

Proof of registration with GST, ESIC and EPFO.

Satisfactory work completion certificate from three Govt./PSUs/reputed private

organization for services provided.

Acceptance certificate of terms & conditions of tender.

Copy of valid license to carry out Electrical work.

Copy of valid certificate of Central Labour Act 1970 & Contact labour Central Rule 1970.

Attested Photo copy of PAN Card.

Affidavit that the firm has not been indicted for any criminal, fraudulent or anti-

competition activity and not blacklisted by any Govt. department or P.S.U. in the last five

years.

Satisfactory work completion certificate as proof of experience of at least 3 years of

successfully executing work of Repair & maintenance (civil & electrical).

The Tenderer must have an average annual turnover of Rs. 50,00,000/- (Rupees Fifty Lakhs

only) and should be profit making during the last three years. Copies of the following

documents should be submitted along with the Technical Bid:

ANNEXURE-'A'

GENERAL CONDITION OF CONTRACT

Definition and interpretation

DEFINITIONS:-

(a) In the contract (as hereafter defined) the following word and expressions shall have the

meaning hereby assigned to them except where to context otherwise requires:

i. “Employer” means the ESIC and the legal successors in title to ESIC. ii. “Engineer” means the person appointed by ESIC to act as Engineer for the purpose the

Contract. iii. “Contractor” means an individual or firms (proprietary or partnership) whether

incorporated or not, that has entered into contract (with the employer) and shall include his/its heirs, legal representatives, successors and assign. Changes in the constitution of the firm, if any shall be immediately notified to the employer, in writing and approval obtain for continued performance of the contract.

(b) i. “Contract” means these conditions, the Specification, the Bill of Quantities, the Tender,

the letter of acceptance, the Contract Agreement (if completed) and such further documents as may be expressly incorporated in the letter of Acceptance or Contract Agreement ( if completed).

ii. “Specification” means the specifications of the words included in the Contract and any modification thereof.

iii. “Drawing” means all the completion drawing, calculation and technical information of a like nature provided by the Engineer to the Contractor under the Contract and all drawings , calculations, samples, patterns, models and other technical information of a like nature submitted by the Contractor and approved by the engineer.

iv. “Bill of Quantities” means the priced and completed bill of quantities forming part of the Tender.

v. “Tender” means the Contractor's priced offer to the Employer for the execution and completion of the work and the remedying of any defects and therein accordance with the provisions of the Contract, as accepted by the Letter of Acceptance. The word tender is synonymous with “Bid” and the words “Tender Documents” with “Bidding Documents”.

vi. “Letter of Acceptance” means the formal acceptance of the tender by ESIC. vii. ”Contract Agreement” means the contract agreement (if any) referred to in (b) (i) above. viii. ”Appendix” to Tender” means the appendix comprised in the form of Tender

annexed to these Conditions.

(c) i. “Commencement Date” means the date upon which the Contractor is handed over the

site. ii. ”Time for Completion” means the time period for which the contract of Special Repairs

has been awarded by the employer to the contractor.

(d) i. “Taking over Certificate” means a certificate issued by employer evidencing successful

completion of the awarded work.

(e) i. “Contract Price” means the sum stated in the Letter of Acceptance as payable to the

Contractor for the execution and completion of the work and remedying of any defects therein in accordance with the provisions of the Contract.

ii. “Retention Money” means the aggregate of all monies retained by the Employer.

(f) i. “Works” means the permanent works and the temporary works or either of them to be

executed in accordance with the contract. ii. “Site” means the places provided by the Employer Special Repairs to roof and damaged

compound wall and street light in ESI Dispensary and staff quarters campus. iii. “Cost” means all expenditure properly incurred or to be incurred, whether on or off the

site, including over head and other charges but does not include any allowance for profit.

ENGINEER 1. Engineer's Duties and Authority:-The Engineer shall carry out the duties specified in

contract.

2. Custody and Supply of Drawings and Documents The drawings shall remain in the sole custody of the Employer/Engineer, butt copies as required there of shall be provided to the contractor free solely for the purpose of this contract.

3. Sufficiency of Tender The contractor shall be deemed to have based his Tender on the data made available by the Employer and on his own inspection and examination of this site conditions.

4. Contractor's Employees The contractor shall provide on the site qualified and experienced technical staff in connection with the Repair and Maintenance of the works and the remedying of any defects therein. The minimum staff shall be as per description of work mentioned in BOQ.

