THE EXECUTIVE COMMITTEE RECOMMENDS THAT 10.22 hectares (25.26 acres), more or less, of vacant land being Part of Lot 19, Concession 2 and designated as Blocks 55 and 56 on a draft Plan of Subdivision prepared by Schaeffer & Dzaldov Ltd., Ontario Land Surveyors, under their Job No. 03-585-00A, dated August 20, 2008, City of Vaughan, Regional Municipality of York, located east of Dufferin Street, south of Major Mackenzie Drive, be purchased from Thornhill Ravines Development Corporation;

THAT the purchase price be $2.00;

Attached is a plan showing the location of the subject lands.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the approved Greenlands Acquisition Project for 2006-2010. Through the review of Phase 2 of subdivision 19T-03V01 for proposed single lot residential development of this site, TRCA staff established the limits of the open space lands (i.e. Blocks 55 and 56 on Plan of Survey) which is comprised of the valley corridor of the East Don River at this location.

TAXES AND MAINTENANCEBased on our preliminary review of the environmental criteria for lands that are eligible to receive a property tax exemption under the Provincial Conservation Land Tax Incentive Program, it would appear that all of the subject property would be eligible for exemption for the 2010 taxation year. The addition of the subject parcel of land will not significantly impact TRCA's maintenance costs at this location.

RATIONALEThe subject property falls within TRCA's approved master plan for acquisition for the Don River watershed as outlined in the approved Greenlands Acquisition Project for 2006-2010. Through the review of subdivision 19T-05V06 for proposed single lot residential development of this site, TRCA staff established the limits of the open space lands (i.e. Blocks 197 and 198 on draft Plan of Subdivision) which are comprised of the valley corridor and a tableland buffer of a tributary of the East Don River at this location.

RES.#B6/09 - EMPLOYEE EXPENSE POLICYAmendment. Approval of amendment to Section 5.0 - to Conferences/Training Courses and Travel of the Employee Expense Policy.

THE EXECUTIVE COMMITTEE RECOMMENDS THAT Section 5.0 - Conferences/Training Courses and Travel, of the Employee Expense Policy be amended, as outlined below in staff report.

CARRIEDBACKGROUNDAt Authority Meeting #6/04, held on June 25, 2004, Resolution #A182/04 was approved as follows:

THAT the Employee Expense Policy as described in the following report dated May 25,2004, be approved to be effective July 1, 2004.

Section 5.0 - Conferences/Training Courses and Travel as approved by the Authority is outlined in Attachment 1.

In 2007 the Executive Committee directed staff to report back to the Executive Committee on what was learned during the conferences/training courses/presentations attended by staff outside of Canada, travel for which was approved by the Executive Committee as per the policy.In 2009 the Executive Committee directed staff to review the policy for travel and look at cost of travel as being the determining factor for level of approval required rather than location. In addition, the members requested that staff report back to the Executive Committee on a wide range of these experiences to help keep the members informed of the important lessons learned and presented to other groups by Toronto and Region Conservation Authority (TRCA) staff.

RATIONALEStaff has reviewed Section 5.0 of the policy and recommend that Section 5.0 be amended as outlined in Attachment 2.

The first amendment requires that the human resources (HR) manager pre-approve travel when the corporate training budget is to be used. Attendance at training courses is often within adivisional budget rather than the corporate training budget, and as a result the employee's manager or Director should pre-approve the expense, rather than being done by the HR manager as the policy currently states. However, if the corporate training budget managed by the HR manager is to cover the expense, pre-approval by this individual would be required.

The procedure of discussing opportunities with the HR manager will still be followed to ensure the appropriateness of courses for staff and for the potential for money saving opportunities.

The second amendment acknowledges that travel within Canada may be more expensive than travelling outside of Canada. The proposed revised policy reflects this in that the level of approval required would be based on cost rather than location of travel.

Finally, a clause is recommended that states that the CAO's Office will schedule presentations at board meetings on TRCA staff travel and training opportunities that would be of interest to the members

CURRENT POLICY

5.0 Conferences/Training Courses and TravelWhen attending an approved TRCA function including a conference or training course, and if meals are not included as part of the program, an employee may charge up to $40 per day for actual cost of personal meals per person (receipts required); meal costs in excess of the maximum must be approved by the Chief administrative Officer.Expenses relating to conferences must be pre-approved by the employee's manager or Director.Expenses relating to training courses must be pre-approved by the Manager, Human Resources.Accommodation shall be based on best available economy room rates or conference rates.(Employees must ask for the “government rate” to determine if it is the best rate available)Travel arrangements for air, rail or bus transportation are subject to pre-approval by the employee's Manager or Director; air/rail/bus travel shall be based on best available economy fares; travel by other than economy class must be approved by the Chief Administrative Officer or a Director.When traveling on TRCA business, reasonable costs for ground transportation, taxis, transfers, parking, gratuities etc. will be reimbursed/paid subject to approval by the employee's managerAny travel outside Canada must be approved by the Executive Committee.When the Chief Administrative Officer/Secretary Treasurer has been authorized to travel by the Chair, his or her expense shall be submitted to the Chair or designate for approval.For conference and travel expense that is $3,500 or less, the approval of the CAO is required. WHEREAS the Province of Ontario and the City of Toronto are 50% funding partners for the Revised Project for the Etobicoke Motel Strip Waterfront Park (March, 1993) at a project budget of $8,350,000;

WHEREAS the Province and the City have agreed to fund their respective share of any additional costs associated with the expropriations of land should those costs exceed the amount of funding available for the project;

Stefanko and the Order of the Ontario Municipal Board relating to compensation for injurious affection resulting from the expropriation of rear portion of land municipally known as 2143 and 2147 Lakeshore Boulevard West, City of Toronto, from V. and E. Gadzala Holdings Limited and 412264 Ontario Limited as prescribed by the Expropriations Act, R.S.O. 1980, Chapter 148, as amended;

THAT staff be directed to instruct TRCA's legal counsel, Chappell, Bushell, Stewart, to take such action as is necessary to implement the appeal of the decision delivered by S. J. Stefanko and the Order of the Ontario Municipal Board;

AND FURTHER THAT the City of Toronto and the Province of Ontario be so advised.

