IN OPPOSITION TO CATERPILLAR’S SECOND MOTION FOR LEAVE TO FILE AMENDED PETITION FOR CANCELLATION

I, Peter Mastrostefano, hereby declare as follows:

1. I am Senior Vice President, General Counsel for PUMA North America Inc. I

submit this declaration in support of PUMA’s Memorandum in Opposition to Caterpillar’s

Second Motion for Leave to File Amended Petition for Cancellation.

2. I have personal knowledge of the facts set forth in this declaration or I have

reviewed the files maintained by PUMA and obtained personal knowledge of the facts set forth

in this declaration., and I would, and could, testify competently thereto if called upon to do so.

3. PUMA has not abandoned, and does not have an intent to abandon the PROCAT

mark.

4. PUMA does not intend to stop selling PROCAT branded products.

5. PUMA does not intend to stop using the PROCAT mark in association with

clothing, namely socks, headbands, and footwear.

6. Recently, PUMA began offering for sale in the U.S. PROCAT branded products

on its website, puma.com, including PROCAT branded socks and footwear.

7. PROCAT branded headbands will be offered for sale in the U.S. on the puma.com

website within the next ninety (90) days.

8. Attached as Exhibit A are true and correct copies of the puma.com website

showing listings of the PROCAT branded products including socks and footwear.

9. Historically, Target was the primary channel for PUMA’s PROCAT branded

products. PUMA recognizes that purchasers of excess PROCAT branded inventory may list new

PROCAT branded products, including footwear and socks on alternative sales channels. Such

offers for sale are still being made today. Attached as Exhibit B are two examples of such

listings, one on Amazon.com (https://www.amazon.com/PUMA-ProCat-equalizer-Silver-
