General Conditions of Sale

All timber on offer in this sale is covered by Chain of Custody Certificate No FSC: SA-FM/COC-007002 and PEFC: SA-PEFC-FM/COC-007002. These certificates were issued on 12 November 2019 under the QUALIFOR Programme by SGS Forestry. 1. The sale of each Lot is subject to the Standard Contract, specimens of which

may be obtained from the Chief Executive, Forestry and Land Scotland, 1 Highlander Way, Inverness Business Park, Inverness IV2 7GB (Telephone: 0131 370 5541). These agreements describe the normal terms of trading; application of these terms, which is at the sole discretion of Forestry and Land Scotland, is subject to the establishment of satisfactory credit worthiness.

2. The description of the trees in the Sale Catalogue is believed to be accurate

but is not guaranteed except as to the number of trees in tariffed Standing Timber Agreements offered for a lump sum. In all other respects the Purchaser is held as satisfying himself as to the description of the Sale Lots.

3. Arrangements to inspect the timber should be made direct with the Forest

District staff listed. An address list is on the last page of this catalogue. Site boundaries will be clearly marked in a common manner. External boundary trees will be marked with white tape or marking, i.e. the trees to be left standing after harvesting operation. Purchasers will be deemed to have acquainted themselves with arrangements for access and constraints, if any, in respect of each Lot, details of which are also available from the Forest District.

4. Prospective purchasers are advised to consult a copy of the map of timber

haulage (preferred) routes on public roads before bidding for the lots where these apply. Copies of all the maps together with a statement of preferred routes are held by the Regional Managers also all local authority Divisional road Surveyors within the Region.

5. The commencement and completion dates for all agreements are as

indicated against each Lot in the catalogue. 6. No Lot carries entitlement to continuity of supplies of timber outside the

terms and conditions of the Agreement. 7. All bids/offers shall be exclusive of Value Added Tax, which shall be added to

the purchaser price of each Lot at the appropriate rate.

8. Conditional Bids - FLS shall only consider conditional bids for Roadside lots if they meet the terms laid out in Particulars of Sale, Logs at Roadside, paragraphs 10 – 13.

Particulars of Sale

Standing Timber

1. Lots are either offered for lump sum bids or bids per tonne as clearly described on the top of each page in this catalogue.

2. Lots offered for lump sum bids - All volume estimates have been derived

from a full Tariff unless otherwise stated. Tariff sheets may be inspected by appointment at the relevant Forest District Office. Volumes quoted for such sales in this catalogue are estimates of the volume of the standing trees only. The prospective purchaser shall therefore be deemed to have formed his own estimate of volume and nothing herein or in the said record shall be taken as a representation including a contract or as a condition or warranty forming part of the contract if and where made.

3. Purchasers will be deemed to have satisfied themselves as to the occurrence

of butt rot and stain and no subsequent allowance or reduction will be made. 4. Prospective purchasers are advised to obtain a copy of the Harvesting Site

Plan from relevant Regional Managers for each standing sale. These plans detail specific operational requirements for each sale parcel.

5. Purchasers will be deemed to be acquainted with the provisions of Forestry

and Land Scotland’s Forests and Water Guidelines publication and to ensure that they are accorded with in their harvesting operations

Logs at Roadside

6. Presentation of sawlogs for sale will be in accordance with the Forestry Commission's Field Book No.9 "Classification and Presentation of Softwood Sawlogs", a copy of which can be obtained on request from the Chief Executive, Forestry and Land Scotland, 1 Highlander Way, Inverness Business Park, Inverness IV2 7GB

7. Lots are either offered for a price per cubic metre underbark or for a price

per tonne as clearly described on the top of each page in this catalogue. 8. Where lots are offered for a price per cubic metre underbark - the volume of

the timber will be calculated from the weight of loads supplied, converted to volume using volume/weight fixed conversion factors where such agreements currently exist between Forestry and Land Scotland and relevant parties. Successful purchasers that do not have an agreement for fixed conversion factors with Forestry and Land Scotland shall be given the opportunity to adopt the relevant fixed conversion factor(s) based on the national data set within the relevant supplying location. Failing such an

agreement being reached, conversion factors shall be calculated from measurements of the volume of 1:10 sample loads. The volume of the sample loads will be obtained by the methods described in Field Book 9.

9. The average DBH of the standing trees from which the logs will be produced

is an estimate only, provided for the guidance of prospective purchasers - it is not guaranteed.

10. Forestry and Land Scotland (FLS) carefully consider the log specification, including the product range, for sawlogs and roundwood and advertise them for sale at roadside on this basis. In the event of a conditional bid being placed, FLS shall only consider a request to change that specification if it falls within the Minimum Top Diameter, Minimum and Maximum lengths and Average DBH as advertised in the sale catalogue. Any condition outwith this range shall be excluded.

11. Conditional bids that do not influence the advertised specification and

therefore the value of the sale lot shall of course be considered wherever possible.

12. In the event of a conditional bid being accepted, FLS reserve the right to vary the contract volume if the breakout is adversely affected.

13. Conditional Bids must be recorded on a Lot by Lot Basis. FLS shall not accept conditional bids condensed into 1 single Lot and covering multiple lots. FLS reserve the right to exclude any conditional bids that are not correctly submitted on a Lot by Lot basis