Edward Gadzala and his two related companies owned 2109, 2113, 2143 and 2147 Lakeshore Boulevard West, City of Toronto and on February 28, 1996, Toronto and Region Conservation Authority (TRCA) expropriated the following land from these properties:

A) A one (1) metre strip from the southerly limit of 2113 and 2109 Lakeshore Boulevard West (house properties) owned by A. Edward Gadzala and eliminated the riparian rights.

B) 1.379 acres from 2147 Lakeshore Boulevard West (motel property) owned by 412264 Ontario Limited of which approximately 1.06 acres are beneath the waters of Lake Ontario.

C) 1.432 acres from 2143 Lakeshore Boulevard West (motel property) owned by V. and E. Gadzala Holding Limited of which approximately 1.17 acres are beneath the waters of Lake Ontario.

In December 1997 the City of Toronto expropriated the balance of 2113 and 2109 Lakeshore Boulevard West (house properties).

Ontario Municipal Board (OMB) The matter of the expropriation by both the City of Toronto and TRCA was heard by the Ontario Municipal Board (OMB) in late 2003 and early 2004. The Decision and Order of the Ontario Municipal Board was issued on October 4, 2004 by OMB Member C.A. Beach. The award was as follows:

$2,100,000.00 on account of the market value of the land expropriated from the motel properties;$880,000.00 on account of the loss of riparian rights from the motel properties;$13,000.00 on account of the value of land expropriated from two house properties;$168,000.00 on account of the loss of riparian rights from the house properties;An amount less than $1,860,000.00 on account of injurious affection to the remainder of motel properties;$4,000,000.00 on account of damages for delay;$15,000.00 on account of disturbance damages arising out of the construction;$41,507.86 on account of the cost of the hearing over the ownership of accreted land;$20,257.74 arising out of the costs of the injunction application;plus interest and costs.

The OMB also awarded for the City of Toronto expropriation $1.96 million for market value, $1.85 million for lost opportunity for parkland dedication, interest and costs.

Divisional CourtBoth the City of Toronto and TRCA appealed the decision to the Divisional Court. The appeals were heard in late 2005 and the decision was released on April 24, 2006. The Divisional Court allowed TRCA’s appeal with respect to disturbance damages for delay and deleted the award of $4 million. The balance of TRCA’s appeal was dismissed. The Divisional Court allowed the City's appeal with respect to disturbance damages for loss of opportunity for parkland dedication and deleted the award of $1.85 million. The balance of the City’s appeal was dismissed.

Ontario Court of AppealBoth Gadzala and TRCA filed a notice of motion for leave to appeal the Divisional Court decision to Ontario Court of Appeal. Both notices of motion for leave to appeal were denied.

Injurious Affection ClaimThe injurious affection claim relates to reduction in market value to the retained land that resulted from the expropriations. In the 2004 decision by Mr. Beach he found that injurious affection claim was restricted to the motel properties and was to be less than $1,860,000. Gadzala originally calculated his injurious affection claim using the density from the house properties expropriated by the City. Mr. Beach directed that the injurious affection amount was to be recalculated without the density from the house properties.

Since the OMB decision, we have had a number of discussions with Gadzala and his representatives including a mediation session with an experienced member of the OMB, Mr. Granger. The discussions and mediation were unsuccessful. Since no agreement was reached, the matter was heard by the OMB on June 3 and 4, 2008. The Decision and Order of the OMB was issued on June 19, 2008 by OMB Member S. F. Stefanko. The award was the sum of $1,859,999 plus interest (6% per year simple interest from the date of expropriation).

Pursuant to the Expropriations Act, an appeal is to the Divisional Court from the decision of the OMB. Both the City of Toronto and TRCA appealed the decision of the OMB. The Divisional Court dismissed these appeals and awarded costs of the appeal to Gadzala.

Solicitor's AdviceTRCA's solicitor Paul Henry of Chappell Bushell Stewart LLP has reviewed the decision and recommended against an application for leave to appeal the decision to the Ontario Court of Appeal.

Funding Partner's AdviceSolicitors and staff of the City of Toronto and the Province of Ontario supported the recommendation that TRCA not appeal the decision.

FINANCIAL DETAILSTo date TRCA has paid Mr. Gadzala $5,128,760.81 on account of market value, riparian rights, disturbance damages and interest. Based on a payment date of April 30, 2009, we have calculated the payment for the injurious affection award plus interest and Gadzala's Divisional Court cost as $3,371,676.16. The final item to be settled in this expropriation are Gadzala's costs which we understand are in excess of $2.7 million.

The Revised Project for the Etobicoke Motel Strip Waterfront Park (Revised March 31, 1993) had approved funding of $8.35 million with a funding partner split of 1/2 the Province of Ontario, 1/3 the City of Etobicoke and 1/6 the Municipality of Metropolitan Toronto. With amalgamation the funding partnership is now 1/2 the Province of Ontario and 1/2 City of Toronto. Prior to the expropriation, TRCA obtained a commitment from the City of Etobicoke, the Municipality of Metropolitan Toronto and the Province of Ontario that they would cover any additional costs over and above the original project costs that resulted from the expropriations, based on the same funding formula as the original project. To date the City and the Province have contributed an additional $7.33 million for payment of the Gadzala award and the Red Carpet Inns Limited settlement.

BACKGROUNDToronto and Region Conservation Authority (TRCA), as the 'lead' source protection authority for the CTC Region, has the regulatory responsibility for the fiscal management of provincial funding for source protection studies within the CTC Source Protection Region (includes Credit Valley, Toronto and Region and Central Lake Ontario conservation authorities).

The board has received reports and authorized staff to enter into a number of financial activities related to source water protection. This report seeks approval for new sole source contracts specified below as well as providing information on other major budgetary matters.

Operating and Administration and Water Budget funds that have been transferred to TRCA by the Province of Ontario for 2008-09 must be spent or encumbered by March 31, 2009 or returned to general revenues. Funds for 2009-10 have been requested as part of the annual work planning and budget cycle. Approval of the new budget request will likely occur in April-May 2009. Contract awards will be contingent on having the available funds on hand from 2008-09, transfers from the Province and/or as part of the new approved funds for 2009-10.

