    AFFIDAVIT OF RICHARD L. VELKY IN SUPPORT OF PLAINTIFF'S RESPONSE TO DEFENDANTS' MOTION TO DISMISS

    Richard L. Velky, having been duly sworn, deposes and states the following:

    1. I am over eighteen years of age and understand the nature and obligations of an oath. This affidavit is based on personal knowledge and the facts stated herein are true and correct.

    2. I make this Affidavit in support of Plaintiffs' Response to Defendants' Motion to Dismiss.

    3. I am currently Chief of the Schaghticoke Tribal Nation, and have been Chief since 1987.

    4. In 1985 Alan Russell, a former STN chairman, was voted out of office in an election supervised and validated by the Connecticut Indian Affairs Council; sanctioned by the STN Tribal Council for allegations including assault and misuse of STN property for personal gain; and had his voting rights revoked. In response, he and his family left STN and, claiming that he was still the actual chairman of the Tribe, started a brand new group he called Schaghticoke Indian Tribe, or "SIT". Mr. Russell formally disassociated himself with STN on October 24, 1997. Since that time SIT—which is simply Mr. Russell and a handful of other disgruntled former STN members—have done little more than occasionally engage in litigation.

    5. The State has recognized STN as the Schaghticoke Tribe since Mr. Russell's departure and the formation of SIT. Exhibit 2 is a true and correct copy of a June 14, 2000, letter sent to me by State DEP Commissioner Arthur J. Rocque, and stating in part: "Inasmuch as you have represented the Schaghticoke Tribe in matters before this Department for approximately thirteen

    years and inasmuch as the CIAC has not accepted a challenge to the Schaghticoke Tribal seat, I see no reason to question the validity of your leadership at this time. It is therefore the intent of this Depaitment to continue to communicate with the tribe principally through you as Chief until such time as another individual claims leadership of the Schaghticoke Tribe and is able to present verifiable evidence of that claim.". This letter has been kept in STN's files since its receipt in 2000.

    6. Additionally, Exhibit 3 is a true and correct copy of a July 21, 1999 letter from the State of Connecticut Indian Affairs Coordinator to me, identifying STN as the Schaghticoke Tribe, and myself as "Tribal Chairman and Chief' since 1987. This letter has been kept in STN's files since its receipt in 1999.

    7. These two letters from the State, attached as Exhibits 2 and 3 to Plaintiffs' Response, expressly contradict the statement attested to by Graham J. Stevens in ¶ 11 of his affidavit attached to Defendants' Motion to Dismiss, where he states "[i]t is unclear to the DEEP whether Mr. Velky, Mr. Russell, both or neither, represent(s) the Schaghticoke, nor has the DEEP taken a position as to who is(are) the proper representative(s) of the Schaghticoke". (Emphasis added.)

    8. Exhibit 4 is a true and correct copy of the June 7, 2016 Tribal Resolution CEV-16 authorizing the filing of this lawsuit.

    9. Exhibit 5 is a true and correct copy of Connecticut State Archives, Indian Series 1, vol. 2, 1647-1789, p. 75.; 5/1752; Public Records of Connecticut, RC 10:108. This record has been kept in STN's files since 2004.

    10. Exhibit 6 is a true and correct copy of 05/1752 CCLR 4:610-611; 4:621. This record has been kept in STN's files since 2004.

    Dear Chief Velky:

    I am writing to clarify the agency position outlined in a letter from our Indian Affairs Coordinator, Ed Sarabia, dated May 16, 2000 prompted by your further inquiry. As you know and as we discussed in our meeting in Aprii, the Department of Environmental Protection does not have the authority to make a determination in matters relating to tribal leadership. Questions over such leadership, however, are critical to the discharge of our statutory responsibilities relating to tribes and, when disputes arise, we rely on advice from the Connecticut Indian Affairs Council. Inasmuch as you have represented the Schaghticoke Tribe in matters before this Department for approximately thirteen years and inasmuch as the CIAC has not accepted a challenge to the Schaghticoke Tribal seat, I see no reason to question the validity of your leadership at this time.

    It is therefore the intent of this Department to continue to communicate with the tribe principally through you as Chief until such time as another individual claims leadership of the Schaghticoke Tribe and is able to present verifiable evidence of that claim. I. would seek the advice oft AC should the evidence supporting such a claim be in dispute.

