FMM President, Tan Sri Dr LimWee Chai together with theCouncil Members hosted a dinnerfor YB Dato’ Sri Mustapa Mohamed,MITI Minister on February 23,2017. Also present at the dinnerwere Datuk Seri J Jayasiri,

Secretary General of MITI andsenior officers from MITI, MIDA,MATRADE and SME Corp.

In his welcome remarks, FMMPresident Tan Sri Dr Lim Wee Chaistressed the importance for both

the Government and privatesector to work closely. YB Dato’Sri Mustapa Mohamed concurredwith FMM President on theimportance of such engagementsand acknowledged that he hadlearnt a lot through regularengagements with industry.

In a two-hour Question and Answersession, FMM Council Membershighlighted their concerns arisingfrom the implementation of Goodsand Services Tax, issues related toforeign workers’ levy, introductionof the Employment InsuranceScheme as well as the need toincrease domestic consumptionand boost automation.

The Minister commended FMM fororganising the dinner and said theengagement session was veryuseful and proposed that similarengagement sessions be held withFMM on a regular basis.

A seminar on Free Trade Agreements: What to LookOut For and How to Maximise the Benefits was held onMarch 16, 2017 which was attended by 189 participants.

Seminar speakers included Datuk Isham Ishak, DeputySecretary General (Trade) of MITI and MITI officers,Syahril Syazli, Director of Strategic Negotiation, ZarinaAli, Assistant Director of Trade and Industry Support andMohd Firdaus Agus, Certified Trainer from Dagang NetTechnologies. Participants were briefed on the recentchanges to preferential trade forms and how tomaximise the tariff advantage through the use ofCertificates of Origin. Participants were also providedwith examples of calculation of rules of origin todetermine the local content of the product. DagangNet Technologies explained the correct proceduresto participants on how to apply for the PreferentialCertificate of Origin and the common mistakes madeby applicants.

The FMM LEAN Manufacturing Series is a series ofworkshops conducted by experienced trainerswho share their know-how on best practices inimplementing LEAN with FMM member andnon-member companies.

The inaugural workshop of the FMM LEANManufacturing Series on Food & Beverage (F&B)was held from January 16 to 17, 2017 to educateparticipants on how Value Stream Design could beimplemented in the F&B industry to reduce overalloperating costs. A total of 14 participants attendedthe workshop conducted by Shaharum Ashaari,a continuous improvement specialist of LEAN with16 years of experience in LEAN and Six Sigmadeployment in various industries.

Display Ad targeting capabilities.Participants were introduced toways in integrating digital in theirmarketing campaigns and long-termstrategy for digital transformation.

After the briefing, FMM memberswere invited to a walkabout in GoogleMalaysia office. Google Malaysia isconsistently named as one of thebest companies to work for. In order topromote a work-life balance among its

employees, Google houses a gameroom that provides employees withentertainment such as pool tables,ping-pong tables, foosball tables, videogame rooms etc. to destress! It alsofeeds its employees three free gourmetmeals a day.

In January 2017, FMM, Technicaland Vocational Education Division(TVED), Ministry of Education (MOE)and Industry Talent ManagementDivision, Malaysian InvestmentDevelopment Authority (MIDA)launched the ApprenticeshipProgramme Pilot Project.

The Apprenticeship Programme isaimed at addressing the perennialshortage of technical skills highlightedby FMM members. The programmeis a fast-track effort to developvocational skilled workers thatcan be directly assimilated into industry.Students would be trained up to leveltwo or three of the Malaysian SkillsCertification (MSC) through coursesconducted by the Vocational Colleges(VC) under the purview of MOE.

The inaugural intake of 36 studentsat 16 years of age currently in thenational school system for the pilotproject was recruited via a jointinterview session between participatingcompanies and the VC at Sungai Bulohon January 18, 2017. A total of fivemember companies are participatingin the pilot project and the studentswould be placed at the respective VCfor the following courses being offered.(See Table A below)

The Apprenticeship Programme isimplemented based on the NationalDual Training Scheme i.e. throughacademic studies and industrialtraining. At the end of the two-yearprogramme, the students are expectedto achieve the award of MSC atlevel two or three depending on thecourse of study. The structure of theApprenticeship Programme wouldbe six months of academic studyfollowed by another six months ofindustrial training for each year of thetwo-year programme.

This structure allows the companiesto extend the period of training forthe apprentices until they reach theage of 18 to be legally employed.Companies are given the option toemploy the apprentices at the end ofthe programme.

