Vision

EuropElectro helps to bring Europe and China closer together in technical legislation, standardization and certification for electrical and electronic products in order to facilitate the trade with these products in both directions.

Mission

We create and drive a network of people communicating in the field of technical legislation, standardization and certification. In these fields we build up an exchange of experiences between European electrical and electronics companies and Chinese authorities, administration and organisations. We provide information about developments in national Chinese technical legislation, standardization and certification for the support of our member companies. We also provide such information from Europe for the support of the Chinese administration, standardization and certification. We aim for supporting Chinese authorities to use international ISO and IEC standards in the Chinese standardization system. Our goal is to facilitate the trade of electrical and electronic products with regard to technical requirements. Through the cooperation with ORGALIME we are the voice of our member companies from all over Europe in China. WANG Xu

Background

2012 was the first year for the implementation of the 12th Five-Year Plan (hereafter referred to as the 12th FYP). The 12th FYP’s specific sectors were published at the end of January 2012 e.g. the 12th FYP for Standardisation Development. 2012 was the last year of the current China Government; the new government took over in March 2013. Environmental protection is considered the most critical challenge for China’s economic development.

During 2012 EuropElectro has continually built a professional network with the Chinese government and authorities as a recognised significant partner by them. In China, EuropElectro not only opened the door to the Chinese government but also engaged in representing the European industry to the Chinese government and European Commission cooperation programme.

EuropElectro has completed its 2012 task plan with the cooperation of ORGALIME and ZVEI. EuropElectro has built a network of experts from our member companies by organising four work groups, one information platform and one task force to address priority and emergency tasks. We actively brought our European industry interests in the key areas related to the China market access conditions into the China legislation and standards drafting processes.

In 2012 China was a partner country of the Hannover Fair. During the fair, EuropElectro invited and arranged the CEC and SAC delegations to visit the industry association and some of our member companies. CEC and MIIT delivered speeches to introduce the China’s Power Industry and Energy Conservation policies/status to the German industry at the Sino-German Energy Summit organised by ZVEI.

In order to promote the “Manufacturer’s Self-declaration of Compliance” in “China RoHS”, EuropElectro arranged for the China RoHS regulator – MIIT and CNCA to communicate with the European Commission and Orgalime regarding RoHS development in EU and China.

Through these arrangements, EuropElectro was able to strengthen a platform for our members to communicate with the Chinese government/authorities. This will also facilitate an understanding of our industry and business by the Chinese government/authorities. EuropElectro believes this can only foster a win-win situation which will be good for us all.

I am sure that together we can accomplish even more in 2013.

General Policy: 2012 is the first year for the implementation of the 12th Five-Year Plan (hereafter referred to as the 12th FYP).

The 12th FYP’s specif ic sectors were published at the end of January 2012 e.g. the 12th FYP for Standardisation Development.

2012 was the last year of the current China Government; The new government took over in March 2013. Environmental protection is the most critical challenge for China’s economic development.

Industrial Policy: In the 12th FYP the emphasis is on fostering and developing the ‘SEVEN Emerging Industries of Strategic Importance’. These include energy conservation, env i r onmen ta l p ro t e c t i on , nex t gene ra t i on information technology, biology, high-end equipment manufacturing, new energy resources, new materials, and new energy vehicles.

Actions: As part of the ‘SEVEN Emerging Industries of Strategic Importance’, new energy automobiles, IoT (Internet of Things), the smart grid and demand-side management will continue to receive government investment and support.

Standards Policy: The China standardisation system will be reformed. It will encourage industry alliances to develop standards in those industries with new and high technologies;

The standardisation work will focus on the "SEVEN Emerging Industries of Strategic Importance", energy savings and emissions reduction.

China Standardisation law is under revision. Patents involved in the standards urgently need to be regulated.

1. Executive Summary

Energy Savings and Emissions Reduction Policy: Objectives of Energy Savings (by 2015)1:Energy consumption for GDP2 per CNY 10,000 will be reduced by 16% compared to that of 2010, and by 32% compared to that of 2005.

Objectives of Emissions Reduction (by 2015):The intensity of carbon dioxide emissions per unit of GDP will be reduced by 17% compared to the data from the 11th FYP.

