Applicants who provide false or misleading informationmay either have their applications refused, or their visapermitting them to remain in Australia cancelled.

Health requirementsAll applicants are required to meet Australia’s healthrequirements. You and your family unit members included inthis application may be required to undergo a chest x-ray andmedical examination. Please refer to form 1163i Healthrequirement for temporary entry to Australia for furtherdetails.

If applying outside Australia under Assessment Levels 3, 4, or 5,you should not undertake your medical or x-ray examinationsuntil advised to do so by the Australian Government office.

Members of the family unitThe term ‘members of the family unit’ covers your spouse anddependent children of you or your spouse, who are unmarriedand have not turned 18 years of age. School-age dependantsare unmarried dependent children of you or your spouse whohave turned 5, but have not yet turned 18 years of age.

Members of your family unit may apply for visas that will allowthem to join you in Australia. They may apply for visas at thesame time as you, or after you have arrived in Australia andcommenced your course of study. If you are in Australia andyour family members intend to apply to join you in Australiaafter you have commenced your course of study, you will needto complete form 919 Student dependant nomination. Youmust send this form and other necessary documentary evidenceto your family members for them to lodge at the relevantAustralian Government office.

Note: If you are processed at Assessment Levels 3, 4 or 5 andintend to undertake a course of 12 months or less in duration,members of the family unit will not be permitted to accompanyyou to Australia on a student visa.

All members of your family unit must be declared onyour application form, whether or not they intend to travelto Australia with you. A member who is not declared will not beeligible for entry to Australia as a family unit member, unlessthey were not your spouse or child at the time you lodged yourapplication but have since become so.

A school-age family unit member joining you in Australia isexpected to attend school in Australia. You must provideevidence of enrolment for them in order to be granted a studentvisa as a family unit member. You are responsible for theireducation costs in accordance with the charging policy of therelevant Australian State or Territory.

Your spouse will have a condition placed on their visa that limitstheir period of study in Australia to a maximum of 3 months.If they wish to undertake a course(s) of study beyond thisperiod they must apply for a student visa in their own right.

If you are an AusAID or Defence-sponsored student, membersof your family unit must provide evidence of support of therelevant Minister for them to be granted a visa as a studentdependant.

‘No further stay’ conditionsYour visa will be subject to a number of visa conditions.Information on these conditions can be found in theinformation form 1160i Applying for a student visa and theDIMIA website.

In certain circumstances, your visa may be subject to the ‘nofurther stay’ condition 8534 or 8535.

Condition 8534

If you are an Assessment Level 3, 4 or 5 student whose overallintended period of study is 10 months or less in duration, youwill usually be subject to a ‘no further stay’ condition. Thismeans that after entering Australia, you may not be granted anyother visa while you remain in Australia, other than a furtherstudent visa with permission to work or a Graduate – Skilledvisa1. You may be exempt from the mandatory imposition ofthe ‘no further stay’ condition if you are an Assessment Level 3student and can show an additional A$12,000 and funds to coverliving and school costs for a 12 month period in addition to theperiod of your intended study in Australia.

A ‘no further stay’ condition may also be imposed on your visa,irrespective of your Assessment Level or period of study, if thedecision maker considers this appropriate.

Condition 8535

If you are sponsored by the Commonwealth of Australia or thegovernment of your home country, you may be subject to a ‘nofurther stay’ condition. This means that after entering Australia,you will not be entitled to be granted any other visa while youremain in Australia apart from a further student visa withpermission to work or a further student visa with the consentof your sponsor1.

Visa application chargeYour completed application form, together with the correct visaapplication charge, can be lodged at the nearest AustralianGovernment office if applying outside Australia, or at the nearestDIMIA office if applying in Australia. You can check the visaapplication charge with your nearest DIMIA office, or fromform 990i Charges, which is available in the Forms section ofDIMIA’s website www.immi.gov.au

Payment must accompany your application and is generally notrefunded if the application is unsuccessful. If you have paidenrolment or tuition fees, it is your responsibility to get a refundof these fees.

To make a payment in Australia, please pay by credit card, debitcard or by bank cheque or money order made payable to theDepartment of Immigration and Multicultural and IndigenousAffairs. Please do not pay by cash or personal cheque.

