Each assessment task in this booklet consists of the following:

This must be filled out, signed and submitted together with your assessment responses.If you are submitting hardcopy, the Cover Sheet should be the first page of each task’s submission.If you are submitting electronically, print out the cover sheet, fill it out and sign it, then scan this and submit the file.

Written answer question guidanceThe following written questions use a range of “instructional words” such as “identify” or “explain”, which tell you how you should answer the question. Use the definitions below to assist you to provide the type of response expected. Note that the following guidance is the minimum level of response required.

Analyse – when a question asks you to analyse something, you should do so in in detail, and identify important points and key features. Generally, you are expected to write a response one or two paragraphs long.

Provide answers to all of the questions below:

1. Identify and document the title and date of the WHS/OHS Act and Regulation for the state in which you are located.

Work health and safety (WHS) laws require employers and all other workplace parties to consult andcooperate in the management of workplace risks, in order to protect the health and safety of workersand others who might be at risk from the work. ... It applies in all NSW workplaces, including mines.While health and safety requirements are now largely consistent across the country, NSW’s WHS Act hasa number of variations from the model WHS Act, so NSW-specific legislation should always be checkedfor details.The legislation is supported bycodes of practicethat provide guidance in achieving the requiredstandard of health and safety.Codes of practice approved in NSWare listed on the website of SafeWork NSW.WHS regulatorsThere are two WHS regulators in NSW – for the State’s mining and energy sectors it isNSW Resourcesand Energy; for all other workplaces it isSafeWork NSW(formerly WorkCover NSW).Health and safety dutiesThe WHS Act 2011 has broadened the range of people who have a duty of care. In addition to employersand other ‘persons conducting a business or undertaking’ (PCBUs), duties to manage risks are imposedon all parties who are in a position to contribute to the successful management of workplace risks,including designers, manufacturers, importers and suppliers of equipment and substances; and peoplewho install, construct or commission plant or structures.Duty-holders must, as far as is reasonably practicable, eliminate (or failing that, minimise) risks to healthand safety arising from the work.

2. Identify the purpose of a WHS code of practice and give an example.

Codes of practice are practical guides to attaining the standard of work health and safety (WHS)

required by WHS laws.

Codes of practice do not have the same legal force as the WHS Acts or regulations, although they

are designed to be used in conjunction with these. In other words, a prosecution cannot be

mounted simply on grounds of failing to comply with a code of practice.

alternative course of action that achieves the same or a better standard of WHS. However,

Codes of practice are developed, usually with public consultation and with input from industry

groups and interested parties, primarily by the state or territory government departments

responsible for WHS regulation.

Each state and territory’s principal WHS (or OHS) Act sets out the legal status of codes of practice

in that jurisdiction. In Victoria, newer codes of practice are known as ‘compliance codes’. A code

of practice is not considered to be in effect unless it has been approved by the Minister

responsible for WHS

3. Outline the factors that must be taken into account in determining control measures for hazardous manual tasks as stated in the model Work Health and Safety Regulations 2011.

Manual tasks include stacking shelves, working on a conveyor line or sitting at a computer. Some manual tasks are hazardous and can cause serious injury like musculoskeletal disorders.

4. Define the term duty holder under WHS/OHS legislation and the primary duty of care of a PCBU under WHS legislation.

Duty Holder – refers to any person who owes a work health and safety duty under the WHS Act including a person conducting a business or undertaking (PCBU), designer, manufacturer, importer, supplier, installer of products or plant used at work (upstream duty holders), an officer and workers.

5. Outline two examples of a WHS policy that a business may implement.

In Australia, businesses have the primary duty of care for WHS. PCBUs must ensure the health and safety of workers so as far as is reasonably practicable, as well as others such as visitors.

● PCBUs include individuals, for example sole traders or people who are self-employed, partners in a partnership as well as companies and organisations.Business owners or those who make decisions that affect the business—referred to as ‘officers’ in the model regulations—must exercise due diligence and make sure the PCBU complies with its health and safety obligations This includes making sure there are appropriate practices or systems of work in place as well as actively monitoring and evaluating health and safety at the workplace.

● Due diligence requirements are set out in the WHS laws. They are not onerous and there are plenty of resources to help you understand your obligations.

● Most employers are required to have workers’ compensation insurance. This generally covers payments to workers for any lost wages if they are unable to work due to an injury or ill health, as well as medical costs and rehabilitation expenses to help them return to work as soon as possible.

6. Explain the process of risk assessment and control in workplace health and safety.

Risk assessment is a term used to describe the overall process or method where you:

● Identify hazards and risk factors that have the potential to cause harm (hazard identification).● Analyze and evaluate the risk associated with that hazard (risk analysis, and risk evaluation).● Determine appropriate ways to eliminate the hazard, or control the risk when the hazard cannot be

eliminated (risk control).

A risk assessment is a thorough look at your workplace to identify those things, situations, processes, etc. that may cause harm, particularly to people. After identification is made, you analyze and evaluate how likely and severe the risk is. When this determination is made, you can next, decide what measures should be in place to effectively eliminate or control the harm from happening.

The CSA Standard Z1002 "Occupational health and safety - Hazard identification and elimination and risk assessment and control" uses the following terms:

Risk assessment – the overall process of hazard identification, risk analysis, and risk evaluation.

Hazard identification – the process of finding, listing, and characterizing hazards.

Risk analysis – a process for comprehending the nature of hazards and determining the level of risk.

(1) Risk analysis provides a basis for risk evaluation and decisions about risk control.

(2) Information can include current and historical data, theoretical analysis, informed opinions, and the concerns of stakeholders.

(3) Risk analysis includes risk estimation.

