    Article I Preliminary

    1) Definitions

    Competent Agency where referenced, refers to the Presidency of Meteorology and Environment or its designated representative. assessor refers to the PME or Competent Agency personnel who conduct the assessment of technical competence of facility operators. CoTC means Certificate of Technical Competence. It is the written certification of competency issued by PME or the Competent Agency stating that the TCP of a TSD facility has met the requirements for the specified level of certification. disposal means the discharge, deposit, injection, dumping, spilling, leaking, or placing of any waste into or on any land or water so that such waste or any constituent thereof may enter the environment or be emitted into the air or discharged into any waters, including ground waters. FAPP means Fit and Proper Person. facility is the collective term used for the place where the activities of storing, treating or disposing of waste are carried out under the authorisation of a site licence. GER refers to the Kingdom of Saudi Arabias General Environmental Regulations 2001. hazardous waste is a waste with properties that make it dangerous or capable of having a harmful effect on human health and the environment. KSA refers to the Kingdom of Saudi Arabia. licence holder refers to the owner or operator of a TSD facility in whose name the site licence is held. operator is the person who directly supervises and is personally responsible for the daily operation and maintenance of a TSD facility. PME refers to the Presidency of Meteorology and Environment who are designated as the responsible authority for the protection of the environment and the development of environmental protection standards in the Kingdom of Saudi Arabia. PPE means personal protective equipment.

    recycling is the separation and collection of wastes materials for the subsequent transformation or remanufacture into usable or marketable products or materials. site licence is a waste management licence issued in respect to activities in or on specified land. SQE means Statement of Qualifying Experience. storage means all operations intended to keep or contain wastes and other hazardous, toxic or radioactive substances for the purpose of treatment, transportation or disposal. TCP means technically competent person. transporter means a person engaged in the off-site transportation of waste by air, rail, highway or water and is anyone who transports the trackable waste from its place of production or storage to another location. treatment is any means or technique of altering the physical, chemical or biological properties of wastes used to neutralize such wastes; utilize substances or energy contained therein or released by them; and transform the hazardous wastes into wastes that are non-hazardous, less hazardous or safer when transported, stored, disposed of, prepared for storage, or reduced in volume. TSD Facility refers to a treatment, storage and/or a disposal facility.

    2) Citation a) This document may be cited as the National

    Waste Training and Assessment of technical competence of operators Standard for KSA. This standard revises the current General Standards for the Environment (specifically document number 1409-01) issued by the Presidency of Meteorology and Environment (PME).

    3) Timescales for implementation . a) The effective date of this standard is 01/05/1433H

    4) Purpose a) The objective of this standards is to establish the framework to ensure that efficient, nuisance-free and environmentally acceptable waste management procedures are practiced in KSA by outlining the minimum requirements for training, certification and assessment of persons participating in or responsible for the operation of treatment, storage and disposal facilities. b) This standard is designed to ensure a consistent and transparent assessment process and one which will enable PME to demonstrate that a systematic and fair approach to assessment has been undertaken. c) The aim of the provisions in this standard is to provide a framework for PME or the Competent Agency on how to carry out the assessment and examination of technical competence of Operators of waste facilities so as to ensure a required level of competence that will protect human health and improve control of environmental pollution. d) This standard also provides the framework for training carried out by PME or an approved PME training body for waste facility operators in becoming technically competent to a standard capable for assessment by PME or the Competent Agency.

    5) Scope a) This standard is to be applied by PME or other PME approved body with responsibility for assessing the technical competence of designated facility operators. b) The standard extends to all TSD Facilities required to be licensed under the Waste Regulatory Control and Compliance Standard.

    c) This standard does not apply to industrial waste water facilities, sewerage systems and waterworks treating liquid wastes, or to facilities used solely for the disposal of liquid municipal or industrial wastes.

    6) Exemptions

    a) Specific exemptions may be specified within this standard at any point where relevant to the Article that they are common to.