For clients outside Australia, before you make a payment, pleasecontact the Australian Government office to find out whatmethods of payment can be accepted at that office.

Authorisation of a person to receive writtencommunicationsYou may authorise another person to receive all writtencommunications about your application for a student visa withDIMIA. That person will be known as your authorised recipient.To do this you will need to complete Question 73 Options forreceiving written communications and Question 75 Authorisedrecipient details in this form. The authorised recipient will needto sign at Question 77. You can only appoint one authorisedrecipient at any time. DIMIA will communicate with the mostrecently appointed authorised recipient.

DIMIA is required under section 494D of the Migration Act1958 to send to your authorised recipient any writtencommunications relating to your application that wouldotherwise have been sent to you. DIMIA will only send to yourauthorised recipient information which you are entitled toreceive. For example, if you are a visa applicant and have asponsor, your authorised recipient will not receive personalinformation about your sponsor, unless your sponsor alsoappointed the same authorised recipient.

If you decide to change the authorised recipient that you havenominated after you have lodged your application, you mustpromptly advise DIMIA in writing of the details of that person.

If you are a Business Skills visa holder and need to advise DIMIAof a change of authorised recipient you should use form 922Notification of address or change of address for Business Skillsvisa holders.

Authorisation of a migration agent to act on your behalfIf you have a migration agent acting on your behalf in relationto your application for a student visa you need to completeQuestion 73 Options for receiving written communicationsand Question 78 Migration agent details. The migration agentwill need to sign at Question 80.

Appointing a migration agent to act on your behalf includesauthorising DIMIA to send to that agent any writtencommunication about your student visa application that wouldotherwise have been sent to you.

You will be taken to have received any documents sent to thatagent as if they had been sent to you.

When you provide details of the migration agent please makesure you give the agent's 7-digit migration agent registrationnumber (MARN) and the agent's full name.

If you change your migration agent or end his/her appointmentafter you have lodged this application you must promptly adviseDIMIA by using form 956 Appointment of migration agent orexempted agent, which is available on the DIMIA website orfrom your migration agent. You should also notify the agent ofthis, preferably in writing.

Appointing a migration agent to act on your behalf includesauthorising DIMIA to:• discuss your student visa application with your agent and

seek further information via your agent; and• send to your agent any written communication about your

student visa application that would otherwise have been sentto you. This means your migration agent will be yourauthorised recipient for written communication undersection 494D of the Migration Act 1958 and you will be takento have received any documents sent to the migration agentas if they were sent to you.

DIMIA will communicate with your agent about yourapplication, including your personal information such as health,police checks, financial viability and personal relationships. Ifyour agent authorises it, this communication may take place bye-mail. DIMIA will only send to your agent information whichyou are entitled to receive. For example, if you are a visaapplicant and have a sponsor, your agent will not receivepersonal information about your sponsor, unless your sponsorhas also appointed the same agent.

In some situations DIMIA staff will need to speak with youdirectly, rather than your migration agent, for example, if youare applying for a visa DIMIA may interview you about yourpersonal circumstances relevant to the visa application. In somesituations DIMIA staff will also send documents to you directly(such as your passport) instead of sending these to your agent,but will inform your agent that it has done so.

If you have appointed a migration agent to act for you, you arestill responsible for the accuracy of information and supportingdocumentation that you provide to your agent so that youragent can provide it to DIMIA.

Using a migration agentYou are not required to use a migration agent. However, if youintend to use a migration agent you are advised to use aregistered migration agent.

Under Australian law, anyone who uses knowledge of migrationprocedures to offer immigration assistance to a person wishingto obtain a visa to enter or remain in Australia must beregistered.

Using an agent exempted from registrationOnly registered migration agents can provide ‘immigrationassistance’ for a fee or gift. Consent to communicate electronicallyDIMIA may use a range of means to communicate with you.However, electronic means such as fax or e-mail will only beused if you indicate your agreement to receiving communicationin this way.

About the information you give in this formDIMIA is authorised to collect information provided on thisform under Part 2 of the Migration Act 1958 ‘Control of Arrivaland Presence of Non-Citizens’. The information provided willbe used for assessing your eligibility for a student visa to travelto and enter and/or remain in Australia, to monitor the conductof migration agents, and for other purposes relating to theadministration of the Migration Act.

