The 71st meeting of State Level Expert Appraisal Committee, Chhattisgarh was held on 10/01/2011 at Conference Hall, SEAC, Secretariat, 1-Tilak Nagar, Shiv Mandir Chowk, Main Road, Avanti Vihar, Raipur at 12:30 P.M. Dr. Harendra Kumar, Chairman, SEAC, Chhattisgarh chaired the meeting. The following members of SEAC were present in the meeting: -

At the outset, the Technical Officer, SEAC, Chhattisgarh welcomed the Chairman and Members of State Level Expert Appraisal Committee, Chhattisgarh. Agenda wise discussions were carried out as follows: -

Agenda Item No. 1 -Confirmation of minutes of the 69th and 70th meeting of SEAC, Chhattisgarh

Minutes of the 69th and 70th meeting of SEAC, Chhattisgarh held on 22/12/2010 and 23/12/2010 respectively was presented before the Committee. The Committee approved the minutes of the meeting.

Agenda Item No. 2 - Internal Discussion on the proposals received for TOR/EC as per provisions of the Environment Impact Assessment Notification, 2006.

(1) M/s K.L. Energy & Coal Benefication Private Limited, Village Dehjari, District Raigarh (C.G.)

The Project proponent had previously submitted application (Form-I, Project Report) for prescribing Terms of Reference (TOR) for preparing draft EIA report for Coal Beneficiation Plant of capacity 0.9 million tonnes per year (Output Basis) and Power Plant of 17 MW at Khasra No. 47/1, 49/2, 51/3, 54/1, 59/1, 60/3, Village Dehjari, Kharsiya, District- Raigarh (CG). The case was considered in the 4th, 8th 10th, 15th and 19th meeting of SEAC held on 03/05/2008, 03/06/2008, 19/08/2008, 22/10/2008 and 26/12/2008 respectively. Committee then considered the proposal as B1 category and prescribed the Terms of Reference (TOR) for preparing draft EIA report. The prescribed Terms of Reference (TOR) for preparing draft EIA report was communicated vide letter 03/02/2009.

Public hearing has been conducted on 24/09/2010 at ground near Government Middle School, Dehjari, Tehsil-Kharsia, District- Raigarh. Public hearing documents has been sent by Member Secretary, Chhattisgarh Environment Conservation Board, Raipur vide letter 30/10/2010. Member Secretary, Chhattisgarh Environment Conservation Board, Raipur further sent some more documents (objection/suggestion) received vide letter dated 13/12/2010.

Project proponent applied for grant of environmental clearance vide their letter dated 29/10/2010 and 26/11/2010. Project proponent also submitted copy of Memorandum of Understanding signed by M/s Drolia Mineral Industries Private Limited, Mumbai (importer and supplier of coal in India) and director of M/s K.L. Energy & Coal Benefication Private Limited for supply of imported coal of maximum quantity 25,000 tonnes per year.

Committee perused the application, information/documents submitted by project proponent and public hearing documents. After deliberation, Committee decided to ask the project proponent to submit the following information/document:-

Revised from I or supplementary information as per amendment notification issued by Ministry of Environment & Forests, Government of India vide S.O. 3067(E) dated, 01/12/2009 should be submitted.

TOR compliance statement issued by SEAC, Chhattisgarh vide letter dated 03/02/2009.

Final lay out plan.

Project feasibility report for coal reject/middling /rice husk / coal based power plant and coal washery as pre model feasibility report published by Ministry of Environment and Forests, Government of India.

In the final EIA report the fuel to be used for power plant has been given as rice husk and coal only; where as, during TOR present the fuel to be used was given as coal reject/middling /rice husk / coal. Fuel mix along with supply source should be clearly given.

Long Term Firm MoU for supply of imported coal should be submitted as per Ministry of Environment & Forests, Government of India circular dated 01/11/2010. Firm Linkage of coal should be submitted as per Ministry of Environment & Forests, Government of India circular dated 01/11/2010.

Firm MoU for supply of rice husk and coal reject/middling should be submitted.

The annual throughput of coal for coal washery for the three years.

The list of clients/companies along with copy of agreement between project proponent and companies to whom the washed coal to be supplied.

The mode of transport/conveyance of incoming unwashed coal and outgoing washed coal, rejects, coal fines, ash etc. Transportation routes showing villages, schools/colleges, residential areas etc. to be given.

The transportation through rail should be explored and proposal along with action plan to be submitted.

Detailed material balance.

Water requirement in washing operations and in power plant.

Study of alternative sites should also be submitted so as to justify the selected site from environmental angle.

Contour map along with the site plan of the project and project land use area statement including land for project operations, such as coal handling plant, washery, power plant, building infrastructure, effluent treatment plants, raw coal, washed coal, reject coal, coal fines, ash stock yard, colony, greenbelt, undisturbed area, natural topographical features (such as existing roads, drains/natural water bodies if any) to be left undisturbed, proposed diversion / re-channeling of natural drainage or water courses, if any.

Information regarding surface hydrology, water regime, hydrogeology and ground water regime.

Map showing the core zone delineating the agricultural land (irrigated and un-irrigated), uncultivable land (as defined in revenue records), forest areas (as per records), grazing land and waste land.

Surface water, ground water, soil, noise and ambient air quality at at-least eight stations / locations around the proposed site.

Details of workshop, if any, and treatment of workshop effluents.

The detailed action plan for the redressal of concern raised by public and commitments made in the process of public hearing.

Community welfare / eco development activities and budget allocation.

SEAC, Chhattisgarh further decided that project proponent should be asked to present the case along with above information /documents and other relevant information /documents.

Project proponent should be informed accordingly.

(2) M/s Chhattisgarh Mineral Development Corporation Limited, Bauxite Mines, Village- Narmadapur, Tehsil- Sitapur, Sarguja

The Project proponent submitted application (Form-I, and Mining Plan) for Environment Clearance on 11/11/2010 for bauxite mining of 3.00.000 tonnes per annum capacity in 47.812 ha area. The brief of the project is as follows:-

The Proposal was discussed in 71st meeting on 10/01/2011. After deliberation, the Committee decided to ask the project proponent to submit the following information/documents: -

Layout plan and area map of 10 km radius clearly showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries, mines, stone crushers and other polluting sources etc.

