    An Act to am end th e Sexual Offences Act, 1986

    2. In this Act, Act means the Sexual Offences Act,

    1986.

    3. Sect ion 2 of the Act is amended by insert ing ina p p r o p r i a t e a l p h a b e t i c a l o r d e r t h e f o l l o w i n g

    definitions: coh a b i t a n t m ea n s a p er s on i n a

    cohabita t ional relat ionship in accordancew ith th e Coha bitat iona l Relat ionships Act,

    1998;

    grievous sexua l a ssa ult mea ns

    (a )the penetra tion of the vagina or a nus of

    the compla inant by a body par t o therthan the penis of the accused or thirdperson as t he ca se may be;

    (b)the penetra tion of the vagina or a nus oft h e c o m p l a i n a n t b y a n o b j e c t

    manipu la ted by the accused or th i rdp e r s o n , a s t h e c a s e m a y b e , e x c e p t

    when such penetration is accomplishedfor medica lly recognised tr eatm ent;

    (c)the placing of the penis of the accusedor th i rd person , a s the ca se may be ,

    into the m outh of th e complaina nt; or(d )the placing of the mouth of the accused

    or t hird person a s th e ca se may be, ont oor into the vagina of the complaina nt.

    4. Section 4 of the Act is repealed and the followingsection is substituted:

    4. (1) Su bject to subsection (2), a person(th e a ccused) commits th e offence of ra pe

    w h e n h e h a s s e x u a l i n t e r c ou r s e w i t ha noth er person (th e compla ina nt )

    (a )w i t h o u t t h e c o n s e n t o f t h ecomplainant where he knows that

    the complainant does not consentto t he int ercourse or h e is reckless

    a s t o w h e t h e r t h e c o m p l a i n a n tconsents; or

    (ii) is obta ined by personat ing

    someone else;

    (iii) i s o b t a i n e d b y f a l s e o r

    f r a u d u l e n t r e p r e s e n t -

    at ions as to the nature of

    th e int ercourse; or

    (iv) is obta ined by unlaw fully

    detaining the complainant.

    (2) A person who commits the offence

    o f r a p e i s l i a b l e o n c o n v i c t i o n t o

    i m p r i s o n m e n t f o r l i f e a n d a n y o t h e r

    punishment w hich ma y be imposed by law,

    except tha t if

    (a )the complainant is under the age

    of tw elve years;

    (b)the offence is committed by two ormore persons acting in concert or

    w i t h t h e a s s i s t a n c e o r i n t h e

    presence, of a th ird person;

    (c)t h e o f f e n c e i s c o m m i t t e d i n

    p a r t i c u l a r l y h e i n o u s c i r c u m -

    stances;

    (d )the compla inant was pregnant a t

    t h e t i m e o f t h e o f f e n c e a n d t h e

    a c c u s e d k n e w t h a t t h e c o m -

    plaina nt w as pregna nt ; or

    (e)the accused has previously been

    conv icted of th e offence of ra pe,

    he shall be liable to imprisonment for the

    rema inder of his na tura l life.

    (3) The Cour t or body may order a

    p e r s on w h o i s c on v i c t e d o f a n o ff e n c eunder this Act, to pay to the complainant

    adequate compensat ion which shall be a

    charge on the proper ty o f the person so

    convicted.

    (4) The provisions of subsection (3)

    shall not deprive the complainant of the

    right to claim compensation in any other

    C o u r t , s a v e t h a t t h e C o u r t t h a t a w a r d s

    further compensation may take the order

    under subsection (4) into account when it

    makes a further awa rd.

    ( 5 ) T h i s s e c t i o n a l s o a p p l i e s t o a

    husband in relation to the commission of

    th e offence of ra pe on h is w ife.

    (6) I n s u b s e c t i o n ( 5) h u s b a n d o r

    w i f e i n cl u d es a coh a b it a n t w i t h i n t h e

    m e a n i n g o f t h e C o h a b i t a t i o n a l

    Relationships Act, 1998..

    5. The follow ing s ection is insert ed a fter section 4:

    4A. ( 1) S u b j ec t t o s u b s e c t i o n ( 2 ), aperson (the accused) commits the offence

    commits the act on another person ( the

    complainant)

    (a )w i t h o u t t h e c o n s e n t o f t h e

    complainant where he knows that

    the complainant does not consent

    to the ac t or he is reckless as to

    or

    (b)w i t h t h e c o n s e n t o f t h e

    complaina nt wh ere the consent

    (2) S ubs ections (2) t o (4) of section 4

    applies, mu tat is mu tandi s, to the offence

    of grievous sexua l assa ult a s it does to the

    offence of ra pe.

