Before radioactive materials can be used at a temporary job site at any Federal facility, the jurisdictional status of the job site must be determined. If the jurisdictional status is unknown, the Federal agency should be contacted to determine if the job site is under exclusive Federal jurisdiction. A response should be obtained in writing or a record should be inade of the name and title of the person at the Federal agency who provided the determination and the date that it was provided. Authorization for use of radioactive materials at job sites under exclusive Federal jurisdiction shall be obtained either by: (1) filing a NRC Form-241 in accordance with 10 CFR 150.20(b), "Recognition of Agreement State Licenses,"; or (2) by applying for a specific NRC license,

Before radioactive materials can be used at a temporary job site in another State, authorization shall be obtained from the State if it is an Agreement State, or from the NRC for any non-Agreement State, either by filing for reciprocity or applying for a specific license.

14. An exemption is granted to the requirements of 1200-2-5-.80(1) of "State Regulations for Protection Against Radiation" for the use of radioactive material at 72-B East Hill Street, Mt. Juliet, TN 37122.

This exemption may be withdramn or modified by the Department at any time it is determined necessary in order to protect the public health and safety or if it is found that the conditions upon which this exemption has been granted have been violated.

15. A. The licensee shall exercise appropriate administrative control to ensure that no person will use or porsonally supervise the use of radioactive material until such person has received instruction in applicable Sections of 1200-2-4, 1200-2-5, 1200-2-8, and 1200-2-10 of "Stale Regulations for Protection Against Radiation", the licensee's written instructions referred to in Condition 16, and in the provision of this license as to possession and use within Tennessee.

B, The Radiation Safety Officer for this licensee is Robert W. O'Neal.

16, Written instructions entitled "Operating and Emergency Procedures" attached to application dated July 17, 1996, with attachments, shall be followed except where they may conflict with "State Regulations for Protection Against Radiation", or specific conditions of this license. A copy of these instructions shall be supplied to each individual using or having responsibility for the use of radioactive material. Any changes in these instructions shall have the prior approval of the Department.

17. An exemption is granted to the requirements of 1200-2-8-.04(10)(a),(d), and (e) of "State Regulations for Protection Against Radiation" to not require the Arnersham Pipeliner Model 1 and associated equipment to meet the requirements of American National Standard N432-1980 "Radiological Safety for the Design and Construction of Apparatus for Gamma Radiography."(published as NBS Handbook 136, issued January 1981) American National Standards Institute, Inc., 1430 Broadway, New York, NY 10018 (ANSI N432).

This exemption may be withdrawn or modified by the Department at any time it is determined necessary in order to protect the public health and safety or if it is found that the conditions upon which this exemption has been granted have been violated.

18. Pursuant to 1200-2-8-.04(5) of "State Regulations for Protection Against Radiation", the licensee is authorized to perform tests for leakage and/or contamination in accordance with procedures contained in application dated July 17, 1996, with attachments,

19. The licensee is authorized to receive, possess, and use sources of Iridium 192 and Cobalt 60 where the radioactivity exceds the maximum amount of radioactivity specified in Item 9 of this license provided:

A- Such possession does not exceed the quantity specified in Item 9 by more than 20% for Iridiumn 192 and 10% for Cobalt 60;

B. Records of the licensee show that no more than the maximum amount of radioactivity per source specified in Item 9 of this license was ordered from the supplier or transferor of the radioactive material;

C. The levels of radiation for radiographic exposure devices and storage containers do not exceed those specified in 1200-2-8 of "State Regulations for Protection Against Radiation."

20, Sealed sources of radioactive material shall not be combined for use to produce a radiation level in

excess of the level produced by the largest source authorized by this license.

21, The licensee shall not open sealed sources containing radioactive material,

22, The licensee shall maintain complete and accurate records of the receipt and disposal of radioactive material. The licensee shall, for radioactive material no longer useful for any purpose and for any equipment or supplies contaminated with such material for which further use and decontamination is not planned, define those materials as radioactive waste and treat them as such in accordance with the following provisions:

A. Radioactive waste material shall not be stored with non-radioactive waste.

B. A written record of all radioactive waste material shall be maintained until it has been determined by a suitable Survey or radioassay that it has decayed to background levels or until it has been shipped to art authorized recipient in accordance with all applicable regulations. Accountability of radioactive waste material prepared for shipment but not yet shipped from the licensee's premises shall be maintained by the licensee by an internal record system such that the licensee is constantly aware of the material's location and the proposed time of shipment,

Individuals who are involved in the shipping of such material and/or the storage of such material prior to shtipment, shall be trained in the precautions necessary for sucnl bandling and storage.

C. For material which has decayed to background lovels as determined by radioasay or external level as measured with appropfiately calibrated instrtunents, records shall indicate that the material was determined to be no longer radioactive and will indicate the methods and results or the survey or analysis,

D. Shipment records of radioactive waste material shall be maintained and the licensee shall require written confirmation from the authorized recipient of such material that this material has been received.

E, All records and written confirmations required by this condition shall be maintained for inspection by the Department.

The requirements for this condition are in addition to any other requirements for the handling and/or disposal of radioactive material contained in this license and "State Regulations for Protection Against Radiation."

23. No provision of this license relieves the licensee from compliance with other Federal, State and local laws, ordinances, and regulations applicable to the licensee's activities

24. Except as specifically provided otherwise by this license, the licensee shall possess and use radioactive material described in Items 6, 8, and 9 of this license in accordance with statements, representations, and procedures contained in application dated July 17, 1996, with attachments, and letter dated July 17, 1996.

26. The licensee shall submit a survey of the four outside walls, including the door, of the new storage vault for radioactive materials. This survey shall take into account occupancy factors, radiation levels in mR/hr (minus background), and hours per year (2000 hours inside the building and 8760 hours at the exterior wall of the building). The survey must take into account the fully audhrized source activities and may take into account source residence time in the storage vault, This survey shall show that radiation levels outside the vault shall not exceed 100 inrem in a year.

To change Condition 24. This condition will now read as follows:

24.
