MatchingrequirementsareprimarilysatisfiedfromlocaltaxabatementsandfavorableinterestloansfromtheNJHMFAandotherlendersthat

EssexCountywillprovideadeferredpaymentloantoassisthomebuyerstopurchaseeligible
propertiesthroughaFirstTimeHomeBuyer'sprogram.Thehomebuyer’sloanisdueifthebuyer(1)
sellsand/ortransferstitletothepropertytoapersonotherthantheBorrowerandtheirspouseor
partner,(2)uponthebuyersceasingtousethepropertyastheirprimaryresidence,(3)uponbuyers
defaultunderanytermsoftheLoanAgreement,Mortgage,PromissoryNoteand/orDeed
Restrictionor(4)uponbuyersdeathwithin(15)fifteenyearsorthedurationoftherequired
affordabilityperiod.Incompliancewith24CFR92.254(a)(5)(ii)(A),theCountywilllimittheactual
amountrecapturedfromhomebuyerstonetproceeds.Per24CFR92.254(a)(5)(ii)(A),netproceeds

"Thegranteehereunderdoesacknowledgethatthecostofacquisitionofthepropertyhasbeen
satisfiedinpartoutoftheproceedsofacertainloanfromtheCountyofEssexundertheFederal

24CodeofFederalRegulation,Part92.TheprovisionsthereofmaybeenforcedbytheCountyof
Essexbyanactionforspecificperformance,foreclosureofmortgageorsuitonthepromissorynote,
mortgagefiledinaCourthavingjurisdiction.Thepremisestobeacquiredshallbesubjecttothe
specificprovisionsoftheLoanAgreementdated(ClosingDate),theMortgage,thePromissoryNote

TheDeedrestrictionplacedbytheLenderonthepropertyshallterminateuponforeclosure,or
transferinlieuofforeclosurebytheFirstMortgage.Theamountprovidedinthisloanwillbepaid
fromthenetproceedsofsaleoftheproperty,subjecttothetermsandconditionshereinincluding
expresslytheprovisionsandtermsoftheHOMEprogramandtheregulationsthereunder24CFR
Part92.254(a)(5)(ii)(A)(1).

AswiththeFirstTimeHomeBuyerprogram,theCountywillexercisearecaptureprovisionwiththe
developeragencyand/orthefinalhomeownertoensuretheaffordabilityofunitsacquiredwith
HOMEfunds.
TheacquisitionloanfortheBorrowerwouldbedueandpayablepriortotheexpirationofthe
AffordabilityPeriodasdefinedintheapplicableLoanAgreementduetoanychangeinuseofthe
HOMEassistedunitsasdefinedintheLoanAgreement;asaleortitletransferofthepropertybythe
Borrower;afailurebytheBorrowertobeincompliancewithHOMErequirements;oruponany
specifiedconditionfordefault.
Incompliancewith24CFR92.254(a)(5)(ii)(A),theCountywilllimittheactualamountrecaptured
fromhomebuyerstonomorethannetproceeds.Per24CFR92.254(a)(5)(ii)(A),netproceedsare
thesalespriceminussuperiorloanrepaymentsandanyclosingcosts.
ForadeveloperinitiatedprojectinvolvingtheacquisitionofapropertyusingHOMEfunds,adeed
restrictionthatincludeslanguagesimilartothatpresentedbelowwouldbeincorporatedinthe
Deedtoberecordedandontheloanagreementuponacquisitionofthesubjectpremises:
"Thegranteehereunderdoesacknowledgethatthecostofacquisitionofthepropertyhasbeen
satisfiedinpartoutoftheproceedsofacertainloanfromtheCountyofEssexundertheFederal
HOMEprogramandthatthepremisesshallbesubjecttotheaffordabilityrequirementscontainedin
24CodeofFederalRegulation,Part92.TheAffordabilityPeriodwillbe20years,andwillbe
enforcedthroughaDeedRestrictionthatrunswiththelandtobeexecutedbytheBorrower.The
AffordabilityPeriodwillnotcommenceuntilaCertificateofOccupancy(CofO)andaproject
completionreporthasbeensubmittedbytheBorrowertotheLender,andtheProjecthasmetthe
requirementsforProjectCompletionoutlinedin24CFR92.2,whichwillrequirethattheproperty
acquisitionbeexecuted;allHOMEfundshavebeendisbursedbytheCountyanddrawnfromtheUS
Treasury;theprojectsiteisfullyleasedup;andrequiredcompletiondatahasbeenenteredinHUD’s
IDISsystem.TheCountywillnotifyBorroweroftheactualdateofcompletionandtheexactdateof
theexpirationoftheAffordabilityPeriod,whichshallbecalculatedbasedonthedateof
completion.Ifnecessary,theBorrowershallexecuteanamendmenttothedeedorcorrectivedeed
thatextendstheaffordabilityrestrictionsof24CFR92.252totheexactdateofexpirationofthe
AffordabilityPeriod.TheAffordabilityPeriodshallremaininforcedespiteanyprepaymentofthis
Loan.TheprovisionsthereofmaybeenforcedbytheCountyofEssexbyanactionunderthe
Mortgageinforeclosure,MortgageNote,theDeveloper’sWrittenAgreement,orthisLoan
Agreementforaccelerationoftheloanasprovidedinparagraph4oftheLoanAgreement.The

