By BARBARA FULENWIDER When a proposed tax rate is less from one year to the next yet more money will be col- lected to fund a city, council members usually unanimously approve it. At Missouri City’s Oct. 6 council meeting the vote was 6-1 with At-Large Councilman Chris Preston voting nay on all three motions to adopt. Council voted to adopt the interest and sinking (I&S) tax rate of $0.177907 per $100 val- uation and that was approved 6-1. Last year’s I&S rate was $0.19337. Then they voted to adopt the maintenance and operation (M&O) tax rate of $0.387093 and again the vote was 6-1. Last year the M&O rate was $0.38038. The third vote to adopt the total tax rate of $0.565000 compared to the 2014 rate of $0.57375. The motion to ap- prove resulted in the same 6-1 vote. Property values increased by 7.19 percent, which means even though the tax rate de- creased, property owners will pay more. For instance, the owner of a house valued at $100,000 will pay $6.71 more in city taxes this year than last. At the Oct. 6 meeting, At- Large Councilman Jerry Wyatt pointed out, “This tax rate is actually a reduction from our current tax rate. I think mem- bers of the budget committee try not to ask citizens for any more than we need. While there was a tax rate reduction taxes went up because values went up. “The good part,” Wyatt said, “is our commercial contribu- tion from all the businesses – Lakeview Business Park, Ben E. Keith, etc., – have increased to 28 percent” of the total taxes the city collects. “The fact is everybody in Missouri City will benefit from this tax reduction.” Wyatt noted that most of the warehouses in Missouri City are owned by the companies that occupy them. He said the city, county and water district all give tax abatements to vari- ous businesses, “which works to Missouri city’s benefits to continue to get those types of places coming in.” Background information provided to council says the to- tal tax rate will yield approxi- mately $925,000 more in tax revenues for 2015 and provide for increased public safety. The extra funds will buy the city a $625,00 fire engine, a $96,075 public safety in-car camera program and $94,780 will fund a public safety au- dio recording system. Another $108,231 will buy a commu- nications program for first re- sponder vehicles. LACE UP AND BE THE DIFFERENCE. It’s time to put on and lace up those sneakers. Missouri City cuts tax rate on a 6-1 vote By SESHADRI KUMAR The November general elec- tion is upon us and early voting begins next Monday, Oct. 20. But, there is no election fever, at least in Fort Bend County. The campaign signs at some major road intersections are the only reminder that there is an election. Of course, the school bond election is on the mind of some and their concern is not so much about politics as it is about over- crowded schools. Statewide races like the gov- ernor and lieutenant governor, however, figure in television broadcasts and news reports. While the Republican Party candidates at county level had some contested primaries and did some campaigning, Demo- crats did not even have much of a contested primary. Campaign ads in print media are a rarity and some mailers are likely to arrive toward the last few days before the elec- tion. Consequently, voters may know very little about the can- didates. Some names have not even been heard anytime be- fore and probably, will be seen for the first time on the ballot. The incumbents have a slight advantage of name recognition. The county election admin- istration and the school district have published election notices elsewhere in this newspaper. Though the governor’s race may be a factor to draw more voters to the polls, the voting is likely to be poor or lackluster as in the previous, non-presiden- tial elections. The turnout was 45 percent in 2010, with Rick Perry and Bill White on top of the ballot. This year, the heated race is between Greg Abbott (R) and Wendy Davis (D) for governor. Also, running for governor are Kathie Glass, Libertarian and Brandon Parmer, Green Pat candidate. The lieutenant governor’s race is also keenly watched be- cause of a Houston candidate, conservative State Senator Dan Patrick. He faces Sen. Leticia Van de Putte (D). Robert D. Butler, (L) and Chandrakantha Courthey (G) are also in this race. In countywide races, incum- bent County Judge Bob Hebert faces James F. Pirtle (D). Incumbent Republican Dis- trict Attorney John Healey is opposed by Wilvin J. Carter, a Democrat. Incidentally, Carter’s wife Tameika Carter, (D) is running for County Court-at-Law Judge #1. The Republican candidate is Chris Morales. If both the Carters win, would Prosecutor Carter try a case in the court of Judge Carter? Prob- ably, not, a special judge may have to hear the cases argued by Carter. This situation will arise only if both the husband and wife win the election. In other countywide races, incumbent District Clerk An- nie Rebecca Elliott (R) is chal- lenged by Democrat, Michael D. Antalan. County Clerk candidate Lau- ra Richards (R) faces Lila Vil- lagomez (D). Justice of the Peace Pct. (1), Place 2 incumbent Mary Ward (R) is opposed by Karen Me- doza (D). In the races for Texas House of Representatives, Dist.26. State Rep. Rick Miller, (R), in- cumbent, is challenged by Am- ber Passo (D). In Dist. 27 incumbent Ron Reynolds (D) faces David Ham- ilton (R). Hamilton is banking on the fact that Reynolds is awaiting trial in Montgomery County on 10 counts of felony charges of barratry or ambu- lance chasing. In Dist.85, incumbent Phil Stephenson (R) faces Cynthia Drabek (D). The ballot also has a state- wide Proposition. Prop. 1, if approved, will amend the Con- stitution to allow for a portion of severance tax revenue, a production tax paid by oil and gas companies, to go toward the state highway fund. Early voting begins Monday FBISD Bond: Yes, no or don’t care It is crunch time. Fort Bend ISD board of trustees and the administration have taken a critical step. They have called the $484 million bond election. The administration has made its best case for this referendum. It has played the right cards. A well established facilities master plan, an imminent need to build new school campuses to get rid of trailers, the need to have a technology upgrade and up to date security are among the factors which led to the bond election. The administration has also announced that there will be no increase in tax rate to pay for the debt. What else can you ask for? If the pressing needs of the district can be met with no additional burden on taxpayers, that is a recipe for success, say the pro- ponents of the bond. But that is not all. Besides those who are ready to vote yes for the bond, there are those who would vote no and a third segment, that really does not care one way or the other. Among the opponents of the bond, there are two groups. One group of voters are op- posed to a number of aspects like the security cameras in bus- es and the proposed career and technology center. Another group is more op- posed to the timing of the bond election than the bond referen- dum itself. In fact, at the very first public hearing on the proposed bond election, the dominant senti- ment among speakers was to delay the bond election until next May. This group wanted the feeder patterns and boundary studies completed first before deciding on future campuses. But, the administration and the board of trustees did not heed. Those who believed in the new superintendent and the board of trustees, as a welcome change from the past, were somewhat disappointed that the board ignored their plea for delaying the election until the boundary studies and feeder pat- terns are completed. More significantly, the ad- ministration did not satisfy this section of the public on why the election should be held now and what harm would be caused by having the election in May. Even some of the yes voters say they do not like some parts of the bond proposal. However, they have faith in the board and will take up the issues on a case by case basis when time comes for approval those items. To pacify those who wanted immediate boundary and feeder pattern studies, the administra- tion announced an expedited schedule, but promised changes only for the two new elementary schools and some other cam- puses, leaving the door open for complete feeder pattern and boundary studies for the future. Even a couple of board mem- bers are not happy with this de- velopment, but they may not venture to oppose the bond in the larger interest of the district. The debate over the bond election is taking place more on the Facebook page FBISD Con- cerns. Comments on this page pretty much reflect the prevail- ing sentiment among FBISD voters. It would be worthwhile to recall some of the opinions expressed by the Facebook group. An interesting comment reads: If saying “no” means you believe other concerns need to be reviewed first, that’s logi- cal. Saying “no” as some sort of punishment sound more like revenge or something. A bond opponent comment- ed thus: My main problem all along is the all or nothing approach to the bond package. The Admin- istration and the Board chose this path, not the voters, not the teachers, not the students. I do not agree with the Cam- eras, security fences and win- dow film in the Safe & Secure Plan because from first hand knowledge I do not believe it is going to make any student safer and it will not make our schools any more secure. I do not agree with adding cameras and GPS to existing buses that do not have seat belts or AC. I do not agree with putting a wireless network on debt since these are items that only last a couple years. I do not agree with handing FBISD $56 mil- lion for CTE with no plan, no programs and no idea how it will be spent. A bond supporter followed:As of right now, I plan to vote “yes” and will support the dis- trict when they ask for money for schools and will actively oppose money being spent on items such as window film and new cameras. I am not thrilled about cameras in our schools and not thrilled it is in the bond. I would much rather add a lot of teachers who can be so much more effective in controlling discipline issues real time. But the most compelling case has been made by those who want the boundary studies first and the bond election in May. Impartial observers will be hard pressed to reject this line of ar- gument. less from one year to the next yet more money will be col-lected to fund a city, council members usually unanimously approve it.

