In the matter of recognition of the Chinese martial arts in Spain. The generic name for our sport is “Wushu”, which includes all forms of Chinese martials arts, including but limited to descriptions such as: Kungfu, Taichi, Taiji, Sanda, Sanshou, Shaolin etcFollowing a thorough analysis of:- the Olympic Charter, of the International Wushu Federation (IWUF) Constitution and the RFEJDA (Real Federación Española de Judo y Deportes Asociados) Statutes the European Wushu Kungfu Federation (EWUF) Executive Board concludes the following: 1. Wushu has been recognised by the IOC since 2007 as an independent sport, and cannot, under any circumstances, be assimilated to an «associated sport» of any other sport recognised by the IOC. 2. According to the Olympic Charter Article 29 «The national federations», a national federation «must exercise a SPECIFICsports activity , be affiliated to an International Federation recognised by the IOC and be governed by and comply in all aspects with both the Olympic Charter and the rules of its International Federation». 3.     Subject: Chinese Martial Arts in Spain

    Dear Minister Elena Garzón Otamendi, Dear President Alejandro Blanco Bravo,

    The intention of this letter is to make you aware of the following. In the matter of recognition of the Chinese martial arts in Spain. The generic name for our sport is “Wushu”, which includes all forms of Chinese martials arts, including but limited to descriptions such as: Kungfu, Taichi, Taiji, Sanda, Sanshou, Shaolin etc…

    Following a thorough analysis of:- the Olympic Charter, of the International Wushu Federation (IWUF) Constitution and the RFEJDA (Real Federación Española de Judo y Deportes Asociados) Statutes the European Wushu Kungfu Federation (EWUF) Executive Board concludes the following:

    1. Wushu has been recognised by the IOC since 2007 as an independent sport, and cannot, under any circumstances, be assimilated to an «associated sport» of any other sport recognised by the IOC.

    2. According to the Olympic Charter Article 29 «The national federations», a national federation «…must exercise a SPECIFIC…sports activity, be affiliated to an International Federation recognised by the IOC and be governed by and comply in all aspects with both the Olympic Charter and the rules of its International Federation».

    3. The specific sports activity of the Real Federación Española de Judo y Deportes Asociados (hereafter «the RFEJDA») is the sport of Judo, also recognised by the IOC as an independent sport.

    4. The RFEJDA, according to the Article 29 of the Olympic Charter «must…be governed by and comply IN ALL ASPECTS with both the Olympic Charter and the RULES OF ITS INTERNATIONAL FEDERATION».

    That means that the RFEJDA and all its structures are governed and comply in all aspects with the Rules of the International Judo Federation (IJF) which is recognised by the IOC as another independent sport.

    5. In addition to that, the Statutes of the International Judo Federation state that: «3.2 Statutes of Members

    The Statutes and Regulations of Member National Federations must be in compliance with the IJF Statutes and all other Regulations and Decisions of the IJF».

    6. The Statutes of the RFEJDA state that:

    «4. La RFEJYDA está afiliada a la Federación Internacional de Judo (FIJ) y a la Unión Europea de Judo (UEJ), CUYOS Estatutos acepta y se obliga a cumplir, ello, desde luego, dentro del ordenamiento jurídico español.)».

    (The RFEJYDA is affiliated to the International Judo Federation (IJF) and European Judo Union to which statutes it accepts and is obliged to comply, provided this remains in accordance with Spanish juridical order).

    7. The IWUF Article 11 (Responsibilities of Continental Federations, National Federations and Associate Members) of the IWUF Constitution states that:

    «Continental Federations, National Federations and Associate Members have the following responsibilities towards the IWUF:

    Article 11.3 Observe and comply with the IWUF Constitution and rules and ensure that their own constitution and rules and those of their members do not conflict with those of the IWUF».

    It is noted, that the RFEJYDA which IS NOT a national wushu federation, CANNOT COMPLY with the IWUF Constitution and rules, because the RFEJYDA (According to the Olympic Charter Article 29) and to the Statutes of the International Judo Federation and its own Statutes have to comply with the Constitution of the International Judo Federation.

    It is noted, that the principle aim of the International Judo Federation (and its National Members, here the RFEJYDA), according to the Article 2 of its Statutes is to lead and organize judo activities throughout the world; to protect the interests of judo throughout the world; to organize IJF events; to develop the practice of judo throughout the world for all categories of the population etc.

    It is also noted that the principle aim of both the IWUF and the EWUF, according to the Article 2 of the IWUF Constitution is to:

    2.2 To promote and encourage the development and practice of wushu in all of its manifestations throughout the world.

    2.3 To formulate and compile technical rules and regulations governing all wushu competitions.

    2.4 To organize and approve international wushu competitions and activities, to standardize IWUF member federation competitions and activities and to formulate standards for approval and certifying of International wushu judges and coaches.

    Therefore, none of the aims, neither of the International Judo Federation, nor of its members complies with the IWUF Constitution’s Article 11 (11.3). The 2 organisations have completely different and non-compatible aims and goals.

