INTRODUCTION

Since the late 1990s, majority of Government Agencies and Port Operators in Malaysia had switched from manual cargo declarations to electronic declarations using online systems. These online systems were developed to facilitate port users to declare their cargoes and to apply for permits online.

Even though the development of these online systems facilitates the process of declarations and application for permits, but there can be issues arising with the systems due to power failures, unstable internet connection as well as other technical issues faced by the systems.

In order to overcome these problems, the Ministry of Transport (MOT)

has requested all OGA’s, the Port Authority and the Terminal Operators with

online systems to prepare a Fallback Procedure to ensure that the import/

export and transhipment of cargo is carried out as normal without causing

any interruptions to port operations. Port Klang Authority as the regulatory

body was instructed to develop a Fallback Procedure for Systems

1. Careline (DNT) to notify Users on system breakdown with 30 minutes. 2. User to declare K1, K2 and K3 manually on the Customs Prescribed Form in

4 copies. 3. As for K4, K5 and K6, Users shall print CUSCAR and submit to Customs

office by hand for endorsement. 4. For consignments that require license/permit from Other Government

Agencies (OGA), the User shall obtain the license/permit and the respective OGA shall endorse the declaration at the back the Prescribed Form. If there is no requirement of license/permit from OGA, User can proceed to Customs Officer for duties and tax assessment.

5. For consignment that require payment of duties and tax, Users will proceed to the cashier for payment. The cashier will issue the Customs Official Receipt (COR) and endorse documents before it is submitted to the Customs Officer for release of consignment.

6. User must submit the endorsed documents for release of consignment at the port gate.

Note: This fallback procedure if applicable for the following situations: 1. User making new declaration during the system breakdown; 2. Declaration made not registered (no CUSDEC registration number); 3. User made a declaration but did not receive the registration number; 4. System breakdown and no CUSDEC received.

-CUSDEC REGISTRATION NUMBER-

1. Careline (DNT) to notify Users on system breakdown with 30 minutes. 2. Users that have not obtained the CUSDEC registration number is required to

contact Careline (DNT) to obtain the number. 3. If User can obtained the CUSDEC registration number, User to print

temporary declaration on an A4 paper and submit to Customs office by hand for endorsement.

4. If there is no CUSDEC registration number, User to declare K1, K2 and K3 manually on the Customs Prescribed Form in 4 copies. As for K4, K5 and K6, Users shall print CUSCAR and submit to Customs office by hand for endorsement.

5. For consignments that require license/permit from Other Government Agencies (OGA), the User shall obtain the license/permit and the respective OGA shall endorse the declaration at the back the Prescribed Form. 1. Careline (DNT) to notify Users on system breakdown with 30 minutes. 2. If the system experiences a breakdown after User has obtained CUSDEC

registration number and payment has been receipted, User shall print temporary declaration on an A4 paper, together with the CUSDEC registration number and submit to Customs office by hand for endorsement.

3. The JKDM Cashier will note the payment receipt number on the temporary declaration and cross-check with the Audit roll.

4. The Customs Enforcement Officer shall manually endorse the temporary declaration form as proof of cargo release, and will note the registration num-ber into the “Buku Rekod Pelepasan Manual”

Note: 1. In the event SMK is down at a particular Customs station, and is not

experiencing an overall breakdown, the assessment process has to be done electronically (online) at another station under the purview of the similar State Customs Director.

MALAYSIAN IMMIGRATION DEPARTMENT (ENTRY POINT BY SEA) / JABATAN IMIGRESEN MALAYSIA (PINTU MASUK MELALUI LAUT)

1. Immigration Department Careline to notify Users on system breakdown within 30 minutes.

2. User to submit Stowage list (if any) and supporting documents (crew list / passenger list) regarding the arrival/departure of vessel from/to foreign or lo-cal ports to the Immigration Office.

3. Upon the vessel arrival, Immigration Officers will board the vessel and carry out the inspection. Master of the Vessel needs to provide valid travel documents of all crews, passengers (if any) and stowaway (if any), and the documents such as Crew Lists, Passenger Lists (if any), Stowaway Lists (if any), Ship Articles and other documents if requested to the Immigration Officers.

4. Master also needs to declare a no-stowaway declaration form if there is no stowaway on board (arrival) or certify that all crews and passengers (if any) are on board during vessel sailing to next foreign port or local port in Sabah/Sarawak (departure).

5. After the Immigration Officers are satisfy with the inspection, permission to enter Malaysia for all crews and passengers and cargo movements will be given (arrival) or the vessel to leave the port will be given (departure).

6. If the Immigration Officers not satisfied with the inspection, all the crews and passengers will not be allowed to enter Malaysia (arrival). Not To Land (NTL) Notice will be issued to the master of the vessel. All crews and passengers will have to stay on board until the vessel leave the port.

