PROCLAMATION BY HIS HONOUR OIJSBERT REITZ HOFMEYR, A COM-

PANION OF ,THE MOST DISTINGUISHED ORDER OF SAINT , MICHAEL AND SAINT GEORGE, AD-MINISTRATOR OF SOUTH WEST AFRICA.

WHEREAS it is expedient to amend Proclamation of the Administrator of the Protectorate of South West Africa dated the 19th day of January 1920 entitled'the "Deeds Registry Proclamation 1920";

NOW THEREFORE, under and by virtue of the powers in me vested, I do hereby proclaim, declare and make known as follows:-

1. In this Proclamation the expression "the principal Pro-clamation" means . the Deeds Registry Proclamation 1920, and the expression ".the Deeds Registries Act 1918" means the Deed~ Registries ,Act 1918 of the Union Parliament as applied to this Territory by the said Proclamation. Any expression to _which . in the principal Proclamation a meaning has been assigned m and for the purposes thereof bears, when used in this Proclamation, ,the same meaning.

2. Sub-section , (1) of Section one of the principal Pro-clamation shall be and is hereby amended by the deletion of the words "together with the regulations and schedule of fees framed thereunder" ..

3. S~ction three of the Deeds Registries 'A.ct 1918 shall be and 1s hereby amended by the deletion of paragraph (j) and the substitution therefor of the following new paragraph (j):

"(j) register, when lawfully made, mijnpachts, grants of rights to minerals, or precious stones, and notarial cessions, ,notarial leases and notarial cessions of leases of such rights".

.1.. B~- the addition at the end of sub-section (1) thereof d the following words:-

··Provided further that where any one owner is t:!ltitled ·under the agreement of partition to receive aore than one defined portion, the Registrar may !i=iue one Certificate of Partition Title in accord-ance wjth one or more diagrams, and may permit the registration for such defined portions, in accord• anc~ _\\ith one or more diagrams, of one deed of parnuon transfer".

B. By t~e insertion in sub-section (2) thereof, after "defined portion" of the words "or portions".

5. The regulations framed under the Deeds Registries Act 1918 shall as from the first day of July 1923 cease to be of force and effect except in so far as they relate to any act matter or thing done or performed thereunder, and as fro~

ministrateur van het Protektoraat van Zuidwest Afrika ge-dateerd de 19de dag van Januarie, 1920, genaamd de "Registratie van Akten Proklamatie 1920" te wijzigen;

ZO IS HET, dat ik onder en krachtens de macht mij verleend, hierbij proklameer, verklaar en bekend maak als Voigt:- .

1. In deze Proklamatie betekent de uitdrukking "de Hoofd Proklamatie" de Registratie van Akten Proklamatie 1920 en de uitdrukking "de Registratie van Akten Wet 1918" de Re-gistratie van Akten Wet, 1918, van het Unie Parlement, toe-gepast op dit Oebied door voornoemde Proklamatie. Enige uitdrukking, waaraan in de ttoofdproklamatie een betekenis gegeven is voor de doeleinden van dezelve, zal, indien in deze Proklamatie gebruikt, dezelfde betekenis hebben.

2. Sub-artikel (1) van Artikel e en van de Hoofdproklamatie zal zijn en is hierbij gewijzigd door weglating van de woor• den "te samen met de regulaties en bijlage van fooien onder dezelve opgetrokken".

3. Artikel d r i e van de Re_gistratie van Akten Wet 1918 zal zijn en is hiermede gewijz1gd door weglating van para-graaf (j) en de vervanging er van door de volgende nieuwe paragraaf (j):

"(j) registreren, jndien wettig gemaakt, mijnpaehten, kon-cessies van .rechten op miner-alen of edelgesteenten en notariele cessies, notariele pachten en notariele cessies van .pachten van zulke rechten."

4. Artikel a ch t van de Registratie van Akten Wet 1918 zal zijn en is hiermede gewijzigcl als volgt:-

A. door toevoeging aan het einde van sub-artikel (1) van dezelve van de volgende woorden :-

"Verder met dien verstande dat waar enige ei-genaar, onder de overeenkomst van verdeling berechtigd is, meer dan een bepaald dee! te ont• vangen, de Registrateur een Certifikaat van Titel van Verdeling kan uitgeven overeenkomstig een of meer kaarten en de registratie van zulke bepaalde gedeelten, overeenkomstig een of meer kaarten kan goedkeuren, van een akte van verdeling trans• port."

B. Door toevoeging in sub-sektie (2) van dezelve na "bepaald gedeelte" van de woorden "of gedeelten'':

5. De regulaties opgetrokken onder de Registratie vaii Akten Wet 1918 zullen van af de eerste dag van Julie 1923 ophouden van kracht en uitwerking te zijn, behalve in zoverre als zij be.trekking hebben op enige wet, zaak of ding onder dezelve gedaan of uitgevoerd, en zullen van af voornoemde datum de regulaties, opgetrokken ter vervanging er van en

the said date the regulations framed in substitution therefor and publish:ed (under Union Government Notice No. 1630 dated the .sixth day of October 1922 shall, as far as circum• permit and subject to the emendments set fo1th in Schedule "A" to the principal Proclamation and in so far as they are not in conflict with any regulation promulgated by the Administrator in pursuance of the powers conferred upon him by section s eve n of the principal Proclamation, be of force and effect.

-6. This Proclamation shall be read as one with the princiIJal Proclamation and may be cited for all purposes as the "Deeds Registry Proclamation 1920 further Amendment Proclamation 1923" and shall commence and take effect on the first day of July 1923.

The successful tenderer for ·any of the holdings on which the boundaries or part thereof ~e fenced, shall accept liability under any law relating to fenCJ~ in South West Africa, for any amount which ma,y be claimed by adjoining owners in terms of the said law.

The ownership of land in South West Africa does not include the ownership in minerals and precious stones in, on: or under such land. All the above farms are .open to pro-specting and pegging by any person duly authorised thereto in accordance with the provisions of the Imperial Mining Ordinance 1906, .as amended by Proclamation No. 24 of 1919. 2. 6. Advertenties moeten, voor zoverre mogelik, op de machine geschreven zijn. Bij geschreven advertenties moel alleen op een kant van het papier geschreven warden, en alle namen moeten duidelik zijn; ingevaf een naam ingevolge onduidelike handschrift foutiev wordt gedrukt, kan de adver• tentie slechts dan weer gedrukt warden afs de kosten van een meuw · plaatsen betaald warden.

7. Het jaarlikse intekengeld voor de Officiefe Koerant is 12/-, postvrij in dit Oebied en de Unie van Zuid-Afrika, en in het vooruit betaalbaar.