Whether the project site located in whole or in part within 10 km from the boundary of: (i) Protected Areas notified under the Wild Life (Protection) Act, 1972, (ii) Critically Polluted areas as identified by the Central Pollution Control Board from time to time, (iii) Notified Eco-sensitive areas (including national park/ wild life sanctuary), (iv) inter-State boundaries, (v) Reserved Forest/protected forest)? Please provide details.

Whether mining lease area involves any forestland? Whether mining operations carried out in forestland in the past? If yes, the permission/clearance from forest department should be submitted along with details of action taken to reclaim this area.

Copy of approved modified mining plan for mining of 3,00,000 tonnes per annum and original approved mining plan.

Lease allotment letter / letter of intent for mining of 3,00,000 tonnes per annum and date of agreement made after approval of mining lease. Submit the copy of agreement.

Submit the copy of permission obtained for start of mining operations (if any).

Submit the copy of permission for land entry in the lease area (if any). Date of start of mining operations (if any). Whether the environmental clearance obtained as per provisions of Environment Impact Assessment Notification 1994? If yes, submit the copy of the same.

The year wise mining/production carried out till date (if any).

Details regarding annual return submitted to IBM for production/mining operations. Submit the copy of the same (if any).

Declaration of the occupier (managing Director/Director who has control over the mine premises) regarding the existing/proposed activities on land adjoining to the land of present proposed activity.

The Committee decided after submission of the above mentioned information/documents, proposal would be re-considered.

Project proponent should be intimated accordingly.

(3) M/s Hind Energy & Coal Benification (India) Private Limited, Village- Melnadih, Tehsil-Kota, Distt- Bilaspur

The project proponent submitted application (Form-I and Pre-feasibility Report) for prescribing Terms of Reference (ToR) for preparation of draft EIA report for obtaining environment clearance on 01/12/2010. The project proponent has proposed Coal Washery of capacity 0.96 million tonnes per annum. The brief of the project is as follows:-

The case was discussed in the 71th meeting of SEAC, Chhattisgarh held on 10/01/2011. After deliberation, the Committee decided to ask the project proponent to submit the following information/documents and present the case with relevant details: -

Alternate sites considered for this project and justification for selection of proposed site from environmental angle should be submitted.

Site details: existing condition, land acquisition document, permission from concerned authority should be submitted.

Layout plan and area map (toposheet) of 10 km radius showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries / mines, stone crushers and other polluting sources etc. should be submitted. Distance of above features from coal washery site should be clearly given.

Linkage of coal along with agreement for supply of raw coal should be submitted.

The list of clients/companies along with copy of agreement between project proponent and companies to whom the washed coal to be supplied.

The list of clients/ companies along with copy of agreement between project proponent and companies to whom the rejects / coal fines to be supplied/sold/returned should be submitted.

The project proponent submitted application (Form-I and Pre-feasibility Report) for prescribing Terms of Reference (ToR) for preparation of draft EIA report for obtaining environment clearance on 01/12/2010. The project proponent has proposed Coal Washery of capacity 0.96 million tonnes per annum. The brief of the project is as follows:-

The proposal was discussed in 71st meeting held on 10/01/2011. Committee perused the application /documents submitted by project proponent. Committee noted that:-

Pre-feasibility report submitted by project proponent is not concerned with M/s Bharti Coal Beneficiation Private Limited; instead, it describes the details of KJSL Coal & Power Private Limited, Korba, which is not matching with applied product. Hence, pre-feasibility report as per model feasibility report published by Ministry of Environment and Forests, Government of India should be submitted.

Long Term Firm MoU/ Firm Linkage for supply of coal required for power plant has not submitted as per Ministry of Environment & Forests, Government of India circular dated 01/11/2010.

The details and copy of land documents under possession has not submitted.

Study of alternative sites and justification of the selected site from environmental angle has not submitted.

After deliberation; in view of above, Committee recommended for de-listing of the proposal.

SEIAA, Chhattisgarh and project proponent should be intimated accordingly.

(6) M/s Pathrakundi Lime Stone Mine, Village- Pathrakundi, Tehsil-Tilda, District- Raipur

The Project proponent submitted application (Form-I and Mining Plan) for Environment Clearance on 10/12/2010 for lime stone mine of 3,00,000 tonnes per annum capacity in 7.044 ha area. The brief of the project is as follows:-

The Proposal was discussed in 71st meeting held on 10/01/2011. After deliberation, the Committee decided to ask the project proponent to submit the following information / documents: -

Approved mining plan for lime stone mine of 3,00,000 tonnes per annum capacity should be submitted.

Environment Clearance for mining capacity of 5000 tonnes per year was granted on 27/10/2009. Whether project proponent started mining operation? If yes, then date of start of mining, year wise mining/production carried out till date, IBM return, compliance report of previous Environment Clearance should be submitted.

Water source, consumption with water balance and effluent generation, treatment and reuse, emission sources and emission control systems, solid waste / hazardous waste management system with respect to increase in production capacity should be submitted.

Layout plan and area map of 10 km radius clearly showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries, mines, stone crushers and other polluting sources etc.

(7) M/s Godawari Power & Ispat Ltd. (Ari Dongri Iron Ore Deposit) Village- Bhanupratppur, Distt- Kanker.

The Project proponent submitted application (Form-I and Pre Feasibility Report) for Environment Clearance on 07/12/2010 for Iron Ore Mine of 3.0 Lakhs tonnes per annum capacity in 32.36 ha area. The brief of the project is as follows:

The Proposal was discussed in 71th meeting of SEAC, Chhattisgarh held on 10/01/2011. After deliberation, the Committee decided to ask the project proponent to submit the following additional informations: -

Layout plan and area map of 10 km radius clearly showing major topographical features such as land use, drainage, location of habitats, major construction including railways, highways, pipelines, major industries, mines, stone crushers and other polluting sources etc.

Project proponent applied to SEIAA Chhattisgarh for prescribing TOR on 26/03/2008. The proposal was considered by SEAC Chhattisgarh in 2nd, 3rd and 4th meeting held on 05/04/2008, 26/04/2008 and 03/05/2008 respectively. TOR was issue to the project proponent by SEAC Chhattisgarh on 29/05/2008. Public hearing was conducted by Regional Officer Chhattisgarh Environment Conservation Board, Bilaspur on 24/12/2008 at Middle School Campus, Village Bhelai, Janpad Panchayat- Baloda, District - Janjgir-Champa (C.G.). Public hearing proceedings were received by SEIAA Chhattisgarh from Member Secretary Chhattisgarh Environment Conservation Board, Raipur vide their letter no. 8673/TS/CECB/2009 Raipur dated 07/01/2009. Project proponent has applied to SEIAA Chhattisgarh for the grant of environmental clearance on 16/02/2009 along with final EIA report incorporating the issues discussed in public hearing, public hearing proceedings, final layout plan and project feasibility report as per schedule five of EIA Notification 2006.