5. Engineer at Liberty to Object The Engineer shall be at liberty to object and require the contractor to remove forthwith from the Works any person provide by the contractor who, in the opinion of the Engineer, misconducts himself, or is incompetent or negligent in the proper performance of his duties or whose presence on site otherwise considered by the Engineer to be undesirable and such person shall not be again allowed upon the works without the consent of the Engineer. Any person so removed from the works shall be replaced as soon as possible.

6. Safety, security and Protection of the Environment The contractor shall throughout the execution and completion of the works and the remedying of any defects therein:

i. Have full regard for the safety of all persons entitled to be upon the site and keep the site (so far as the same is under his control) and the works (so far as the same are not completed or occupied by the Employer) in an orderly state appropriate to the avoidance of danger to such persons and

ii. Provide and maintain at his own cost all lights, guards, fencing, warning signs and watching, when and where necessary or required by the Engineer or by any duly constituted authority for the protection of the works or for the safety and convenience of the public or others, and

iii. Take all reasonable steps to protect the environment on and off the site and to avoid damage or nuisance to persons or to property of the public or others resulting from pollution, noise or other causes arising as consequence of his methods or Repair.

7. (a) Insurance of work by the contractor for his liability: i. During the Repair and Maintenance period for loss or damage to property and life

arising from a cause which contractor is responsible. ii. For loss or damage occasioned by the contractor in the course of any repairs carried out

by him for the purpose of complying with his obligations. It shall be the responsibility of contractor to notify the insurance company of any change in the nature and extent of the works and ensure the adequacy of the insurance cover at all times during the period of contract.

7.2 Damage to persons and property

The contractor shall except if and so far as the Contract provides otherwise, identify the Employer against all losses and claims in respect of:

a. Death of or injury to any person, or b. Loss or damage to any property (other than the works)

Which may arise out of or in consequence of the repair and maintenance of the works and the remedying of any defects of any therein, and against all claims, proceedings, damages, costs, charges and expense whatsoever in respect thereof.

8. Accident or Injury to Workmen

The Employer shall not be liable for or in respect of any damages or compensation payable to any workmen for death or injury resulting from any act or default of the contractor. The contractor shall identify and keep indemnified the Employer against all such damages and compensation and expenses whatsoever in respect thereof or in relation thereto.

8.1 Evidence and Terms of Insurance The contractor shall take out appropriate insurance to cover his work and workers and staff employed by him fully. The contractor shall provide evidence to the Engineer/Employer as soon as practicable after the respective insurance have been taken out but in any case prior to the start of work at the site that insurance required under the contract have been effected.

8.2 Compliance with Statutory, Regulations

The contractor shall conform in all respects, including by the giving of all notices and the playing of all fees, with the provision of

a. Any national or state statue , Ordinance, or other law, or any regulation, or bye-law of any local or other duty constituted authority in relation to the execution and completion of the Works and the remedying of any defects therein, and

b. The rules and regulations of all public bodies and companies whose property or rights are affected or may be affected in any way by the Works, and the contractor shall keep the Employer indemnified against all penalties and liability of every kind for breach of any such provision.

9. Default of Contractor in compliance

In case of default on the contractor in carrying out such instruction within the time specified therein or, if none, within a reasonable time, the Employer shall be entitled to employ and pay other persons to carry out the same and all costs consequent thereon or incidental thereto shall, be determined by the Engineer and shall be recoverable from the contractor by the Employer , and may be deducted by the Employer from any monies due or to become due to the contractor and the Engineer shall notify the contractor accordingly.

10. Time for Completion The Repair and Maintenance work shall be for a period of one year or as mentioned in the letter of commencement and shall start from the date issue of letter commencement and shall stands terminated after the expiry of one year.

11. Extension of Time for Completion The Repair and Maintenance contract may be extended on the written mutual consent of both Employer and Contractor for a further period of one year. However, employer reserves its right to terminate the Repair and Repair and Maintenance contract by giving 15 days notice at any time during the currency of the contract if the services of the agency are not satisfactory as per the opinion of employer or its representative.

