Discussion

TheCountywillusetheanticipatedresourcesoftheCDBG,HOMEandESGprogramstofundtheprojectsidentifiedinthe2016OneYearAction

Plan.Inaddition,theCountyanticipatesthatwiththeFederalHousingFinanceAgency'swilldirectFannieMaeandFreddieMactobegin

allocatingfundstotheHousingTrustFundandtheCapitalMagnetFundpursuanttotheHousingandEconomicRecoveryActoof2008.Begining

in2016itisexpectedthat65%ofthesefundswillbeallocatedtoHUDandultimatelytoStatesandparticipatingjurisdictions.Thesefunds,80%

ofwhichwillbemadeavailabletorentalhousingactivitiesand10%tohomeownershipactivities,couldleverageexistingHOMEfundsin2016.

FromPY2013throughMarch2016,theCountyexecutednineLoanAgreementstotaling$6.8MM.Theseprojectsare

providinganaggregateofseventynineHOMEassistedaffordableHousingunits,sixofwhicharespecificallydedicatedfor

homelesspersonsandsixteenofwhichareoccupiedbypersonswithspecialneeds.

Annualawardsforthepasttwoprogramyearswere$845Kand$807Krespectively.However,theCountywasableto

provideadditionalfundingofapproximately$3MMbydrawingfromaccumulatedProgramIncomeandpreviously

unallocatedfundsfrompriorprogramyears.

AsofMarch22,2016,theCountyhas$200KavailableforFirstTimeHomeBuyers(FTHB),$121KreservedforCHDOprojects

andapproximately$1.4MMforprojectactivities($650KofwhichisbudgetedfortheNCCABetterLifeprojectforwhicha

LoanAgreementwillbeexecutedbyorbeforeApril20,2106.)

Basedontheprojectactivitiesfundedin2014and2015,thecurrentbalanceoffundsavailable,andtheanticipatedawardof

$806KinPY2016,theCountyprojectsitwillcommit$850Kto$1MMduringPY2016.

ThenumberofHOMEassistedaffordablehousingunitsyieldedbyfutureprojectsdependsinpartontheamountoffunds

leveragedagainsttheCounty’sHOMEloans.Forexample,theCountyprovidedfundingforaseniorcitizenhousingprojectin

BellevillethatwasprimarilyfundedbyotherfundingsourcesbutyieldedahighnumberofHOMEassistedunits.

Forthepastthreeyears,theaverageratioofHOMEdollarsfromtheCountytothenumberofHOMEassistedunitswas

approximately$86,000.

Basedonthisratio,fundsavailability,andthemaximumsubsidylimitsforHOMEfundedprojects,itisanticipatedthatthe

Countywouldproduce10HOMEassistedunitsfromrehab/newconstructionactivities,1householdunitthroughtheFirst

TimeHomeBuyerProgram,andpotentially2unitsforpersonswithSpecialNeedsthroughaCHDOsponsoredactivity.

defaultunderanytermsoftheLoanAgreement,Mortgage,PromissoryNoteand/orDeed

Restrictionor(4)uponbuyersdeathwithin(15)fifteenyearsorthedurationoftherequired

affordabilityperiod.Incompliancewith24CFR92.254(a)(5)(ii)(A),theCountywilllimittheactual

amountrecapturedfromhomebuyerstonetproceeds.Per24CFR92.254(a)(5)(ii)(A),netproceeds

arethesalespriceminussuperiorloanrepaymentsandanyclosingcosts.Thispolicyappliestoall

HOMErecapturetransactions,includingthoseinvolvinglegaldocumentsexecutedpriortoadoption

ofthispolicyandspecifyingthattheentireHOMEinvestmentwillbere-captured.

ForallHomebuyeractivitiescompletedwithHOMEfunds,adeedrestrictioninthefollowingform

shallbeincorporatedintheDeedtoberecordedandontheloanagreementuponacquisitionofthe

subjectpremises:

"Thegranteehereunderdoesacknowledgethatthecostofacquisitionofthepropertyhasbeen

satisfiedinpartoutoftheproceedsofacertainloanfromtheCountyofEssexundertheFederal

HOMEprogramandthatthepremisesshallbesubjecttotheaffordabilityrequirementscontainedin

24CodeofFederalRegulation,Part92.TheprovisionsthereofmaybeenforcedbytheCountyof

Essexbyanactionforspecificperformance,foreclosureofmortgageorsuitonthepromissorynote,

mortgagefiledinaCourthavingjurisdiction.Thepremisestobeacquiredshallbesubjecttothe

specificprovisionsoftheLoanAgreementdated(ClosingDate),theMortgage,thePromissoryNote

andforaffordabilitycontainedin24CFR92.504foraperiodoffifteenyearsfromthedateof

acquisitionforthepropertybytheBorrower."