The application submitted was considered in 28th meeting of SEAC, Chhattisgarh held on 31/03/09. As per decision, project proponent made presentation in the 32nd meeting of SEAC, Chhattisgarh on 26/05/2009.

During presentation project proponent informed the committee that: -

The land use has been diverted for industrial purpose. There was no habilitation at the project site. Hence no R & R issues are involved.

Water Requirement : 250 KLD. Permission from CGWA obtained vide latter no. 21-4(31/NCCR/CGWA/2008-1040) dated 22/09/2008.

No nallha / water body and public road existing inside the project site

The main water course is Leelagar nadi flowing from North to South >5.0 km on West of the site. Hasdeo right bank irrigation canal is about 3.5 km East of the site.

No National Park, Biosphere Reserve, Archaeological Monument and Wildlife sanctuary exists. The reserved forests are Burgahan RF, Bitkuli RF and Dalha RF. The nearest southern fringe of Burgahan reserved forest is about 500 m away from the site in the west and northwest direction.

Nearest town & Railway station is Akaltara.about 12 km away. Nearest State Highway is Korba Baloda Champa [3 km]. The nearby villages around the proposed project site are Bhelai 600-700 m south, Achanakpur 2.0 km west, Baloda 3 km southwest, Birgahani 1.5 km north, and Korbi 1 km southeast. Industrially backward area. There are a few cottage industries and brick kilns.

Based on the consideration of the documents submitted, the presentation made by the project proponent, discussion held, the Committee recommended for grant of Prior Environmental Clearance for the proposed 0.95 MTPA Coal Benefication Plant.

The proposal and recommendation of State Level Expert Appraisal Committee, Chhattisgarh was considered in the 11th meeting of SEIAA, Chhattisgarh held on 10/11/2009. The SEIAA Chhattisgarh perused the information/affidavit submitted by project proponent. Environmental Clearance issued by SEIAA, Chhattisgarh vide letter no. 400/SEIAA-CG/EC/Coal Washery/BSP/58/09 Raipur, dated: 27/11/2009.

Meanwhile, project proponent applied to SEIAA Chhattisgarh on 19/11/2010 for relaxation of condition no. 28 and correction in condition no. 37 of the environmental clearance granted by SEIAA, Chhattisgarh. The proposal was considered in the 17th meeting of SEIAA, Chhattisgarh held on 04/12/2010. After deliberation, SEIAA Chhattisgarh decided that the request letter submitted by the project proponent regarding amendment in the EC conditions should be forwarded to SEAC, Chhattisgarh for their consideration and recommendation.

The Proposal was discussed in 71th meeting of SEAC, Chhattisgarh held on 10/01/2011. After deliberation, the Committee recommended for waive off condition no. 28 and correction in condition no. 37 of the environmental clearance granted by SEIAA, Chhattisgarh.

SEIAA may be informed accordingly.

(9) M/s Spectrum Coal & Power Limited, Village Ratija, Tehsil- Katghora, District Korba (C.G.)

The project proponent submitted application (Form-I and Pre-feasibility Report) for prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 13/01/2009. The project proponent has proposed expansion project for setting up of Coal washery reject based power plant of capacity 1x50 MW at Village Ratija, Tehsil- Katghora, District Korba (C.G.). The case was discussed in the 22nd meeting of SEAC, Chhattisgarh held on 31st January 2009. After deliberation, the Committee then decided to ask the project proponent to submit the additional information/documents and present the case. After detailed deliberation, the Committee then decided to ask the project proponent to present the case in 26th meeting of SEAC Chhattisgarh on 13/03/09.

The brief of the project is as follows:-

Project proponent made presentation along with the desired information in the 26th meeting of SEAC, Chhattisgarh on 13/03/2009. After deliberation committee decided that project proponent should be asked to submit the additional information/documents. Project proponent submitted the information on 04/04/09 and 07/05/09.

Project proponent informed that:

1. Transport of raw material from SECL mines to Power Plant is planned by closed conveyor from April 2011 before coal firing scheduled in June 2011. Till that time coal will be transported by road in covered trucks. The Railway siding and rapid loading system (RLS) of clean coal and reprocessed reject coal meant for coal washery is planned for which consultant is appointed.

2. The prevailing wind direction, windrose diagram, short term maximum incremental concentration of pollutants and prevailing ambient air quality monitored /predicted for 1st unit of 50 MW capacity - submitted.

3. Emission of air pollutant calculation submitted (considering 0.4% sulphur content in coal/ washery reject)

The proposal was reconsidered in 34th meeting on 19/06/2009 of SEAC, Chhattisgarh and recommended for prescribing TOR. TOR was issued on dated 13/07/2009. Public Hearing was conducted on 23/06/2010. The public hearing proceedings were submitted before SEIAA, Chhattisgarh vide letter dated 27/07/2010. Project proponent submitted final draft EIA report vide letter dated 12/12/2010.

The Proposal was discussed in 71th meeting of SEAC, Chhattisgarh held on 10/01/2011. After deliberation, the Committee decided to ask the project proponent to submit the following additional informations: -

Linkage of coal along with agreement for supply of raw coal should be submitted.

The list of clients/companies along with copy of agreement between project proponent and companies to whom the washed coal to be supplied. Also, documents regarding permission to supply washed coal from M/s Reliance Natural Resources Limited and environmental clearance for its supply of coal mines, as applicable should be submitted.

The list of clients/ companies along with copy of agreement between project proponent and companies to whom the rejects / coal fines to be supplied/sold/returned should be submitted.

Mode of transportation of raw coal should be submitted. Transportation through rail should be explored. Proposal along with action plan should be submitted in this regard.

Raw coal source and supply routes should be defined clearly. Transportation routes of raw coal, washed coal, middling/rejects in the map incorporating the details of major establishments i.e. village, basti, school/college, commercial area etc. falling in the transportation route should be submitted.

Project proponent should be intimated accordingly.

(10) M/s Amamuda Diversion Scheme (Water Resources Division, Kota) Village Amamuda , Block - Kota, Dist. Bilaspur

Agenda Item No. 3 - Discussion on the proposals submitted for reconsideration.