12. Defect Identification and its rectifications Agency shall immediately attend the defects and complaints notice at site. The agency shall provide and develop as system for regular Repair and Maintenance of all the services which includes defects identifications and it’s immediate rectification so, that services are not affected. It shall be the sole responsibility of the repair and Maintenance agency that all the services are kept in functional condition round the clock during the currency of the contract. Defect Liability period shall be 12 months from the date of completion of work under BOQ measurable works. The contractor shall rectify at his own expenses any defect in the work carried out by him during this period. On failure of the contractor to do so, the same shall be completed by the employer at the risk and cost of the contractor.

13. Penalty for Delay

If the Contractor fails to attend any complaint or defect in due course of time and if in the opinion of engineer delay is on the part of Repair and Maintenance agency, the employer can impose liquidated damages on the contractor as detailed in the particular conditions.

14. Contractor’s Failure to Carry out Instructions In case of default on the part of the Contractor in carrying out defect rectification works, the Employer / Engineer shall be entitled to employ and pay other persons to carry out the same and if such work, in the opinion of the Engineer, the Contractor was liable to do at his own cost under the Contract, then all costs consequent thereon or incidental thereto shall be determined by the Engineer and shall be recoverable from the Contractor by the Employer, and may be deducted by the Employer from any monies due or to become due to the Contractor.

15. Instructions for Variations Quantities given in the BOQ are estimated quantities. The quantity of any particular item may vary to any extent. However prior approval of ESIC, is mandatory for any Quantity variation or new/extra item necessary variation in particular items or overall cost, does not entitle contractor to claim any extra rate cost. MEASUREMENT

16. Works to be measured The Engineer shall determine by measurement of the value of actual work done in accordance with the Contract and the Contractor shall be paid proportionately. Part rate shall be made for any part of BOQ items not fully execute. Engineer shall be at liberty to decide the break up of Sum items and to decide the part rate for any particular item. Incase overtime working of staff under item no. 1 is required, specific instructions of the engineer is to be obtained. Payment shall be made at applicable overtime rates.

17. Method of Measurement The works shall be measure net, notwithstanding any general or local custom, except where otherwise provided in the Contract. CERTIFICATES AND PAYMENTS

18. Monthly Statements The Contractor shall submit a bill in 3 copies to the Engineer by 7th day of each month for work executed up to the end of previous month in tabulated form approved by the Engineer, showing the amounts to which the Contractor considers himself to be entitled. The bill must be supported with the following documents.

a) Attendance sheets along with salary certificates, wages sheets of all the workers and staffs deployed against item No. ‘A’.

b) Certified bills miscellaneous materials purchased under different heads against item No. ‘A’.

c) Details of defects/complaints attended and rectified within time. d) Details of complaints attended late.

19. 1 Deduction of Income Tax The amount to be deducted towards the advance income tax shall be at the rate applicable. 19.2 Monthly Payments

After submission of monthly bill complete in all respects by the contractor, Engineer shall check the bill with the help of contractor and certify for payment within 15 days of the submission of bill.

19.3 Performance Guarantee Within two weeks of award of work, the Contractor shall submit a Performance Security for proper performance of the Contract in the format enclosed as Annexure ‘D’. The performance guarantee shall be valid for the duration of the contract period plus 60 days.

The performance security can be encashed by the Employer to recover any amount which is payable by the Contractor to the Employer on any account for a cause arising out of the contract.

The Engineer may by any Interim payment Certificate make any correction or modification in any pervious interim payment Certificate which has been issued by him, and shall have authority, if any work is not being carried out to his satisfaction, to omit or reduce the value of such work in any Interim Payment Certificate.

19.4 Correction of Certificates The Engineer may by any Interim Payment Certificate make any correction or modification in any previous Interim Payment Certificate which has been issued by him, and shall have authority, if any work is not being carried out to his satisfaction, to omit or reduce the value of such work in any Interim Payment Certificate.

19.5 Final Certificate Within 28 days after receipt of the Final Statement, and the written discharge, the Engineer shall issue to the employer (with a copy to the Contractor) a Final Certificate stating: (a) The amount which, in the opinion of the Engineer, is finally due under the Contract,

and

(b) After giving credit to the Employer for all amounts previously paid by the Employer and for all sums to which the Employer is entitled under the Contract.

20. Default of Contractor If the performance of the contract and is not satisfactory and not corrected within 15 days of receiving notice, then employer shall be at liberty to terminate the contract and get the work executed through other means at the risk and cost of the Contractor.