    Sec. 47-66j. Rules for tribal membership. The membership rules may include previ- mons for revocation of membership.     LEGAL SERVICES AGREEMENT WITH NIX PATTERSON & ROACH LLP ("NPR")

    Be it enacted by the Tribal Council of Schaghticoke Tribal Nation:

    WHEREAS, Schaghticoke Tribal Nation is a state-recognized Indian Tribe governed by a Tribal Council and Officers who act in accordance with the powers granted to it by its Constitution and By-Laws:

    WHEREAS, Schaghticoke Tribal Nation believes that it has a valid legal claim(s) against the State of Connecticut pertaining to unpaid mortgages on Tribal lands, and related damages and economic losses, due to constitutional and fiduciary violations;

    WHEREAS, although past performance is not a guaranty of future success, Schaghticoke Tribal Nation wishes to retain NPR to pursue claims against the State of Connecticut regarding the Tribe's mortgage rights, including payment on said mortgages issued in connection with the transfer or sale of Tribal lands;

    NOW, THEREFORE BE IT RESOLVED, Schaghticoke Tribal Nation has retained NPR to represent the interests of the Tribe in pursuing mortgage rights action(s) relating to Tribal lands;

    BE IT FURTHER RESOLVED, Schaghticoke Tribal Nation hereby authorizes NPR to file a lawsuit in the appropriate forum(s) to enforce the Tribe's mortgage rights, claiming damages based on constitutional and fiduciary obligations, and any other available claims, damages and relief relating to damages incurred due to the failure to recognize and honor mortgage and payment obligations on or relating to Tribal lands;

    BE IT FURTHER RESOLVED, Schaghticoke Tribal Nation approves and accepts the terms of, and hereby authorizes the Tribal Chief to execute the attached legal services agreement with NPR (POWER OF ATTORNEY AND CONTINGENT FEE AGREEMENT), which is fully incorporated in this Resolution. This approval and acceptance is made pursuant to and in compliance with the Tribe's Constitution, including Article VII (a) (2);

    BE IT FINALLY RESOLVED, Schaghticoke Tribal Nation agrees that should any dispute arise relating to this Resolution or the legal services agreement with NPR, jurisdiction and venue over that dispute lies solely and exclusively in the United States District Court for the District of Connecticut, in Hartford, Connecticut.

    CERTIFICATION This is to certify that the above Resolution #CEV-16 was duly passed by the Schaghticoke Tribal Nation Council in session on June 7, 2016. The said Resolution was adopted pursuant to authority vested in the Council by the Schaghticoke Tribal Nation Constitution.

    I highway laid out in the Country lands on the West Side of Ousatunneck River begun at A heap of Stones four rods West of Said River in the South line of Sharon Township for the West bound of said highway And the East bounds thereof is the South East Corner of Sharon Township by said River Two Hundred and fifty two Rods to A heap of Stones on the West Side of Said highway and four Rods from Said River Thence North 50 degrees West twelve Rods to a Rock with Stones on it then West three Degrees North twenty rods to A Black Oak Pole and Stones laid to it Then S 69 degrees W Eighty rods to A Walnut pole and Stones laid to it Then S 52 degrees W forty rods to A heap of Stones Thence W 11 degrees S to A Rock with Stones on it Thence S 63 degrees W One hundred and twenty Eight rods to A Rock with Stones on it Thence W 7 degrees 3/4 S twenty four rods to A White Oak tree with Stones laid to it Thence W 2 degrees S Sixteen rods to A Rock with Stones on it which is the SE Corner of Lot N'o 13 Thence South 50 Degrees West Twenty Eight rods to A heap of Stones by the North Side of A brook near the W line of Paul Welches and David Nobles land and Said highway to he four rods wide on the Eastwardly Side of the aforementioned Lines and boundaries Thence Running Southerly through Said Welches and Nobles land Seventy Six and to be two rods wide till it comes to the Bank of the aforesaid River Then running South Westerly by Said river (and being two rods wide on the top of the bank on the West Side of Said river) Three Miles and One hundred and Eighty four rods to A Great Black Oak Tree with Stones laid to it Eight rods and an half Northward from the S:E Corner of Cap't Charles Bulkleys Land Then West 17 Degrees North twenty rods to A heap of Stones in Said Buckleys land the highway to be two rods wide on the N Side of the two last mentioned bounds Then South 25 degrees IA West twenty rods to A heap of Stones then South 66 degrees West Twenty two rods to A Meer Stone by the East side of the highway leading from Jonathan Rowleys to the Colony Line and to the South End of the Long Meadow (So called) Said Meer Stone is the South bounds of the highway which We have now been describing the Course of which is to be Two rods wide all the way from the Great Black Oak Tree by the River aforementioned to Said Meer Stone

