6. County Warden’s Welcome and Remarks
Warden Bain welcomed the members and noted that residents can now view County Council meetings with closed captioning, courtesy of Cogeco Cable. He noted that he had attended the following events:
• Planning meeting for the North American Strategy for Competitiveness conference which will be at Caesars in Windsor in September

• Meeting with the Deputy Premier, where he and Mr. Gregg, CAO, presented her with the many issues that are important to this area such as expanded hydro line to Leamington and Kingsville; economic development; high speed broadband; joint and several liability; and reliable funding.
• Essex County Historical Society meeting
• Nurse Practitioner program funding announcement.

A) Erie St. Clair Local Health Integration Network (ESC LHIN)
Gary Switzer, CEO, ESC LHIN and Sandra Lariviere, Health System Design Manager, ESC LHIN to make a presentation to County Council regarding Windsor/Essex Phase 1 Community Capacity Plan.
73-15 Moved by Mr. Fazio Seconded by Mr. McNamara That Mr. Switzer and Ms. Lariviere be permitted to address County Council. Carried
Mr. Switzer explained that the Community Capacity Plan is a roadmap for the transition of services from acute care that can be safely delivered in the community. Mr. Switzer explained that the objective of the process was to create a stronger coordinated care path between primary care services, community services providers and hospital services. Representatives on the Steering Committee were from Windsor Regional Hospital, Hotel Dieu Grace Hospital, Leamington District Memorial Hospital, CCAC, community health services providers, long-term care and rest homes,

Windsor Housing, Family Health Team, Essex-Windsor Emergency Medical Services, and ESC LHIN.
Some of the potential components of services identified for care transition to the community were:
• Cancer
• Cardiac
• Critical care
• Diagnostics
• Emergency
• Medicine
• Mental health
• Rehab
• Renal
• Surgery
• Women and Children.
He noted that the goal was to ensure that care is provided to the patient in the appropriate setting. He also advised that the Committee would continue to consider and further refine which services and functions may be delivered safely in a community setting. The Phase 1 report, which is part of the September 23, 2014, Open Board meeting package, can be viewed at: www.eriestclairlhin.on.ca.
With regards to mental health, Mr. Switzer advised that the Steering Committee was working closely with the OPP and Windsor police on this issue.

Several Council members stated that in order for this to work, the hospitals and other community agencies would have to work closely together.
B) Jack Miner Migratory Bird Foundation
Mary Baruth, Executive Director, Jack Miner Migratory Bird Foundation to speak to County Council regarding the 150th birthday of Jack Miner on April 10, 2015 and the events scheduled for the National Wildlife Week Festival, April 11 – 12, 2015.

Mrs. Baruth presented a PowerPoint presentation on the 150th birthday celebrations of Jack Miner and the events scheduled for National Wildlife Week Festival.

C) Community Paramedic Remote Patient Monitoring
Council considered Report Number 2015-R004-EMS-0401-BK, dated April 1, 2015 from Bruce Krauter, Chief, Essex-Windsor Emergency Medical Services regarding the Community Paramedic Remote Patient Monitoring Project.
Several Committee members expressed concern that although funds were being provided for this program at this time, it may not be available at a later date and then the County would be responsible for funding the program. In addition, there was concern that with the aging population, mental health issues, and off-loading issues at

the hospital, the paramedics would not have time to administer this program.
Mr. Gregg stated that the purpose of the program was to reduce the number of EMS calls since the patients would be closely monitored and not require as many repeat visits to emergency rooms. He also noted that there was a clause in the agreement which would allow the Essex-Windsor EMS to withdraw from the program with proper notice. Mr. Gregg also advised that they have received assurance that Essex-Windsor EMS would not be the monitoring agency for this program going forward after this study.
Mr. Gregg advised that if the program were to be cancelled, an education strategy would need to be developed for those residents involved in the pilot study. He noted that Council would be provided with a report on the pilot study on a regular basis.

A) WindsorEssex Economic Development Corporation
Mr. McNamara stated that he was very disappointed in the comments made at the recent Windsor City Council meeting in regards to the performance of Sandra Pupatello, the Chief Executive Officer of the WindsorEssex Economic Development Corporation. He also stated that he felt that the current representation on the WEEDC Board did not need to be revised. Mr. McNamara also stated that

he felt the negative publicity and comments made by the press on the WindsorEssex Economic Development Corporation could have the effect of hurting economic growth in the region. Numerous members of County Council, including all the Mayors of the local municipalities concurred with the comments and concerns raised by Mr. NcNamara. He asked that the Warden bring this message to the Mayor of the City of Windsor in an effort to stop the negative publicity.