TheDeedrestrictionplacedbytheLenderonthepropertyshallterminateuponforeclosure,or

transferinlieuofforeclosurebytheFirstMortgage.Theamountprovidedinthisloanwillbepaid

fromthenetproceedsofsaleoftheproperty,subjecttothetermsandconditionshereinincluding

expresslytheprovisionsandtermsoftheHOMEprogramandtheregulationsthereunder24CFR

Part92.254(a)(5)(ii)(A)(1).

AswiththeFirstTimeHomeBuyerprogram,theCountywillexercisearecaptureprovisionwiththe

developeragencyand/orthefinalhomeownertoensuretheaffordabilityofunitsacquiredwith

HOMEfunds.

TheacquisitionloanfortheBorrowerwouldbedueandpayablepriortotheexpirationofthe

AffordabilityPeriodasdefinedintheapplicableLoanAgreementduetoanychangeinuseofthe

HOMEassistedunitsasdefinedintheLoanAgreement;asaleortitletransferofthepropertybythe

Borrower;afailurebytheBorrowertobeincompliancewithHOMErequirements;oruponany

specifiedconditionfordefault.

Incompliancewith24CFR92.254(a)(5)(ii)(A),theCountywilllimittheactualamountrecaptured

fromhomebuyerstonomorethannetproceeds.Per24CFR92.254(a)(5)(ii)(A),netproceedsare

thesalespriceminussuperiorloanrepaymentsandanyclosingcosts.

ForadeveloperinitiatedprojectinvolvingtheacquisitionofapropertyusingHOMEfunds,adeed

restrictionthatincludeslanguagesimilartothatpresentedbelowwouldbeincorporatedinthe

Deedtoberecordedandontheloanagreementuponacquisitionofthesubjectpremises:

"Thegranteehereunderdoesacknowledgethatthecostofacquisitionofthepropertyhasbeen

satisfiedinpartoutoftheproceedsofacertainloanfromtheCountyofEssexundertheFederal

HOMEprogramandthatthepremisesshallbesubjecttotheaffordabilityrequirementscontainedin

Loan.TheprovisionsthereofmaybeenforcedbytheCountyofEssexbyanactionunderthe

privatenonprofitorganizations(includingcommunityandfaith-basedorganizations).

TheDivisionofHousingandCommunityDevelopmentisamemberoftheComprehensive

EmergencyAssistanceSystem,whichisacommitteethatoverseestheEssexCountyContinuumof

Care.ThetaskoftheCEASandCoCistoidentifyhomelesspopulationsthatmeetHUDsdefinitionof

homelessnessandalsothosewhoareimminentlyandpotentiallyatriskofhomelessness.Another

taskoftheCoCandCEASistodecidehowfundingsourcesandcoordinationisadministered

betweentheshelterproviders,theirfunders,andtheirclients.Utilizingpolicyandprocedureand

governanceguidelinestheseentitiesoverseethedisseminationoffundingofallsourcesandarethe

stewardsoftheirowndataontheirpopulations.NewJerseyhasaHomelessManagement

InformationSystem(HMIS)thatismanagedbyNJHousingandMortgageFinanceAgency(HMFA);

thissystemisthesoleco-locatedsourceofdata,andisreportedonanannualbasisdirectlybackto

HUDandtheStateofNJ.

TheDivisionputsoutanRFPonayearlybasisforourESGfunds,whichiscollectedandscored

internally.AtthatpointtheCEAScommitteehastheirownexecutiveboardthatwillmeetinorder

toevaluatetheCounty'srecommendationandeitheragreeormakesuggestionsonchangestothe

plan.FromtheretheentireplanisbroughttothefullCEAScommitteefortheirconfirmation,and

theCountywilldoit'sownregularcitizenparticipationprocess.Fromthereweenterintocontracts

withsub-awardees.

4. Ifthejurisdictionisunabletomeetthehomelessparticipationrequirementin24CFR

576.405(a),thejurisdictionmustspecifyitsplanforreachingouttoandconsultingwith

homelessorformerlyhomelessindividualsinconsideringpoliciesandfundingdecisions

regardingfacilitiesandservicesfundedunderESG.

TheCoCcomplieswith24CFR576.405(a),andisworkingtowardsalargercontingentofhomelessor

formerlyhomelessindividualsparticipatingintheplanningprocess.TheCoChastaskeditsown

membershipcommitteewiththeoutreachportionofthistask.

5. DescribeperformancestandardsforevaluatingESG.

Asofrightnow,HUDhasnotprovidedparticularperformancestandardsandgoalsfortheESG

program.WehaveindependentlybeenworkingonstandardsandgoalswiththeCoC,especiallythe

monitoringandevaluationsubcommittee.HMIShasanumerousamountperformance

measurementmetrics,andwecurrentlyoperateaperformancemetricsystemthatoperateswith

percentagesinabovethe80%percentilerangeinallcategories.Thesecategoriesincludedata

quality,zipcodequality,housingutilizationrates,averagelengthofstay,etc.
