Filming in Ontario/Richmond HillOntario is the largest film and television production centre in Canada and one of the largest in North America. Film and television production results for 2013 (see side chart) are reinforcing Ontario’s position as a world-class production centre.

Film and television activity contributed $1.15 billion to the provincial economy in 2013; the third year in a row over the 1 billion dollar mark. Since 2008, economic activity has increased by 70%.

The Ontario Media Development Corporation (OMDC) is the central catalyst for Ontario’s cultural media cluster. It promotes, enhances and leverages investment, jobs and original content creation in the province’s book and magazine publishing, film and television, music and interactive digital media industries.

According to OMDC, the recent film and television activity in Ontario includes Beauty and the Beast Season 3, Bravo 14, Carrie, Covert Affairs, Dark Matter Season 1, Flashpoint, Hannibal Season 3, Haunted Peak, Hemlock Grove Season 3, Jake Joins a Club, Life, Murdoch Mysteries, Nikita, Orphan Black Season 2, Reign, Remedy Season 1, Rookie Blue Season 5, Ruby Season 3, The Divide Season 1, The Drop Season 1, The Good Witch Season 1, The Intruders, The Listener Season 5, The Strain Season 5, Time Vampire and Working the Engels to name a few.

Tax IncentivesThe Ontario Media Development Corporation (OMDC) support provides opportunities for film producers to create new products and for film & TV producers to develop existing markets, access new markets and grow their business. Support is also available to established trade organizations for events and activities that stimulate the growth of Ontario’s film & TV production industry.

Ontario Production Services Tax Credit (OPSTC) The OPSTC is a refundable tax credit to eligible Ontario- based Canadian and foreign-controlled corporations of 25%ofqualifiedOntarioproductionexpendituresfor eligible film and television productions. In addition, this credit can be combined with the federal Film or Video Production Services Tax Credit (CPTC) of16%ofqualifiedCanadianlabourexpenditures.

Ontario Film & Television Tax Credit (OFTTC) The OFTTC is very attractive for both domestic and co-production activity, offering a 35% tax credit on eligible Ontario labour expenditures, plus an additional 10% regional bonus for filming outside of the Greater Toronto Area. The federal government offers an additional 25% on domestic production labour costs.

Ontario Computer Animation & Special Effects Tax Credit (OCASE) The OCASE Tax Credit provides an additional 20% for eligible labour on VFX and animation activities in Ontario (including on-set labour for green-screen shooting).

The following tax credits are jointly administered by the Canadian Audio-Visual Certification Office (CAVCO) and the Canada Revenue Agency.

Canadian Film or Video Production Tax Credit (CPTC) The objective of this tax credit is to encourage Canadian programming and to develop an active domestic productionsector.Thisfullyrefundabletaxcreditisavailableatarateof25%ofthequalifiedlabourexpenditure of an eligible production.

Film or Video Production Services Tax Credit (PSTC) The Film or Video Production Services Tax Credit is designed to enhance Canada as a location of choice for film and video productions employing Canadians, as well as to strengthen the industry and secure investment.ThePSTCisavailableatarateof16%ofthequalifiedCanadianlabourexpendituresincurredin respect to an accredited production.

Through consultation with stakeholders, Ontario Media Development Corporation (OMDC) has created a range of programs and resources to provide financial, strategic and research support to Ontario’s cultural entrepreneurs and established trade and event organizations from the film & TV production industry.

Research grants are also available to incorporated not-for- profit industry organizations undertaking research initiative that support or complement the mandate of the OMDC.

Film Fund This fund is designed to increase the level of domestic film production in Ontario by providing support to Ontario producers for feature film projects in the final stages of development and production financing. The Film Fund consists of two components:

• development–providesfundingintheformofaninterest-free loan of up to $25,000 for the final development stage

• production–providesfundingintheformofarepayableadvance of up to $400,000 on a last-in basis to complete the financing of a feature film.

Export Fund – Film and Television The export fund provides Ontario producers with funding to pursue strategic export development activities that support company growth and produce measurable business development results. Activities supported include targeted sales trips and attendance at international market events. Successful applicants are eligible to receive up to $12,000 capped at 50% of the total costs for all activities.

Industry Development Program OMDC provides support to Ontario’s cultural entrepreneurs by partnering with established trade and event organizations to offer initiatives, events and activities that stimulate the growth of the cultural media industries. These initiatives must promote the potential for measurable commercial transactions or other business-focused opportunities for Ontario companies that create and sell content in the book, film, interactive digital media, magazine, music or television industries and any combination of these industries.

Research Grants OMDC offers financial support directly to incorporated not-for-profit industry organizations undertaking research initiatives that support or complement the mandate of OMDC. Proposed projects should provide information needed by an industry to further industry development or growth; update, improve or strengthen existing data; or address an existing information gap(s) in the creative media industries.

!Filming GuidelinesThe following guidelines apply to all location filming within the boundaries of Richmond Hill, except for current affairs and newscasts.

The Town of Richmond Hill must be advised of all scheduled location filming in buildings, streets, parks and other properties under its jurisdiction ideally at least two weeks in advance of filming commencement, with the exception of commercial photography and special projects approved by Council.

Filming projectsThe Town of Richmond Hill will consider the following projects for on-location filming:

• featurefilms

• commercialphotography(forgeneral publication and advertising)

• televisioncommercials

• documentaries

• educationalfilms

• made-for-televisionmovies

• televisionprograms

• otherprojectsthatmaybe approved by Council

The Town of Richmond Hill will not consider the following projects for on-location filming:• projectsthatseeminglycondonethebreakingofProvincialorFederallaws

• projectsthatareconsidereddistastefulbythegeneralpublicorwhichareexpectedto be released with an X rating.

Filming inside and outside Town-owned buildingsFilm companies must agree to:

• employTownsecurityandTownmaintenancestaff,and reimburse the Town directly for these costs. Security services requiredtoensuretheovernightsecurityofproduction vehicles located outside Town buildings and on town streets must be arranged and paid by the film company

• attheirexpense,restoreallexteriorandinteriorbuilding finishes and fixtures to their condition prior to filming with acceptable materials and to the Town’s satisfaction

• beresponsiblefortherestorationandreplacementofany damaged finishes and fixtures through contractors and suppliers identified by or acceptable to the Town

Special effectsFilm companies and photographers must identify their intent to use special effects involving the following substances: guns, gunfire, explosives, bombs/mock ups, flash powder and detonators.

Film companies must contact directly York Region Police and Richmond Hill’s Fire Chief to acquireappropriateapprovalsfortheuseofthesesubstances.