I wanted to let you know that my private member's bill, Bill 36 the Respecting PrivateProperty Act passed second reading in the Legislature with all-party support. It has been
referred to the Standing Committee on Justice Policy for public consultation.
Bill 36 has received support from residents and a wide range of stakeholders, including theOntario Federation of Agriculture.
If enacted, Ilill 36 would amend the Trespass to Property Act by creating a minimum fine of$500 for trespassing and increase the maximum compensation for damages to $25,000.Currently the Trespass to Property .4ct has no minimum fine for those who trespass, and has a
maximum limit of $1,000 on compensation for damages.
Bill 36 would ensure property owners are fairly compensated for destruction of their property,and signal that trespassing is a serious issue that will not be taken lightly in the justice system.

Background
Section 15(a)(ii) of By-Law #54-2014, being a By-Law to Provide Rules Governing the Order and Proceeding of the Council of the Corporation of the County of Essex requires that “auditor’s fees, consultation fees over and above contractual amounts, legal expenses, and items of a capital nature not already approved in budget estimates are to be referred to County Council for approval”.

Purpose
The purpose of this report is to provide County Council information and recommendations pertaining to construction projects on Highway 3 to be undertaken by the Ministry of Transportation in 2015.
Background
The Province of Ontario through the Ministry of Transportation will be improving a significant portion of Highway 3 in the County of Essex during the 2015 Construction season. The overall scope of work includes a resurfacing component and a full reconstruction project. The limits are as follows:
Part A – Reconstruction – County Road 27 to County Road 34
Part B – Resurfacing – County Road 8 to County Road 27.
The duration of the project is anticipated to be approximately 6 months, undertaken in 3 phases requiring various lane closures and full closures of Highway 3 and local side roads to allow for the reconstruction. The

reconstruction of Highway 3 from CR 27 to CR 34 has been designed to support the future 4 laning of the highway. The newly constructed 2 lane road platform will ultimately become the westbound lanes when the highway is widened to 4 lanes.
Discussion
The County of Essex has worked with the MTO to develop a traffic management strategy that allows for the work to be undertaken as expeditiously as possible while attempting to mitigate the impacts of the proposed road closures. The detour routes have been established with input from the Town of Kingsville, Student Transportation and Emergency Services.
In order to accommodate the full closure of Highway 3, County Roads 18, 23 and 34 will be utilized through the various stages. Appendix 1.0 attached to this report highlights the detour routes and phasing. The project scope includes several improvements to the County Roads to accommodate and manage the detoured traffic. Geometric improvements will be made to the intersection of CR 23/ CR 18 to widen the pavement platform, extend a large culvert and install guiderail protection. These improvements will be left in place after the Highway 3 construction is completed.
Temporary traffic control signals will be installed at the intersections of CR 23/CR 18, CR 29/CR 18/and CR 18/CR 34. These signal installations will be removed after construction as the background traffic volumes do not warrant signalizations. Appendix 2.0 shows these locations.
The project is currently out for tender and an overall schedule will be finalized following award of the contract. MTO has provided the preliminary schedule for the reconstruction with resurfacing to be coordinated within the schedule.

Purpose
To provide County Council with information concerning the ongoing activities of Planning Services.
Background
The Planning Services department provides planning advisory services to County Council on matters related to County-wide land use planning, economic development, and strategic planning matters. This section also prepares responses to provincial policy and program initiatives, and works with local municipal planners to resolve development issues. The Manager of Planning Services acts as the approval authority for plans of subdivision, plans of condominium, part lot control by-laws, and local Official Plan amendments. County Council delegated this authority to the Manager of Planning Services by By-law in accordance with the provisions of the Planning Act.

Discussion
The number of new applications received for plans of subdivision, plans of condominium, part lot control by-laws, and local Official Plan amendments varies from year to year. In the past two years, the County has accepted applications for thirteen plans of subdivision, two plans of condominium, thirteen part lot control by-laws and eighteen local Official Plan amendments. In addition to the accepted applications, there are countless inquiries and preliminary reviews of development proposals. Planning Services also provides comments annually on dozens of local municipal consents/severances, minor variances, Zoning By-law amendments, and Site Plan Control applications.
In 2014, the County completed the five year review of its Official Plan, a large project that spanned almost five years. In the new Official Plan, County Council agreed to undertake a study to determine the most appropriate minimum parcel size for all types of agricultural lots in Essex County. In 2015, the County, through Planning Services, will conduct an Agricultural Lot Size Study to determine the appropriate lot size for various types of agricultural operations. Local Official Plans have a range of minimum sizes from 10 hectares to 40 hectares, and those policies remain in effect until the County study is complete.
As a result of the adoption of the new County of Essex Official Plan, it is anticipated that several of the lower tier municipalities will begin the mandatory five year review of their Official Plans. Planning Services works closely with the local planners throughout this process to ensure that the local Official Plan updates are consistent with the Provincial Policy Statement and the County Official Plan.
Planning Services also acts as an administrative resource to the Housing Advisory Committee (HAC). The Committee serves as an advisory body on issues relating to the supply, demand and need for affordable housing units; acts a medium for informational exchange with sector representatives on housing program initiatives and community issues; acts as a resource and advocate on behalf of stakeholders to educate and advance the awareness of government officials on matters pertaining to housing in Windsor and Essex County.
The Committee is primarily guided by The Housing Analysis and Recommended Strategies Report (HARS 2010), and the Windsor-Essex Ten Year Housing and Homelessness Plan (HHP). Planning Services also serves