7. In case of departure, the vessel, all crews and passengers are not allowed to leave the port until final decision made by Director General of Immigration Department whether allowing certain crews or all crews and passengers to enter Malaysia (arrival) or allowing the vessel to leave the port with certain crews or all crews and passengers (departure) or decision to open Investigation Paper (IP) for legal action procedures. Letter of hold will be issued to the master of the vessel and cc to the port authority and agent.

8. When the case was settled, letter of release will be issued to the master of the vessel and cc to the port authority and agent.

9. Once permission to enter Malaysia or special approval by the Director General of Immigration Department is given, endorsement will be given on the travel documents and other documents (whichever applicable).

10.The travel documents and all documents related will be delivered back to master of the vessel or agent. The crews and passengers are allowed to enter / leave Malaysia through / from the port.

KEMENTERIAN PERDAGANGAN ANTARABANGSA DAN INDUSTRI (MITI)

1. MITI’s IT Department to notify Export/Import Control Section (SKEI) on the system breakdown within 30 minutes. Breakdown notice will be sent to all ap-plicants via email, published on MITI’s website and a notice will be put up at the SKEI Counter.

2. Users are required to register and update all contact information via email to [email protected]. SKEI will update current status of system breakdown via email and MITI portal every 4 working hours.

3. During system breakdown, all applications, processing and issuance of Approved Permits (AP) will not be carried out manually as it may disrupt the work flow of Other Government Agencies such as Customs Department (JKDM) and Road Transport Department (JPJ).

1. Careline (DNT) to notify Users on system breakdown within 30 minutes. 2. User to submit complete importation documents to Pharmaceutical Officer for

filtering of consignment. If documentation is incomplete then the request to release the consignment will be rejected.

3. Physical inspection (if necessary) on the consignment will be carried out by the Pharmaceutical Officer.

4. If it is in compliance with the Laws, the Pharmaceutical Officer will advise the Customs Department (JKDM) on the approval for importation (permit) by releasing the consignment manually by signing (with the official stamp) and writing down the date of release behind the Customs form. The User must submit one copy of the Customs form and other importation documents to the Pharmaceutical Office.

5. If the consignment is not in compliance with the Laws, a letter of hold will be issued by the Pharmaceutical Office. A written justification is then needed from the Importer and will be submitted to the State Pharmaceutical Office. Any further decision after the letter of hold is issued will be determined by the State Deputy Pharmaceutical Director (Selangor).

6. If permit is not granted by the State Pharmaceutical Office, the consignment will be disposed / returned to the country of origin.

SIRIM QAS HQ (Shah Alam - Building 8) / Branch Offices 3. SIRIM QAS HQ / Branch Office to issue quotation to the User upon receiving

complete application. Payment can be made at the SIRIM Customer Service Centre (Building 25) / Branch Office.

4. After the payment is received, sampling and verification, and testing will be carried out by SIRIM QAS Officers at the port of entry. If consignment fails the sampling and verification, and testing process, a Non-Compliance Letter will be issued to the User (Importer), with MITI and Customs Department in reading.

5. A Certificate of Approval (COA) by SIRIM QAS will be issued for consignments that have passed the sampling and verification, and testing process.

6. The COA and any other relevant documentation will be submitted to the Customs Department for clearance of consignment.

2. User to submit application for Permit together with supporting documents to MTIB Office.

3. Physical inspection on the consignment will be carried out by the MTIB Officer. For consignments that fail the inspection, no endorsement will be given and consignment will be disposed / returned to country of origin.

4. Endorsement (with signature of officer and official stamp, and date of release) at the back on the Import document will be given for consignments that pass the inspection.

4. Endorsement (with signature of officer and official stamp, and date of release) on the export license will be given for consignments that pass the inspection.

4. Certificate of Approval (COA) will be issued for consignments that have passed the inspection.

E-TERMINAL PLUS (eTP), WESTPORTS MALAYSIA SDN BHD

1. Westports to notify User on system breakdown within 30 minutes. An announcement will be displayed on the system and stakeholders will be notified via email.

2. During the eTP breakdown, there will be no transactions allowed for import containers. There will also be no container pick-up during this period.

3. Export containers, however, will be accepted by the Terminal and will be stacked in a dedicated area.

4. Users can do a manual request for Special Service Request (SSR) at the Westports Documentation Centre (WDC). User is required to purchase the manual SSR form and the forms need to be filled and submitted at the WDC.

5. In the event there is a breakdown in the eTP (User level), the User can request for manual gate pass at the WDC. User to submit manual documents with the eDO and Customs Official Receipt (COR) at WDC during the application process.

6. In the event of an urgent release, Users need to obtain approval from relevant Authorities as follows:

i. Manual DO clearance ii. Manual OGA clearance iii. Manual Customs clearance iv. PKA’s approval (free zone transactions) Upon obtaining all clearance, WDC will be able to release the Gate Pass for manual gate-out process.