The Apprenticeship Programme alsoprovides students with the optionto take the SPM examination forBahasa Malaysia and History subjectswhich are in line with the SPMcurriculum. Other academic subjects

adhere to the vocational streamcurriculum. The students will betrained on the basic vocational skillsduring the first six months of theprogramme prior to their practicalindustrial training at the companies.

The students are covered by insurancepolicy by Takaful Scheme which MOEundertakes for all students. Companiesmay also provide insurance coverage tothe students under their own insuranceprovider during the period of industrialtraining at the company. The companiesare required to provide allowances forthe students at a minimum rate of RM500per month during the industrial training.

The students selected were fromthose who live around the vicinityof the companies that they would beattached to facilitate their commutefor practical industrial training, while atthe VCs, the students would be placedat hostels, if required.

Get Your Preferential Certificates of Origin from

The Federation of Malaysian Manufacturers (FMM) has been authorised by the Ministry of International Tradeand Industry to be the sole distributor of the Preferential Certificates of Origin (PCO). The PCOs are used to apply

for preferential tariff reduction for products offered under the Free Trade Agreements between Malaysia andpartner countries, provided the rules of origin are fulfilled.

Amendments to the Goodsand Services Tax Act 2014The new Finance Act 2017 hasintroduced changes to various otherlegislations including the Goods andServices Tax Act 2014. Amendments tothe GST Act which came into effecton January 1, 2017 include: 

• Disallow the registered person fromissuing tax invoice which shows thatGST 6% charged for zero rated supplyor on any supply of goods or serviceswhich is not a taxable supply;

• When goods are removed fromfree zone to Principal CustomsAreas including to another freezone, it would be treated as animportation into Malaysia. However,movement of goods from onefree zone to another free zone,designated area or a warehouseunder Section 70, the paymentof GST would be suspended;

• The time of supply of importedservices shall be treated to havebeen made at the followingdates,whichever is earlier:

– The date when any payment ismade by the recipient;

– The date when any invoice isreceived from the supplier whobelongs in a country other thanMalaysia or who carries outbusiness outside Malaysia;

• Impose penalty on the amount oftax that remains unpaid instead ofthe amount of tax due and payable.

GST Relief on All ReusablePackaging MaterialEffective January 1, 2017, the GST ReliefOrder has been amended to grant GSTRelief on reusable packaging material:

• Exported and subsequentlyreimported; or

• Imported for the purpose of refillingwith the goods and subsequentlyre- exported; or

• Filled containers on their secondand subsequent importation and inthe case of foreign manufacturedcontainers, imported with theircontent intended for local use andsubsequently re-exported empty.

Submission of K9 RequiresFull Tax InvoiceFor the movement of goods, LMWcompanies are required to issue afull tax invoice for the total amountof the goods sold and this will triggerthe time of supply. The full tax invoiceshould be submitted with the K9declaration (movement of dutiablegoods from FZ/LMW to PrincipleCustoms Area (PCA). 

No Suspension of GSTfor Supplier OwnedInventory under ApprovedTraders SchemeThe Approved Traders Scheme (ATS)cannot be used to suspend GST ongoods under Supplier Owned Inventory(SOI)/goods owned by supplier exceptunder GST Regulation 88(1)(e) wherethe ATS company is also an approvedtoll manufacturer under the ApprovedToll Manufacturing Scheme (ATMS)

However under GST Regulation 88(1)(g)an application may be made to theMinister to allow the GST suspension. 

Renewal of Approved TradersScheme (ATS) LicenseThe renewal of the ATS license wouldbe possible 6 months prior to expiry.Members with ATS license are advisedto submit their renewal applications assoon as possible as they would besubject to a thorough vetting process. 

Outstanding Input Tax Claims The Customs Department has clearedthe backlog of refunds. However, thereare companies that amended theirreturns after filing and this will delaythe refund process. .

The enforcement of the Card (E-Card)/Temporary Card Programme for illegalimmigrants/Pendatang Asing TanpaIzin (PATI) is from February 15, 2017until June 30, 2017 and is applicable forPeninsular Malaysia only. The E-Card isvalid until February 15, 2018. Duringthis one-year period, employers are toapply for their workers’ (PATI) passportsfrom their respective embassies andwork permits.