At Missouri City’s Oct. 6 council meeting the vote was 6-1 with At-Large Councilman Chris Preston voting nay on all three motions to adopt.

Council voted to adopt the interest and sinking (I&S) tax rate of $0.177907 per $100 val-uation and that was approved 6-1. Last year’s I&S rate was $0.19337.

The vote no group repre-sentative has been an activist-parent and has devoted a lot of time to fi nd solutions to the issues faced by the district. Her opinion does command weight. Her explanation follows:

“Everyone should do their homework before early voting begins next Monday, October 20. There are certainly reasons to vote for the bond. No one can argue that there isn’t serious need in our district. But - after careful deliberation on my part, I’ve opted to vote no until I see changes that highlight our district’s ability to appropri-ately utilize existing funds and facilities.

If you are on the fence - - here are some reasons why many will be voting no on the bond -:

We need to show FBISD that feeder, boundary and academy changes must be completed fi rst. They need to show us they can utilize our existing funds and facilities wisely. Then, we will vote for a bond.

• Vote No because changes to boundary/feeder were vetted by the community and a plan was approved by the board last Spring – but now FBISD says changes could take 2 to 5 years. We have the data – make the changes now.

• Vote No because FBISD is not addressing most of our se-verely overcrowded and under-utilized schools! In 2015 they will only implement lines for the 2 new elementary schools. Unacceptable.

• Vote No because after FBISD assured residents that the Global Studies Academy is-sues would be handled prompt-ly, they have not yet explained how or when. Should problems wait until current students have graduated?

• Vote No because this $500 Million bond which was pulled together in two months in-cludes questionable expendi-tures like close to $60 Million for unspecified Career and Technical Education improve-ments and tens of millions of dollars of padding that will be used to pay for short lifespan maintenance & operations

items. Do you want to still be paying in the year 2045 for carpets installed in 2015?

• Vote No because the bond does not include any high school additions or new builds even though many of our high schools are already at maxi-mum capacity with new com-munities being built as we speak.

• Vote No because you’re tired of hearing “Be patient – these things take time.” They have the necessary data to implement change now. They are stalling in the hopes that we will vote for the bond. Once we do, will change ever come?