    II Laid out another highway in the Country lands lying on the West Side of Ousatunnick River lately Annexd to the Township of Kent Began at A heap of Stones in the Colony line near the South End of the Long Meadow Two Miles and One hundred and fourty four Rods Southwards of SW Corner of Sharon And from thence run South 57 degrees East Twenty Nine rods to A heap of Stones Thence South 50 degrees'/ East Twenty Eight rods to A Crotched [p. 612]

    Crotched Black Oak Tree mark't then S 39 degrees E Twenty Nine rods and an half to A black Oak markt by A Rock Then South 18 degrees E thirty three rods to A black Oak markt then S 15 degrees 'A E thirty three rods to A black Oak tree markt by A Rock then S 37 degrees E forty two rods to A White Oak tree markt then S 64 degrees E twenty Seven rods to A Great white Oak tree markt then South 4 Degrees 'A E Eighty Eight rods to A black oak tree markt Then S 21 degrees E fifty four rods to A Rock with Stones on it Then S 40 degrees East Sixteen rods to A heap of Stones which is the N:W Corner of Jonathan Rowleys land this highway is four rods wide lying on the South Westerly Side of the aforementioned "-- '"' ^^—ee le the Stones on A Rock Last mentioned and then to widen gradually till it comes to be Eigh- land last mentioned then running South 20 degrees East by Said Jonathan Rowleys CCLR 4:611 hundred and Ninety rods to A Maple Tree markt then S 30 degrees E Thirty Nine rods

  • The Lot N 24 In the Country Land annexed to the Town of Kent Contains One Thousand Acres Estimated to be in Value Equal to One hundred Acres of Such land as was made the Standard to Size the Lotts by in the Division of Said Country Land Bounded as follows Viz: Beginning at A heap of Stones in the Colony line it being the S:W Corner of Lot N 23 and from thence running South 12 degrees -1/2 West One Mile to A heap of Stones in the Country Line Then East 28 degrees South four hundred & fifty two rods to A rock with Stones on it being the S,W Corner of land laid out to William Williams and Nathan Crearys land by the foot of the Mountain Two hundred and Eighty Six rods to the West line of of Jonathan Rowleys land to A meer Stone Sixteen rods from Said river Then N 20 degrees West One hundred and Seventy rods to the S:E Corner of lot N 23 Then W 10 degrees N three hundred and Seventy two rods to the first mentioned Corner

    The Lot N 26 In the Country Land lying on the West Side of Ousatunneck river on both Sides of A River called the Ten Mile river Contains about Two hundred & forty Acres Bounded as follows Viz: Beginning at the N:W Corner A heap of Stones in the Colony line in the South line of the Country Grant of land which belonged formerly to Cap't John Read forty Eight rods Northward from the Ten Mile river and from thence running S 6 degrees E by Said Grant One hundred and Seventy One rods to A heap of Stones Then North 3 degrees'/ West Seventy Six rods by Said Country Grant to Ousatunneck river Then Extending Southwardly bounding by said River on the East and the Colony line on the West till it comes to the North line of New Fairfield Township And bounding South by Said New Fairfield

    The Lot N 25 In the Country land annext to the Town of Kent lying on the West Side of Ousatunneck river Contains thirteen hundred Acres of land Inclusive of the land Sequstred for the Use of the Indians at Scaticoke Bounded as follows Viz North by the Lot N 24 West by the Colony line East by Ousatunneck river and South by land belonging to an Indian named Wallops Chickens formerly Capt John Reads land The land contained in this Lot Exclusive of the Sequestred land aforesaid is A Rocky Mountain and noway Sufficent for A farm

    The Lot N 27 In the Country land on the West Side of Ousatunneck river Adjoyning to the North End of New Milford Township Contains Five hundred and twenty five Acres with allowance for the highway that is laid out through the Same Estimated to be in Value Equal to Sixty Acres of such land as was made the Standard to Size the Lofts by in the Division of Said Country Land And is bounded was follows Viz: South by Wimmesuck brook which is the North bounds of New Milford aforesaid & West by New Fairfield Township East partly by A Country Grant formerly laid out and confirmed by Pattent to Adoniram Treadwell and North by Lott N 26 it being Seven rods wide at the North End and it is bounded East part of the way by Ousatunneck river towards the North End thereof

    The Surveying and Bounding out all the afore Described Highways and Lots of Land was finished and Compleated the 81h Day of May 1752