The information you provide might also be disclosed to agencieswho are authorised to receive information relating to adoption,border control, business skills, citizenship, education, healthassessment, health insurance, health services, law enforcement,payment of pensions and benefits, taxation, review of decisionsand regulation of migration agents. It will also be disclosed toany agency of the Commonwealth of Australia, or of a State orTerritory, that is responsible for or otherwise concerned withthe regulation of education providers.

The information on this form, including the results of any testsfor Human Immunodeficiency Virus (HIV), will be used toassess your health for an Australian visa. A positive HIV or othertest result will not necessarily lead to a visa being denied. Yourresult(s) may be disclosed to relevant Commonwealth, Stateand Territory health agencies.

In addition, the relevant registered education provider(s) maybe told whether or not your visa has been granted. Thecollection, access, storage, use and disclosure by DIMIA of theinformation you provide in this form is governed by the PrivacyAct 1988 and, in particular, by the 11 Information PrivacyPrinciples. The information form 993i Safeguarding yourpersonal information, available from DIMIA offices, gives detailsof agencies to which your personal information might bedisclosed.

The Freedom of Information Act 1982 also relates to yourpersonal information. Under this Act you can apply for accessto documents containing your personal information. You orsomeone authorised to access information on your behalf canapply to do this at any DIMIA office in Australia. There is no feefor accessing your own information. If you are overseas, youmust also provide the Australian Government office with anaddress in Australia to which copies of personal records can besent. More information on how to make a request under theFreedom of Information Act is given on form 424 Request foraccess to documents.

Review rightsIf you apply for a student visa in Australia and you are refusedthe visa, you may apply for a review of the decision. You will benotified of your review rights in writing and the time limits forlodging such an appeal.

There are no review rights for decisions to refuse a student visawhere the application is made outside Australia.

82 The following declaration must be signed and dated by all people over18 years of age included in this application.

Both parents or any person who has legal custody must complete thedeclaration on behalf of any children under 18 years of age or any personwho lacks the legal capacity to sign on their own behalf.

• I certify the information supplied on or with this form is correct.

• If granted a visa, I acknowledge that I am required to abide by itsconditions as outlined in the information form 1160i Applying for astudent visa.

• I have attached all documentary evidence as specified on the DIMIAwebsite for my Assessment Level and the visa subclass under whichI am applying.

• I acknowledge that I understand that if the 8534 visa condition isimposed on my visa, it will be indicated by the condition code ‘8534’and by the short description ‘No Further Stay’. I acknowledge that thismeans that the 8534 condition has been imposed on my visa andthat I will not, while in Australia, be entitled to the grant of any othervisa 1, apart from:

- a further student visa with permission to work, the application forwhich was made on form 157P; or

- a subclass 497 (Graduate-Skilled) visa.

• I understand that the effect of the 8534 visa condition is that it willnot be possible for me to apply to remain in Australia beyond theauthorised date on my visa label 1 and that I will be required to departAustralia on or before the date notified on my visa label. I agree tohaving this condition included on any visa issued to me as a result ofthis application if DIMIA decides to impose it as a condition of grantof a visa.

• I acknowledge that I understand that if the 8535 visa condition isimposed on my visa, it will be indicated by the condition code ‘8535’and by the short description ‘No Further Stay’. I acknowledge thatthis means that the 8535 condition has been imposed on my visaand that I will not, while in Australia, be entitled to be granted anyother visa 1, apart from:

- a further student visa with permission to work, the application forwhich was made on form 157P; or

- a further student visa, with the consent of my sponsor.

I understand that the effect of the 8535 visa condition is that it willnot be possible for me to remain in Australia beyond the authoriseddate on my visa label 1, unless I am applying for a further student visawith the consent of my sponsor, and that I will be required to departAustralia on or before the date notified on my visa label. I agree tohaving this condition included on any visa issued to me as a result ofthis application if DIMIA decides to impose it as a condition of grantof a visa.

• I am aware that I must immediately advise DIMIA if I become awarethat any information provided in this form is incorrect or if there is achange in my circumstances that are relevant to this application atany time.