Vote No – and show FBISD that we want our broken dis-trict fixed first. We need a bond – no one can dispute that. But, let’s fi x our existing issues fi rst so we can be sure the bond package we approve adequately addresses where our real needs are.

You can’t vote for spending money on new buildings and/or additions before fi guring out for certain where that money needs to go. I am not comfort-able writing a $500 Million check to a district that once again has kicked the boundary/feeder can down the road; a District that rushed into pulling a bond package together in 2-3 months, without considering how future changes will im-pact need; a District that has included $60 million for CTE with no specifi c idea/explana-tion how/where those funds will be spent; a District that spent considerable funds on a consultant-driven process last year that is being cast aside for another consultant-driven process this year.

I gave my all last year; I devoted hours upon countless hours as did so many other community residents. Why? Because I thought “This is dif-ferent; this is an admin that is going to do what it says; that is going to listen to the communi-ty; that is going to make smart decisions.” I feel duped. I feel like if I hear “be patient - stay with us - these things take time” one more time, I may lose it. Boundary/feeder could happen now. All the data already exists. It could/would/should have an enormous impact on where dol-lars should go. The bond needs

to be step 2.Why do you suppose the

Board and Admin opted for November instead of May? Why the sudden hurry up offense? Why - when during the entire facilities planning process, we were all told repeatedly that it was not about a bond, but about fi guring out how to best utilize our facilities, and determine where new facilities may be needed - why was bond brought to the table one month later? Why was the bond made the primary focus instead of the boundary/feeder work?

The fact that not more than two board members have ex-pressed concern about the delay to feeder/boundary work is very disconcerting - - that does not mean the data is not compelling enough. We did vote for these individuals - - that does not mean they are doing their jobs effectively.

Anyone who has been attend-ing board meetings , who sat on the facilities planning com-mittee; who has been watching boundary/feeder issues for 7 years; or who has been listening to all that has unfolded for the past 6 months, - - would surely know that our Admin and Board are very aware of feeder and boundary changes that need to be made; they are very aware based on data how to make those changes; they are very aware how to go about imple-menting said changes; and yet they are opting to simply use the line “have patience - - these things take time” to keep folks appeased and pass a bond that will not fi x much of what is cur-rently broken, and what will be broken once feeder/boundary changes occur - if ever.

I went wrong in trusting that decisions that in fact were made at the close of last year would be honored and implemented. I trust that our Board and Ad-min are good people; but that doesn’t mean they are doing the right thing. Good, smart people make mistakes too.

The bond and feeders are not separate. I am in no way using the bond issue to beat them into doing what I want. In fact

- those who have monitored this page for longer than the past week would likely remember that not that long ago I was one of very few who voiced

why folks should consider vot-ing YES on the bond. That was before Dr. Dupre revealed to me that no changes are likely for the 2015-2016 year, and in fact most will take 2-5 years, although the feeder plan time-line was accelerated such that it will be complete in January, an acceleration that was a di-rect result of Jenny Bailey and Kristin Tassin pushing admin on the fact that the data exists so that feeders can be done now.

As much as I respect Dr. Dupre, I also know and admire very much his amazing skills at using words in his favor without necessarily committing to any-thing. That’s a fantastic skill - - and one that I wish many of my PR clients had. Look for phrases like, “we might implement some change” or “these things take time” or “we are working on it”

- - what you surely won’t see is “Here is why we can’t implement changes now:

I am not anti-Board, nor am I anti-Admin. I am simply anti-inaction. All I ask is that they do what the district set out to do when we invested tons of money into consultants for long-term facilities planning. If they can’t do that, all I ask is that they tell us why. Tell us why a process that, according to current admin, could have been done in 3 months last year, is now doomed to take on a 2-5 year lifespan. Tell us why we have to engage the community on discussion points the com-munity already engaged upon last year. Tell us why we can’t make decisions using data from the Spring. Tell us why do they take time. What will time buy us?

If someone can give me valid data-driven reasons why 1) boundary and feeder can’t be done and implemented by fall 2015? And 2) why it makes sense to do the bond in November, be-fore we have properly utilized existing facilities? - I would stop digging. Interestingly, no one can answer/has answered those questions. Do boundary feeder. Start now. Finish in April. Bond vote in May.

After this eloquent presenta-tion, it is futile to prolong the debate.

I rest my case as well and will wait for the judgment on Nov. 4.

OF OHIO: Biles was re-cruited by Miami as a quar-terback and exhibited smart signal calling such as, “…Bile ran’em through the line and swept ‘em around the ends, and when he did call a pass it clicked.”

But, an injury cut short his playing days there, so he became assistant fresh-man football and basketball coach . He graduated with a Bachelor of Science degree in Education and received his Master’s degree in Phys. Ed. From Miami, still mak-ing time for a social life as a member of Sigma Chi frater-nity.

FIRST COACHING JOB: After graduation he immediately took a job as an assistant coach at a High School in Cincinnati work-ing his way up to head coach. (This caused a drastic reas-sessment of his carefully con-structed game plan.)

“I’ve had goals all my life and I thought I’d give myself fi ve years to be a head coach in this school. Then, when I got that, I said I would like to be an assistant coach in col-lege in fi ve years or take a good look at what I was do-ing.”

Woodward High School was a “fi rst-year school” and in its initial season Biles was forced to fi eld a varsity squad

of freshmen and sophomores. Those three seasons were a great “learning and teaching” experience. It could be a chal-lenge.