as the County’s representative for the review of applications received under the Investment in Affordable Housing (Rental Housing Capital Component) program funded by the Province. Windsor-Essex received $2.2 million in funding in 2014 and looks to receive further allocations as the program has been extended until 2020.
Planning Services also keeps abreast of the constantly changing Provincial Acts and regulations. For example, the Endangered Species Act has had a significant impact upon the planning process in Ontario. Working closely with the local planners, Planning Services has spearheaded dialogue with the Ministry of Municipal Affairs and Housing as well as the Ministry of Natural Resources and Forestry on this topic, in an effort to clarify municipal requirements and expectations, and adopt an acceptable protocol to ensure a consistent approach throughout the County and the City of Windsor.
Recommendation
That County Council receive the report of the Manager of Planning Services with regard to the ongoing activities of Planning Services.

Subject: Agricultural Lot Size Study

Purpose
To recommend to County Council the selection of a consultant to prepare the Essex County Agricultural Lot Size Study.
Background
The County of Essex Official Plan was adopted on February 19, 2014 and approved by the Ministry of Municipal Affairs and Housing on April 28, 2014. The Official Plan has a strong focus on protecting agricultural lands and the natural environment.
The determination of the appropriate lot size for various types of agricultural operations was an extremely contentious issue throughout the five year review of the Official Plan. The Ontario Ministry of Agriculture, Food and Rural Affairs (OMAFRA) requested that the County include a 40 hectare minimum farm parcel size for general agricultural uses. Recent data indicates that less than 8% of farms in the County of Essex meet this minimum standard.

adoption of a consistent approach across the County for establishing minimum farm lot sizes and policies for farm lot severances.
After hearing the comments received during the public review process, County Council agreed to undertake a study to determine the most appropriate minimum parcel size for all types of agricultural lots in Essex County. In the interim, after considerable discussion and negotiation, the Official Plan permits the continuation of existing agricultural lot creation policies at the local level until the County study is complete and an Official Plan Amendment has been adopted and approved. The study will assist the County in determining the minimum parcel size for all types of agricultural lots, including, but not limited to, new lots for agricultural uses, specialty crop areas, and agriculture-related uses.
The 2015 Budget included appropriate funding to undertake the study. After budget approval, the County issued a Request for Proposals (RFP) for Professional Consulting Services for the Essex County Agricultural Lot Size Study. The RFP was posted on the County’s website and distributed to interested parties through both the County Planning Services and local planning departments. Submissions were received by the County until March 25, 2015, and this report outlines the results of the competition.
Discussion
The County of Essex responded to several inquiries concerning the RFP and in the end received two (2) submissions. The proposals were delivered to the local planners on March 26, 2015. The local planners will form a Steering Committee to review the progress of the study and to provide guidance throughout the project. The Steering Committee model was used with great success during the Official Plan review process.
Each member of the Steering Committee independently evaluated the proposals that were received in accordance with a scoring criteria established and detailed in the RFP. The scoring criteria considered the consulting team profile and designated lead consultant, the study proposal, and the proposal price. At a meeting on April 2, the Committee unanimously recommended that Jones Consulting from Barrie, Ontario be engaged to prepare the study. The proposal from Jones Consulting has a maximum upset fee of $55,685.00, including disbursements, plus HST. Funding for this project will be recovered from the Official Plan Review reserve, and the proposed cost is within administration’s expectations. It is anticipated that the project will be completed before the end of 2015.

Recommendation

Being a By-law to Confirm the Proceedings of the Council of The Corporation of the County of Essex.
Whereas under Section 5(1) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, the powers of a municipality shall be exercised by its Council; and
Whereas under Section 5(3) of the Municipal Act, 2001, S.O. 2001, c.25 as amended, a municipal power, including a municipality’s capacity, rights, powers and privileges under Section 8 of the Municipal Act, 2001, S.O. 2001, c.25 as amended, shall be exercised by by-law unless the municipality is specifically authorized to do otherwise; and,
Whereas it is deemed expedient that the proceedings of the Council of The Corporation of the County of Essex, at this meeting be confirmed and adopted by by-law;
Now therefore the Council of the Corporation of the County of Essex hereby enacts as follows:
That the actions of the Council of The Corporation of the County of 1.Essex in respect of all recommendations in reports of committees, all motions and resolutions and all other action passed and taken by the Council of The Corporation of the County of Essex, documents and transactions entered into during the April 15th, 2015, Regular Meeting of Council, is hereby adopted and confirmed, as if the same were expressly embodied in this By-law.
