2. Ratificationof the Convention

The Convention on the Prohibition of the Develop-ment, Production, Stockpiling and Use of ChemicalWeapons and on their Destruction,done in Paris on the13thof January, 1993,is herebyratified.

3. Powersof the Ministry of TradeandIndustry

The Ministryof TradeandIndustryis herebyempoweredto undertake,in cooperationwiththe appropriategovern-ment organs, all acts necessary for the imple-mentation of the Convention on the Prohibition of theDevelopment, Production, Stockpiling and Use ofChemicalWeaponsand Ontheir Destruction.

4. Effective Date

This Proclamation shall enter into force as of the 2200day

of February, 1996.

These Regulationsare issued by the Council of Minis-ters pursuant to Article 5 of the Definition of Powers andDuties of the Executive Organs of the Federal DemocraticRepublicof EthiopiaProclamationNo. 4/1995.

1. Short Tide

These Regulations may be cited as the "EthiopianInternational Institute for Peace and Development Es-tablishment Council of Ministers Regulations No- 5/1996."

4. Head OfficeThe Instituteshallhave itsheadofficein AddisAbabaandmay establish branch offices elsewhere as may benecessary.

5. Objectives .

The Instituteshallhave the followingobjectives:1) to undertakeresearchand trainingactivitiesdesigned

to promote cooperation and partnership betweenEthiopia and the International Community with aview to further ensuring strict observance of de-mocraticand humanrights guaranteedto all citizensby the Constitution, further strengthening of theprevailing peace and stability and eDhancing theprogressof economicand social development;

2) to contributetowards strengtheningrelations amongcountriesof the Horn of Africabased on mutual trustand respect and on the promotion of commoninterestsand benefits;

3) to explore the potential for future enhancement of:,security, stability and socio-economicdevelopmentin Ethiopia and the Horn of Africa throughpromotion and assistance in research activities andthe provision of conceptual and practical supportthrough on-goingtrainingprogrammes;

4) to promote cooperation between countries of theHorn ofAfricaand theinternationalcommunitywitha view to strengthening the latter's assistance andsupport in building sustainablepeace and develop-,ment in the region, and to promote the creation andexpansion of relations, based on mutual benefits,with other regions.

6. PowersandDutiesThe Instituteshalfhave the followingpowers and duties:1) to conduct and disseminatepolicy-optionstudies on

issuesrelating,to peace and development;2) to review the implementation and application of, policies and principlespertainingto the building of

democratic institutions, the .observance of humanrights, the maintenanceof peace and security andrelatingto foreignrelatiqnsand,cooperationas wellas the building-ofeconomicand socialdevelopmentwith a view to, based on studies, proposing anddisseminating alternative methods of implemen-tation;

3) to undertake research and studies:and to conducttraining designedto promotedemocraticculture andthe handling of' differences through peaceful anddemocraticmeans, to ensure the strictobservanceofhuman rights, to enhance good governance charac-terizedwithaccountablility,transparencyandpublicconfidence, and to promote the expansion andstrengtheningof dem~atic institutions;

4) to collect and analyzeinformationon issues relatingto peace and development,and to disseminatesameto those concerned';

5) to c°l!tributeand assist in the peaceful resolutionofconfli~tsarisingat nationalor regional level;

'6) to conducttrainingprogrammesdesignedto promotesustainable peace and develoPmentwith particularemphasison peaceful methods of conflict resolutionand peace-keeping;

7) to sponsor special forums such as seminars, work-shops, symposia and conferences to share in-depthknowledgeandpracticalexperience;

8) to establishrelationsof cooperationwith governmen-tal and international agencies, non-governmentalorganizationsandinstitutionshaving similar goals;

9) to publish and distributethe resultsof its studiesandresearchactivities; .

10) to acceptassistahceanddonationsin connectionwiththe'fulfillmentof its objectives;

11) to"fix and collect fees, as may be necessary, forservicesit renders;

12) to ownproperty,enterintocontractsand to sue andbesued in its own name;

13) 'to carry'out such otheractivitiesas maybe necessary.for the'fulfil1Inentof its objectives.,

7. OrgllIlizatjonof the'InstituteThe Institute shallhave:

1) a Board of Tf\.lstees(hereinafter"the Board");2) a Dir~tor and DeputyDirectorto be appointedby the

Ministry;and .

The Chairmanand'other membersof the Board shall be"designatedby the Ministry.

9. PowersandDuties of the Board

The Boardshallhave the powers and duties to:1) direct and supervisethe activitiesof the Institute;2) examine and approve the Institute's study, research

. and;training programmes,'and follow-up the im-plementatiOIl'ofsame; "

3) approve the-Institute's annual budget/and supervisethe implementation of same;

4) approve and follow-up the implementation of theint~fJlalregulationsof the Institute; .

5) deliberat~and decide.on other policy issues to besubmittedto it by the Director;

6) evaluate the performance()fthe.Institute and submitreports to the Ministry together with.its recommen-qations.

10. Meetings of the Board1) The Board shall meet as frequently as the activities of

the Institute 'soref.luire.2) There shall be a quorum where more than.half of the

memberS are present at a meeting ofthe Board.3) Decisions of the Board shall be passed when supported

by a majority vote of members present at the meeting;provided, how~ver, that the Chairman shall have a

11. PowersandDuties of the Director1) The Director shall be the chief executive officer of

the Institute and shall, subject to the general direc-tives of the Board, direct and administer the ac-tivitiesof the Institute.

2) Without limitingthe generalitystatedin sub-Artjcle(1) of this Article,the Directorshall:(a) exercise the powers and'duties of the Institute

specifiedin Article5 of these Regulations;(b) employ and administer employees of the Ins-

titute in accordancewiththe internalregulationsof the Institute to be adopted by the Board inobservance of the basic principles of federalcivil servicelaws;

(c) prepare and submit to the Board the workprogrammes and budget of the Institute, andimplementsameupon approval;

(d) effect expenditure in accordance with the ap-proved budget and work programme of theInstitute;

(e) represent the Institute in all its dealings withthird parties;

(t) prepareand submitto the Board the operationaland financialreports of the Institute.

3) The Director may delegate part of his powers anddutiesto theDeputyDirectorandto otheremployeesof the Institute to the extent necessary for theefficient performance of the activities of the Ins-titute.

12. Budget

1) The budget of the Institute shall be drawn from thefollowingsources:(a) FederalGovernmentsubsidy;(b) grantsand donationsreceivedby the Institute;(c) servicefees collectedby the Institute; and(d) any other source.

2) The fund referredto in sub-Article(1) of this Articleshallbe depositedin a bank accountto be opened inthe nameoftheInstituteandshallbe expendedon theimplementationof the objectivesof the Institute.

13. Books of Accounts1) The Instituteshallkeepcompleteand accuratebooks

of accounts.2) Without prejudice to the powers of the Auditor

Generalvestedin himby law, the books of accountsand financial documents of the Institute shall beaudited annually by external auditors to be desig-natedby the Board.

14. Effective DateThese Regulationsshall come into force on the date oftheir publicationin the FederalNegaritGazeta.
