    Fatigue ManagementWhat are a rail transport operators fatigue management obligations

    Rail transport operators must prepare and implement a fatiguemanagement program for rail safety workers (Rail Safety Act 2section 20(1)).

    The fatigue management program must be included in theaccredited operators safety management system (Rail Safety A2008 s12 (2)(f)(vi)).

    Rail transport operators and others carrying out railway operat

    have a general duty to ensure, so far as is reasonably practicabthat rail safety workers comply with the operators fatiguemanagement program (Rail Safety Act 2008 s8(2)(d)).

    What are the fatigue management program requirements?

    Specific requirements for fatigue management programs are sein clauses 11-13 of the Rail Safety (General) Regulation 2008.

    The fatigue management program must:

    q Provide for safe hours of work and safe periods of time betwshifts (Hours of work or periods between shifts are taken to be

    if the effect of their implementation is sufficient to eliminate,manage or control risks to safety arising from fatigue)

    q Provide sufficient numbers of rail safety workers for reasonaforeseeable demand

    q Reflect the scope of the operations and address operatingconditions

    q Balance commercial and operational needs with safety duties

    q Review relevant developments in research related to fatigue, and technology that may be applied to manawork-related fatigue

    q Monitor actual hours against the conditions of work (planned hours)

    q Monitor impact of changes from planned rosters due to swapping, overtime or on-call working

    q Assess effectiveness of the fatigue management program using quantitative measures.

    What fatigue-related risks must be taken into account when developing or making changes to a fatigue managemenprogram?

    The rail transport operator must take into account and assess fatigue-related risks arising from:

    r The impact on workers of scheduling of work and rest

    r The impact of work scheduling and relief practices on social and psychological factors that may impacperformance and safety

    r The kind of work undertaken

    r Physiological factors e.g. the effect on alertness and recovery of the time when work is undertaken anlength and frequency of breaks

    r Need for training of workers to identify and manage fatigue

    r Rest environments provided by the operator

    r Work environments

    r Emergencies or degraded or abnormal conditions

    r

    Variations in shifts and rest periods for different routes etc.

    What are the conditions of work prescribed in rail safety legislation for rail safety workers who drive trains?

    Rail transport operators must provide conditions of work for rail safety workers in accordance with Schedule 2(Rail Safety Act 2008 Section 20(2)). These conditions of work apply to rail safety workers who drive trains.

    Schedule 2 details maximum shift lengths, maximum numbers of shifts which may be worked within certainperiods and minimum length of periods between shifts for rail safety workers who drive freight and passengetrains. It also contains provisions to allow extended periods for these workers to return to home depot or resaccommodation as passengers.

    Schedule 2 limits do not apply in the event of particular circumstances ofunavoidable necessity, accidentor

    emergency. Operators should refer to Schedule 2 for definitions of these circumstances.

    Rail transport operators should note that the conditions of work specified by Schedule 2 are minimum standaand do not preclude shorter shifts or more frequent breaks. This means operators must determine what hourappropriate for the particular operating conditions and the risks of the tasks undertaken by their rail safetyworkers who drive trains. In this regard, operator risk management requirements for fatigue managementprograms and hours of work, specified in the Rail Safety (General) Regulation 2008 clauses 11, 12 and 13 apto rail safety workers who drive trains.

    Can I obtain an exemption from compliance with the conditions of work for train drivers specified in Schedule 2?

    Rail transport operators may apply for exemption from some or all of the conditions of work specified in Sche2 of the Rail Safety Act 2008. ITSRR may grant exemptions subject to a written application demonstrating thoperators risk management approach.

    Application requirements and conditions associated with exemptions from Schedule 2 are set out in clause 14the Rail Safety (General) Regulation 2008, and theApproved Form for Applications for Exemption from Sched

    2.

    What fatigue-related information must be reported to ITSRR?

    Rail transport operators must include information on fatigue in their annual safety performance report to ITS

    (Clause 17 of the Rail Safety (General) Regulation 2008).

    This information includes details of the rail transport operators compliance with the fatigue managementprovisions of the Act and Regulations, including compliance with their own fatigue management program.

    Operators exempted from Schedule 2 of the Act should provide details of monitoring procedures and outcomerelation to the exempt operations and any exemption conditions.

    What general safety requirements apply in relation to fatigue?

    Rail transport operators and other relevant persons with duties under rail safety legislation must also ensure their approach to fatigue risk management complies with any general legislative duties and requirements tharelate to management of risk and safety.

    For example, when establishing, reviewing or varying the fatigue component of the safety management systerail transport operator must consult in a way that meets the requirements of section 12(3) of the Rail Safety 2008.

    Advisory guidance can be found in the National Rail Safety Guideline Management of Fatigue in Rail Safety

    Workers. This guideline does not contain mandatory requirements, but may assist operators in complying wit

    the legislation.
