Protocol for receiving and rehabilitating children rescued/repatriatedfrom other Districts/States
The protocol has been divided into various stages in the rescue/repatriation and
rehabilitation process. A11 the steps should be followed for ensuring the best interest of the
rescued Children:
1. Arrangements prior to receiving children:
. The District Administration should identify various safe places for housing the
rescued/repatriated children immediately in the District. The safe place might be
existing Child Care Institutions or other such short term rehabilitation establishments
(Swadhaar, Ujjawala etc.) in the District. A1l these establishments must have been
declared as fit institutions by the Child Welfare Committee of the District. In case
such establishments do not exist, temporary safe places might be identified by the
District Administration and declared as fit institutions by the CWC. The plan for
housing these children should be in place prior to the arrival of the children in the
District.o Availability of a panel of counsellors, social workers, doctors for providing
immediate services to the children.
o Adequate food, medicines, clothing and transport arrangements for the rescued
children
2. Receiving children:
o A team comprising of representatives of the District Administration (including
professionals from the DCPU) and Childline (if present in the District) should receive
the Chidren. Incase there are girls; a lady should be part of the team.
o It should be ensured that media is sensitised to respect the right to privacy of the
child.o A list of the number of children along with basic information like name, sex, age etc.
should be prepared at the time of receiving the children. The children should be sent
to their respective places of stay as per the plan finalised prior to their arrival.o No claims by parents, relatives etc. to claim children at this stage should be
entertained.
o The children should be provided with clothes, food, bedding, water, soap, oil and any
other forms of immediate care that might be required at the place of stay. Children
needing medical care should be immediately shifted to the district hospitals.
o Care should be taken to segregate yorlnger and older children and boys and girls at the
place of stay. Care takers should be assigned appropriately.
o The place of stay should be secured by a boundary and entry of visitors withoutauthorisation and media should be strictly prohibited

o Standards of care prescribed in the Operational Guidelines for maintaining minimumstandards of care by the Department (Notification No. 18594-WCD-CW-MISC-0021112012-WCD, dated 30-10-2012) should be followed.
3. Production before CWC:
The Children should be produced before the CWC within 24 hours of arrival in theDistrict. Considering the number of children and their condition during rescue, theCWC mightbe requested to conduct its seating in the premises where childrenA debriefing session should be conducted by the CWC with each Child in thepresence of the DCPU staff. Information regarding the parents/guardians of thechildren should also be sought from the children. The CWC should pass interimorders for temporary rehabilitation of the children at the place of safety.The DCPU staff will conduct an inquiry for each child based on the informationreceived from the children and submit a report within a period of 15 days to the CWC
4. Rehabilitation of Children:
During the process of inquiry, if the parents/guardians are traced, the CWC shall givesummons to them to appear before the CWC within a week.
a) rf the parents/guardians are willing to take custody of the child
o The CWC will try and understand the causes for which the child was sent to thelocation from which he/she was rescued and assess whether the parents are ht to takeresponsibility of the child and if so, the parents/extended family will be counseled toassume responsibility of the child.
CWC should assess the case based on the documents produced by the claimants(parents/guardians), the DCPU recommending restoration of the child to theclaimants. Based on this assessment, the committee should decide whether theparents/guardians are fit to look after the child. If the parents and guardians are foundto be fit individuals, then the CwC can pass an order that they find theparentslguardian fit and handover the child to the parents/guardians (JJ (C&p) Act 39-3(a)) The parents/relatives/guardians have to sign an undertaking in Form-IXoutlining their responsibility as parents.
The following verification process should be followed prior to handing over the childto the claimants:
i. Birth certificate of the child, his/her school leaving certificate, and familyphotographs (if available).

ii. CWC should cross question the parents and verify using different means to
establish the authenticity of the parents such as a telephonic call to the Sarpanch
of the village etc.
b) If parents are not willing to take custody of the child
Incase during the process of interaction, the CWC establishes that there is
substantial evidence indicating that the parents/claimants are not fit individuals or unwilling
to take responsibility of the child, the CWC qan order to house the child in the Children's
Home for not more than one year. The CWC should clearly indicate the reasons for the
decision such as care, treatment, education and rehabilitation. The CWC should recommend
counseling or other support services (like linkage to various government schemes) for the
parents so that their capacities are enhanced to take care of the child and the child can be
reintegrated with the family in the shortest possible time.
c) If the child does not have a claimant
If the parents/guardians of the child caxnot be placed and no one comes forward to claim the
child than the protocol for missing, abandoned child should be followed.
5. Follow-up post Restoration:
The District Child Protection Unit should maintain records for each child and follow
up on the progress and whereabouts of the each child quarterly up to a minimum
period of three year. The follow-up should include follow-up visits at least on a
quarterly basis for the first one year and bi-annual visits for the next two years.
The progress repofts should be regularly provided to the CWC. Incase the child is
found to be not going to school or vulnerable in any other way, it should be
immediately brought to the notice of the CWC.
Regularly counseling and motivational support should be provided to both the child
and the family.
In cases where the family needs support for taking care of its children, various
linkages can be done with the support of the District and Block administration and
Panchayat for strengthening the family. Options for provision of sponsorship from the
District Sponsorship Fund should also be explored.
A list of these children should also be provided to the respective Block and Panchayat
Level child protection committees for local level monitoring.