Staff anticipates in April or May 2009 that the Province will approve the Terms of Reference which were submitted in December 2008 outlining the work to be undertaken in each of the three CTC source protection areas. Upon approval, the respective source protection authority has twelve (12) months to submit the Assessment Report to the Ministry of the Environment which includes the source protection committee overseeing completion all the requisite technical studies, peer review and public consultation and any necessary revisions. It is essential that appropriately qualified consultants be retained and available to carry out parts of this work and that all parties complete their work on time. Some work may extend beyond the deadline and the Assessment Report will be amended when the work is complete. It is likely that the Lake Ontario Collaborative Study will not be fully completed when the initial Assessment Report is submitted.

RATIONALEExpert Peer Review of Water Budgets in the CTC Source Protection RegionAt Authority Meeting #9/07, held on November 30, 2007, Resolution #A249/07 was approved as follows:

THAT a contract for the provision of water budget peer review services be awarded to S.S. Papadopulos & Associates as the prime contractor without substitution, of Chris Neville (S.S. Papadopulos & Associates) and Kevin MacKenzie (Golder Associates Ltd.)until September 30, 2008 at the average rate of $1,000 per 8 hour day with an upset limit of $90,000, plus applicable taxes.

Approximately $10,000 is left in this contract and there is work in hand which requires additional funding approval.

Since the award of this contract, these peer reviewers (Chris Neville and Kevin MacKenzie) have provided exceptional service in reviewing and commenting on a number of water budget documents, including attending meetings of the CTC Source Protection Committee to respond to their questions. Their charges for service are very reasonable and they have continually tried to optimize and keep their time spent to the minimum required to provide professional expert opinion. The Source Protection Committee relies on the independent expert peer reviewers to assure them that the technical work upon which the committee must rely has been conducted in a proper manner. The committee also relies on the peer reviewers for expert opinion about any scientific uncertainties, gaps and limitations of the technical studies for the purposes of the committee's decisions.

The knowledge and expertise of these peer reviewers makes them uniquely qualified to continue to provide these services. During this contract, these individuals have also ensured staff that they have not bid on or undertaken water budget work within the CTC Source Protection Region which would have disqualified them from being able to peer review that specific work.

There have been a number of factors outside the control of the consultants that has increased the number of hours required and thus the projected cost from staff estimates in the fall of 2007. These include additional reviews of revised water budget reports to address evaluation of new information requested by municipalities and the Source Protection Committee; and the Province was also delayed in finalizing their Technical Rules and making significant changes in the requirements in the technical content of the water budget studies. Independent expert peer review is a mandatory step in completing water budget studies. The final rules were released in December 2008. This latter delay has necessitated additional review of previously completed materials to ensure they met the new rules. This work is still ongoing, particularly in areas of the Credit Valley Source Protection Area where potential water quality stress has been identified.

Finally there is a need for additional water budget studies and the concomitant new peer review work, in parts of the Credit Valley and Toronto and Region Source Protection Areas as a result of the initial water budget studies.

Staff therefore recommend award of the contract on a sole source basis as per Section 1.14.5 of TRCA's Purchasing Policy as follows:

The required goods and services are to be supplied by a particular vendor or supplier having special knowledge, skills, expertise or experience that cannot be provided by any other supplier.

In accordance with the approved TRCA Purchasing Policy, Executive Committee approval is required for sole source procurement between $50,000 and $200,000.

The contract would be to S.S. Papadopulos & Associates as the prime contractor withoutsubstitution, of Chris Neville (S.S. Papadopulos & Associates) and Kevin MacKenzie (Golder Associates Ltd.) with an upset limit of $200,000 on a fee for service basis at an average cost of $1,100 per day with the duration of the contract to March 31, 2010. Award of any work under this contract will be contingent on having 100% provincial funding and approval, the need for the specific services, and on-going satisfactory performance.

Tier 2 Water Budget for Little Rouge SubwatershedTRCA has completed a Conceptual Water Budget report (April 2007) and a preliminary draft Tier 1 Water Budget Report (July 2008). Based on follow-up work since July, and consultation with the peer review team, one subwatershed in TRCA’s jurisdiction has been recommended for Tier 2 water budget analysis. This process will require the assessment of water supply and demand in the Little Rouge River subwatershed.

The database and numerical model developed by EarthFX for TRCA's Draft Tier 1 Water Budget report will be used for the Tier 2 analysis to assess water budget components at the subwatershed scale. TRCA staff require a consultant to use the existing surface water and groundwater models in transient mode to assess the effects of two and five year drought scenarios and refine the stress assessment calculations. Because of EarthFX’s knowledge and expertise developed through the development and calibration of the Tier 1 water budget model, they are uniquely qualified to undertake this additional work. This firm has recently completed similar groundwater modelling projects for both York Region and the Lake Simcoe and Region Conservation Authority. One of these projects was the wellhead protection area delineation for the Stouffville water supply wells in the Little Rouge River subwatershed.

The cost of retaining other firms to complete this work would be much higher and the process would take significantly longer since there would be a substantial learning curve for another consultant to understand the geologic model construction and numerical model parameter estimation process. As well, all output will be processed through EarthFX's software product, Viewlog®, for which TRCA already has multiple licenses.

Staff therefore recommends award of the contract on a sole source basis as per Section 1.14.5 of TRCA's Purchasing Policy as sited above.

The contract for the preparation of a Tier 2 water budget in the Little Rouge subwatershed would be with EarthFX Inc. with an upset limit of $197,186, plus applicable taxes. The funding required for this contract is already held in trust by TRCA and the need for this work has been approved by the Province. The funds must be encumbered by March 31, 2009.

Memoranda of Agreement for Source Water Protection Work

Tier 3 Water Budget Work in Halton HillsAt Authority Meeting #11/07, held on January 25, 2008, Resolution #A300/07 approved entering into an agreement to transfer funds to the Regional Municipality of Halton to undertake components of a Tier 3 Water Budget Assessment, at the request of the Ministry of Natural Resources.

The Region of Halton engaged consultants through a competitive process to undertake this work. The estimated costs to do the work were significantly higher than the funding provided by the Province. A phased work plan was approved based on provincial funding available atthe time. Subsequently the Province has made additional funding available and the agreement with the Regional Municipality of Halton is being amended to transfer the additional funds for approved work.

Further amendments are anticipated based on receipt of the most recent work plan to complete the required studies. Staff is requesting the requisite funds as part of the 2009-10 budget cycle from the Province. If and when funding is received from the Province, the agreement will be further amended to transfer these funds.