“These things won’t happen nowadays, but I literally had a kid who thought that a jock strap was a nose protector. He was young, and he didn’t know any better. So he was trying to put the jock strap on his face.”

XAVIER UNIVERSITY (A tiny Jesuit school in Cin-cinnati): Biles accepted a job as freshman coach. After a 16-4 record in fi ve years with

the freshmen, he seriously considered leaving the coach-ing profession.

However he was dissuaded from quitting when he was elevated to the head post at Xavier, at age 28, becoming the youngest head coach of a major college in the country. His staff consisted of a former Los Angeles Ram with NO coaching experience, an ac-countant and a man with one year of junior-high coaching.

“I had more guts than I had sense.” He now laughs about it. Working within the confi nes of a tight budget, Biles had to transport his teams in his fl at-bellied pickup to a practice area in the Spring because their regular practice area was the baseball diamond. His as-sistants all had nine-month contracts and moonlighted during the summer. In his fi rst season Xavier beat Kentucky, an upset on the order of “Sam Houston State beating A&M”.

Another game when he hoped to compensate for his fl u-stricken team – he sent out his Captains in street clothes for the opening coin toss.

He suited up the 8 players at half time, who had been ill but were released by the Doc-tor to play the second half. They nailed down a 29-28 vic-tory after trailing 21-0.

Biles’ Xavier teams were in-ventive. They featured at least one gadget play a game. “It started as a joke. Somebody asked where I developed one play. I remembered Wheaties breakfast cereal diagrammed plays and printed them and for laughs I said I found it on a box top. It caught on.” Biles didn’t/doesn’t drink or smoke.

Two of his linemen, Mike Stensrud and Andy Dor-ris were quoted as saying, “I don’t know Ed’s coaching philosophy, but as defensive coordinator he was superior and Ed won’t put up with any bull.” Biles’ best record was 8-2 during the 1965 season when he was named the Cath-olic Coach of the Year.

(FYI: Biles is not a Catho-lic.) Biles is remembered at Xavier for his habit of giving players a chance to play that others gave up on; a fondness for the unusual in offense; and the fact that he was the last man to produce a winning football team at Xavier Uni-versity before Xavier dropped the sport in 1973.

In 1962 when Biles’ team played in the Fairfi eld Stadi-um he told the press the Stadi-um was in such bad shape, he refused to bring his team back to Huntington. After receiving grief from the press, his con-cern was affi rmed. A trio of inspectors were called in and found Biles’ assessment to be accurate with no less than 120 health and safety violations.

Biles resigned at Xavier in January 1969, to take a job as assistant coach with the NFL’s New Orleans Saints. Two years later he joined the New York Jets’ staff, and then moved on to Houston.(Content for this column cour-tesy of Ed Biles and countless

An initiative of the Fort Bend Chamber of Commerce, Fort Bend Volunteers! pre-sented the 2014 Volunteer of the Year award on Tuesday, September 30 at Safari Texas Ranch.

Kevin San Jose, a volun-teer with Texana Center, was named the 2014 Volunteer of the Year.

Out of the 19 outstanding nominations received from throughout the county, Kevin San Jose, a volunteer with Texana Center, was named the 2014 Volunteer of the Year.

Kevin is an outstanding young man who has not let

challenges stop him from suc-ceeding in life.

When Kevin was a child, he was diagnosed with au-tism and found communicat-ing with others very diffi cult. He would shy away from the simplest conversations and interactions.

Fortunately, the 2014 Vol-unteer of the Year learned to overcome this and the many obstacles placed before him. Wanting to offer assistance, Kevin’s mother enrolled him in a social skills group that works with young people di-agnosed with autism between 15 and 21 years of age.

Kevin is one of the best role models to volunteer at Texana Center. He is respected by those in the program because of his dedication to helping others. You can always expect him to be on time, commit-ted, enthusiastic, and to have a positive attitude. Congratula-tions to Kevin San Jose, 2014 Volunteer of the Year!

The winner of this county-wide search for the top volun-teer in Fort Bend County was evaluated by a panel of expert judges.

The judges included Me-lissa Burnham, Executive Vice President at Gulf Coast Medical Foundation, Meghna Goswami, Program Offi cer – Human Services at Houston Endowment, and Kelli King-Jackson, Program Offi cer at The Simmons Foundation.

Sección 1. Orden de elección, Fecha y Electores Elegibles. Se llevará a cabo una elección (la “Elección”) dentro del Distrito el 4 de noviembre de 2014 (“Día de Elección”). Por medio de la presente, la Junta determina que la Elecciónse llevará a cabo en la fecha uniforme de elección y que la celebración de la Elección en dicha fecha es de interés público. Endicha elección, se presentará ante los votantes debidamente calificados residentes en el Distrito el asunto de elegir a tres (3)directores. Cada uno de los directores será electo para fungir por un mandato de cuatro años.

Sección 2. Precintos electorales, Lugares de votación y Horario de votación del Día de elección. Salvo que se disponga lo contrario en esta orden, los limites y territorios de los Precintos Electorales del Condado de Fort Bend que se encuentra en tu totalidad o parcialmente dentro de los limites del Distrito, que llevan los números del precinto establecidos en el Anexo A adjunto a este e incorporado a continuación, son por medio de la presente designados y establecidos como los precintos de votación para la Elección del Distrito, y deberán de constituir los precintos de elección para la elección. Las casillas electorales deberán abrir en el Día de la Elección desde las 7:00 a.m. hasta las 7:00 p.m. en las locaciones designadas en el Anexo A.