Actions: • Energy efficiency improvement key areas are focused

on industry, green buildings and transportation.

• Requirements for compulsory energy efficiency standards and energy labelling will be increased. Some plans have indicated that this will extend to more of our industry products.

• According to the ‘Comprehensive Guideline for Energy Conservation and Emissions Reduction’ in the 12th FYP, a ‘Top Runner’ Standard System will be set up.

• Government incentive policies on high efficiency

products wil l continue and focus on motors, household appliances, green lighting, etc.

• There is a trend towards new voluntary certification, such as a ‘low carbon footprint label’. That will promote a low carbon economy and could potentially be a part of government procurement.

• The ‘100 Energy Efficiency Standards Promotion Programme’ was jointly launched by NDRC3 and SAC4 in 2012. By the beginning of 2013, 54 national energy conservation standards had been drafted or revised.

Product Safety:CCC5 - The revision of the implementation rules for the CCC product group is ongoing; CNCA6 published the new list of certification and testing bodies. CCC reform is ongoing.

Functional safety is also one of the key tasks in China standardisation activities due to the large number of safety-related accidents on work sites.

Products Related to Environmental Require-ments:China RoHS7 - The revision of the ‘China RoHS Regulation‘ was not completed in 2012. On 4 June 2012 the Legislative Affairs Office of China called for public comments on the Revision of the ’China RoHS Regulation (2012 draft version)’. The 2007 version of the regulation is still valid. State-Promoted China RoHS Voluntary Certification started on 1 July 2012.

China WEEE8 – The ‘China WEEE Regulation’ - the ’Regulation on the Administration of the Recovery and Disposal of Waste Electrical and Electronic Equipment ‘- promulgated and entered into force on 1 January 2011, it was not fully implemented until 1 July 2012

Since 1 July 2012, the GAC9 has levied a fee on imported products and since 1 October 2012, the SAT10 has levied fees on domestic products to support the fund. But the performance & quality of the process and system need improvement.

Energy Efficiency & Energy Labelling – Due to the ‘100 Energy Efficiency Standards Promotion Programme’, more than 10 energy efficiency standards were drafted or revised in 2012.

28 product catalogues in total have been covered by energy labelling in China.

China Low-Carbon Certification - Voluntary low-carbon certification is still not in place and there is no clear agenda for it in the near future.

2012 EuropElectro Achievements:

Government Network/Communication: EuropElectro has built a professional network with the Chinese government and authorities and is recognised by them as a reliable and significant partner.

EuropElectro also works as a bridge for EU and China bilateral cooperation. Especially in EuropElectro key business areas, EuropElectro organised face-to-face meetings between the China regulators/authorities and European industry. In April 2012, EuropElectro and ZVEI invited and arranged for an SAC and CEC11 delegation to visit the Hannover Fair and our member companies. On 25 April, EuropElectro invited Chinese speakers from MIIT12 and CEC to the SINO-German Energy Summit that was held in Hannover and on 15 - 16 November; EuropElectro facilitated a CNCA and MIIT RoHS delegation to visit Orgalime and the European Commission to discuss RoHS development. These meetings provided an excellent opportunity for our industry to express our positions to the regulators.

EuropElectro participated in this year ’s EU-China Regulatory Dialogue WG on Standardisation meeting, WG on Conformity Assessment meeting and EU-China Industry Dialogue WG on Energy Efficiency meeting as a European industry representative

Membership in Chinese TCs and Organisations:In 2012 EuropElectro was granted an additional position on the Chinese TC – an ‘O’ (Observer) member of SAC/TC426, the National Technical Committee on Digital Techniques for Intelligent Buildings and Residence Communities of the Standardisation Administration of China. Altogether we have a total of 13 member positions on Chinese TCs and in organisations related to our task list. With our active work in these TCs and organisations we continue to advance our industry interests to the drafting process of the Chinese regulations and standards.