    7) Powers of Authority

    a) The Competent Agency may, for the purposes of this Standard, appoint persons to act on their behalf as technical assessors and monitors in relation to the powers and duties conferred on him by this standard and/or its subsequent amendments.

    c) In addition to the responsibilities conferred by other sections contained within this standard, it shall be the duty of a relevant party;

    i) to give the Competent Agency all such assistance; and

    ii) to provide the Competent Agency with all such information, as that may reasonably be required for the purpose of carrying out an investigation

    d) The Competent Agency or appointed individual for the purpose of waste training and assessment of technical competency of operators may:

    i) Enter any premises for the purpose of carrying out any investigation. ii) carry out such inspections, measurements and tests on premises entered and articles/ records found on any such premises; or iii) at any reasonable time require any relevant party to supply him with copies of, or of extracts from, any records kept for the purpose of demonstrating compliance with the waste training and assessment of technical competency of operators.

    e) This standard enables the issue of regulations and technical memoranda which are enforceable by the Competent Agency who hold delegated authority under the General Environmental Regulations.

    8) Enforcement procedures

    a) Failure to comply with the requirements of these standards may lead to prosecution by the Competent Agency and those convicted of such failure may be subject to fines or periods of imprisonment as laid out in the General Environmental Regulations. b) It is anticipated that the requirements of this standard will be enforced nationally with inspections taking place to verify their implementation at a regional and local level.

    9) Penalty fines

    a) Maximum fines that may be imposed for breeching the applicable standard, breach of permit and failure to comply with an abatement notice are set out in the General Environmental Regulations.

    10) Appeals

    a) A right of appeal exists for any organisation or individual who is required to take action as a consequence of the implementation of the revised standard. b) The right of appeal against conviction or sentence is available through the appropriate judicial system as set out in the General Environmental Regulations.

    c) All appeals should be fully supported with a documented case containing as a minimum, the information required under the appeals process of the General Environmental Regulations.

    11) Periodic review a) As a minimum, the Competent Agency shall undertake a periodic review of this standard every 5 years. b) Where new information suggests that adjustments are required to this standard, all changes will be subject to the appropriate consultation and will be notified to facilities by the Competent Agency. Appropriate implementation time will be allowed.

    Article II Responsibilities 1) Waste Licence Holders

    a) Licence Holders are required to demonstrate that the activities authorised by the licence will be in the hands of a technically competent manager. b) The Licence Holder must decide who is to be assessed when the licence application is made. This applies to applications for licences or for the transfer of a licence and where there is a change in management of an existing site. c) The Licence Holder must identify one or more people who will be responsible for all aspects of site operation. d) Where the Site Licence requires, any changes to the technically competent management of a site must be reported to the Competent Agency by the licence holder, detailing the changes;

    i) providing the names and qualifications

    of any new technically competent person (TCP);

    ii) where he/she fits into the management

    structure;

    iii) a comprehensive schedule of sites allocated to the TCP.

    2) TSD Facility Management

    a) It is up to the owner or Licence Holder to provide a robust management structure for each facility to ensure that the management of the authorised activities is in the hands of a TCP. This management system must be clearly demonstrable to PME or its regional designated representative. b) The management of activities authorised by the Site Licence must be in the hands of a TCP. (See

    Waste Regulatory Control and Compliance Standard). c) Management in this context means that the TCP is in a position to control the day to day activities authorised by the Site Licence and carried on at the licensed site.

    3) Technically Competent Operators

    a) Each TCP must be in a position to control the day to day activities authorised by the Site Licence and carried out at the licensed site.

    b) Technically competent management of an authorised site may be provided by more than one person. This allows Operators to provide control of day to day activities through more than one TCP so that the requirement for on site presence may be shared. c) Each individual must be able to demonstrate their competence in all aspects of site management appropriate to the level of certification applied for. d) Anyone designated as the TCP in the Site Licence application for a treatment, storage or disposal facility must obtain a Certificate of Technical Competence (CoTC).