(01) M/s Solar Industries India Limited, Village Jurali and Kapubehra, Tehsil Katghora, District Korba (C.G.)

The Project proponent submitted application (Form-I and Pre feasibilty Report) for prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 24/11/2009 for Coal Based Power Plant 250 MW, at Village Jurali and Kapubehra, Tehsil Katghora, District Korba. Total area is 200 acres. Proposed cost - Rs. 1079.00 Crore.

The proposal was discussed in 51st meeting held on 27/03/2010 of SEAC, Chhattisgarh. Based on the consideration of the documents submitted and discussion held, the Committee decided to ask the project proponent to submit the additional information/documents.

The project proponent submitted additional information/documents vide letter dated 20/04/2010. The information/documents submitted by project proponent were placed before SEAC Chhattisgarh in the 55th meeting of SEAC Chhattisgarh, held on 28/04/2010. After deliberation, the committee decided to ask the project proponent to present the case.

Project proponent was present in 61st meeting of SEAC Chhattisgarh for presentation held on 14/07/10. It is noted that certain informations like justification of the proposed site viewing close proximity to Korba critically polluted area, comparison of proposed site with the alternative sites duly justified, informations related to land, water, transport issues need further clarifications.

Hence, the Committee decided to ask the project proponent to again present the case with the relevant Environmental issues along with the clarifications on above mentioned issues. Project proponent submitted the desired information/documents vide letter dated 06/09/10.

The submitted information/documents were considered by SEAC, Chhattisgarh in 63rd meeting on 09/09/2010. After deliberation, the Committee decided to ask the project proponent to present the case. Project proponent submitted the information vide letter dated: 29/09/2010 and presented the case on dated: 30/10/2010.

It is noted that the proposed land area is partly govt. waste land, partly private agricultural and partly private waste land. There is no habitation in the proposed project site, no-eco sensitive zone within 15 km radius around the site, no archaeological site within 15 km radius from the identified site and there is no forest present in 10 km radius study area. Water requirement is 28,000 m3/day. Aharan River will be the source of water. Zero discharge concept will be adopted.

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the project proponent should be asked to submit certain additional information. The required information was submitted by project proponent vide letter dated 25/12/2010.

The proposal was reconsidered in 71st meeting on 10/01/2011 of SEAC, Chhattisgarh. The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water, soil, noise and ambient air quality should be monitored at-least at eight locations around the proposed site.

The proposed project does not fulfill the criteria as mentioned in general condition of Schedule of EIA Notification, 2006, hence falls under Category B. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as B1 category and prescribed the Terms of Reference (TOR) for preparing draft EIA report for the above-mentioned project. The prescribed Terms of Reference (TOR) for preparing draft EIA report is enclosed as Annexure-I.

Project proponent should be intimated accordingly.

(02) M/s Nahakasha Tank, Block- Antagarh, Dist-North Bastar Kanker,

A certificate from revenue authority has been obtained with respect to the need of irrigation and willingness to pay the water rates by villagers

When complete an additional Rise production to the tune of 58.10 M tonnes per annum can be anticipated from the project.

The nalla at the proposed scheme flows in well defined channel having about 10 ft wide banks raising 5 ft high with slope of 1:1.

1. As per notification S.O. 3067 (E), dated 01/12/2009, information should be furnished in amended Form-I or additional information as per amended Form I should be submitted.

2. The information /documents as desired vide letter dated 12/01/2010 should be submitted.

3. As 13.624 ha forests land is involved, the copy of forest clearance should be submitted.

4. The number of trees comes in the affected forest land and action taken for compensatory afforestation should be submitted.

5. The details of acquisition (along with the copy of acquisition order) of government land & private land and land diversion certificate for government land & private land should be submitted.

6. The status of the construction of project (head works and canal) should be submitted.

Committee decided that after receipt of the above information /documents, proposal would be considered. Project proponent submitted the above information vide letter dated 01/01/2011.

The proposal was reconsidered in 71st meeting on 10/01/2011 of SEAC, Chhattisgarh. Based on the consideration of the documents submitted and the presentation made by the project proponent, the Committee decided to consider the project as category B-2 and recommended for grant of Environmental Clearance for the Nahakasha Tank at Block-Antagarh, District Uttar Bastar, Kanker (C.G.) subject to fulfillment of terms and conditions as per Annexure-II.

SEIAA may be informed accordingly.

(03) M/s SV Power Private Limited, at Village Renki, Tehsil Pali, District Korba, (C.G.)

The Project proponent submitted application (Form-I and Pre feasibilty Report) for prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 27/04/2010 for expansion of existing capacity by installing 2 x 150 MW coal based captive power plant i.e. from 120 MW to 420 MW at Village Renki, Tehsil Pali, District Korba. Cost of the proposed project is Rs. 1520.00 Crore. The area available is 220 acres.

The proposal was considered in 57th meeting held on 14/05/2010 of SEAC, Chhattisgarh. After discussion committee decided that sub committee of SEAC, Chhattisgarh should visit the site and submit the report for further consideration. As per decision of SEAC, Chhattisgarh, Sub Committee visited the site on 15/07/2010.

The visit of the sub-committee and information/documents submitted by project proponent were discussed in 63rd meeting of SEAC, Chhattisgarh held on 09/09/2010.

After deliberation, Committee decided that project proponent should be asked to submit the requisite information/documents and present the case. Project proponent presented the case before SEAC on 66th meeting held on 27/10/2010. Project proponent came with incomplete information. Since, the requisite informations desired during presentation has not been submitted till date by the project proponent. Hence, SEAC in its 71st meeting held on 10/01/2011 decided to de-list the case.

Project proponent should be intimated accordingly.

(04) M/s Bhatiya Energy & Minerals Private Limited, Village Chhote Dhoumarpali, Tehsil- Kharsia, District Raigarh

The project proponent submitted application (Form-I and Pre-feasibility Report) for prescribing Terms of Reference (ToR) for preparation of draft EIA report for obtaining environment clearance on 23/06/2010 for proposed Coal Washery of capacity 0.96 million tonnes per annum.

The proposal was considered in the 63rd meeting of SEAC, Chhattisgarh held on 09/09/2010. Committee then decided to ask the project proponent to submit some information/documents and present the case. Accordingly, project proponent was informed vide letter dated 19/10/2010. Project proponent submitted information /documents during presentation and made the presentation before SEAC, Chhattisgarh in the 67th meeting held on 30/10/2010. Committee then decided to ask the project proponent to clarify some issues regarding location of site, land use etc. Project proponent was informed vide letter 08/12/2010. Project proponent submitted the information/documents vide their letter dated 03/01/2011. The proposal was discussed in 71st meeting held on 10/01/2011.