Public Forum:EuropElectro has jointly organised 4 forums: - The 11th Industry Automation and Standardisation

Forum - Security & Safety and Appl icat ion of Measurement and Control System jointly organised with SAC/TC124, ITEI in Beijing

- The 2012 International Symposium on Top Runner Systems and Energy Conversation Mechanisms of Energy-Using Appliances jointly organised with CNIS and with the support of NDRC and SAC

- The 2012 International Forum on the Sustainability of Consumer Electronics – Energy Efficiency & China WEEE jointly organised with other international industry organisations in China: CEA – the Consumer Electronics Association of the United States, CEESTA – the China Electronics Energy Saving Technology Association, JEITA – the Japan Electronics and Information Technology Industries Association, KEA - Korea Electronics Association, USITO - United States Information Technology Office in China

- SINO-German Energy Summit supported to organize with ZVEI in Frankfurt

Work Groups:To work closely with our member company experts, EuropElectro has established 4 work groups focusing on ‘China RoHS’, ‘Energy Efficiency’, ‘China WEEE’ and ’CCC’ and 1 information platform focusing on ’Smart Grid and Demand-Side Management Information in China’ as well as 1 task force on ’IP Involved in Standards’. These work groups, and the platform and task force are always open to new participants from our member companies.

Information:EuropElectro published 5 newsletters to ensure our members are informed of further developments in a timely manner. We created 5 study reports to analyse and summarise topics of great concern to our members.

Position Paper:EuropElectro published 2 position papers on the topic of ‘China RoHS’.

EuropElectro’s work has two levels. In general, EuropElectro focuses on horizontal issues.

3.2 Exports & Imports in 2012

The total value of imports and exports in 2012 reached USD 3,866.8 billion ( up by 6.2% over the previous year. Of this total, the value of goods exported was USD 2,048.9 billion (up by 7.9 %) and the value of goods imported was USD 1,817.8 billion (up by 4.3%). The balance of imports and exports (exports minus imports) was USD 231.1 billion, an increase of USD 76.2 billion over the previous year.

In 2012, the gross domestic product (GDP) was CNY 51,932.2 billion - up by 7.8% from the previous year. (USD 100 US = CNY 627)

The value added by primary industry was CNY 5,237.7 billion (up by 4.5%; secondary industry was CNY 23,531.9 billion (up by 8.1%) and tertiary industry was CNY 23,162.6 billion (up by 8.1%). The value added by primary industry accounted for 10.1% of the GDP, secondary industry for 45.3% and tertiary industry for 44.6 %.

The EU, with USD 3,340 million in value, fell to being the second largest importer from China in 2012 (after the United States). With USD 2,121 million in value, the EU has maintained first place as the largest exporter to China.

4.2 Authorised Patents in 2012

A total of 1,255,000 patents were authorized by SIPO14 in 2012. Among them, inventions account for 217,000.

4. Technology Environment

4.1 Expenditure of R&D13 Funds

As reported by the Bureau of Statistics in 2012, China’s total expenditures on R&D continued to maintain rapid growth. The amount of expenditures on research and development activities (R&D) was worth CNY 1,024.0 billion in 2012, up by 17.9% over 2011, accounting for 1.97 % of the GDP. Of this total, CNY 49.8 billion was appropriated for fundamental research programmes.

5. Regulation Environment

5.1 General Economic Environment and Achievements in 2012

2012 was the second year of China’s 12th FYP. As transforming the way of the economic development is one of the major tasks of the government, GDP isn’t the only macro-index used as a tool for macro-economic regulation in China. The table below shows some different indexes and the implementation of each. CPI15 is another important index, which has been growing in a stable way.

* Foreign Trade Growth is the only index that failed to meet its target, but China still experienced growth in the international market share.

According to the macro economic data published by the government, the China economy also shows positive signs of stabilisation and recovery.

5.2 Targets of the Government in 2013

Entrusted by the State Council, the NDRC presented a ‘Report on the 12th FYP Implementation Status in 2012 and Targets for 2013’. According to the report, the implementation status in 2012 was acceptable and the major targets for 2013 are:- to keep the economy growing smoothly. (GDP growth is

about 7.5%.);

- to strengthen the sustainability, balance and harmony of development. (The budget for R&D is to be 2.05% of GDP);

- to maintain the stability of CPI growth; - to further enhance living standards; and- to ensure that the international balance of payments

situation remains healthy.