    ( 3 ) T h i s s e c t i o n a l s o a p p l i e s t o a

    husband in relation to the commission of

    the offence of grievous sexual assault on

    his w ife.

    (4) I n s u b s e ct i o n (3 ) h u s b a n d o r

    w i f e i n c l u d e s a c o h a b i t a n t w i t h i n

    t h e m e a n i n g o f t h e C o h a b i t a t i o n a l

    Relationships Act, 1998..

    6. Section 5 of the Act is hereby repea led.

    7. Section 7(1) of the Act is a mended by deleting t he

    word five and substituting the word twelve and by

    a dding a fter the w ord year s in line five the w ords for

    a first offence and to imprisonment for fifteen years for

    a subsequent offence.

    8. Section 9(2)(b)of the Act is amended by deleting

    the words ten years and substituting the words life

    imprisonment.

    9. Section 10(2)(b)of the Act is amended by deleting

    t h e w or d s t e n y e a r s a n d s u b s t i t u t i n g t h e w or d s

    tw enty-five yea rs.

    10. Section 11(1) of the Act is amended by deleting

    11. Section 12(1) of the Act is amended by deleting

    t h e w or d s t e n y e a r s a n d s u b s t i t u t i n g t h e w o r d s

    tw enty-five yea rs.

    12. The Act is amended by inserting after section 12

    th e follow ing new section:

    12A. A po li c e o ff i ce r m a y t a k e i n t o

    cus tody , w i thou t war r an t , a person who

    has committed, or who the police officerhas reason to be l ieve has commit ted an

    offence under section 6, 7, 8, 9, 10, 11 or

    12..

    13. S e c t i o n 1 3 (1 )(b )o f t h e A c t i s a m e n d e d b y

    de le t ing the words t en yea r s and subs t i tu t ing the

    w ords t w enty-five years.

    14. Section 14(1) of the Act is amended by deleting

    t h e w or d s t e n y e a r s a n d s u b s t i t u t i n g t h e w o r d s

    fifteen year s.

    15. Section 15(1) of the Act is amended by inserting

    a f t e r t h e w o r d s f i v e y e a r s t h e w o r d s f o r a f i r s t

    o f f e n c e a n d t o i m p r i s o n m e n t f o r t e n y e a r s f o r a

    subsequent offence.

    16. S e c t i o n 1 6 ( 1 )( a )o f t h e A c t i s a m e n d e d b y

    insert ing after the words ten years the words for a

    first offence and to imprisonment for fifteen years for a

    subsequent offence.

    17. The Act is amended by inserting after section 29th e follow ing new section:

    18. The Act is amended by repealing section 31 and

    inserting the following new section:31. (1) Any person who

    (a )i s t h e p a r e n t o r g u a r d i a n of a

    minor;

    (b)has the actual custody, charge or

    cont rol of a minor;

    (c)has the temporary custody, care ,

    charge or control of a minor for a

    special purpose, as his attendant,

    e m p l o y e r o r t e a c h e r , o r i n a n y

    other capa city ; or

    (d )i s a m e d i c a l p r a c t i t i o n e r , o r a

    reg is tered nurse or midwife , and

    h a s p e r f o r m e d a m e d i c a l e x a m -

    ina ction in respect of a minor,

    a n d w h o h a s r e a s on a b l e g r ou n d s f o r

    believing that a sexual offence has been

    committed in respect of that minor, shall

    report th e grounds for h is belief to a police

    officer a s soon a s rea sona bly pra ctica ble.

    (2) An y p er s o n w h o w i t h o u t

    reasonable excuse fails to comply with the

    requirements of subsection (1), is guilty of

    a n o f f e n c e a n d i s l i a b l e o n s u m m a r y

    convic t ion to a f ine o f f i f t een thousand

    dollars or to imprisonment for a term of

    s e v en y e a r s o r t o b ot h s u c h f i n e a n d

    imprisonment.

    (3) No report ma de to a police officer

    u n d e r t h e p r o v i s i o n s o f s u b s e c t i o n ( 1 )s h a l l , i f s u c h r e p o r t w a s m a d e i n g o o d

    fa i th for the purpose of complying wi th

    those provisions, subject the person who

    made the repor t t o any ac t ion , l i ab i l i t y ,

    31A. Where a person prevents a minor

    from

    (a )giving a st a tement to th e police; or

    (b)testifying,

    in proceedings relating to a sexual offence,

    he commit s an o f fence and i s l i ab le on

    summary convic t ion to a f ine o f twenty

    thousand dollars and to imprisonment for

    a term of ten years.