21. Amicable Settlement of Dispute The party shall use their best efforts to settle amicably all disputes arising out of or in connection this contact or the interpretation thereof

22. Arbitration Any dispute and difference relating to the meaning of the specifications, designs, drawings and instructions herein before mentioned and as to the quality of workmanship of materials used in the work or as to any other question, claim, right matter or thing whatsoever in any way arising out of or relating to the contract, designs, drawings, specifications, estimates, instructions or these conditions or otherwise concerning the works or the execution or failure to execute the same whether arising during the progress of the work or after the completion or abandonment thereof in respect of which:- Amicable settlement has not been reached. Shall be referred to the Sole Arbitration of the Chief Engineer, ESIC who shall proceed as per the Arbitration Act, 1996.

22.1 The work under the contract shall continue, during the Arbitration proceedings. 22.2 The award of the Arbitrator shall be final, conclusive and binding on both the parties.

23. Payment on Termination

In the event of termination of the contract, employer shall be at liberty to get balance work done at the risk and cost of the contractor and due payment of the contractor, if any, shall be released after the completion of whole of the works.

ANNEXURE-'B'

PARTICULAR CONDITION OF CONTRACT

a. CPWD specification shall be followed where not available, BIS/Engineering practice as directed by the Engineer shall be followed.

b. Complaints shall be made in the format (Enclosed-I). c. A complaint register (format at Enclosed-II) shall be maintained the repair and maintenance

office of the contractor in which all complaints received shall be documented. d. All repair and maintenance related complaints shall be attended to within two hour falling

which a recovery of Rs 100 per event hour shall be made from the subsequent payment certificate of the contractor.

e. The Sewer man shall ensure that all line are maintained in a clean condition by carrying out preventive cleaning of all lines at least once each month.

f. As the work will have to be carried out in building and area in use the contractor shall ensure:-

1. That the normal functioning of ESIC activity is not effected as far as possible. 2. That the work is carried out in orderly manner without noise and obstruction to flow of

traffic. 3. That all rubbish etc. is disposed off at the earliest and the place is left clean and orderly at

the end of a each day’s work. 4. The contractor shall ensure that his repair and maintenance staff is qualified and licensed

for their part of work. He shall be responsible for their conduct. 5. The staff should behave in a courteous manner. The contractor shall be held responsible for

any loss or damage to ESIC property. 6. The contractor shall ensure safety of his workers and other at site of work and shall be

responsible for any consequence arising out of execution of the repair and maintenance work.

7. When instructed to do so, the contractor shall ensure proper record keeping and storing of irreparable/dismantled material.

8. Water and electricity shall be made available free of cost at nearby source of work. The contractor has to make his own arrangement for use the same including drawing temporarily lines etc. The responsibility for following relevant rules, regulations and loss in the record shall be entirely that of the contractor.

SPECIAL TERMS & CONDITIONS

1. The contractor shall ensure the regular supervision and control by the contractor himself or by his supervisor on the workmen deployed by them under due intimation.

2. The workmen engaged by the contractor / agency shall observe safety precautions connected with the work as stipulated in the relevant statutes.

3. Contractor shall provide shoes, masks and gloves as basic needs to protect the health from the very nature of duties performed by their employees.

4. The staff employed by the contractor for performance of the contracted jobs, shall be of sound health, be mentally alert and physical fit. The contractor shall be bound to change the personnel deployed, if any, if found unsuitable by ESIC and decision of the ESIC in this regard shall be final and binding on the contractor.

5. Any miscellaneous work related to cleaning as allotted by this office will have to be done at no extra cost. No work shall be carried out without the knowledge of this office.

6. The workmen will work in an orderly manner without causing damage / loss to the Corporations property or equipment. The Contractor is responsible for making good any damage / loss to Corporation’s property / equipment in case of such damage by his workmen, failing which the amount incurred shall be recovered from the bill.

7. The contractor shall be responsible for any injury / loss of life caused to persons or things, (fittings/fixtures/furnishings, etc) any damage caused to any property of ESIC etc, which may arise from the operations or neglect of any person of the quotations/contractor team or any person engaged by him for any purpose related to the execution of this contract. The bidder / contractor shall indemnify ESIC against all liabilities arising out of these operations in any way under any acts of the Government and also in award of any compensation or damaged consequent upon any claim arising out of above.

8. ESIC shall not be liable for any breach or delay in carrying out any of the contractual obligations as result of strike, lock out, industrial / labour disturbance, fire / accidents damages, any act of God, riot, war or any conditions arising from similar causes beyond the control of the Corporation.