According to policy documents published, two new points are worth our members’ attention:1. The Government Wants to Have a Fair and Foreseeable Policy Environment

In the 12th FYP for Utilization of Foreign Investment and Overseas Investment, the government of China is showing its decision and will to open wider to the outside world and to promote a stable and transparent management system for foreign and overseas investment, which will be very helpful for achieving a fair and foreseeable policy environment.

2. Instruction Catalogue for Key Products and Services (P/S) for the ‘Seven Strategic Emerging Industries’

The NDRC, MIIT, MOF16 and other related government departments released the ‘Instruction Catalogue for Key Products and Services of Strategic Emerging Industries’ according to the State Council’s policy document, ‘The Decision to Speed up Fostering and Developing Strategic Emerging Industries’. About 3,100 products and services of the ‘Seven Strategic Emerging Industries’ are included in the catalogue.

6. Status of High Priorities

6.1 China Marketing Access Conditions Development in 2012

In 2012, technical requirements for market access still remain the same, but the scopes of the regulations have expanded.

There is a trend toward voluntary certifications, such as for the Low Carbon Footprint Labelling, Certification of

Low-Carbon Products and State-Promoted China RoHS Voluntary Certification, being adopted through government incentive policies for promoting a cyclical economy in the 12th FYP. We should closely monitor the development of these kinds of voluntary certifications in case our products are included in the scope of these policies in the future.

6.1.1 CCC - China Compulsory Certification

EuropElectro CCC WG worked jointly with the CCC regulator, CNCA, to get our industry interests, e.g. the “manufacture self-declaration on compliance” concept, included in the CCC process.

CCC Development in 2012The revision of the CCC regulation continued to be implemented in 2012. Revision of the implementation rules for every product group was still ongoing in 2012 and will continue in 2013.

The ‘New Version of CCC Categories Description and Definition Range Table’, a new ‘Adjustment/Designa- tion of CCC Certification Bodies’ and the ‘New Catalogue’s Corresponding 2012 HS Codes’ were published in 2012.

No new implementation rule was published in 2012 and some referenced standards in the implementation rule were revised.

Next StepsEuropElectro and our CCC WG will pay close attention to the CCC reform and pilot projects to ensure that we bring our industry interests into the regulation discussion process.

EuropElectro and our CCC WG will continue to track the revision process of the implementation rules for related products in 2013

Industry Concerns & Our WG TargetEuropElectro supports the CCC simplification and reduction of the administrative burden for manufacturers. The Self-Declaration of Compliance (SDoC) by manufacturers continues to be our industry position. Also included are:

- The timing and form of implementation of the ‘recall’ requirements for CCC non-conformity products in accordance with the 2009 version of the CCC regulation;

- Compliance with the 2009 version of the implementation rules (e.g. cost and time required for approval of the ‘Technical Responsible Person’); and

- Protection of manufacturers’ know-how.

EuropElectro Actions for Members- Published an unofficial translation of the new CCC

catalogue and a comparison analysis and conclusions between the new and old versions.

- Participated in EU-China Regulatory Dialogue on Conformity Assessments WG meeting / Attended Sino-German product safety work group meeting as industry representative in China.

- Maintained membership on the CCC regulation team hosted by the CCC regulator, CNCA and participated in the discussion on CCC reform

6.1.2 Energy Efficiency Development in 2012

Energy Efficiency Progress and Status:- 100 Energy Efficiency Standards Promotion Programme

In order to implement the ‘12th FYP of Energy Conservation and Emissions Reduction’ and strengthen the role of energy conservation standards, NDRC and SAC jointly launched the ‘100 Energy Efficiency Standards Promotion Programme’. According to the programme, 100 energy conservation standards will be drafted or revised over two years.

- Compulsory Energy Efficiency Standards and Labelling in 2012

Energy Efficiency Standards Status: - 54 compulsory energy efficiency standards have been

published in total; aside from these, more than 7 standards are under solicitation for comments.

Implementation Rules for Labeling:- 28 of the 54 product catalogues which are covered by the

compulsory energy efficiency standards are required to have energy efficiency labelling. Furthermore, at least 8 implementation rules are under solicitation for comments.