    Article III Certification Requirements 1) Test for Technical Competence

    a) The Competent Agency must not grant or transfer a licence for a TSD facility unless there is a designated TCP who is deemed a Fit and Proper Person (FAPP) in relation to that activity.

    b) The test for technical competence in respect of a FAPP is the qualifications and experience required of a person for the purposes of this Standard.

    c) Proof of technical competence will be required by the Competent Agency in respect of each person in whom the day to day management of a facility may be vested;

    i) this proof must be verified by the

    production of the relevant certificate by the TCP;

    ii) certificates are assessed at the facility

    in relation to the actual work of managing the relevant type of facility.

    d) To gain a certificate, a candidate must demonstrate a wide range of management competencies and technical knowledge.

    2) Technical Competence Certification

    a) TSD facilities must be managed by FAPPs certified as Technically Competent Persons. b) An Operator must be designated by the facility owner or Licence Holder to be the TCP and obtain certification or must employ an Operator already holding a CoTC.

    c) A person interested in obtaining a CoTC must undergo training carried out by PME or a PME approved training body and pass an assessment and examination conducted by PME or the Competent Agency.

    d) From the date of implementation of this Standard, a facility operator aged 55 or over with at least 5 years experience in the previous 10 years of managing a particular type of facility does not need to undergo the training requirements as detailed in this Standard. They must, however, undergo the assessment process to obtain a CoTC. e) A certified Operator designated by the owner or Licence Holder must ensure that;

    i) the operation and maintenance of the facility is in conformance with the provisions detailed in the series of Waste Standards; ii) the facility is operated in accordance with the facility licence and approved operation plan; iii) personnel employed at the facility are trained in their job responsibilities and such training shall be documented and made available to PME or the Competent Agency for inspection upon request; iv) policies and procedures for proper and safe facility operations are developed and periodically updated.

    f) A certified facility Operator must be present at a TSD facility during all hours of operation. The designated TCP need not be at the facility during all hours of operation but must be within 2 hours normal travel time of the facility and able to be contacted during 75% of the hours of operation. g) A trained Operator (who need not be certified) is allowed to operate a high volume TSD facility provided that a certified TCP oversees the operation at least twice a week and the facility is not been placed under a prohibition restricting operation. h) Certification is valid for three years. The incumbent must obtain 16 hours of approved refresher training during this three year period. Such training should be available regionally.

    i) If proper refresher training is not taken within the specified period and the recertification fee is not paid within three months of expiration of a certificate, the certificate automatically expires. A person seeking reinstatement must retake full training and pass the assessment process. j) Under certain circumstances, PME or the Competent Agency may suspend, revoke or refuse to renew certification.

    3) Site Attendance

    a) There must always be a minimum site attendance of 25% of the operational time of the site on a weekly basis by the certified Operator at all types of TSD facilities, except in landfill sites in post-closure phase. b) The Site Licence will dictate the number of hours of attendance at the facility required by the certified Operator, taking into consideration the licensed activity together with the type of waste being handled. c) A record of the attendance together with the weekly operational hours of the facility must be kept and made available for inspection by the Competent Agency. d) For two or more authorised facilities where they;

    i) are in the hands of the same owner or Licence Holder, and

    ii) share a common boundary,

    consideration will be given to assimilating the site attendance requirements of the facility with the lower site attendance requirements into the requirements of the facility with the higher attendance percentage. This consideration will be given and detailed in the Site Licence for each facility. e) For landfill sites in post-closure phase where the only authorised activities which are continuing are the management of landfill gas, water and leachate, specific on-site attendance by a TCP is not required. Therefore, there is no limit to the number of closed landfill sites which may be managed by a single technically competent certified Operator.

    4) Fees

    a) A non-refundable application fee must accompany the application to the Competent Agency and is based on costs incurred by that body in the application review and assessment process.

    b) Fees are payable on application for initial assessment for certification, for reassessments and for renewal of certificates.