Los funcionarios de la Elección serán aquellas personas que cumplan con los requisitos, recomendadas y nombradas según lo dispuesto en el Convenio de Elección Conjunta.

La junta de boletas de votación anticipada se conformará de individuos calificados recomendados y nombrados como se ha previsto en el Convenio de Elección Conjunta.

Sección 3. Votación Anticipada. (a) La votación anticipada en persona, en la elección, en todos los precintos electorales se llevará a cabo en los lugares, horarios y días indicados en el Anexo B, o en ciertos otros lugares que de aquí enadelante puedan ser designados según lo dispuesto en el Convenio de Elección Conjunta.

(b) El oficial de votación anticipada será el Administrador según lo dispuesto en el Contrato de Servicios Electorales y el Convenio de Elección Conjunta. Los oficiales suplentes de votación anticipada serán nombrados por el Administrador según lo dispuesto en el Contrato de Servicios Electorales y el Convenio de Elección Conjunta. La dirección postal del oficial de votación anticipada a la cual se pueden enviar las solicitudes y las boletas para votar por correo es: Elecciones del Condado deFort Bend, 4520 Reading Road, Rosenberg, Texas 77471.

Sección 4. Boleta Oficial de Votación. La votación se realizará mediante el uso de los sistemas de votación "Hart Intercivic eSlate" cómo ha sido aprobado por el Condado de Fort Bend, Texas (incluyendo el sistema "Hart Intercivic Ballot Now" para las boletas por correo). Las boletas oficiales para la Elección serán preparadas de acuerdo al Código Electoral de Texas y tendrán impresa la lista de nombres de los candidatos para el cargo de director y espacios en blanco para votos

escritos. El votante podrá votar por ninguno (0), uno (1), dos (2) o tres (3) personas para director. Un voto escrito sólo se tomará en cuenta si se emite para un candidato por escrito certificado. Se colocará una lista de candidatos por escrito certificados, de haber alguno, en cada lugar de votación anticipada durante el período de votación anticipada y en el lugar de votación el Día deElección. Se prepararán las boletas oficiales de votación en inglés y en español. Habrá disponible asistencia oral en español para todas las personas que la requieran. Cualquier persona que necesite asistencia verbal en español se deberá comunicar con el juezpresidente o con el oficial de votación anticipada.

El personal de la estación central de conteo serán aquellas personas que cumplan con los requisitos, recomendadas y nombradas según lo dispuesto en el Convenio de Elección Conjunta.

Sección 5. Aviso de Elección. Por medio de la presente y en conformidad con la Sección 4.003 del Código Electoral de Texas se instruye al Secretario de la Junta a que haga colocar el aviso de la elección en inglés y en español en unlugar público en el Distrito al menos veintiún (21) días antes de la fecha de la Elección. Asimismo, por medio de la presente seinstruye la Secretaria de la Junta a que publique un aviso de la elección en inglés y en español en el tablero de boletines deledificio del tribunal del condado que se utiliza para colocar avisos de asambleas de la Junta, al menos veintiún (21) días antes de la fecha de la Elección. Dicho aviso deberá permanecer colocado continuamente hasta el Día de Elección inclusive.

Sección 6. Conducción de la Elección. La Elección se llevará a cabo y realizará y entregará los resultados a la Junta en conformidad con el Código Electoral de Texas y la Constitución y las leyes del Estado de Texas y de los Estados Unidosde América. Además, la Elección será celebrada en conformidad con los términos y las condiciones del Convenio de Elección Conjunta y el Contrato de Servicios Electorales. En la medida que no disponga lo contrario el Convenio de Elección Conjunta, Tom Sage de Andrews Kurth LLP, por medio de la presente se designa como Agente para el Secretario de la Junta, para servir como custodio de los registros electorales. El Agente mantendrá los registros electorales en conformidad con el Código Electoral de Texas. Toda documentación que deba presentarse ante el Secretario de la Junta según las disposiciones de esta Orden o del Código Electoral de Texas pueden enviarse al Secretario de la Junta Directiva del Distrito de Servicios Públicos Municipales deBurney Road, dirigidos a Andrews Kurth LLP, 600 Travis, Suite 4200, Houston, TX 77002, a la atención de: Tom Sage.

Sección 7. Convenio de Elección Conjunta y Contrato de Servicios Electorales.elección Por el presente se autoriza al Presidente de la Junta a negociar y finalizar el Convenio de Elección Conjunta y el Contrato de Servicios Electorales para aprobación de la Junta.

Sección 8. Acciones necesarias. Por la presente se autoriza e instruye al Presidente y al Secretario de la Junta y al abogado del Distrito o sus representantes a realizar todos los trámites requeridos por la Ley Federal de Derecho al Voto. Además se autoriza e instruye al Presidente y al Secretario de la Junta y al abogado del Distrito a realizar cualquier otra acciónnecesaria para cumplir con las disposiciones del Código Electoral de Texas, el Código de Agua de Texas y la Ley Federal de Derecho al Voto, y los términos y las disposiciones del Convenio de Elección Conjunta para ejecutar las disposiciones de esta Orden, ya sean expresamente autorizadas en la presente o no.

Sección 9. Definiciones. Salvo que se indique lo contrario en este documento, las definiciones usadas en el preámbulo de esta Orden por la presente se adoptan e incorporan para todos los fines.

