How to File the Petition for Change of Name 1. When You Must File a Name Change in Family Court: Filing on behalf of a child:

If you are seeking to change the name of a minor child; or

Filing on your own behalf with a pending or past Family Law case:

If you are seeking to change your name and you have or had a family law case in Orange County, the Petition for Change of Name must be filed at the Lamoreaux Justice Center in Orange (Family Court). Please contact Self -Help Services for filing options or instructions.

• A Family Law case includes Divorce, Legal Separation, Nullity, Parentage (when parents are not married) Custody and Visitation, Domestic Violence Restraining Orders, or Child Support.

• Even if your case is “closed” because you reached a judgment or an agreement with the other party in your case, you must file the Petition for Change of Name at the Family Court in Orange County.

A f iling fee of $465 will be charged to file a Name Change with the Family Court in Orange County, unless you qualify for a fee waiver.