It is currently anticipated that this study will not be completed until March 2010. The work must then be peer reviewed and presented to the CTC Source Protection Committee for their acceptance.

Transfer of Funds for Water Quality Sampling as part of the Lake Ontario Collaborative StudyStaff is entering into agreements with Niagara Peninsula, Halton, Credit Valley and Ganaraska River conservation authorities to transfer funds to cover staff costs to collect water quality samples in Twenty Mile Creek, Sixteen Mile Creek, Credit River, Ganaraska River and Cobourg Creek as part of the work to assess drinking water threats in the nearshore of Lake Ontario in the vicinity of municipal drinking water intakes. This work is an eligible expense against TRCA's current provincial source water protection funding, as long as the money is either expended or encumbered by March 31, 2009. TRCA is the technical lead for this work on behalf of all the conservation authorities.

Upon signing of the agreements, 75% of the funds ($11,250 per tributary) will be transferred, with the remaining 25% ($3,750) transferred upon receipt of the requisite report. The reports are due no later than December 31, 2009.

The CTC Source Protection Region was appointed as the lead source protection region for the Lake Ontario Collaborative Study in September 2008. The Region of Peel continues to be the lead for managing the technical studies grant funding received from the Ministry of the Environment in 2007. There are not sufficient funds left in the original provincial grant to Region of Peel to undertake all the new work required to meet the new Technical Rules. If further funds are required, the funding will be transferred to the Region of Peel from the responsible conservation authority from their provincial funds upon approval of the work by the Province. The Ministry of the Environment is no longer making grants directly to municipalities for source water protection work that is the responsibility of the source protection committee and source protection authority to prepare and submit to the Province under the Clean Water Act, 2006 and associated regulations.

CARRIEDBACKGROUNDLocated within Albion Hills Conservation Area, a 446 hectare active-use park north of the Village of Bolton in the Region of Peel, the Albion Hills Field Centre (AHFC) is an 8,000 square foot building able to accommodate up to forty-four (44) student, youth or adult visitors for overnight environmental education excursions. Typical visits are from two to five days with the participants living on-site and being immersed in environmental and sustainable lifestyle learning programs. Total annual attendance at AHFC is, on average, about 2,550 participants.

Constructed in 1962, AHFC is a cedar and granite chalet-style building equipped with bedrooms, washrooms, classrooms, offices, a lounge, a dining hall and commercial kitchen facilities. Many of the existing systems, fixtures and infrastructure components are reaching the end of their lifecycle and are in need of replacement or retrofit. AHFC is a Gold Certified EcoSchool that demonstrates excellent building occupancy behaviour in energy, waste, greening and ecological literacy. TRCA is currently undertaking a major renovation and retrofit of the facility in order to improve the mechanical and sustainability functions of the building, the student learning environment and market appeal of the education program through aesthetic improvements. This major facility upgrade and retrofit will significantly contribute to AHFC’s business sustainability and strengthen its position as an important environmental and sustainability education resource.

Beginning in June of 2007, Montgomery Sisam Architects undertook an assessment and conceptual redesign of AHFC to determine the feasibility of renovating and adding on to the facility in order to provide an upgraded and more suitable learning environment for visiting students. The results of this assessment and redesign determined that it was feasible to undertake a significant reconstruction of the facility that fulfilled sustainability criteria with the final intent achieving Leadership in Energy and Environmental Design (LEED) certification.

In February of 2008 Montgomery Sisam began the detailed architectural work for the complete retrofit and renovation of AHFC. In order to minimize disruption to student use throughout the school year, renovation and construction activities at AHFC are limited to mid-June through late-September. As such, the complete retrofit of the field centre is being phased over a number of years with entire segments of the building being completed in each phase. Early on in the detailed architectural design process it was determined that the kitchen renovation and retrofit would be a suitable first construction phase, based on the potential climate change impact of improved mechanical systems and high-efficiency kitchen equipment, and the ability to complete the scope of work in a twelve week period.

In October of 2008 Montgomery Sisam Architects Ltd. prepared detailed design and construction drawings for the AHFC kitchen to begin the tendering and building permit process with a projected start date for construction of June 2009. In January of 2009, Percon Construction, who has been retained as project managers for the kitchen renovation, began soliciting tenders for the following segments of the work:

CARRIEDBACKGROUNDTRCA, with the support of our member municipalities, has developed and implemented a Regional Watershed Monitoring Network within TRCA's area of jurisdiction. The network has been designed to be a comprehensive, integrated and coordinated system which fulfils the needs of the Remedial Action Plan (RAP), TRCA, and the individual watershed and waterfront councils and alliances, while furthering the interests of municipal, provincial and federal partners. The Regional Watershed Monitoring Program includes aquatic habitat and species, fluvial geomorphology, terrestrial natural heritage (flora and fauna), surface water quality, surface water quantity (flow and precipitation), groundwater and air quality.

The surface water quantity component, which includes precipitation and stream flow data, is critical to TRCA's flood forecasting and warning program and is also used by municipalities and consultants for stormwater management planning, municipal infrastructure design and watershed modelling. The focus of this assignment is to retain a consultant for one year to maintain, monitor, and archive stream flow data for 23 gauges within TRCA's entire stream gauge network. The consultant will also continue to develop stage/discharge relationships for each gauge and train TRCA staff to complete these tasks independently.

RATIONALEHistorically, the majority of gauging has been carried out by Environment Canada, through their Water Survey Canada (WSC) division for stream gauge monitoring. Outside of Environment Canada's objectives, TRCA identified the need to increase the knowledge base of our watersheds by increasing the number of gauges and expanding the network. Presently, TRCA staff does not have sufficient staff resources needed to operate and maintain the network, therefore, staff require the services of a private contractor. The availability of private contractors who undertake water quantity work remains limited in the area. While some consulting firms offer a service of flow measurement in storm and sanitary sewers, very few are able to monitor open channel flows to Environment Canada standards.