9. Contractor shall indemnify and keep ESIC indemnified against breach of Acts, Rules, Laws and Regulations and / or non compliance thereto by its employees. In case of delay in attending / non attending of complaint due to shortage of labour for or otherwise within the time specified by the Authority and if the work get executed thorough other agency then the expenditure so incurred plus 10% of the same shall be recovered from the contractor’s payment. In case of any dispute, the decision of Joint Director of ESIC, SRO Gulbarga shall be final and binding on the contractor.

10. The bidder/contractor shall indemnify ESIC under Workmen’s/Worker’s compensation Act, Personal Injuries Act, Insurance Act, etc and or other Industrial Legislation in force

from time to time. The contractor shall be responsible for any violation/non-compliance of the Labour laws and ESIC shall stand indemnified against any claim or compensation of whatsoever nature in this regard by the bidder/contractor.

11. The materials used for repair/replacement should be conforming to BIS standards/CPWD specification/materials of good quality available in the market. Sample of materials to be supplied/used may be produced and got approved from the JD/ concerned Engineer I/c. Further any Item which are to be used & rate not already approved (non tender item), the contractor has to obtain prior approval of the competent authority and purchase bills to be submitted along with the monthly bill.

12. Escalation: No escalation in case of Repair and Maintenance (Civil and Electrical) service provided in ESIC on any account shall be permitted after the submission of the quotations and during the currency or extended period of the contract.

13. Penalty: In the event of failure to maintain the Repair and Maintenance (Civil and Electrical) services on any day as per terms and conditions of this quotation in part or in full, the Repair and Maintenance (Civil and Electrical) service agency shall be liable for payment for damage charges @ Rs. 1000/- besides proportionate deduction which shall be recovered from the monthly bills. If ESIC finds the agency misusing the facilities provided by ESIC for the services or for other purposes not covered under the contract, ESIC will be free to levy damages which may extend up to Rs 1000/- per event.

14. Payment Terms:

i. The contractor shall submit his monthly bill in triplicate along with the challans of the EPF, ESI, tax paid challans, monthly muster sheet and payment register, bank statement copy showing the credit of salary to the workers to the Sub Regional Office, ESIC, Kalaburagi (Gulbarga) by 5th of each month. The Payment shall be released through ECS/NEFT payment system only in the bank account of the contractor after necessary deductions of statutory dues, etc duly certified by the caretaker/Admin division.

ii. TDS and other statutory taxes shall be deducted at source from the monthly bills. iii. The payment will be made on monthly basis of the personal deployed by the contractor

and based on the attendance sheets and other supporting documents duly verified by the caretaker. No other claim on whatever account shall be entertained by this office.

iv. The contractor will ensure that the workers engaged by him must receive their entitled wages on time. The following procedure shall be adopted.

a) The contractor shall pay the wages of the personnel on or before 7th of the calendar month following for which the services were rendered. This payment of wages must not be linked to payment / clearance of the bill by this office.

b) The payment to such workers must be made by the agency through cheque/ECS. Under no circumstances payments shall be made in cash. If the agency does not make payment to its workers through cheque/ECS, the contract may be terminated and the security deposit will be forfeited.

v. In order to ensure that workers get their entitled wages, the billing cycle for the agency is to be calendar month. The bills must be submitted along with all the certificates / documents as follows:

a) The wages of workers for the last month credited to their bank account and the details of payment with bank account Nos and bank statement enclosed.

b) A certificate to the effect that ESI/EPF/Service Tax/ Other statutory dues amounting to Rs _______ for the month of (previous month) deposited on _________ (copy of challans to be enclosed) has to be submitted.

c) Employee wise details of ESI and EPF contribution paid is to submitted every month/quarter as applicable.

d) Undertaking that all statutory labour laws including minimum wages act is being complied with.

e) Proof of payment of service tax. (Copy of paid challans to be enclosed)

15. Compliance with Labour Laws: The contractor is responsible for compliance of the following points given below:

i. It shall be the sole liability of the contractor to obtain and to adhere by all necessary licenses/permissions from the concerned authorities as provided under the provisions of the contract Labour (Regulation & Abolition) Act 1970.

