:1. (l) Thestatecovcrnmentslrallwithinaperiodofdneemondsfrom the datc ofcominencemcnt ofthis Ac! clnstitute, by

notifioatiorL a body to be known as the Nagaland women

Commission to perform the functions assigned, and, to

oxcrcise powers conferred upon it, under this Act

(2) l hc Co[unission shall consist ofa ChaiMoman and two

women members to be nominated by the State

Covemment. who shall be persons ofeminence with

su flicient knowledge and experience in women related

issues.

(l ) One oflhe seniorMernben, and ifboth are equally seoior,

one ofthem at the discretion ofttle State Goverr)meot,

shall be designated as the Membsr-S$retary of the

Commission.

(2) Thc Chairwoman, the other Member and Member-Secretary may resign their offices on their own accord atany time by tenderirg the resignation to the StateGovenrnent and their r€signation will b€ etrective from$le date ofnotification in tlle olEcial gazette.

(3) On a c4mplaint made by any person, the Chairwoman orthe other Member or the Member-secretarv shall heronoved tom oiice, ifshe,-

(") becomesundjschargediosolvent;

(b) is convicted and sartenced to inrpdsonment for an offencewhich in the opinion oftle State C,ovemrnent involves moralturpitude;

(c) becomes of uEsound mind and stands so declarerl by acompetent cout;

(d) refuses to act or becomes incapable ofacting;

(e) is, withour obtaining leave ofabsence from thc StatcGovernrnent, absent fiom threc consecutivc meetings ol.the Commission; or

(f) has abused the ol'fice, in the opinion ofth€ StareGovemment, so as to render her unfi1to hold the officeruryfitticr

Provided no person shall be removed Fom office until aritrquiry, as perrules to bemade by the State Govemmenl. hasbeen held and concludcd within thrce monrhstiom the date oIreceipt ofa complaint seeking her renoval.

(4) Any vacancy in the o ffices ofthe Chairwoman ot the otherMember or the Member-Secretary shall be filled wirhin ttreemonth$ ofthe occnrrence ofthe vacancy.

(5) The remuerzrion and other facilities thet may b€ prov.idcd totbe Chairwornan, the other Mernber and Member-Secrrtaryofthe C-ommission shall be as prescnbed by rules to b! mndeby the Star e Covemment