In 2007, OHS participated in a competitive bid process to provide these services to TRCA. Based on a detailed review and evaluation of the proposals, TRCA unanimously agreed that OHS should be awarded the contract for the following reasons:

OHS has successfully monitored and maintained over a hundred stream gauges throughout Ontario including TRCA's stream gauge network for the past eleven years;existing stage/discharge curves could be compromised if a less experienced consultant was retained;OHS conducts all field work and data processing for TRCA and has gained experience in TRCA monitoring needs and objectives, location of the existing stations, and has provided technical expertise regarding various types of monitoring equipment;OHS is familiar with the set-up, downloading, and Serial Data Interface (SDI) sensor programming of the Sutron 9210 datalogger used by TRCA at some of their stream gauge stations;OHS will continue to provide training so that TRCA staff can gain the knowledge required to complete these tasks independently within the next 2 years.

TRCA has provided a detailed task list to OHS for which they have provided a quote of $115,990 plus applicable taxes. Staff is of the opinion that this represents good value for the extent of work requested. OHS has the most experience in the field of open channel flow monitoring and has successfully and effectively provided TRCA with these services for the past eleven years. Therefore, staff recommends that the project be a sole source contract with OHS as per Sections 1.14.1 and 1.14.5 of TRCA's Purchasing Policy which reads, in part, as follows:

Each year the US-IALE hosts a symposium to bring together professionals in the field of Landscape Ecology. This years theme is Coupling Humans and Complex Ecological Landscapes.

RATIONALEThe foundation of the Terrestrial Natural Heritage System Strategy (TNHSS) is based on key principles of landscape ecology. The Terrestrial Natural Heritage group of TRCA continues to undertake numerous projects that rely on the fundamentals of landscape ecology. Some of these projects include Ecosystem Recovery Planning, Invasive Plant Strategies and Wildlife Movement Barrier Mitigation. Attendance at the symposium will be beneficial to TRCA byhelping to ensure staff are up to date in terms of contemporary research in the field of landscape ecology. The topic areas of the symposium are directly relevant to the planned projects of TRCA’s terrestrial natural heritage group. Attendance will also increase the profile ofTRCA and help to establish and strengthen networks with other agencies and researches working in similar fields of study.

Ms. Shrestha is completing her PhD at the University of Toronto and will be presenting some of her results at the symposium.

Upon her return, Ms. Shrestha will make a presentation to the Executive Committee as well as to TRCA staff on the results and outcomes of the symposium.

The lands are currently occupied by a converted heritage home, commercial office and retail plaza along Yonge Street and a single detached dwelling that fronts onto Arnold Avenue. The lands immediately north of the property along Yonge Street are occupied by an office complex. The lands to the west and immediately north of the Arnold Avenue property are occupied by single detached dwellings. Retail commercial developments are located immediately south of the property and a public school is located on the opposite side of Arnold Avenue.

A remnant tributary of the Don River traverses the northern boundary of the Arnold Avenue property and diverts southward into an intake structure connected with the storm sewer system. This tributary is regulated under Development, Interference with Wetlands and Alterations to Shorelines and Watercourses Regulation (Ontario Regulation 166/06) as the feature poses a flooding hazard.

The Planning Act applications for the subject property are to amend the City of Vaughan's Official Plan and Zoning By-law (By-law 1-88, as amended), in order to facilitate the construction of a 12-storey residential building and associated buildings and structures. The lands are currently designated as "Low Density Residential" and "General Commercial" under OPA 210 and zoned "R1V Single Family Detached Dwelling" and "C1 Restricted Commercial" under Zoning By-law 1-88, as amended.

The applications have been appealed to the OMB by the proponents for City of Vaughan Council's refusal or neglect to enact the proposed Official Plan and Zoning By-law Amendments. The proponents have also filed appeals under the Ontario Heritage Act, R.S.O. 1990, c. O. 18, regarding By-law No. 323-2007 which adopted a Heritage Conservation District Plan for the Thornhill Heritage Conservation District. As matters of built cultural heritage are outside of the jurisdiction and interests of TRCA, staff will not be addressing the matters relating to the Ontario Heritage Act.

Upon receipt of the Notice of Pre-Hearing Conference, received by TRCA Planning and Development staff February 7, 2008, it was determined by staff that the subject property is regulated under Ontario Regulation 166/06 and had been subject to flooding during the August 19, 2005 storm event. As confirmed with City of Vaughan staff during a phone discussion in February 2008, TRCA Planning and Development staff were not circulated with the original Official Plan or Zoning By-law Amendment applications which were initially submitted to the City of Vaughan in 2005. TRCA staff initiated discussions with City of Vaughan Planning Staff and the applicant in order to attempt resolution of issues pertaining to flooding and natural heritage issues prior to the commencement of the hearing.

TRCA staff conducted a site visit on April 7, 2008 to assess the ecological function of the existing open channel. The applicant has attempted to address the issues relating to maintaining or enhancing the ecological function on the property through a planting / restoration plan. At this time, a few minor issues remain outstanding with the planting / restoration plan; however, TRCA ecology staff are satisfied that these issues can be adequately addressed through the Ontario Regulation 166/06 permitting process.

In an attempt to address the flooding concerns on the property, the applicant has submitted a Drainage Study and proposed a new relief storm sewer to be connected with the existing storm sewer system. The Drainage Study demonstrates that both the new storm sewer and the downstream storm sewer line have capacity to accommodate a Regional Storm event. TRCA water resource staff are satisfied that the revised servicing scheme will adequately address flooding concerns.

RATIONALEThe OMB hearing is scheduled to commence March 9, 2009. It was TRCA staff's intention, based on the progress we made to resolve the issues, that we were not expecting to attend the hearing. At this time, TRCA staff are satisfied that the work completed by the proponent's consultants have addressed our issues. However, City Engineering Staff have some outstanding matters. As such, we are requesting Executive Committee approval to obtain legal counsel and attend the hearing to ensure what we have negotiated is maintained / carried through in the OMB's decision of the application, should the application be approved.

Staff anticipate that we will only participate for one day at the hearing and legal will only be advisory.

DETAILS OF WORK TO BE DONEStaff is requesting authorization of the Executive Committee to retain legal counsel to ensure that TRCA interests are protected and addressed at the hearing should discrepancies between the City's Engineering Department and TRCA technical staff remain. Staff and retained legal counsel will continue to work with the parties and participants to the hearing to resolve any outstanding issues and will continue to represent the interests of TRCA before the OMB.