    Article IV Training Requirements

    1) Facilities and Certificates of Technical Competence

    a) All TSD facilities required to be licensed under the Waste Regulatory Control and Compliance Standard must have a designated TCP with the appropriate certification corresponding to the relevant facility. b) The type of facilities and the corresponding CoTC titles and certificate codes are detailed in Appendix A. c) TSD facilities need to be licensed appropriately but it may not follow that a particular CoTC is the relevant award where facilities carry out more than one treatment, storage or disposal activity. This is primarily where storage facilities introduce processes and equipment that may change them into a treatment type of facility but the primary activity is one of storage and transportation of waste. Appendix B details the types of waste activities and corresponding CoTC award required in such circumstances.

    2) Training Requirements a) TCP candidates who wish to be certified must have knowledge and be trained in all of the following areas;

    i) TSD facility theory, site infrastructure and basic design concepts including how features protect groundwater, surface water and air quality.

    ii) TSD facility site operations such as:

    Elements of a Site Licence and operational provisions;

    Handling and reporting of hazardous

    waste; Handling of waste including the

    movement, sorting and storage of waste;

    Receiving and transporting waste for

    onward transfer; Daily filling sequences for landfill

    sites; Site security.

    iii) general TSD facility maintenance such as regular maintenance of leachate and gas collection systems, and cleaning and repair of surface water control systems.

    iv) preparation and restoration of TSD

    facilities for aftercare. v) monitoring and reporting requirements

    specific to the relevant TSD facility including spills and storage requirements.

    vi) employee health and safety to include

    hazardous substances, PPE, clean up requirements and hazardous risks from landfill gas.

    vii) employee training to include developing,

    implementing and documenting training programmes for all personnel at the TSD facility.

    b) Training must also cover the specific requirements applicable to the type of CoTC and corresponding TSD facility that the candidate is applying for.

    Article V Assessment of Technical Competence

    1) The Assessment Process

    a) The assessment is made up of three parts;

    i) the Statement of Qualifying Experience (SQE) Form to demonstrate the level of experience and its relevance to the proposed activities;

    ii) a site visit to talk through site operation,

    the operation plan and the Site Licence requirements;

    iii) a question and answer session.

    b) Two Assessors from PME or the Competent Agency must be present at all times during the assessment. c) Each Assessor must have at least two years experience of waste management and must have attended the training course associated with the assessment. d) Where there has been a conflict of interest between a candidate and an Assessor, or a concern over the objectivity of the assessment, particularly where a candidate is seeking a re-assessment, then the candidate can request that an Assessor stand down from the assessment process and another Assessor take their place.

    e) Where a certified TCP is moving to another TSD facility of the same type to the one they already hold a CoTC for, they are need only be re-assessed during a site visit to enable them to demonstrate their knowledge and understanding of the particular site for which they will be providing technically competent management. f) A facility operator aged 55 or over at the date of implementation of this Standard, with at least 5 years experience in the previous 10 years of managing a particular type of facility, must undergo the assessment process to obtain a CoTC without having to provide evidence of attending an approved training course.

    2) Statement of Qualifying Experience Form

    a) The Candidates type and level of experience must be examined in the area of waste management in which they will operate. Details must be supplied in the form of a SQE endorsed by two referees. b) If a candidate has no relevant experience within the waste management industry then the assessment will be more detailed than for a person with relevant experience. c) Previous work experience of the candidate outside the waste management industry can be taken into account as well as level achieved by the candidate on the approved technical competence training course. d) The SQE form is intended to provide the Assessor with an insight into the candidates background and level of relevant experience. It must be used to assess the depth of assessment required for the site visit and a question and answer session. e) The qualifying period for experience is the preceding 10 years prior to the application date. The candidate will ideally be able to show that they have had at least 5 years relevant experience but candidates with no previous waste management experience must not be ruled out. f) The candidate must submit the SQE form to PME or the Competent Agency with the corresponding fee to enable the assessment process to commence. (The SQE form is produced in Appendix C of this Standard). g) The site visit and question and answer session must take place within 2 months of the date of receipt of the SQE form or the application process must be repeated.

