All sale contracts of Forniture Nautiche Italiane Srl products to third party are regulated by these Terms and Conditions, which form an integral and essential part of any offert, order and order confirmation of purchase of the products. The sale terms applicable to the order are those in force on the date of the order.

Orders: In order to avoid misunderstandings, must be specified: 1. Client number; 2. Article’s code; 3. Description of the same; 4. Color and size, where necessary5. and quantity;

For orders less than 200 € will be applied an operating cost of € 10. for supply less than the standard packages increase of 20% on the price list in force. Orders will be processed according to availability of the moment; the backorder will be sent, unless the reverse order, as soon as possible, Ex Works or with a new order.

Prices:All prices shown are VAT EXLUDED.Forniture Nautiche Italiane Srl reserves itself the right to make changes to the price list without prior notice in the event that the cost components of individual articles make it necessary. All prices are those published on the website www.fni.it. Is a customer’s responsability kept updated to the price list in force. it is forbidden to reproduce the price list without our written permission.

Payments: Payments must be done to Forniture Nautiche Italiane Srl at the deadline for the agreed amount. The payment terms must be agreed with the management. The late payment of invoices over the agreed terms determines the start of interest entitlement and the consequent suspension of ongoing or future supplies. In the case of deferred payment sale the property of the goods remains to the vendor, and does not pass to the buyer until after the full payment of the price (Art. 1523 at segg.cc). During this period the supplied goods may be claimed by the seller, wherever they are, even if combined or incorpate to goods to the buyer or any third party; also the same seller is authorized to retain from now on account of installments already received damages. The coverage of the price with checks, bills, drafts and transfers do not contribute to the payment if not successful securities and does not produce in any case novation of the original claim, nor any prejudice to the covenant of the reservation of ownership.

Shipping: The goods travel at the risk and peril of the customer. only shipments by courier Bartolini, are insured by us against the risk of theft, damage or loss, even if partial. To give effect to such insurance is necessary to accept the shipment by the carrier “with reservation”, specifying the exact reason. After the verification of damage, this must be reported by FAX or e-mail attaching a copy of the acceptance “with reservation” of the goods, and will be returned free of charge as missing or damaged. If the goods are accepted without reservation Forniture Nautiche Italiane srl will not intervene in any way for compensation. The responsability of Ex Works shipment is to the client with the associated risks of theft, loss or damage, even partial, any disputes are to be made directly to your carrier. All shipments, unless expressly stated to the transport will be carried out by the courrier considered most appropriate by the company. Any delay in delivery will not be able to justify claims for reimbursement of payment of damages. Any complaints about the goods will only be accepted if made within 8 days of receipt of goods.

Returned Goods: Returned goods must be strictly authorized, and accompanied by the return authorization number in advance required. The goods not accompanied by the authorization will be refused and returned to sender. it is possible to give back  the goods no later than 20 days after the invoice date, or no later than the time provided by law. The shipment must be made shouldering the shipping costs, if agreed in advance will be accepted Ex Works shipments but with a charge of the cost on the next bill. The DDT made must be received complete with number and date of DDT or purchase invoice and return number assigned to you. This absence will be grounds for non-acceptance of return. The goods must be in exactly the condition in which it is received. The non-conforming goods will be refunded. A reimbursement for the costs of handling will be charged 20% of the value with a minimum of € 10.00 subject to higher net write-back, which will be billed at cost. The credit note, when due, will be issued within 12 months from the date of invoice.

Warranties: It guarantees that the product supplied is free of defects for the purposes of normal use for a period of one year from the date of shipment. Within that period, all the pieces will be replaced by us recognized as defective for reasons dependent on the material or workmanship, provided they are not changed. Our responsibility is in any event limited strictly to the replacement of defective parts, declining any responsibility for any consequences or damage arising from the goods supplied, including the labor for disassembly and assembly and for the purchase of complementary parts. The warranty does not include labor to replace supplies, travel or transportation. Any refund is not allowed for incidental expenses incurred or to be immobilized or for hauling and launching boats or other expenses. Any other warranty, even the law of excluded and shall be deemed superseded by these conditions. The purchaser waives its right of recovery.

Forum: For any dispute, however, dependent on contracts governed by these conditions of sale, even in cases of continence or joinder where the seller is the defendant, is exclusive jurisdiction of the courts of Livorno.

Forniture Nautiche Italiane S.r.l. disclaims any responsibility for possible inaccuracies contained in this catalog due to printing errors or transcription; We reserve the right to make changes to its products that it considers necessary or useful without undermining the essential characteristics. The pictures of the products and their technical and aesthetic as well as their colors are for demonstration purposes only and are not binding and may in no case be used for possible complaints. The commercial management of Forniture Nautiche Italiane S.r.l. reserves by letter signed to authorize the use and publication of photographic material of his property.