It is noted that coal washery site is situated at Village Chhote Dhoumarpali, Tehsil- Kharsia, District - Raigarh (C.G.). Nearest railway station Robertson is situated about 2.0 km in south east direction. Nearest town Kharsia is situated about 6.0 km in south west direction. Nearest River Mand is flowing 2.3 km in east direction. There are no national park / wildlife sanctuary, tiger reserve/elephant reserve/turtle nesting ground, core zone of biosphere reserve, habitat for migratory birds, religious & historic places, notified archaeological sites, defense installation, area of scientific and geological interest, tribal settlements / urban agglomeration, interstate boundary within 10 km radius. Rabo reserve forest (NE, 4.5 km), Bargarh reserve forest (NW, 4.5 km) Bansajhar reserve forest (SW, 5.0 km), Endu reserve forest (NNW, 7.8 km), Burhapahar protected forest (SW, 2.4 km), Lotan reserve forest (NNE, 9.8 km) are situated . Project proponent has proposed Coal Washery (wet process) of capacity 0.96 million tonnes per annum. Raw coal of 0.96 minion tonnes per annum would be washed. Washed coal of 0.64 minion tonnes per annum and 0.32 minion tonnes per annum (shale 0.08 minion tonnes per annum and fines & middling 0.24 minion tonnes per annum) would be obtained. Coal would be sourced from SECL mines of Chhal and Barod of Raigarh area. Project proponent has acquired 7.673 ha land in Village Chhote Dhoumarpali for establishment of coal washery project. Coal washery will be established about 700 meters away from main railway line. Project proponent has proposed to develop railway siding in 14.33 ha land near main railway line. The present land use of the site is agriculture (one crop). Total water requirement is 90.0 KL/Day. The water would be sourced from ground water. Thickener and belt press would be installed for the treatment of effluent generated. Treated effluent would be recycled in the process. Septic tanks and sokpits would be installed for treatment of domestic effluent. Zero discharge shall be maintained. Fines & middling would be sold to power plant and shale would be used for land filling and road construction. Raw coal, fines, middling and shale etc. would be conveyed through closed conveyor belt. Dust suppression system and water spraying system would be installed. Adequate air pollution control system in all vibrating feeders, all roll crusher, stacking tube, screen, de-sliming screen etc. would be installed. Thick green belt in 2.67 ha area (33% of total area) would be developed all along the plant premises. Estimated cost of the project is Rs. 31.00 Crores. A connecting road on project proponents land will be developed between railway siding and coal washery, which will be used for transportation of washed coal. Raw coal would be transported by road and clean coal would be transported by rail. Project proponent also informed that they will try dispatch of washed coal through nearest kharsia and Bhupdeopur railway siding till completion of their own railway siding.

After deliberation, the Committee considered the proposal as category B1 and prescribed the Terms of Reference (ToR) for preparation of draft EIA report for obtaining environment clearance as per Annexure III.

Project proponent should be intimated accordingly.

(05) M/s Raipur Development Authority, Area Development Project (Town Development Scheme- 4, Kamal Vihar), Raipur

Raipur Development Authority, Raipur has submitted application (Form-I, Form-IA and Concept Plan) for obtaining Environment Clearance vide letter dated 09/11/2010 on 11/11/2010 for Area Development Project (Town Development Scheme- 4, Kamal Vihar) having 647.84 ha in part of villages Tikrapara, Dumartarai, Devpuri, Boriakhurd and Dunda, Tahsil and District - Raipur (C.G.).

Proposal was considered in the 68th meeting of SEAC, Chhattisgarh held on 24/11/2010. The Committee then decided to ask the project proponent to submit the requisite information/documents and present the case. Project proponent was informed vide letter dated 08/12/2010. Project proponent submitted the revised application and requisite information/documents during presentation vide their letter dated 23/12/2010 and presented the case in 70th meeting of SEAC Chhattisgarh held on 23/12/2010. Committee then decided that project proponent should be asked to submit affidavit on following:-

1. Adherence to land use proposed in the Raipur Master Plan.

2. Provision of dedicated green area in Town Development Scheme- 4 (Kamal Vihar) and keeping the same without changes during execution of project.

3. Affirmation pertaining to legal proceding in the honorable High Court of Chhattisgarh, Bilaspur with the clarification that none of the writ petition filed relate to any environmental issues.

Chief Executive Officer, Raipur Development Authority, Raipur has submitted the affidavit on 29/12/2010 stating that

1. That Raipur Development Authority, Raipur will not deviate from the land use proposals in scheme area as provided in the said master plan.

2. That the dedicated green area (gardens, city parks, regional parks and road side plantation) covers total of 185 ha.

3. That during execution of TDS -4, Raipur Development Authority, Raipur will ensure that no changes are made in the green areas and that the total green area will not be less then 185 ha.

4. None of the writ petition (8 nos.) filed in honorable high court of Chhattisgarh has raised any issues that relate to the environment.

Proposal was reconsidered in the 71st meeting held on 10/01/2011. It was noted that:-

1. Proposed project involves reconstitution of land in accordance with the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 and its development in accordance with the Raipur Development Plan 2021 (Punarvilokit). Approximately 647.84 ha undeveloped land shall be developed in accordance with the Raipur Development Plan 2021 (Punarvilokit). Administrative approval for the scheme [Town Development Scheme- 4 (Kamal Vihar)] has been accorded by Housing and Environment Department, Government of Chhattisgarh vide letter dated 10/08/2009. Joint Director, Town and Country Planning Department, Government of Chhattisgarh has sanctioned the layout vide letter dated 02/07/2010. Housing and Environment Department, Government of Chhattisgarh permitted the Raipur Development Authority, Raipur to take further action as per rule vide letter dated 03/07/20010. Town Development Scheme- 4 (Kamal Vihar) has been approved by Board of Director of Raipur Development Authority, Raipur and notified in Chhattisgarh Rajpatra dated 16/07/2010. 2. Few unapproved, illegal constructions on proposed Raipur Development Plan 2021 (Punarvilokit) roads are proposed to be demolished.