ii. The contractor shall discharge obligations as provided under various statutory enactments including the Employees Provident Fund, Miscellaneous Provision Act 1952, Employees State Insurance (ESI) Act 1948, the contract (R&R) Act 1970, Minimum Wages Act 1948, Payment of Wages Act 1948, Workmen’s Compensation Act 1923, the payment of Bonus Act 1965 and other relevant acts, rules and regulation enforced from time to time. Non observance of the provisions under above shall grant right of termination forthwith.

iii. The contractor shall be responsible for required contributions towards PF, ESI or any other statutory payment shall deposit these amounts on or before the prescribed dates. The contractor shall submit the proof of depositing the employee’s and employer’s contributions. The contractor shall also be responsible to pay any administrative / inspection charges thereof, wherever applicable, in respect of the personnel employed by him for the work of ESIC. Any dispute related to PF, ESI, Labour Act shall be dealt with by the contractor entirely at contractors risk and costs. All the records shall be maintained by the contractor and shall produce for inspection to ESIC as and when required. In case ESIC is called upon to make payment on the direction, decree or proceeding of court/criminal court or by statutory authority then ESIC shall have all the rights to recover the said amount in full and shall be authorized to deduct the same directly from the payment to be made to the contractor or by invocation of Performance Security so kept with ESIC.

iv. The contractor shall be solely responsible for the payment of wages and other dues to the personnel deployed by him latest by 7th of the following month through Bank A/cs. The contractor shall be directly responsible for and shall indemnify ESIC against all charges, dues, claims, etc arising out of the disputes relating to the dues of the personnel deployed by him. Penalty as per discretion of The Joint Director ESIC, SRO Gulbarga would be levied on the contractor in case of receipt of complaint of any nature like

lower payment of wages, non disbursal of bonus, etc from the personnel deployed by the contractor for the work of ESIC and contract is liable to be cancelled.

v. Income Tax/other taxes/duties at the prevailing rate as applicable from time to time shall be deducted from the contractor’s bill.

16. Working Hours: The services are required for all the days from 9 AM to 5.30 PM or as decided by ESIC.

17. SECTION-I Introduction and scope of work Employees State Insurance Corporation is a central Government statutory body Under Ministry of Labour having various buildings of Hospitals/ Dispensaries/ Offices/Staff quarters throughout the state. Annual repair and maintenance works, minor seepage work/painting/replacement of door/windows in respect of the buildings is being undertaken by the Corporation.

Branch Office, Dispensaries and attached staff quarters The following are the dispensaries and branch offices and staff quarter attached to the branch offices / dispensaries and officers quarters which are to be maintained under this contract are ESIC Dispensary, Branch Office & Staff Quarters at Gulbarga and Bellary

18. Performance Guarantee/Security Deposit: 10% (5% at Performance Guarantee+5% at Security Deposit) of the annual contract amount is to be deposited by way of Demand Draft of any Nationalized bank in favour of ESIC Fund A/c No.1 payable at Gulbarga by the successful contractor within 10 days from the date of award of contract. After completion of work5% of Security Deposit shall be refunded and 5% of Performance Guarantee satisfactory performance of the contract and shall be refunded only after completion of the agreement period including defect liability period and on adjustment of dues, if any. Defect- liability period will be one year from the date of installation/completion of work. No interest shall be payable by ESIC on the security deposit/ Performance Guarantee.

19. Termination of Contract: In the event, the contractor fails to execute the work with due diligence or expedition or shall refuse or neglect to comply with any order given to him in writing by the ESIC or on behalf of the ESIC within the scope of the contract, or shall contravene the provisions of the contract, the ESIC may terminate the contract after giving one month notice in writing to the contractor. Such notice may be served either by hand delivery or through post at the address given in the contract. This shall be deemed to be served on the contractor. The contractor who does not provide proof of payment of statutory dues will be terminated after giving one month notice. Child labour is strictly not allowed and will result in termination of the contract with immediate effect. The disputes if any arising on account of any difference in opinions, specifications, scope of work etc, between ESIC and the contractor, the decision of The Joint Director ESI Corporation SRO Gulbarga shall be final and binding on both the parties.

20. Ensure that all the requisite information/documents as per Annexure-C

21. Along with the above works, Contractor should execute any other/unforeseen works likely to arise during the course of contract period pertaining to maintenance, upliftment of building/arrest of seepage/leakage, replacement of damaged items etc as directed by the competent authority. The rate for these works will be allowed as per Schedule Rate of CPWD/KPWD or actually claimed by the contractor, whichever is less