Registration for the E-Card is FREE butmust be done by the employer of thePATI and can be done at ImmigrationPutrajaya and all State Immigrationoffices. The programme is for theplantation, agriculture, manufacturing,construction and services sectors andopen to male and female PATI from15 source countries i.e. Bangladesh,Cambodia, India, Indonesia, Kazakhstan,Laos, Myanmar, Nepal, Pakistan,the Philippines, Sri Lanka, Thailand,Turkmenistan, Uzbekistan and Vietnam.

The PATI, in order to qualify for theE-Card, must fulfil certain conditionsincluding working with an employer,no criminal record, passed medicalexamination and not on Immigrationblacklist. The E-Card however is notapplicable for the following:

• PATI’s dependents – they shouldsurrender themselves at the nearestImmigration Office – EnforcementDivision for repatriation underVoluntary DeportationProgramme/Program PATI Serah DiriSecara Sukarela Untuk Kembali KeNegara Asal or “3+1 programme”,where the PATI will be compoundeda flat rate of RM300 plus RM100(for a one-way pass return home).

• UNHCR cardholders.

The Immigration Department will makethe final decision on the approval of theE-Card. Employers who continue toemploy PATI who are not registered

under the E-card programme or anyother programme currently enforcedby the authorities will be penalisedin accordance with Section 55 (B) ofImmigration Act 1959/63 as follows:

• Fine not less than RM10,000 andnot more than RM50,000; or

• Imprisonment not exceeding12 months; or

• Both.

A certificate presentation ceremonyofficiated by YB Dato’ Seri Ong Ka Chuan,Second Minister of International Tradeand Industry held on October 25,2016 marked the end of the UNIDO –Industrial Energy Efficiency in MalaysianManufacturing Sector (IEEMMS)programme. Also present at theceremony were YB Datuk Haji AhmadMaslan, Deputy Minister, Ministry ofInternational Trade and Industry (MITI)and S. Sanjaya, Industrial DevelopmentOfficer, UNIDO Headquarters and seniorofficers from MITI and the MinistryEnergy, Green Technology and Water.The ceremony was held to acknowledgecompanies, individuals and organisationsthat took part in the programme.

The UNIDO-IEEMMS programmewhich commenced in June 2011attracted participation of more than300 Malaysian companies from varioussub-sectors, of which 40% weremedium-sized industries. During theceremony, 54 factories were givenCertificates of Appreciation for hostingthe Energy Management Systemand Systems Optimisation ExpertProgrammes. Certificates of Achievementwere awarded to participants under

the Expert Programmes, namelyEnergy Management System (EnMS),Compressed Air System Optimisation,Fan System Optimisation, PumpSystem Optimisation and SteamSystem Optimisation.

In his keynote address, the Ministerurged industries to develop actionplans to continually improve energyperformance which could lower theiroperating cost and reduce greenhousegas (GHG) emissions. The programmeestimated a total amount of GHGemission reduction over a seven-yearperiod to be at -19,000 kt CO2/year(estimated from initial energy savingdata collection), which includedelectrical and thermal savings.

The project team concluded that theEnMS and Systems Optimisationprogramme had helped to “soften theground” and was able to demonstrate realbenefits to the industry and governmentstakeholders. Implementation of theEnMS and Systems Optimisation has alsoencouraged companies to move towardsISO 50001 certification and to focus onthe sustainability of the system andenergy saving activities.

TheMAEESTA project specifically focuseson thermal energy efficiency and solarthermal applications in the industrialsector and aims to establish a solarthermal technology deploymentroadmap by the first quarter of 2018.This programme will collaborate withthe Government, academia, bankers,end-users and industry to propose awide range of policy instrumentssuch as a regulatory framework,economic and fiscal incentives andpartnership to further encourageprivate sector investments in thisnew emerging technology. On January 10, 2017, FMM SMI WorkingCommittee organised a factory visit toPacestar Industries (Selangor) Sdn Bhdlocated at Telok Panglima Garang,Selangor Darul Ehsan. A total of29 representatives from 16 membercompanies participated in the visitled by Ir A K Woo, Vice-Chairman of FMMSMIs Working Committee.

Pacestar Industries (Selangor) Sdn Bhd isa manufacturer of precision engineeredcomponents with its Head Officelocated in Johor. Participants had theopportunity to view the automatedsurface finishing curtain coatingprocess. The curtain coating is theprocess of applying a thin layer ofpaint onto a flat surface of the metalsheet to be stamped without breakage,scratches and greases. Participants werealso given a tour of the metal stampingand silk-screen printing section. The visitconcluded with a networking tea break.
