INSURANCE REQUIREMENTS FOR PROFESSIONAL SERVICES

A Certificate of Insurance is to be sent to the Risk Management Department of Mesquite Productions, Inc. reflecting the following insurance coverages (or the equivalent thereof):

Commercial General Liability - $1,000,000. per occurrence $1,000,000. aggregate Automobile Liability - $1,000,000. CSL Automobile Physical Damage Professional Liability - $1,000,000. per occurrence (Re: Contractor Expertise/Advice) $1,000,000. Aggregate

For all of these coverages, provide an endorsement naming Mesquite Productions, Inc., its parent(s), subsidiaries, successors, licensees, related & affiliated companies, their officers, directors, employees, agents, representatives & assigns as Additional Insureds as their interests may appear and as Loss Payees as their interests may appear.

All endorsements required above must indicate that Named Insured's insurance is primary and any insurance maintained by the Additional Insureds is non-contributing to any of the Named Insured’s insurance. A Thirty (30) Day written Notice of Cancellation. non-renewal or material reduction in coverage

The insurance carriers must be licensed in the state in which services are rendered & have an A.M. Best Guide Rating of at least A:VII

We also require the endorsements; the insurance Exhibit does create a contractual obligation. Once I have the revised cert/endorsement, I will revise the Exhibit further to match the insurance paperwork. As the vendor has no employees, the work comp requirements will be waived. The limits are lower than we would normally accept but, as this is the building owner’s preferred vendor, we will accept what the vendor has. 1. Evidence of excess/umbrella liability insurance $2M per occurrence & aggregate 2. Evidence of work comp with statutory limits and employer’s liability with $1M limits. If the company has no employees and therefore is not required by law to maintain this coverage, we just need an email from the vendor confirming that is the case. If that is the case, the work comp wording underlined in item #4 below may be omitted. 3. Professional liability limits are insufficient as we require $5M. The higher limits may be supplied via an excess/umbrella policy. 4. This wording should be added to the Description of Operations box … Mesquite Productions, Inc., its parent(s), subsidiaries, successors, licensees, related & affiliated companies, their officers, directors, employees, agents, representatives & assigns are added as Additional Insureds as their interests may appear and as Loss Payees as their interests may appear. The Named Insured’s policies are primary and any insurance maintained by the Additional Insureds is non-contributory. As respects Worker’s Compensation coverage, a waiver of

Consulting Engineer) Do you think the $1M coverage for GL & Prof Liab enough?  According to Chris, this is the preferred vendor of the property owner.  The vendor, an electrical engineer, doesn’t want to purchase additional coverage as the job is only $2500 so it isn’t worth the extra premium.

The vendor is preparing specs/designs for air conditioning units, stage panels which will increase power for lighting, & electrical service for power to run the higher capacity air conditioning units.  A contractor will then do the actual work/installation based on the designs.  See email string below.  Limits sound a little low to me but doesn’t sound like there are other options as this is the guy the building owner wants.  The only other thought I have is to get the building owner to hire him and we reimburse the cost?

1) Does not have Umbrella coverage. In order to provide this coverage the General Liability Primary Limits must be increased to $1,000,000 Occurrence/$2,000,000 Aggregate which will increase his premium. 2) Insured does not have WC insurance with our agency. If he has never carried WC it will be difficult to place coverage due to “No Prior” 3) Professional Liability limits are $1,000,000. Not sure we can provide up to $5,000,000. It has to be submitted to the carrier for approval. We would have to issue an Umbrella for the Excess over the $1,000,000, but we’d have to increase the GL first as stated above. 4) Description of Operations Wording is ok. 5) Insured does have Blanket Additional Insured Endorsement and Primary/Non Contributory but must have a written contractor with Vendor. the contractor must be licensed/insured in FL 

the terms and limits of the contractor’s insurance must be acceptable to the landlord and must add landlord as additional insured 

the contractor must supply a copy of its license and insurance policies to the landlord before work commences   You should check with the landlord to see if what it will require from Norman F Bray.
