Since “Doctored” the groundbreaking documentary about the corruption of medical industry came out in late September there has been a buzz about the film and what impact it may have on the general population. The CCA hosted a screening at our Annual Convention prior to the release of the film and producer Jeff Hays spoke a bit about the film and what he was trying to achieve through the project. The main message was get this film into the public’s hands and spread the message of the film as far and wide as you can.

Dr. Jeremy Overholt in Loveland, CO and Dr. Randy Roman in Grand Junction have both taken on the challenge to spread the message, both are holding screenings in thier area for their patients and thier community. On the following page you can follow the link to a packet on how to host a screening in your own area. Court Clarifies Who Can Bring Bad Faith Claims against Insurance Companies, but

Questions Remain

On September 27, 2012, the Colorado Court of Appeals issued an opinion allowing a roofer to continue in a bad faith case against Allstate for failing to pay the vendor for roof repairs under a homeowner’s insurance policy. The roofer had contracted with the owners of four homes insured by Allstate to repair their roofs. The contracts provided that the repair costs would be paid from insurance proceeds and granted the roofer full authority to talk with Allstate regarding the insurance claims. The roofer met with Allstate to discuss the four homes and to determine the amount of the claims. The roofer repaired the roofs but later learned that additional repairs were necessary to comply with building codes and to maintain certain manufacturers’ warranties. The roofer made the additional repairs and invoiced Allstate. Allstate paid the claims amounts that were agreed to during the original adjustment, but refused to pay for the additional repairs. The roofer filed suit against Allstate for unreasonable delay and denial of benefits. The trial court ruled that the roofer was not a first-party claimant who was entitled to sue, agreeing with Allstate’s argument that the roofer could not sue since it had no contract with Allstate. On appeal, the Court of Appeals reversed and held that the roofer could sue Allstate for unreasonable delay and denial of benefits.

This is potentially an important decision for health care providers who believe that an insurance company, such as a med pay carrier, is unreasonably delaying and denying payment to them for their services. Whether trial courts apply the language in this case broadly enough to allow providers to sue insurers remains to be seen. One practical suggestion while the issue is being fleshed out is to have your patients sign a formal assignment of their rights under their med pay insurance to you for payment of services. There is still an open question regarding whether judges will limit this ruling to cases such as this one where there was an arrangement made between the insurer and the vendor before the work was done. However, the holding of the case is broad, stating that a repair vendor who brings a claim against an insurer on behalf of its insured qualifies as a first-party claimant under the statute. It was milestone time and I was ready for an adventure, something big, time to shake up things. So why not climb Mount Kilimanjaro, the highest free standing mountain in the world and the highest on the African continent.

Fourteen others joined me, half of which were medical professionals.

I enjoyed the opportunity to share my chiropractic mission with them as we trekked towards the top.On January 8th our cadre of 14 started the journey and on January 15th twelve of us reached the summit. It took 5 acclimatizing days to reach our base camp at 15,750 feet. It took 7 hours climb to the top of Kili at 19,340 in the second worst conditions that our local guide of over 200 trips to the top had experienced. He estimated the winds to be a constant 40mph and gusting well over 60mph. At that elevation the air is thin indeed , 50% of what we experience at sea level. The ferocity of the wind felt like it was tearing what meager oxygen that was left from us. I had asked for an adventure and I got it.

Along the way I had several opportunities to be in service to others. Some interesting

standouts were; adjusting an Olympic athlete en route to a competition at the Amsterdam airport; treating a Maasai warrior in his village, and having the “peak” experience (pun

intended) of adjusting Max Young the tour operator of Max Adventure Travel on the summit at 19,340 feet.

My patients have asked

me, “How has this changed your life?”

Upon reflection I have to respond that it has not.

What it has done is “add to my life”. I am reminded of several things; that life is short, time is moving fast and that my life here in Denver is exceedingly good. That being present in the moment, situationally aware, using determined persistence, listening to your guides, preparing beforehand, having flexibility (TIA this is Africa) and working with a team (it helps to have a supportive wife) will take you to your ultimate desired destination. The journey may be hard and long, but it is always more fun when shared with others. So I encourage my comrades out there to step out and share who you are with the world in a larger context. Live your life more fully, it is the only one you have.

Ask ten chiropractors what would most transform their practice, and nine of them will say New Patient Mastery. It makes sense. New patients are the life’s blood of a growing, thriving practice—but they also require more time and attention, education, and salesmanship from you and your staff. How can you streamline and secure new patient procedures so that this vital process flows easily and organically from the point of first contact?

New Patient Phone ProceduresThe first, and possibly the most critical, procedure for your staff to master is the new patient phone call. A great way to start is to establish specific appointment blocks for scheduling new patients. Some offices like to cluster these in the middle of each shift; other practices prefer to place new patients at the bottom of each hour (9:30, 10:30, etc.). Still others hold by a looser, “We Accept New Patients Any Time” policy. It doesn’t really matter which you pick. The key is to be consistent, and to provide an easy, standardized scheduling procedure for your front desk staff. Take the time this week to decide upon and set a standard for your practice. And clearly communicate this to your team.

New Patient Examination ProcessIt’s easy for busy doctors like us to fall into a routine and overlook the obvious, such as maximizing the intake process. Obviously, this is less than ideal from a diagnostic perspective—but it’s also bad business. Spending the time to take a thorough patient history and perform a thorough exam will, not only leave you better-informed about your new patient’s issues, but it will also boost your bottom line. How? By doing a thorough intake, you can bill for a more appropriate—and often higher—EM code, with the accompanying higher fee. Time spent early on with new patients allows you to increase your efficiency as the relationship develops, and continues to pay off over time.

New Patient PaymentsSometimes front desk staff dislike fielding the question, “How much does it cost to see the doctor?” because new patients aren’t always happy with the answer. You can make this problem virtually disappear by becoming

The Campaign Finance Reform Act establishes rules on contributions to PACs (Political Action Committees) in Colorado. The maximum contribution an individual can make to a PAC is $550 per election cycle (every two years). For example, an election cycle is from December 2012 to December 2014. Corporate/business checks are allowed as well as checks from individual accounts. A husband and wife may make a single $800 contribution if the contribution is done from a joint checking account. Each family member may contribute with their own personal account, but only one contribution can be made from a joint account. In addition, contributions can be made directly to candidate campaigns by individuals up to $400 each two-year election cycle ($200 for the primary election and $200 for the general election). Please include your current address, profession/employer with your contributions to make it easier for the candidates to properly report.