Sección 10. Funcionarios Electorales. Antes del Día de Elección, los jueces electorales, jueces alternos, funcionarios y demás personal necesario para la conducción de la Elección serán designados según con el Convenio de Elección Conjunta y el Contrato de Servicios Electorales. Por medio de la presente se autoriza al Presidente de la Junta a nombrar a cualquier otro funcionario que no es designado en esta orden o que no es designado en virtud del Contrato de Servicios Electorales y del Convenio de Elección Conjunta según sea necesario y apropiado para la celebración de la Elección en conformidad con el Código Electoral de Texas.

Sección 11. Asambleas públicas. Por medio de la presente se determina que la asamblea en la cual se ha considerado y adoptado esta Orden está abierta al público, según lo exige la ley, y que el aviso escrito indicando la hora, el lugar y el asunto de dicha asamblea, y la adopción propuesta de esta Orden, se dio según lo requerido por el Capítulo 551 del Código del Gobierno de Texas y la Sección 49.063 del Código de Agua de Texas. La Junta ratifica y confirma además dicho aviso escrito, su contenido y la publicación del mismo.

Sección 12. Divisibilidad. En caso de que alguna disposición de esta Orden resultase inválida, ilegal o inaplicable, la validez, legalidad y aplicabilidad de las disposiciones restantes no se verá afectada ni impedida por la misma.

Sección 13. Fecha de efectividad. Esta Orden será efectiva inmediatamente después de su aprobación.

WHEREAS, Burney Road Municipal Utility District (the “District”), at a meeting held on February 27, 2012, open to the public, unanimously approved a Resolution Changing General Election Date and Adjusting Terms of Office for Burney Road Municipal Utility District, thereby effectively changing the date of its general election to be held on the first Tuesday after the first Monday in November of even-numbered years (the “November Election Date”) and further, adjusting the terms of office of its directors to align with the November Election Date, in accordance with the Texas Election Code; and

WHEREAS, the District will hold an election on November 4, 2014, to elect three members to the Board of Directors of the District (the “Board”) as required by the laws of the State of Texas; and

WHEREAS, the Board, pursuant to Chapter 31, Texas Election Code, is entering into an agreement for election services with John Oldham, Elections Administrator (“Administrator”) for Fort Bend County, Texas, (the “Election Services Contract”) for purposes of providing equipment and election administration services on behalf of the District; and

WHEREAS, the Board, pursuant to Chapter 271, Texas Election Code, intends to enter into an agreement to conduct a joint election with Fort Bend County and other political subdivisions within Fort Bend County (the “Joint Election Agreement”); and

WHEREAS, the Board deems it necessary to call the election hereinafter described; Now Therefore,

BE IT ORDERED BY THE BOARD OF DIRECTORS OF BURNEY ROAD MUNICIPAL UTILITY DISTRICT THAT:

Section 1. Election Order; Date; Eligible Electors. An election (the “Election”) shall be held within and for the District on November 4, 2014 (“Election Day”). The Board hereby finds that the Election will be held on the required uniform election date and that holding the Election on such date is in the public interest. At said election there shall be submitted to the duly qualified resident electors of the District the matter of electing three (3) directors. Each of the directors to be elected shall serve a four-year term.

Section 2. Election Precincts, Voting Locations, and Voting Hours on Election Day. Except as otherwise provided herein, the presently existing boundaries and territory of the Fort Bend County Election Precincts that are wholly or partially within the boundaries of the District, which bear the precinct numbers set forth in Exhibit A attached hereto and incorporated herein, are hereby designated and established the voting precincts for the District for the Election, and shall constitute the election precincts for the election. The polls shall be open for voting on Election Day from 7:00 a.m. to 7:00 p.m. at the locations set forth in Exhibit A.

The officers of the Election shall be those qualified individuals recommended and appointed as provided in the Joint Election Agreement.

The early voting ballot board shall consist of those qualified individuals recommended and appointed as provided in the Joint Election Agreement.

Section 3. Early Voting. (a) Early voting in the election by personal appearance for all election precincts shall be held at the locations, at the times, and on the days set forth in Exhibit B, or at such other locations as may be designated as provided in the Joint Election Agreement.

(b) The early voting clerk for the joint election shall be the Administrator as provided in the Election Services Contract and the Joint Election Agreement. Deputy early voting clerks shall be appointed by the Administrator as provided in the Election Services Contract and the Joint Election Agreement. The early voting clerk’s mailing address to which ballot applications and ballots to be voted by mail may be sent is: Fort Bend County Elections, 4520 Reading Road, Rosenberg, Texas 77471.

Section 4. Official Ballot. Voting shall be conducted by the use of the Hart Intercivic eSlate voting systems as approved by Fort Bend County, Texas (including the Hart Intercivic Ballot Now system for ballots by mail). The official ballots for the Election shall be prepared in accordance with the Texas Election Code, and shall list the names of the candidates for the office of director and allow for write-in votes. The voter may vote for none (0), one (1), two (2), or three (3) persons for director. A write-in vote shall only be counted if it is cast for a certified write-in candidate. A list of certified write-in candidates, if any, shall be posted at each early voting polling place during the early voting period and at the polling place on Election Day. The official ballots shall be prepared using English and Spanish. Oral assistance in Spanish shall be made

available to all persons requiring such assistance. Any person requiring oral assistance in Spanish should contact the presiding judge or early voting clerk.

The personnel for the central counting station shall be those qualified individuals recommended and appointed as provided in the Joint Election Agreement.