- The table below shows the labelling implementation status for each product catalogue.

Action for Members • On 12 January 2012, EuropElectro organised a visit to

CNIS with some members.

• On 25 April 2012, EuropElectro invited Chinese speakers to the ‘SINO-German Energy Summit’ in Hannover, Germany.

• On 12 June 2012, EuropElectro and CNIS held a meeting with ZVEI

• On 13 - 14 June 2012, EuropElectro helped to organise the ‘2012 International Symposium on Top Runner Systems and Energy Conservation Mechanisms of Energy-using Appliances’, an important event hosted by NDRC and SAC.

• On 5 July 2012, EuropElectro helped to organise the ‘2012 International Forum on the Sustainability of Consumer Electronics - Consumer Electronics Energy Efficiency’ in Qingdao.

• On 13 September 2012, the Energy Efficiency WG was held at EuropElectro’s office.

• EuropElectro distributed related regulation notices, incentive policies and management rules to members in a timely manner.

• EuropElectro updated ‘Energy Management and its Trends in China’ for our members.

• EuropElectro summarised and analysed China’s ‘Top Runner Proposal’ for our members.

Next Steps2013 is in the middle of the 12th FYP period so plans and projects that have been put in place previous to this year will be implemented this year. EuropElectro will monitor and track the progress closely and apprise our members of any updates as soon as we are made aware of them. Meanwhile, EuropElectro will continue to cooperate with local administration departments and organisations though some concrete projects. For instance, in June 2013, EuropElectro will cooperate with the CNIS (China National Institute of Standardisation), responsible for Energy Management in China, on the topic of Energy Efficiency.

domestic market. But the risk that this certification will be referred to in requirements for China government procurement or other incentive policies is still high. This voluntary certification started on 1 July 2012.

Industry Concerns and WG TargetWG Target: To promote the self-declaration of conformity and find out how the manufacturing industry can comply with ‘China RoHS’:

• Track and influence the transparency of the ‘China RoHS’ compliance process e.g. ‘the China RoHS’ CCC process and key management catalogue and ensure that members have advance awareness of the risk;

• Lobby MIIT regulators in an earlier phase to accept the ‘exclusion’ and ‘exemption’ scopes allowed in the EU RoHS Directive in the ‘China RoHS’;

• Determine whether the ‘China RoHS’ is in accordance with the EU RoHS directive;

• Continue to promote our industry position for inclusion in the legislation process;

• Promote the self-declaration of conformity in ‘China RoHS’; and

• Write a comparison report on the ‘EU RoHS2’ directive and the ‘China RoHS Regulation’.

comprehensive introduction to the development of the ‘EU RoHS Directive (2011/65/EU)’

6.1.3 China RoHS

The EuropElectro China RoHS WG was launched in 2007.

China RoHS Development in 2012 Regulat ion status: The revision of the ‘China RoHS Regulation’ was not completed in 2012. On 4 June 2012 the

Legislative Affairs Office of China called for public comments on the revision to the ‘China RoHS Regulation (2012 draft version)’. The 2007 version of the regulation is still valid.

Standards status: No new standard related to the China RoHS was published in 2012.

Compliance requirement status: In 2012 the ‘China RoHS’ compliance requirement was still in its first implementation stage – Information Disclosure. There was no CCC requirement for ‘China RoHS’ compliance in 2012. The concrete conformity assessment system is under construction now.

On 24 July, MIIT had a month-long call for public comments on a draft of the ‘Normative Document on Enterprises’ Declaration of Conformity on the Pollution Control of Electrical and Electronic Products’. EuropElectro suppor ts MIIT ’s cons iderat ion o f adopt ing the ‘manufacturer self-declaration of conformity’ in the ‘China RoHS’ butthe current version is not a general ‘manufacturer self-declaration of conformity’ model and has major differences from the one adopted in the ‘EU Low-Voltage Directive Model A’ (which is also the compliance model for EU RoHS2). EuropElectro submitted a members’ common position paper on this normative document to the relevant regulators.