Risk evaluation – the process of comparing an estimated risk against given risk criteria to determine the significance of the risk.

Risk control – actions implementing risk evaluation decisions.

7. Explain three ways in which hazards can be identified in the workplace.

There are many types of workplace hazards, which tend to come under four main categories:

○ physical hazards – the most common workplace hazards, including vibration, noise and

○ ergonomic hazards – physical factors that harm the musculoskeletal system, such as

repetitive movement, manual handling and poor body positioning;

○ chemical hazards – any hazardous substance that can cause harm to your employees;

○ biological hazards – bacteria and viruses that can cause health effects, such as hepatitis,

HIV/AIDS and Legionnaire’s disease.

8. Describe the purpose of the hierarchy of control and each of the options available from most effective to least effective. Provide an example for each in terms of how it may be applied in a workplace.

The hierarchy of control creates a systematic approach to managing safety in your workplace by providing a structure to select the most effective control measures to eliminate or reduce the risk of certain hazards that have been identified as being caused by the operations of the business.

The hierarchy of control has six levels of control measures, the most effective measure is at the top of the hierarchy and the least effective is at the bottom. So the idea is that you start from the top of the hierarchy in choosing your control measure, and work your way down.

The hierarchy of control involves the following steps:

1. Elimination – removes the cause of danger completely.2. Substitution – controls the hazard by replacing it with a less risky way to achieve the same outcome.3. Isolation – separates the hazard from the people at risk by isolating it.4. Engineering – using engineering controls, i.e. making physical changes, to lessen any remaining

risk, e.g. redesign a machine by adding safeguards.5. Administration – use administrative controls to lessen the risk, e.g. install signs, rotate jobs.6. Personal Protective Equipment (PPE) – require your employees to wear PPE, e.g. provide gloves,

earplugs, goggles, iridescent vests.

9. Give two reasons why it is important to report WHS incidents within the workplace to relevant persons and identify at least two position holders to whom incidents may be reported

Everyone has a duty to report incidents to their supervisor or manager, whether or not someone is hurt. This obligation applies to:

● employees● self-employed persons● contractors and their employees.

For the self-employed and contracting companies, the incident also needs to be communicated to the mining or exploration operation they are engaged by. The mine manager or exploration manager can then submit a report to the Safety Regulation System (SRS).

Learning from incidents

While unwelcome, it is important to learn from incidents to help:

● reduce the potential for a recurrence● minimise losses to both the workforce and production● reduce the effect of any future incident.

The department publishes Significant Incident Reports and Safety Bulletins on reported incidents and accidents. These safety alerts allow information to be communicated to industry with the hope that similar incidents can be prevented.

Significant Incidents Reports cover individual incidents or accidents.

Safety Bulletins are produced to highlight safety concerns where there has been a cluster or trend of similar incidents, whether in Western Australia or worldwide.Australian Careers College RTO code 31642 V1.0-2019 Page 16

employers must keep records of these incident.

A notifiable incident is when:

● a person dies● a person experiences a serious injury or illness● a potentially dangerous incident occurs.

Significant penalties apply if you don’t notify us of a ‘notifiable incident’.

You must also notify your insurer within 48 hours.

11. Within what time period within which an employer must notify their worker’s compensation insurer where a work has received a workplace injury?

You should notify your employer as soon as practicable of your workplace injury. You should also keep your employer informed about any time away from work that you may need, or any assistance that you need to return to work, which could include reduced hours or modifications to your duties or work area.

If you lose income or require treatment as a result of your workplace injury and you want to claim compensation, you need to fill in and lodge a Northern Territory 'workers' compensation claim form' with your employer.

If you want to claim for loss of income, you will need to give your employer a 'statement of fitness for work - first certificate' filled in and signed by your treating doctor or medical practitioner. The claim form is in two parts - the first is required to be completed by you (or someone on your behalf) and the second part is required to be completed by your employer.

You must sign the worker's authority to release medical and relevant personal information and declaration at the end of part one on the claim form for the claim to be valid.

Once you have lodged a completed and signed 'workers' compensation claim form' with your employer, the employer has three days to complete and sign part two of the form and forward it to their insurer.

The insurer must make an initial decision on the claim within 10 working days of the employer receiving it. The insurer will manage and make all the decisions regarding the claim on behalf of the employer.

Task summary This assessment task requires you to evaluate a work health and safety management system and recommend improvements, as well as implement improvements.

This assessment is to be completed in the simulated work environment in the RTO.

Assessment criteriaFor your performance to be deemed satisfactory in this assessment task, you must satisfactorily address all of the assessment criteria. If part of this task is not satisfactorily completed, you will be asked to complete further assessment to demonstrate competence.

1. Write a performance report.

You are required to review the data above and develop a report for the CEO.

For each area provide an evaluation according to the Performance Reporting Matrix.

For each area also provide recommendations for improvement given the organisation’s benchmarks as set out in the scenario information.

You should include at least two recommendations per area and your recommendations should be based on the benchmark identified by the CEO and be relevant to Grow Management Consultants Operations.

2. Send an email to the CEO (your assessor).

The text of the email should be in grammatically correct English, written in an appropriate (polite, business-like) style.

It should introduce and briefly explain the purpose of the attachment,

Assume that the CEO has advised that WHS performance indicators need to be identified as soon as possible as part of their campaign to implement improvements to WHS at Grow Management Consultants.

Conduct research to identify at least four suitable performance indicators for the company.Explaining the rationale for each, as well as how regularly performance should be measured using this

indicator.

Write a short (about one page) report on the performance indicators that you have identified.

4. Send an email to the CEO (your assessor.)