Proposal:The applicant seeks permission to undertake minor site grading and permanently place fill material within the estimated Regional Storm Flood Plain to facilitate the construction of a replacement dwelling north east of Bayview Avenue and Sheppard Avenue East. Historically, fill had been removed from the rear yard in order to allow the construction of a large walk-out area for the basement level of the existing dwelling. The proposed grading works, while minor in nature, will have the effect of replacing some of the removed fill in order to remove the proposed new dwelling from the estimated flood plain. The lot backs onto a hardened, channelized tributary of the Don River. Atemporary asphalt access road is proposed to provide access around the property for construction access purposes. Construction of the proposed upgrades is scheduled to begin in summer 2009. Upon construction completion, the City will restore the area associated with the temporary access road to its current condition or better.

Control of Flooding:There will be no impacts to the control of flooding. All grades within the Regional Storm Floodplain will be maintained.

The entire subject property is located within the Regional Storm Flood Plain; however, the proposed replacement septic system is located further back from the watercourse than the current existing septic system and is located outside of the Hydraulic Floodway. The proposed works will not result in any grade changes over existing conditions and TRCA Water Resource staff are satisfied that the works will not affect the storage or conveyance of flood waters.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The applicant seeks permission to undertake the permanent placement of fill material in order to construct a recreational trail within, and adjacent to, the valleylands of the Little Rouge Creek. The proposed works are located in the northwest quadrant of the Community of Stouffville within a commercial and residential development known as Cardinal Point (Municipal File No. 19T(W)-03.005A). The residential portion of the development is located to the south and east of a tributary to the Little Rouge Creek at the intersection of the newly constructed Millard Street and Baker Hill Boulevards. The valleylands have been protected through the development process and now present an opportunity for a recreational trail and restoration planting.

As a condition to development approval, the Town of Whitchurch-Stouffville has required that the developer construct a recreational trail along the southern and eastern perimeter of the valleylands. The trail system is to be constructed of asphalt. The majority of the trail will be 3 metres in width. A section will be narrowed to 2.4 metres in width to provide additional buffering, at the request of TRCA staff, where the trail is adjacent to a wooded area.

Control of Flooding:A portion of the trail crosses beneath the Millard Street Bridge at the Little Rouge Creek. This portion of the trail will be located within the Regional Storm Flood Plain. However, existing grades will be maintained resulting in no impact to the storage or conveyance of flood waters.

Pollution:Sediment and erosion controls for the site are currently in place for the ongoing development activities. These facilities will isolate trail construction activities from the watercourse.

Dynamic Beaches:Not applicable

Erosion:There are no slope stability or geotechnical issues associated with this proposal.

Conservation of Land:The trail route has been carefully sited in the field along with TRCA staff. The route avoids all sensitive areas associated with the valleylands. In fact, the east-west portion of the trail is located outside of the valley to limit any adverse environmental impact associated with the trail to the greatest extent possible. Further, the trail will be screened and buffered with an extensive planting plan of native, self-sustaining vegetation, as shown on the plans.

PlantingsThe plans included with this proposal provide for extensive valleyland restoration plantings along with trail buffering and screening plantings.

Policy Guidelines:This proposal is consistent with Section 4.1.2 B), New Resource-based Uses, of TRCA's Valley and Stream Corridor Management Program.

The proposed works are located entirely within the 120 metre Wetland Area of Interference boundary of a Provincial Significant Wetland (PSW) which forms a part of the Eaton Hall-Mary-Hackett Lakes Wetland Complex. The works are located within an already disturbed area (manicured lawn) and will not result in the removal of any significant vegetation and are located approximately 60 metres away from the PSW. TRCA ecology staff are satisfied that the proposed works are sufficiently setback from the PSW and there will be no adverse impact as a result of the works.

Control of Flooding:The proposed works are not located within the Regional Storm Flood Plain, there will be no impacts on the storage or conveyance of flood waters.

Pollution:Sediment control fencing will be erected and maintained around the areas of disturbance to prevent the transport of sediment.

The City of Brampton and the Regional Municipality of Peel are currently in discussions regarding the location of the watermain in relation to the future culvert west of Bramalea Road. As a result, the watercourse crossing west of Bramalea Road will be reviewed separately as a Schedule B under the Municipal Class EA along with two other watercourse crossings along Countryside Drive between Bramalea Road and Airport Road. Proposal:The Don Valley Brick Works subject property is located in the Don Valley on the west side of the Bayview Avenue extension and north of Bloor Street in the City of Toronto. The Brick Works is owned by the TRCA, under management agreement with the City of Toronto and subject to a Lease Agreement with Evergreen for the industrial pad portion of the property. On November 7, 2008 the TRCA Executive Committee approved Permit No. C-08828 for Phase 1 of the regeneration of the Brick Works. This first permit for Phase 1 included site preparation, building stabilization and servicing. The history of Evergreen's involvement with the Brick Works is described in detail in the Executive Committee permit report of November 7, 2008 (AgendaItem No. 10.42).

This permit application is to allow for Phase 2 of construction to begin in April 2008 and includes full or partial restoration and occupation of twelve (12) buildings, the stabilization of three (3) buildings to remain unoccupied for the time being, the construction of a new four-storey multi-purpose building designed to meet or exceed the LEED Platinum rating and located above a restored Building No. 12, final grade surface parking, final grading of the courtyard adjacent to the chimney and front entrance, installation of a series of pedestrian bridges, and restoration of the site with native trees, shrubs and grasses. TRCA staff has reviewed and approved a Site Plan application for the works included in Phase 1 and Phase 2. This Site Plan application has been approved with conditions by the City of Toronto.

Conditional Permit:TRCA staff has required Evergreen to develop and implement a Site Flooding Management and Evacuation Plan with the assistance of TRCA staff and various emergency management agencies such as Police, Fire and EMS prior to occupancy of the development. This is a condition of the Site Plan approval and the Lease Agreement. Therefore, the development and continued implementation a Site Flooding Management and Evacuation Plan to TRCA satisfaction is also a condition of the approval of this permit.