Section 5. Notice of Election. In accordance with Texas Election Code, Section 4.003, the Secretary of the Board is hereby directed to cause notice of the election to be posted in English and Spanish at a public place in the District at least twenty-one (21) days before the date of the Election. In addition, the Secretary of the Board is hereby directed to post a notice of the Election in English and Spanish on the county courthouse bulletin board used for posting notices of meetings of the Board at least twenty-one (21) days before the date of the Election, said notice to remain posted continuously through Election Day.

Section 6. Conduct of Election. The Election shall be held and conducted and returns made to the Board in accordance with the Texas Election Code and the Constitution and laws of the State of Texas and the United States of America. The Election shall also be conducted pursuant to the terms and conditions of the Joint Election Agreement and Election Services Contract. To the extent not otherwise provided for in the Joint Election Agreement, Tom Sage of Andrews Kurth LLP is hereby designated as Agent for the Secretary of the Board to serve as custodian of the election records. The Agent shall maintain the election records in accordance with the Texas Election Code. Any filings required to be made to the Secretary of the Board under the provisions of this Order or the Texas Election Code may be made to the Secretary of the Board of Directors of Burney Road Municipal Utility District, c/o Andrews Kurth LLP, 600 Travis, Suite 4200, Houston, TX 77002, Attention: Tom Sage.

Section 7. Joint Election Agreement and Election Services Contract. The Board hereby authorizes the Board President to negotiate and finalize the Joint Election Agreement and Election Services Contract for approval of the Board.

Section 8. Necessary Actions. The Board’s President and Secretary and the attorney for the District or their designees are hereby authorized and directed to make any filings required by the Federal Voting Rights Act. The Board’s President and Secretary and the attorney for the District are further authorized and directed to take any action necessary to comply with the provisions of the Texas Election Code, the Texas Water Code and the Federal Voting Rights Act and the terms and provisions of the Joint Election Agreement in carrying out the provisions of this Order, whether or not expressly authorized herein.

Section 9. Definitions. Except as otherwise indicated herein, the definitions used in the preamble to this Order are hereby adopted and incorporated for all purposes.

Section 10. Election Officials. Prior to Election Day, the election judges, alternate judges, clerks, and other personnel necessary for conducting the Election will be appointed in accordance with the Joint Election Agreement and Election Services Contract. The President of the Board is hereby authorized to appoint any such other officials not designated herein or appointed pursuant to the Joint Election Agreement and/or Election Services Contract as are necessary and appropriate to conduct the Election in accordance with the Texas Election Code.

Section 11. Open Meetings. It is hereby found that the meeting at which this Order has been considered and adopted is open to the public, as required by law, and that written notice of the time, place, and subject matter of said meeting, and of the proposed adoption of this Order, was given as required by Chapter 551, Texas Government Code, and Section 49.063, Texas Water Code. The Board further ratifies and confirms said written notice and the contents and posting thereof.

Section 12. Severability. In case any provision of this Order shall be invalid, illegal or unenforceable, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby.

Section 13. Effective Date. This Order is effective immediately upon its approval.

More than 750 people were on hand at St. Laurence Cath-olic School Friday, September 26, to take part in the annual Grandparent’s Day celebra-tion.

This special day began with a packed Mass led by Father Drew Wood, pastor at St. Lau-rence parish, and the church was fi lled with grandparents, guests, faculty, and students. Following the Mass, students in the school’s pre-kindergar-ten and kindergarten programs performed. While serving a light breakfast in the main campus gym, the grandparents and special guests enjoyed a performance from each grade.

Also, the school band and choir gave an amazing perfor-mance. The day was capped off with the grandparents and guests visiting the classrooms that were proudly shown off by the students.

TO THE RESIDENT, QUALIFIED ELECTORS OF FORT BEND INDEPENDENT SCHOOL DISTRICT:

NOTICE IS HEREBY GIVEN that an election will be held in the FORT BEND INDEPENDENT SCHOOL DISTRICT, on the 4th day of November, 2014, in accordance with the following order:

ORDER BY THE BOARD OF TRUSTEES OF FORT BEND INDEPENDENT SCHOOL DISTRICT CALLING A BOND ELECTION TO BE HELD WITHIN SAID DISTRICT; MAKING PROVISIONS FOR THE CONDUCT AND THE GIVING OF NOTICE OF THE ELECTION; AND CONTAINING OTHER PROVISIONS RELATING THERETO

WHEREAS, the Board of Trustees (the “Board”) of the Fort Bend Independent School District (the “District”) finds and determines that it is necessary and advisable to call and hold an election for and within the District on the proposition hereinafter set forth; and

WHEREAS, it is hereby officially found and determined that said election shall be held on a uniform election date established by Section 41.001(a), Texas Election Code, as amended, as required by Texas law; and

WHEREAS, the Board, pursuant to the applicable provisions of the Texas Election Code has or will enter into an agreement to conduct a joint election with other political subdivisions within Fort Bend County (the “County”) and contract with the County Elections Administrator (the “County Elections Administrator”) for election services (collectively, the “Election Agreement”); and

WHEREAS, the Board finds and declares that the meeting at which this Order is considered is open to the public, and that the public notice of the time, place and purpose of the meeting was given, as required by Chapter 551, Texas Government Code, as amended; Now Therefore,

BE IT ORDERED BY THE BOARD OF TRUSTEES OF FORT BEND INDEPENDENT SCHOOL DISTRICT:

Section 1. Findings. The statements contained in the preamble of this Order are true and correct and are hereby adopted as findings of fact and as a part of the operative provisions hereof.