2. IftheContinuumofCarehasestablishedcentralizedorcoordinatedassessmentsystemthat
meetsHUDrequirements,describethatcentralizedorcoordinatedassessmentsystem.
TheContinuumofCareisintheprocessoffinalizingacoordinatedassessmentsystemandhopesto
beabletolivetestthepilotthathasbeencreatedwiththeassistanceofit'sownsubcommitteeand
HUDconsultantswithinthenextcoupleofmonths.
Theideabehindtheassessmentistohaveasystemwhereanyoneatanyentrypointinthe
Homelesssystemcanbelinkedupwiththeappropriateservicestheyneed.Utilizingstandardized
toolsandrealtimeHMISbedregistries,thehopeistodramaticallyandsubstantiallyimprovethe
timebetweenenteringtheHomelesssystemandreceivingservices.Theotherhopeistheexpedited
linktoserviceswillreducefrequencyandlengthsofepisodichomelessness.
3. Identifytheprocessformakingsub-awardsanddescribehowtheESGallocationavailableto
privatenonprofitorganizations(includingcommunityandfaith-basedorganizations).
TheDivisionofHousingandCommunityDevelopmentisamemberoftheComprehensive
EmergencyAssistanceSystem,whichisacommitteethatoverseestheEssexCountyContinuumof
Care.ThetaskoftheCEASandCoCistoidentifyhomelesspopulationsthatmeetHUDsdefinitionof
homelessnessandalsothosewhoareimminentlyandpotentiallyatriskofhomelessness.Another
taskoftheCoCandCEASistodecidehowfundingsourcesandcoordinationisadministered
betweentheshelterproviders,theirfunders,andtheirclients.Utilizingpolicyandprocedureand
governanceguidelinestheseentitiesoverseethedisseminationoffundingofallsourcesandarethe
stewardsoftheirowndataontheirpopulations.NewJerseyhasaHomelessManagement
InformationSystem(HMIS)thatismanagedbyNJHousingandMortgageFinanceAgency(HMFA);
thissystemisthesoleco-locatedsourceofdata,andisreportedonanannualbasisdirectlybackto
HUDandtheStateofNJ.

TheDivisionputsoutanRFPonayearlybasisforourESGfunds,whichiscollectedandscored
internally.AtthatpointtheCEAScommitteehastheirownexecutiveboardthatwillmeetinorder
toevaluatetheCounty'srecommendationandeitheragreeormakesuggestionsonchangestothe
plan.FromtheretheentireplanisbroughttothefullCEAScommitteefortheirconfirmation,and
theCountywilldoit'sownregularcitizenparticipationprocess.Fromthereweenterintocontracts
withsub-awardees.
4. Ifthejurisdictionisunabletomeetthehomelessparticipationrequirementin24CFR
576.405(a),thejurisdictionmustspecifyitsplanforreachingouttoandconsultingwith
homelessorformerlyhomelessindividualsinconsideringpoliciesandfundingdecisions
regardingfacilitiesandservicesfundedunderESG.
TheCoCcomplieswith24CFR576.405(a),andisworkingtowardsalargercontingentofhomelessor
formerlyhomelessindividualsparticipatingintheplanningprocess.TheCoChastaskeditsown
membershipcommitteewiththeoutreachportionofthistask.
5. DescribeperformancestandardsforevaluatingESG.
Asofrightnow,HUDhasnotprovidedparticularperformancestandardsandgoalsfortheESG
program.WehaveindependentlybeenworkingonstandardsandgoalswiththeCoC,especiallythe
monitoringandevaluationsubcommittee.HMIShasanumerousamountperformance
measurementmetrics,andwecurrentlyoperateaperformancemetricsystemthatoperateswith
percentagesinabovethe80%percentilerangeinallcategories.Thesecategoriesincludedata
quality,zipcodequality,housingutilizationrates,averagelengthofstay,etc.