Control of Flooding:The site is in a floodplain and susceptible to routine flooding. The site is susceptible to approximately four metres of flooding during a 350-year flood event and approximately six metres during a Regional flood event. Bayview Avenue is typically closed to through traffic in response to flooding. The buildings are located within a widened area of the Don Valley where the floodplain is not subject to the full impact of flood flows in the Don River. As such, there are challenges to re-occupying the site so that the designated heritage buildings can be restored and the history of brick making in this part of the Don Valley can be preserved. Therefore, the Master Plan, Lease Agreement and subsequent planning and permit approvals require the following: 1) all buildings will be flood proofed to the 350 year flood event and a flood study shows that there will be no impact to up or down stream flooding; and 2) an Site Flooding Management and Evacuation Plan will be developed and implemented. As such, extensive efforts have been made by Evergreen to manage the flooding on site, including the following:

1) The approach to flood proofing includes raising the base grade and ground floor elevations of much of the industrial pad to above the two year flood elevation to eliminate the "nuisance" flooding that occurs on a routine basis. This base grading was approved as part of the November 7, 2008 permit for Phase 1. The approach to floodproofing also includes "wet" floodproofing the buildings to the 350 year flood elevation. This includes raising all critical electrical and mechanical infrastructure to approximately 4 metres above grade, installing trips on electrical connections, using materials such as concrete or brick that can take water and confirming that the buildings can structurally withstand a Regional flood event. TRCA Engineering staff are satisfied that Evergreen's structural, mechanical and electrical consultants have met these requirements in their designs. Finally, the overall "on the ground" footprint of the existing development has been reduced and the new development above Building No. 12 is raised above the 350 year flood elevation. All of these floodproofing measures have been confirmed through the Site Plan approval process.

2) The development of the Site Flooding Management and Evacuation Plan is being prepared by Evergreen with assistance from a committee including TRCA staff, City staff, and Fire, Police and EMS staff, among others. The development and implementation of this Plan is required as a condition of the Lease Agreement and Site Plan approval, and occupancy of the development will not be considered until such time as the Plan is complete. The Plan will include a communications protocol, emergency power, a process to trigger full human and vehicle evacuation of the industrial pad under the threat of flooding and, in the unlikely situation where a full evacuation is not possible, the provision of an on-site safe haven located above the Regional Storm flood elevation in the new development above Building No. 12. The Plan's procedures will evolve over time based on experience with the threat of flooding. As noted, development and implementation of this Plan is a condition of the issuance of this permit.

TRCA staff is satisfied that all of the above requirements are met in Phase 2 and the regeneration of the Brick Works can proceed to completion. The work to take place in Phase 2 will have no impact on the storage or conveyance of flood waters. In addition, an Emergency Response Plan reviewed and approved with the November 7, 2009 permit continues to be in effect throughout Phase 2. This Plan provides the necessary protocols for Evergreen's contractor to follow if there is a threat of flooding during construction.

Pollution:Temporary sediment control is already in place per the Greater Golden Horseshoe Area Conservation Authorities, Erosion and Sediment Control Guideline for Urban Construction. These controls include a stormwater management pond with interim erosion and sediment controls during construction, swales, rock-check dams, oil-grit separators, and sediment control fencing.

Dynamic Beaches:Not applicable.

Erosion:Temporary erosion control is already in place per the Greater Golden Horseshoe Area Conservation Authorities, Erosion and Sediment Control Guideline for Urban Construction. Geotechnical issues were resolved in Phase 1.

Conservation of Land:The proposal within the industrial pad is not located in a significant area and will not impact the conservation of land. The industrial pad is either fully developed with buildings, paved parking or previously disturbed. However, the site is adjacent to an Environmentally Significant Area. The design of the project has been influenced by the recommendations of a Natural Heritage Impact Study. Tree protection hoarding was installed as part of Phase 1. Native restoration plantings will be provided on the valley slopes, within the buffers to be located between the toe of slope and the eastern parking area, and within the industrial pad during Phase 2 of the development.

PlantingsNative tree, shrub and grass plantings will mitigate the loss of various hazard trees and non-native species that will be removed as part of Phase 1. The plantings have been secured through the Site Plan approval process.

Policy Guidelines:The TRCA reviews all Planning and Permit applications in concert with the Valley and Stream Corridor Management Program. An Objective of the Program is to “prevent development that… affects the control of flooding, pollution or conservation of land within valley and stream corridors.” The Program recognizes that “where development has occurred within valley…corridors, increased flexibility for valleyland management is required” and provides policies for redevelopment of existing developed sites located within the floodplain. Specifically, the Program prohibits major additions but allows for redevelopment with replacement structures and/or minor additions subject to various criteria, the intent of which is to reduce the risk to life and property damage. Phase 2 of the project includes a minor addition. One of the policy guidelines for such redevelopment is that "ingress and egress should be 'safe' pursuant to Provincial floodproofing guidelines and/or achieve the maximum level of flood protection determined to be feasible or practical based on existing infrastructure". In the case of the Brick Works, 'safe' ingress and egress cannot be achieved and the construction of 'safe' ingress and egress cannot be constructed through the valley slopes without negatively impacting the conservation of land.

However, there are a number of fundamental differences to this application, including: 1) the Program recognizes the provincial interest in preserving and restoring buildings and structures designated as architecturally or historically important; 2) a recognition of the need for an additional environmental education centre in the Toronto region; and 3) the site is owned by the TRCA, managed by the City of Toronto and is subject to a Lease Agreement that mandates flood proofing and implementation of an Emergency Response Plan during construction and a Site Flooding Management and Evacuation Plan for Evergreen's staff and visitors upon occupancy. As such, TRCA staff are satisfied that the maximum level of flood protection determined to be feasible or practical based on existing infrastructure is achieved in Phase 2. Therefore, the risk to life and property can be sufficiently reduced so that both the overall plan for the redevelopment, including the Phase 2 works included in this permit application meet the objectives of the Valley and Stream Corridor Management Program.

Proposal:The proposal consists of the reconstruction of Pennon Road and Daleview Court located west of Islington Avenue, north of Major Mackenzie Drive in the City of Vaughan. The reconstruction of the roads will include the construction of new storm sewers. The new storm sewer proposed in the Regulated Area on Daleview Court will be installed by open cut. The size of the storm sewer will be 4.0m of 375mm PVC. The new storm sewer proposed in the Regulated Area on Pennon Court will be 12.0m of 400mm corrugated high density polyethylene (CORR HDPE). Allworks will take place within the City of Vaughan's right-of-way.

Control of Flooding:The proposed project will have no impacts on the storage or conveyance of floodwaters.