3. There will be 15 sectors in the scheme. Total no. of land owners is 5730 in the scheme.

4. Total 32.71 ha change in land use is proposed as under:-

(a) Recreational to residential 10.24 ha

(b) Residential to recreational 10.24 ha

(c) Educational to residential 04.98 ha

(d) Agricultural to residential 07.25 ha

5. The area proposed for the Town Development Scheme will have connectivity through the new Dhamatari road (NH 43) and the old Dhamatari road. The area shall also have air and rail connectivity through the existing Raipur Airport, (approx. 10 km. away) and the Raipur railway station (approx. 09 km away). Two bus terminals area have been proposed in the scheme. Urla Industrial Area is approx. 11.1 km and Siltara Industrial Area is approx. 15.75 km fron proposed site.

6. Project involves construction of roads, drains, water supply, sewer line, decentralized sewage treatment plants, solid waste management system, play grounds, parks, electric supply system and other amenities.

7. All roads shall be as proposed in the Raipur Development Plan 2021 (Punarvilokit), (ROW: 75m, 45m & 30 m). All sector level roads shall be (ROW: 18m, 12m, 9m & 7m). Provision of footpath and cycle track has been made on all main roads. Bus Terminals shall be two nos., one on the old Dhamtari road and the other on the new Dhamtari road.

8. No changes in the existing water bodies are proposed. However changes in land surface, consequent to land development would cause a higher surface run-off for which the proposed drainage network shall be designed.

9. Projected population density of 250 persons has been envisaged.

10. The requirement of water during the development period shall be worked out during the DPR finalization. However the water requirement once the scheme projected population achieved is estimated to be 18 Million Liter per day as follows:-

Fire demand 1.05 Million Liter per day would be met through treated waste water. Water supply will be through Municipal Corporation, Raipur. Concurrence for supply of 18 MLD water has been given by Municipal Corporation, Raipur vide their letter dated 14/12/2010.

11. Estimated sewage generation @ 80 % of water supply will be around 12.5 Million Liter per day. Sewage will be treated in sewage treatment plants. Underground drainage system will be provided for collection of sewerage. Decentralize sewerage treatment plant in sector will be provided and treated effluent will be used for plantation fire fighting etc.

12. Solid waste management system will include door to door collection of wastes, segregation, composting of bio-degradable wastes. The solid waste management system shall be integrated with the city level infrastructure.

13. Town Development Scheme 4 has been designed for a population of 1.1 lakh and estimated power requirement will be 16 MW. The proposed demand would be met by importing power at 33 KV line from the nearest sources. 4 nos. 33/11 KV substation of each capacity 30 MVA would be built in or around the scheme area.

14. Total green area will be around 185 ha.

16. Estimated cost of project is around Rs. 815.38 crore.

17. Eight writ petitions i.e. WPC 6280/2010, 6281/2010 and 6282/2010, 6471/2010, 7165/2010, 7157/2010, 7154/2010 and 7158/2010 pending in the honble High Court of Chhattisgarh at Bilaspur. As per project proponent, no stay has been granted by honble High Court as yet.

Project proponent requested the Committee to appraise the Town Development Scheme- 4 (Kamal Vihar) project based on Form I, Form IA and Conceptual Plan submitted and grant Prior Environmental Clearance.

After detailed deliberation Committee considered the proposal as silver grading based on the environmental issues related to scheme and decided to recommend the project for grant of environmental clearance along with following terms and conditions mentioned Annexure - IV.

(06) M/s Jaysawal Neco Limited, Village-Manpur, Kabirdham

Project proponent had applied to Ministry of Environment and Forests, Government of India for Environment Clearance vide letter dated 08/08/2007 for mining of 0.078 million tonnes per annum lime stone in Manpur in mining lease area of 12.145 ha. The proposal was considered for ToR presentation during appraisal committee meeting held on 12/12/2007. The ToR was granted by MoEF on 4th January 2008 vide letter no. J-11015/887/2007IA.II(M). Public Hearing was held on 17/10/2008 at Primary School Bhawan, Village - Manpur, Gram Pachayat Ranjitpur, Tehsil & Block- Sahaspur-Lohara, District - Kabirdham (C.G.).

The project being in B Category, Ministry of Environment and Forests, Government of India, New Delhi transferred the original file to SEIAA Chhattisgarh vide letter no. J-11015/887/2007IA.II(M) dated 12/06/2008. Public hearing proceedings were received by SEIAA Chhattisgarh from Member Secretary, Chhattisgarh Environment Conservation Board, Raipur vide letter no. 8936/TS/CECB/2009 Raipur dated 19/01/2009. Project proponent has applied to SEIAA, Chhattisgarh for the grant of environmental clearance on 26/02/2009.

The case was considered in the 28th, 33rd, 43rd, 49th, 51st and 63rd meeting of SEAC, Chhattisgarh held on 31/03/09, 30/05/2009, 30/09/2009, 18/01/2010, 27/03/2010 and 09/09/2010 respectively. Project proponent made presentation in the 43rd meeting of SEAC, Chhattisgarh held on 30/09/2009.

The information / documents submitted by the project proponent were reconsidered in 63rd meeting of SEAC Chhattisgarh held on 09/09/2010. Committee then noted that information / documents submitted by the project proponent vide letter dated 16/06/2010 is incomplete especially with respect to the point no. 02 and 03 of the letter dated 20/04/2010. Project proponent has not carried out the monitoring of ambient air, noise, surface/ground water quality, soil etc. at various locations within 10 km radius. Project proponent has also not submitted name of flora and fauna and endanger species (if any) of flora and fauna in buffer zone authenticated by the competent authority. The final EIA report by the submitted project proponent does not reveal the name of authorized consultants engaged with their brief resume and nature of consultancy rendered. Project proponent was informed vide letter 22/10/2010. Project proponent submitted some information vide their letter dated 27/11/2010. The proposal was re-considered in the 71st meeting of SEAC held on 10/01/2011. SEAC perused the information submitted by project proponent. In response to SEACs letter, project proponent informed that they are going to initiate the base line data collection in 10 km buffer zone from 01/12/2010. Project proponent has submitted list of nine air monitoring stations only. As project proponent has not submitted the desired information/documents asked vide letter 22/10/2010; Committee decided that after receipt of the information/documents desired vide letter dated 22/10/2010, the proposal should be placed before SEAC for further consideration. Committee further decided to recommend for de-listing of the proposal till the submission of desired information/documents.

SEIAA should be intimated accordingly.

