RECOMMENDATIONS Municipal Licensing and Standards, Scarborough District, recommends that the Scarborough Community Council: 1. Refuse the application for exemption from Chapter 447-2 Fences, of the Toronto Municipal Code, to allow the existing and offending flankage and rear yard fences of 197 Ellington Drive. 2. Confirm the notice and direct that a second notice be given under this article. FINANCIAL IMPACT There is no financial impact anticipated in this report. DECISION HISTORY The City of Toronto Council enacted the amalgamated By-Law 472-2000 on July 6, 2000 to prescribe the height and description of fences on private property and to require owners' of privately owned outdoor swimming pools to erect and maintain safety fences

SUMMARY

RECOMMENDATIONS

and gates around private swimming pools. This By-Law and the amendments are now found in the Toronto Municipal Code Chapter 447.

ISSUE BACKGROUND

This is a single family detached residential property located south of Ellesmere Road and east of Warden Avenue in the subject Ward (Attachment #1). The Municipal Licensing and Standards Division has received an application from the property owner seeking relief for the flankage and rear yard fences on the subject property constructed of wood/board that exceeds the permitted heights found in the Fence By-law, Chapter 447.

The property owner is seeking relief for the existing south and west elevation fences which exceed the 2.0 metre height restriction. The existing west and south elevation flankage and rear yard fences are approximately 2.29 metres in height (Attachments #2, 3 and 4).

COMMENTS

The Municipal Licensing & Standards Division received a complaint on August 29, 2013 regarding the height of the rear yard fences. A subsequent inspection was conducted and a Notice of Violation was issued dated October 9, 2013. The property owner submitted an application, including three letters of support to be exempt from the bylaw that requires the fences in the rear yard to be at a maximum height of 2.0 metres and allow the existing board fences to remain stating that it is to provide privacy, noise attenuation and safety for their property. The existing/offending rear yard fences measure approximately 2.29 metres in height.