    3) Site Visit

    a) The site visit has the aim of providing the Assessors with an opportunity to assess the

    candidate in their working environment and to gain the necessary assurances that the site will be adequately controlled and managed on a day to day basis. b) The site visit consists of a tour of the site to discuss site construction and operation during which detailed discussion of the Site Licence provisions (or draft provisions) will take place. c) Where more than one TCP has been designated for the TSD facility, the site visit must be conducted with each person separately and preferably on the same day. d) The date and time of the visit must be confirmed to the candidate at least 7 days prior to the visit, in writing. Cancellation by the candidate without 24 hour notice will result in an unsuccessful assessment (this can only be waived in exceptional circumstances). e) The discussion during the site visit includes providing the candidate with an opportunity to demonstrate their practical knowledge and understanding in managing the site covering topics such as site infrastructure, operation, environmental control, monitoring and record keeping. f) Assessors must record and document the responses of the candidate in a Site Visit Technical Assessment Record Form (see Appendix D) which determines the abilities that have been demonstrated during the site visit. g) The Site Visit Technical Assessment Form must be completed by both Assessors immediately following the site visit. h) Assessors must follow the scoring system to assist in quantitative assessment of the level of knowledge and understanding demonstrated by the candidate as follows:

    3 Good Applicant has detailed knowledge of the issue and fully understands the underlying principles

    i) An average score of 2 or more for each shaded section on the assessment form is required for

    success. Issues not adequately addressed during the site visit may be covered during the question and answer session. j) The Site Visit Technical Assessment Form can be used for all TSD facilities. Sections which are not relevant to a particular facility must be omitted from the assessment and this must be indicated on the form.

    4) Question and Answer Assessment

    a) The candidate has the opportunity to demonstrate further their knowledge and understanding of waste management, using PME standard range of questions to ensure consistency throughout KSA. b) At least 7 days notice must be given to the candidate of the date for the question and answer assessment. Confirmation must be sought by the Assessors that the proposed date is convenient. Where possible, this can be carried out on the same day as the site visit. c) Prior to the assessment, the assessors must select a range of questions relevant to the TSD facility for which the CoTC application applies. If the site does not cover hazardous wastes, then the candidate need only demonstrate an awareness of hazardous waste requirements. d) Questions are to be grouped into sections covering areas similar to those covered in the site visit but including sections on broader waste management issues such as waste transporter requirements and waste classification. e) Candidates who have no previous waste management experience will be expected to answer more questions than those who have demonstrated relevant qualifying experience. f) Candidates must not be advised of the questions to be put in advance. g) The Assessors must score the answers to the questions after the candidate has left the room using the same scoring system as the site visit assessment. Candidates must score an average of 2 or more in each section to be successful.

    5) Making the Assessment a) Within 5 working days following the question and answer session, the candidate must be informed in writing confirming their success or otherwise. b) A Certificate of Technical Competence must be sent to the successful candidate, issued with a certificate number, detailing the code and title of the certificate, the name of the TCP, the name and

    address of the corresponding TSD facility and the date of the award. c) Certification is valid for three years, before which time the TCP must undergo refresher training and apply to the Competent Agency for a renewal of their CoTC supported by written evidence of passing the refresher training course and accompanies with the appropriate fee. d) Where a candidate has failed the assessment, a re-assessment must follow the same procedures as for a first assessment. e) Where a candidate fails the re-assessment twice, the owner or Licence Holder of the TSD facility must be advised that their designated candidate as the TCP has been unsuccessful and that an alternative person must be nominated. Alternatively, the Competent Agency may refuse the licence application or suspend the Site Licence on the grounds that the applicant is not a FAPP.