(07) M/s Shri Lakshmi Power Limited, Village Bitkuli & Pasid, Tehsil Bhatapara, District Raipur

Project proponent submitted application (Form-I and Techno Economic Feasibility Report) for prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance vide letter dated 22/09/2010 on 24/09/2010 for proposed Coal Based Captive Power Plant 2X150 MW, at Village Bitkuli / Pasid, Tehsil Bhatapara, District Raaipur (C.G.). Project proponent vide letter dated 15/10/2010 (receive on 23/10/2010) requested for withdrawal of above application. Project proponent vide letter dated 15/10/2010 (receive on 23/10/2010) further submitted application (Form-I and Techno Economic Feasibility Report) for prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance for proposed Coal Based Captive Power Plant 3X120 MW, at Village Bitkuli / Pasid, Tehsil Bhatapara, District Raaipur (C.G.). Estimated cost of the proposed project is Rs. 1836 Crore. The Total land identified is 125.4527 ha (310 acres).

The proposal was discussed in 67th meeting held on 30/10/2010 of SEAC, Chhattisgarh. Committee then decided to ask the project proponent to submit some information/documents. Project proponent was informed vide letter dated 08/12/2010. Project proponent submitted some information/documents vide their letter dated 29/12/2010. Meanwhile project proponent again changed the configuration from 3 x 120 MW to 1 x 360 MW. Project proponent has not incorporated the information/documents as desired vide letter dated 08/12/2010 in the proposal.

Ministry of Environment and Forests, Government of India has issued circular no J-11013/41/2006-IA.II (I) dated 01/11/2010. As per para 3 of the circular, all the proposals relating to thermal power project shall be considered only after firm coal linkage is available and the status of environment and forestry clearance of the coal sourced i.e. the linked coal mine/ coal block is known. In case of project based on imported coal, a copy of firm MoU signed between coal supplier and project proponent shall be required. As per para 4 of the circular, all such proposals relating to thermal power, steel manufacture and sponge iron which are pending in the MoEF or with State Level Environment Impact Assessment Authorities (SEIAAs)/ State Expert Appraisal Committees (SEACs) concerned for consideration of environmental clearance shall be deferred and delisted till the status of environment and forestry clearance of the coal supply source for Indian coal or the MoU for imported coal as stated in para 3 above has been established and furnished. This procedure has come into force with immediate effect. As project proponent has not submitted the copy of firm coal linkage along with the status of environment and forestry clearance of the coal sourced (i.e. the linked coal mine/ coal block) or a copy of firm MoU signed between coal supplier and project proponent for supply of imported coal; after deliberation, SEAC decided to recommend the proposal for de-listing.

SEIAA, Chhattisgarh should be intimated accordingly.

Agenda Item No. 4 - Consideration of the proposals relating to thermal power, steel manufacture and sponge iron which are pending in the SEAC, Chhattisgarh for consideration of TOR/Environment Clearance, as per decision taken in 68th meeting of SEAC, Chhattisgarh held on 24/11/2010 in view of Ministry of Environment & Forests, Government of India circular no. J-11013/41/2006-IA-II(I), dated 01/11/2010.

(01) M/s Lords Power Private Limited, Village Mudpar, Tehsil Janjgir, District Janjgir Champa (C.G. )

The project proponent submitted application (Form-I and Pre- feasibility Report) for prescribing TOR for preparation of Environment Clearance on 20/03/09. Project proponent has proposed Coal Based Power Plant of 2x 35 MW. The brief of the project is as follows:

Project proponent was present in 33rd meeting of SEAC Chhattisgarh for presentation. Project proponent informed the committee that some more time would be required for submission of information/documents. Project proponent requested the committee that the presentation should be made after compilation of the requisite information/documents. Project proponent has submitted the requisite information/documents vide its letter dated 10/11/2009. The case was reconsidered in 46th meeting of SEAC, Chhattisgarh held on 30/11/2009. Since, Project proponent has not submitted the land details SEAC, Chhattisgarh decided to defer the case and after submission of land documents, case would be reconsidered.

Project proponent submitted the desired information/documents vide letter dated 08/09/10. The submitted information/documents were considered by SEAC, Chhattisgarh in 63rd meeting on 09/09/2010. Since the project proponent came with incomplete information/documents related to possession of land etc., the Committee further decided to consider the case only after submission of the same.

Since, no coal linkage is lying presently with the project proponent. Hence, Committee in its 71st meeting held on 10/01/2011 decided to ask the project proponent to submit the coal linkage details/documents in view of circular dated 01/11/2010 regarding the confirmation of coal linkage of the project proponent.

Project proponent should be intimated accordingly.

(02) M/s Pinnacle Power Pvt. Ltd. Village Gram Panchayat Banari, Tehsil Akaltara, District- Janjgir Champa

The project proponent submitted application (Form-I and Pre Feasibility Report) for prescribing Terms of Reference (TOR) / Environmental Clearance on 06/10/2009. The project proponent has proposed Thermal Power Plant and Induction Furnace at Village Gram Panchayat Banari, Tehsil Akaltara, District- Janjgir Champa (C.G.). The brief of the project is as follows:

The case was reconsidered in 46th meeting of SEAC, Chhattisgarh held on 30/11/2009. Committee discussed the case and decided to ask the project proponent to submit the other requisite information/documents in respect of revised project proposal.

Project proponent was present in 53rd meeting held on 31/03/2010 of SEAC Chhattisgarh for presentation. The project proponent came with incomplete information/documents desired vide letter dated 12/01/10. Hence, committee decided to postpone the presentation.

SEAC, Chhattisgarh further considered the case in its 58th meeting held on 18/06/10 and decided to ask the project proponent to submit the information regarding status of land acquisition to be certified from the land revenue Government department in case of Govt. land and agreement/lease deed papers in case of private land being acquired/proposed to be acquired at an earliest failing which the case may be referred to be de-listed. In this regard, an affidavit also is to be submitted to endorse their commitment.

Project proponent submitted the requisite information along-with affidavit vide letter dated: 26/09/2010. The case was considered before SEAC, Chhattisgarh in its 68th & 71st meeting held on 24/11/2010 & 10/01/2011 respectively. After deliberation, Committee decided to ask the project proponent to submit the other requisite information/documents in respect to firm coal linkage w.r.t. Circular dated: 01/11/2009 and justification of alternative sites to avoid agriculture land use.

Project proponent should be intimated accordingly.