    8. It is also noted, that Article 1 (3) of the Statute of the RFEJDA it states:

    «The RFEJDA dedicates its activity to the practice, promotion and development of Judo and Associated Sports. Of the 6 enumerated sports Judo is the Principal.

    That clearly means that the Sport of wushu has no equal rights and is placed in the secondary position.

    It is also noted, that the IWUF Constitution in its Article 12 states that:

    «Article 12: Autonomy of Continental Federations, NFs and Associate Members

    12.1 Continental Federations, NFs and Associate Members are required to protect and maintain their autonomy and independently manage all internal affairs without any pressure or interference from a third party.

    9. The IWUF Constitution Article 6 states that: Article 6: National (Territorial) Federation Membership «6.1 Wushu governing bodies of all nations or territories may apply to join the IWUF and become its National Federation».

    It is noted, that the Article 6 has NO MENTION of any federations governing any other independent sports having wushu as its «associated sport» (the RFEJDA).

    It is also noted, that the Article 6.2 states:

    «6.2 The IWUF shall only accept one National Federation from each country or territory», and again, there is NO mention that the IWUF accepts any federations governing any other independent sports.

    It is also noted, that the IWUF Constitution clearly says: «Wushu governing bodies» (that means Wushu organisations, exercising, in compliance with the Olympic Charter Article 29 a «specific» activity – here Wushu) and not «Bodies, governing Wushu», which is the case of the RFEJDA governing Wushu.

    10. Thus, the analysis made with the support of the Olympic Charter, the Constitution of the IWUF and the EWUF as well as that of the IJF and RFEJDA enables us to conclude, that the RFEJDA, CANNOT, under the provisions of both the IWUF and EWUF Constitutions and the Olympic Charter and under the provisions of its own Statute and that of the IJF, be either a provisional, or full member of the EWUF, because of the Constitutional non-compliance, the existing discrimination of the sport of wushu and the general non-conformity to the IWUF and EWUF Constitutions. Based on this analysis, the EWUF Congress in 2016, after unanimously voting to change its membership requirements and after amending its Constitution to accept as its members only independent Wushu organisations, has informed the RFEJDA representatives, and made them aware that after the transition period of 2 years, since the decision of the Congress, the membership of any non-independent member federation pertaining to any sport other than Wushu should be void, and advised them to begin to work on the creation of the independent Wushu federation in Spain, as stipulated by the Olympic Charter and the IWUF and EWUF Constitutions.

    It is noted that the Spanish delegates were present and voted in the 2016 EWUF Congress and voted in favour of the motion described above.

    In Orense in June 2018 our Executive Member had a meeting with Mr. Firmino Parra a member of the Judo federation. This meeting was in the presence of other members of the Wushu department; Mr. Rafael Julian, Pablo Alvarez ...

    Mr Firmino Parra accepted, and it was clear, that up until that point nothing has been done to comply with the EWUF/IWUF constitutions and he did not believe that within the foreseeable future that it would be possible for the Judo federation to allow Wushu to have an independent Chinese martial arts federation, even though he personally did not oppose it, on the contrary. Reviewing the situation at the end of 2018 nothing had been done to work towards the aim of independent status for Wushu.

    This transition period to independent status expired in 2018.

    It is noted that both the Judo and Karate federations were invited to send delegates to our meetings in Moscow, Russia in April 2019 and neither took advantage of this offer to help resolve this situation and become part of a unified dedicated independent Wushu federation that could serve and benefit the broad community of Spanish Wushu athlete’s.

    11. As stated in the EWUF constitution, in the absence of an independent Wushu Federation in a country or region, the EWUF may, at its sole discretion, accept any organisation in such a country, provided that its Constitution and goals comply with the Constitution of the IWUF and EWUF.

    12. Taking into consideration, that after the transition period of 2 years there had been no progress, the membership of the RFEJDA became void. Following its Constitution, the EWUF Extraordinary Congress on 27 April 2019 in Moscow, Russia unanimously accepted the situation of the RFEJDA membership being void and accepted into Provisional Membership the «Spanish Confederation of Wushu Kungfu» – an independent wushu organisation, legally registered under the provisions of the Spanish Law.

    It is noted, that since the «Spanish Confederation of Wushu Kungfu» is not yet recognised by the authorities in Spain, they cannot represent the country of Spain, and shall be listed as the « Spanish Confederation of Wushu Kungfu – EWUF Provisional Member». The use of the national anthem and the flag of Spain is left at the discretion of the « Spanish Confederation of Wushu Kungfu » in accordance with the provisions of Spanish law.

    A proposal to terminate the membership of the RFEJDA to the IWUF for not conforming to the IWUF Constitution and goals shall be submitted to the IWUF Congress in October this year, together with the proposal to accept into provisional membership the «Spanish Confederation of Wushu Kungfu».

    It is our desire to see Wushu united in Spain and we shall appreciate your help and cooperation in this regard.