    31B . (1) Without prejudice to any oth erwrit ten law, where the Court is sat isf ied

    t h a t a m i n o r i s be in g p r e v en t e d f r o m

    giving evidence and where a statement is

    made in any writ ten form or manner by a

    minor, or writ ten in any form or manner

    by another person on behalf of the minor,

    and upon the dictation of the minor, that

    sta tement may be admissible in a t r ia l as

    evidence of any fact of which direct oral

    evidence of th e minor w ould be a dmissible.

    (2) Th e C o u r t m a y a d m i t i n t o

    evidence the following statement made by

    a minor:

    (a ) a s ta tement made to and wr i t ten

    by t he police;

    (b) a statement made in the form of a

    sta tutory declara t ion;

    (c) a sta tement writ ten by the minor

    himself;

    (d ) a s t a t e me n t w r i t t e n b y a n o t h erperson on behalf of a minor who

    can not write .

    (3) The followin g provisions sh a ll

    (e) i f t h e s t a t e m en t r e fe r s t o a n y

    other document , the copy of the

    party to the proceedings shall be

    document or by such information

    (4) Th e p r o s e c u t i o n s h a l l g i v e a

    copy of the sta tement to an y oth er pa rty t o

    the proceedings ten clear days before the

    prosecution tend ers it int o evidence.

    (5) Any document or object referred

    to and ident i f ied in a wr i t ten s ta tement

    tendered in evidence under this sec t ion

    sha ll be trea ted a s if it ha d been produced

    as an exhib i t and ident i f ied in Cour t by

    the w itness.

    (6) A m i n o r w h o s e w r i t t e n

    statement is tendered in evidence under

    this sect ion shall be treated as a person

    w ho had been examined by th e Court.

    31C . (1) Without prejudice to any other

    writ ten law, where a sta tement , referred

    to in section 31B , appears to the Court to

    ha ve been prepa red for th e purposes of(a ) pending or contemplated criminal

    proceeding s; or

    (b) a criminal investigat ion,

    t h e s t a t e m e n t s h a l l n o t b e t e n d e r e d i n

    ev idence in a t r i a l w i thou t le ave o f the

    Court, and the Court shall not give leave

    u n l e s s i t i s o f t h e o p i n i o n t h a t t h e

    s t a t e m e n t o u g h t t o b e a d m i t t e d o n t h e

    int erest of justice.

    (2) I n c on s i d e r i n g w h e t h e r t h e

    a d m i s s i o n o f a s t a t e m e n t u n d e r s u b -

    s e c t i o n ( 1 ) w o u l d b e i n t h e i n t e r e s t o f

    justice, the Court sha ll have regard

    (a ) to the cont ents of the sta tement;

    (3) A writ ten sta tement mentioned

    (a ) i f the sta tement is writ ten by the

    m i n o r , b y t h e p r o s e c u t i o n

    submi t t ing the s t a t ement t o the

    Court ; or

    (b) i f t h e s t a t e m en t i s w r i t t e n o n

    behalf of a minor, by call ing the

    person who wrote the s ta tement

    t o p u t t h e s t a t e m e n t i n t o

    evidence.

    (4) Where a st a tement is tendered

    int o evidence under subsection (2), it sha ll

    be read to the Court, and the defendant is

    e n t i t l e d t o c h a l l e n g e i t s a d m i s s i b i l i t y

    before it is a dmit ted int o evidence.

    (5) Where th e defenda nt exercises

    his right under subsection (4), the J udge

    or Ma gistra te sha ll conduct a voi r d i rea nd

    decide whether the whole or any part of

    the st a tement is a dmissible into evidence.

    19. Section 32 of the Act is a mended by

    (a ) inserting before the word After occurringin l ine one o f subsec t ion (1) , t he wordsB efore or;

    (b) deleting in subsection (1)(i) t h e w o r d s o r a s t h e a c cu s e d

    occurring in t he th ird line;

    (ii) the w ords or t he a ccused occurringin th e second line of para gra ph (a );

    (i ii) the word (a ) ; an d

    (iv) para graph (b);

    (c) d e l e t i n g t h e d e f i n i t i o n o f t h e w o r daccused occurring in subsection (4).

    20. The Act is amended by inserting after section 34the following n ew P a rt :

    (4) Subsection (2) shall have effect as

    i f t h e p er s o n h a d b e e n s e n t e n c ed i n

    respect of ea ch of the offences to a term of

    imprisonment wh ich

    (a ) in t he case of consecutive t erms, is

    e q u a l t o t h e a g g r e g a t e o f t h o s e

    terms;

    (b) in the case of concurrent terms, is

    e q u a l t o t h e a g g r e g a t e o f t h o s e

    t e r m s a f t e r m a k i n g s u c h

    deduction as may be necessary to

    secure tha t no per iod of t ime is

    count ed more tha n once.