(03) M/s Mahavir Energy & Coal Beneficiation Limited. Village Bhengari, Raigarh

The Project proponent had applied for environmental clearance for 2X30 MW power plant at Village Bhengari, Tehsil Gharghoda, District Raigarh (C.G.) on 13/01/10. The proposed cost is Rs. 253.85 Crores. ToR was issued by Ministry of Environment and Forests, Government of India, New Delhi vide letter no. J-13012/260/2007-IA.II(T) dated 12/03/2008. The public hearing was held on 31/10/2009 for proposed project on the ground of Government Higher Secondary School at Village Navapara- Tenda Tehsil Gharghoda, District Raigarh. The public hearing documents were received on 22/10/2009 from Chhattisgarh Environment Conservation Board, Raipur. The project proponent has submitted Final EIA Report along with the issues discussed in public hearing, copy of video CD of public hearing proceedings, copy of final layout plan and copy of project feasibility report. The project proponent was informed to present the case vide letter dated 19/04/10. The Project proponent made presentation in the 54th meeting of SEAC, Chhattisgarh held on 24/04/2010. The project proponent then requested to give another chance for presentation so that they could present the case before the committee with full details and information. The committee then accepted the request and asked to present the case along with all above information/documents in the next meeting. Accordingly, project proponent was informed vide letter dated 20/05/2010. Project proponent has not yet requested for presentation.

As per decision taken in 68th meeting of SEAC, Chhattisgarh held on 24/11/2010, proposal was put up before Committee in 71st meeting held on 10/01/2011.

The Project proponent submitted application (Form-I and Pre-feasibility Report) for prescribing Terms of Reference (TOR) for preparation of draft EIA report for obtaining Environment Clearance on 17/06/2010 for expansion by installation of induction furnace for manufacturing of steel ingots/billets of capacity 144000 TPA and installation of rolling mill for manufacturing of rolled and structural products of capacity 105000 TPA in existing sponge iron plant premises at Village Bilha & Mohabhata, Post & Tehsil - Bilha, District - Bilaspur (C.G.). The project cost of Rs. 41.00 Crore. The total area is 108.00 acres.

The proposal was discussed in 59th meeting held on 25/06/2010 of SEAC, Chhattisgarh. After discussion committee decided that a sub committee of SEAC, Chhattisgarh should visit the site and submit the report for further consideration.

The proposal was discussed in 71st meeting held on 10/01/2011 of SEAC, Chhattisgarh. After deliberation, Committee decided to ask the project proponent to submit the other requisite information/documents in respect to firm coal linkage w.r.t. circular dated: 01/11/2009.

Project proponent should be intimated accordingly.

Cost of the proposed project is Rs. 225.00 Crore. The area available is 60 acres.

The proposal was considered in 64th meeting held on 29/09/2010 of SEAC, Chhattisgarh. After discussion committee decided that sub committee of SEAC, Chhattisgarh should visit the site and submit the report for further consideration.

Meanwhile, the case was considered before SEAC, Chhattisgarh in 71st meeting held on 10/01/2011 in reference to circular dated: 01/11/2009. After deliberation, Committee decided to ask the project proponent to submit the other requisite information/documents in respect to firm coal linkage w.r.t. circular dated: 01/11/2009.

The proposal was discussed in 57th meeting held on 14/05/2010 of SEAC, Chhattisgarh. Committee then decided that a Sub-Committee of SEAC, Chhattisgarh should visit the site for further consideration. As per decision of SEAC, Chhattisgarh, Sub Committee visited the site on 24/07/2010. Committee made a detailed inspection of the existing plant and the proposed site for manufacturing of M.S. Black Pipe, Lancing Pipe, ERW Pipe & M.S. Idler Pipe. The visit of the sub-committee and information/documents submitted by project proponent were discussed in 63rd meeting of SEAC, Chhattisgarh held on 09/09/2010. Committee then decided to ask the project proponent to present the proposal with relevant information / documents. Project proponent was informed vide letter dated 19/10/2010. Project proponent vide letter dated 27/10/2010 requested for deferment of presentation due to absence of their director. Project proponent also not submitted the relevant information / documents as desired vide letter dated 19/10/2010. Project proponent not submitted land documents along with patwari khasara, layout plan etc. Committee then decided that after receipt of the requisite information /documents as desired vide letter dated 19/10/2010 and land documents along with patwari khasara, layout plan etc.; proposal would be considered accordingly. Project proponent was informed vide letter dated 08/12/2010.

Meanwhile project proponent informed vide letter dated 05/01/2011 about withdrawal of their proposal. The request letter was put up in the 71st meeting held on 10/01/2011. SEAC perused the letter and decided to recommend for withdrawal of the proposal.

SEIAA, Chhattisgarh should be intimated accordingly.

(02) M/s Chhattisgarh Mineral Development Corporation Limited, Village- Kudarwahi, Tehsil Keshkal, Dist.- Bastar (C.G.) (Area 20ha.)

The Project proponent submitted application (Form-I, and Pre-Feasibility Report) for Environment Clearance on 14/11/08 for Bauxite mining of 10,000 TPA capacity in 20.00 ha area. The proposal was discussed in 20th meeting on 27/12/08 of SEAC, Chhattisgarh. Committee then decided to ask the project proponent to present the case. Project proponent made presentation in the 25th meeting of SEAC, Chhattisgarh on 16/02/2009.

Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee then decided that project proponent should be asked to submit the clarification regarding points raised during the presentation. Project proponent then assured the committee to submit the desired information at the earliest. Committee then decided that after receipt of the requisite information, the information/documents should be placed before the committee for consideration of Environmental Clearance as per Environment Impact Assessment Notification, 2006. Accordingly, project proponent submitted the desired information on 27/04/09. The submitted information/documents were considered by SEAC, Chhattisgarh in 30th meeting on 08/05/2009.

The Committee was unanimously of the opinion that the study area should cover an area of 10 km radius around the proposed site and surface water, ground water, soil, noise and ambient air quality should be monitored at-least at eight locations around the proposed site.

The proposed project fulfills the criteria as mentioned in the Schedule of EIA Notification, 2006, hence falls under Category B. Based on the consideration of the documents submitted, the presentation made by the project proponent and discussion held, the Committee decided that the proposed project should be considered as B1 category and prescribed the Terms of Reference (TOR) for preparing draft EIA report for the above-mentioned project. The Term of Reference (TOR) was issued vide letter darted 15/06/2009.