Voluntary certification status: In 2010 the ‘State-Promoted China RoHS Voluntary Certification’ was introduced. This is only a voluntary certification with no customs control and no market surveillance in the

• Organised EuropElectro members to formulate a common position paper on ‘Revision of China RoHS Regulation (2012 draft version)’ to submit to the regulators

• Organised EuropElectro members to formulate a common position paper on the ‘Normative Document on an Enterprise’s Declaration of Conformity on the Pollution Control of Electrical and Electronic Products (Exposure draft version) to be submitted to regulators

• Represented European industry by participating in the CNCA & MIIT joint ‘China RoHS’ expert WG and SAC/TC297.

6.1.4 China WEEE

‘China WEEE’ Development in 2012 The ‘China WEEE’ Regulation – ‘Regulation on the Administration of the Recovery and Disposal of Waste Electrical and Electronic Equipment’ promulgated and entered into force on 1 January 2011, it was not fully implemented until 1 July 2012.

By 1 July 2012, the three supporting systems for ‘China WEEE’ were finally established:– the product catalogue for waste electrical and electronic equipment for disposal; the collection and disposal of waste electrical and electronic equipment; and the fund levy and management for the disposal of waste electrical and electronic equipment.

Status: - Product Catalogue There are NO NEW products included in the product

catalogue in 2012. The first ‘batch catalogue’ of waste

electrical and electronic equipment for disposal was published in 2010. It covers televisions, refrigerators, washing machines, air condit ioners and micro-computers. Second-hand goods are not covered by the regulation. NDRC, MEP and MIIT are responsible for the establishment and changes to the catalogue. The second ‘batch catalogue’ is being worked on.

- Collection & Disposal MoFCOM is resposible for the WEEE collection and the

related management measures were under construction in 2012.

MEP is in charge of WEEE disposal. The ‘Management Measures for Qualification Approval for the Disposal of Waste Electrical and Electronic Equipment’ was published in 2010. Enterprises disposing of waste electrical and electronic equipment must be examined and receive approval, before they can engage in this business. In July 2012 MEP published the list of the first batch of disposal enterprises subsidised by the WEEE fund.

- Fund Levying and Management The ‘Management Measures for Fund Levying and

Usage of Disposal of Waste Electrical and Electronic Equipment’ entered into force on 1 July 2012. The fund must be levied on the electric and electronic products listed in the ‘China WEEE’ catalogue.

The fund criteria is: CNY 13/TV set, CNY 12/refrigera-

tor, CNY 7/washing machine, CNY 7/room air conditioner and CNY 10/microcomputer. The fund is used as a subsidy for disposal enterprises and the ‘China WEEE’ management fee.

On 1 July 2012, the GAC began levying the fees on imported products and on 1 October 2012, the SAT began levying the fees on domestic products; however, the performance and quality of the process and system need improvement.

Industry Concerns- Development of EPR in China WEEE regulations and its

contents

- Involvement of manufacturers in the management of the WEEE funds

- Product catalogue adjustment based on the China WEEE regulation

Our Work Group TargetThe EuropElectro ‘China WEEE’ WG was established in 2009 and the task list was reviewed on 4 August 2011. The following tasks, based on our members’ concerns were agreed upon:

- Developing a EuropElectro position paper on ‘China WEEE’ legislation as a guideline for members’

- Periodically exchanging information and organising the WG meetings, if necessary, for detailed discussion

- Following up on the development of ‘China WEEE’ legislation, such as the adjustment of the fee levying standards, product catalogue adjustments, etc.

- Cooperating with other foreign associations on topics of common interest concerning ‘China WEEE’ legislation

Actions for Members in 2012- Continued to track the development of the fund levying

mechanism; EuropEelctro, together with the association partners invited China regulators - officials from MIIT, MoFCOM , NDRC and MoF - to explain the ‘China WEE’ fund levy and management status for our industry in July in Qingdao

- Maintained our membership in related TCs and promoted the European electrical and electronics industry position

- Translated ‘Management Measures for Fund Levying and Usage of Disposal of Waste Electrical and Electronic Equipment’ and related documents

Next Steps- Monitoring ‘China WEEE’ fund usage and management

- Monitoring future adjustments to the product catalogue