Pollution:Standard erosion and sediment control measures (sediment fencing) will be implemented prior to construction and maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering any watercourse or wetland. Proposal:The purpose is to construct an emergency drainage swale within a Regulated Area of the Don River Watershed. The swale is to provide overland flow relief during a 100-year event as required by the City of Vaughan Engineering Department as part of a related Site Plan Application (Site Plan Application No. DA.04.029). The Site Plan Application involves the construction of an addition to an existing residential complex on the subject property. The only portion of the works associated with the Site Plan Application that falls within the Regulated Area is part of the emergency drainage swale and the swale's spillway.

The spillway of the swale is located within a vegetated area along the top of bank of a mild slope and the majority of the swale is located near the dripline of existing vegetation (varying in distance between 2 to 10 metres), which extends away from the slope . Proposal:The Town of Markham has undertaken a study called the Markham Erosion Restoration Implementation Plan, June 2007 (Plan). The study was completed as a Master Plan in accordance with the Municipal Class Environmental Assessment (MCEA) process under the Environmental Assessment Act (EEA). The Plan examined existing and future infrastructure requirements and integrated those with environmental assessment principles to identify a number of priority erosion restoration sites along the watercourses within the Town of Markham. The list of priority sites included those sites that are a risk to public health and safety. The Plan also outlined a restoration plan to address these erosion sites on a site specific basis and that would then go through further review under the appropriate Schedule under the MCEA process. TRCA has been involved and provided input in the review of this plan. The current proposal has been reviewed through a Schedule B, Municipal Class Environmental Assessment.

This proposal has been identified in the plan as site #3, and as a priority restoration site due to the opportunity for naturalization and aesthetic improvement. It is being undertaken in order to facilitate the remediation of eroding banks as well as to protect an existing manhole located on the edge of the creek bank. The works will include replacing the eroding cable-concrete matting with a riffle-pool configuration thereby restoring some natural channel function and minor modifications to the low flow cross section in order to blend into the existing valley terrain. The existing sanitary manhole will be protected using a single row of armourstone, to be embedded behind a surface treatment which employs a soil/rock mix overlaid with seed, an erosion control blanket and plantings. The banks around the manhole will be contoured and blended into the adjacent restored bank.

Control of Flooding:The storage or conveyance of floodwaters will not be impacted by the proposed works.

Pollution:Standard erosion and sediment control measures (sediment fencing and coffer dam) will be implemented prior to construction and maintained for the duration of construction, and until the site is stabilized and restored, in order to prevent construction generated sediments from entering any watercourse or wetland. The purpose is to undertake the restoration of creek banks by providing bank stabilization using bioengineering techniques in order to prevent flanking of an existing armourstone treatment within a coldwater fisheries timing window. A Letter of Advice will be provided by TRCA staff on behalf of Fisheries and Oceans Canada (DFO) for this project.

The permit will be issued for the period of March 6, 2009 to March 5, 2011.

RATIONALEThe application was reviewed by staff on the basis of the following information:

Proposal:The Town of Markham has undertaken a study called the Markham Erosion Restoration Implementation Plan, June 2007. The study was carried out under the Municipal Class Environmental Assessment planning process. The purpose of this study was to identify priority erosion restoration sites along the watercourses within the Town of Markham which may pose a risk to public health and safety, and to develop a restoration plan to address these erosion sites on a site specific basis. TRCA has been involved and provided input in the review of this plan.

This proposal is identified in the plan as Site #12, and is being undertaken in order to facilitate the remediation of eroding creek banks. The works include planting several trees and shrubs and using brush layering along the creek banks over the disturbed area the top of bank of Mount Joy Creek to stabilize the eroding slope. The works are required in order to protect an existing manhole.

Control of Flooding:The storage or conveyance of floodwaters will not be impacted by the proposed works.

Pollution:Standard erosion and sediment control measures (sediment fencing and coffer dam) will be implemented prior to, and maintained for the duration of construction, and until the site is stabilized and restored in order to prevent construction generated sediments from entering any watercourse or wetland. Erosion and sediment control measures have been provided in accordance with the TRCA Erosion and Sediment Control Guideline For Urban Construction.

Dynamic Beaches:Not applicable

Erosion:The proposal is to conduct instream works to stabilize a channel. Staff has reviewed the proposal and has no channel stability concerns with the proposed works.

Conservation of Land:With erosion and sedimentation plans in effect, the potential for a Harmful, Alteration Disruption or Destruction (HADD) of fish habitat will be mitigated and a Letter of Advice will be provided by TRCA staff on behalf of Fisheries and Oceans Canada (DFO). This application is subject to the coldwater fisheries timing window, all works to be completed between July 1 and September 15.

PlantingsAll disturbed areas will be restored with native, non-invasive species following construction. This project will result in a net gain of approximately 1000 trees and shrubs within the study area.

Policy Guidelines:The proposal complies with section 4.3, Infrastructure and Servicing of the Authority's Valley and Stream Corridor Management Program

Proposal:The purpose of this application is to undertake works within a TRCA Regulated Area of the Etobicoke Creek Watershed in order to facilitate the construction of 17.15 square metre (184.6 sq. ft.) sunroom addition at the rear of an existing dwelling. The rear of the subject property is located within the Regional Storm Floodplain limit associated with the Etobicoke Creek valley to the east. Although a portion of the property is located within the Regional Storm Floodplain, the proposed addition and existing residence are located outside of the Regional Storm Floodplain and sufficiently setback. Also, the proposed structure will be located on top of an existing concrete porch. The rear portion of the subject property is currently a manicured lawn. As such, there are no geotechnical and/or ecology related concerns with this proposal.

Control of Flooding:The proposed works are located outside of the Regional Storm Floodplain. As such, no impacts to the storage and/or conveyance of flood waters are anticipated.

Pollution:Appropriate erosion and sediment controls (silt fence) have been proposed with this application, and will be maintained throughout all phases of construction.

Dynamic Beaches:Not applicable.

Erosion:There are no geotechnical and/or slope stability concerns associated with this project.

Conservation of Land:No significant vegetation will be removed as a result of construction.

PlantingsThe proposed sunroom addition is located on top of an existing concrete porch. Assuch, plantings are not required as part of this project.

Policy Guidelines:This proposal is in conformity with Section 4.2.2 (C) – Minor Additions – of the Authority’s Valley and Stream Corridor Management Program (VSCMP).