    34B . (1 ) A p e r s on w h o i s s u b je ct t o

    n o t i f ica t i on r e q u i r em e n t s s h a l l , w i t h i n

    f ou r t e en d a y s o f h i s s e n t e n c e or t h e

    commutat ion of his sentence as the case

    may be, or of his being dealt with under

    section 34A(1)(c), notify to the police in the

    local police ar ea t he follow ing informa tion:

    (a ) his name and, where he also uses

    one or more other names, each of

    those na mes;

    (b) his home address;

    (c) his da te of birth.

    (2) A person subject to notification

    requirements shall before the end of the

    period of fourteen da ys beginning w ith

    (a ) his us ing a name which has no t

    been notified to the police under

    this section;

    (b) any change of his home address;

    or

    (c) his having resided or stayed for a

    (3) For the purpose of determining

    time w hen t he person in question(a ) i s r emanded in o r commit t ed to

    custody by a n order of a court;

    (b) i s s e r v i n g a s e n t e n c e o f

    imprisonment;

    (c) is detained in a hospita l; or

    (d ) is outs ide Trin ida d a nd Tobag o.

    34C . (1) A person ma y g ive a notificat ion

    requirement

    (a ) by attending at any police stationin his local police area and giving

    an oral not if icat ion to any police

    o f f i c e r ; o r t o a n y p e r s o n

    authorised for the purpose by the

    officer in cha rge of th e sta tion; or

    (b) by sending a writ ten not if icat ion

    to an y such police sta tion.

    ( 2 ) A n y n o t i f i c a t i o n u n d e r t h i s

    s e c t i o n s h a l l b e r e c o r d e d i n a r e g i s t e r

    p r o v i d e d f o r t h a t p u r p o s e a n d s h a l l b ea c k n o w l e d g e d ; s u c h a c k n o w l e d g e m e n t

    shall be in w rit ing and in such form a s the

    M i n i s t e r , t o w h o m r e s p o n s i b i l i t y f o r

    n a t i o n a l s e c u r i t y i s a s s i g n e d , m a y

    (3) In this section

    34D . (1) If a person

    (a ) fails w ithout rea sona ble excuse, to

    comply with section 34B (1) or (2);

    or

    (b) notifies to the police, in purported

    compliance with section 34B (1) or(2 ), a n y i n f or m a t i o n w h i c h h e

    knows t o be false,

    he shall be liable on summary conviction

    t o a f i n e o f f i v e t h o u s a n d d o l l a r s o r t o

    imprisonment for one yea r or both .

    (2) A person commits an offence

    u n d e r s u b s e c t i o n ( 1 )(a )on t h e d a y on

    which he f i r s t f a i l s , w i thou t reasonab le

    excuse, to comply with section 34B

    (1) or(2), and continues to commit it throughout

    a n y p e r i o d d u r i n g w h i c h t h e f a i l u r e

    c on t i n u e s ; b u t a p er s o n s h a l l n ot b e

    p r os e cu t e d u n d e r t h a t p r ov i s i on m o r e

    than once in respect of the same failure.

    resides or is found.

    34E . (1) Where a person is convicted of

    an offence under the sections to which this

    sect ion a ppl ies , t h e Cour t sha l l r equ i re

    tha t t he person be medica lly exa mined.

    (2) Where upon such examinationi t i s found tha t the person examined i s

    s u f f e r i n g f r o m t h e H u m a n I m m u n e

    Deficiency Virus (hereinafter referred to

    a s H I V ) o r a n y o t h e r c o m m u n i c a b l e

    disease, informat ion t o tha t effect sha ll be

    given promptly to the virtual complainant

    a nd t he person examined.

    (3) Subject to subsection (2), the

    informa tion sha ll be confidential.

    ( 4 ) W h e r e i t i s f o u n d u p o n

    e x a m i n a t i o n t h a t t h e c o m p l a i n a n t h a s

    c o n t r a c t e d H I V o r a n y o t h e r

    c om m u n i c a b l e d i s e a s e t h e c ou r t , u p o n

    application by the complainant and upon

    b e i n g s a t i s f i e d o n a b a l a n c e o f

    p r o b a b i l i t i e s t h a t t h e c o m p l a i n a n t

    contrac ted the disease as a resul t o f the

    offence, ma y order the defenda nt to pay t o

    the complainant compensation in addition

    to a ny a mount ordered un der section 3(5).

    (5) This section applies to sections

    4, 5, 6, 7, 8, 9, 10, 11, 12 a nd 13.