Section 2. Election Ordered; Date; Proposition. An election (the “Election”) shall be held for and within the District on Tuesday, November 4, 2014 (“Election Day”), in accordance with the Texas Election Code (the “Code”). At the Election the following proposition (the “Proposition”) shall be submitted to the qualified voters of the District in accordance with law:

PROPOSITION NO. ONE

SHALL THE BOARD OF TRUSTEES OF FORT BEND INDEPENDENT SCHOOL DISTRICT (THE “DISTRICT”) BE AUTHORIZED TO ISSUE AND SELL AT ANY PRICE OR PRICES THE BONDS OF THE DISTRICT IN THE AMOUNT OF $484,000,000 FOR THE CONSTRUCTION, ACQUISITION, AND EQUIPMENT OF SCHOOL BUILDINGS IN THE DISTRICT, FOR THE PURCHASE OF THE NECESSARY SITES FOR SCHOOL BUILDINGS, AND FOR THE PURCHASE OF NEW SCHOOL BUSES, INCLUDING SAFETY AND SECURITY AND TECHNOLOGY INFRASTRUCTURE FOR THE DISTRICT, WHICH BONDS MAY BE ISSUED IN VARIOUS ISSUES OR SERIES, SHALL MATURE SERIALLY OR OTHERWISE NOT MORE THAN 40 YEARS FROM THEIR DATE, AND SHALL BEAR INTEREST AT SUCH RATE OR RATES, NOT TO EXCEED THE MAXIMUM RATE NOW OR HEREAFTER AUTHORIZED BY LAW, AS SHALL BE DETERMINED BY THE BOARD OF TRUSTEES OF THE DISTRICT WITHIN THE DISCRETION OF THE BOARD AT THE TIME OF ISSUANCE; AND SHALL THE BOARD OF TRUSTEES BE AUTHORIZED TO LEVY AND PLEDGE, AND CAUSE TO BE ASSESSED AND COLLECTED, ANNUAL AD VALOREM TAXES ON ALL TAXABLE PROPERTY IN THE DISTRICT SUFFICIENT, WITHOUT LIMIT AS TO RATE OR AMOUNT, TO PAY THE PRINCIPAL OF AND INTEREST ON SAID BONDS AND THE COSTS OF ANY CREDIT AGREEMENTS EXECUTED OR AUTHORIZED IN ANTICIPATION OF, IN RELATION TO, OR IN CONNECTION WITH THE BONDS; SAID BONDS TO BE ISSUED AND SAID TAXES TO BE LEVIED, PLEDGED, ASSESSED, AND COLLECTED UNDER THE CONSTITUTION AND LAWS OF THE STATE OF TEXAS INCLUDING THE TEXAS EDUCATION CODE?

Section 3. Official Ballot.

(a) Voting at the Election, and early voting therefor, shall be by the use of the lawfully approved County voting systems and ballots.

(b) The preparation of the necessary equipment and the official ballots for the Election shall conform to the requirements of the Code so as to permit the electors to vote “FOR” or “AGAINST” the aforesaid Proposition which shall be set forth on the ballots substantially in the following form:

Section 4. Persons Qualified to Vote. All resident, qualified electors of the District shall be eligible to vote at the Election.

Section 5. Election Precincts, Voting Locations and Voting Hours on Election Day. The election precincts for the Election shall consist of the territory within the boundaries of the District situated within one or more County election precincts, which bear the precinct numbers set forth in Exhibit A, attached hereto and incorporated herein. The voting location for voting on Election Day for each election precinct shall be as set forth in Exhibit A, or at such other locations as hereafter may be designated by the County Elections Administrator as provided in the Election Agreement. The President of the Board or her designee is hereby authorized to update Exhibit A to reflect the locations designated by the County Elections Administrator, and such locations are hereby approved. On Election Day the polls shall be open from 7:00 a.m. to 7:00 p.m.

Section 6. Early Voting Locations, Dates and Times.

(a) Early voting by personal appearance for all election precincts shall be held at the locations, at the times and on the days set forth in Exhibit B, attached hereto and incorporated herein, or at such other locations as hereafter may be designated by the County Elections Administrator as provided in the Election Agreement. The President of the Board or her designee is hereby authorized to update Exhibit B to reflect the locations designated by the Elections Administrator, and such locations are hereby approved.

(b) The County Elections Administrator is hereby appointed as the Early Voting Clerk. Applications for ballot by mail shall be sent to: Fort Bend County Elections; Attention: John Oldham; 4520 Reading Road, Rosenberg, TX 77471. As provided in the Election Agreement, the County Elections Administrator’s permanent county employees are appointed as early voting clerks. The County Elections Administrator is hereby authorized to appoint such other deputy early voting clerks as necessary for the Election as provided in the Election Agreement.

Section 7. Joint Election. The District has determined that it is in the best interest of the District to participate in a joint election with other governmental entities in the County holding elections on Election Day and contract with the County Elections Administrator for election services.

Section 8. Appointment of Election Officers. The election judges, alternate judges, clerks, members of the early voting ballot board, the central counting station officials, and other personnel necessary for conducting the Election shall be appointed, election judges and alternate judges may be changed, polling places may be combined for some precincts, and the central counting station shall be established and staffed all as provided in the Election Agreement and such actions are hereby approved. Further, the Board hereby authorizes the President of the Board to appoint any such other officials not designated herein or appointed pursuant to the Election Agreement as are necessary and appropriate to conduct the Election in accordance with the Code.

Section 9. Notice of Election. Notice of the Election shall be given by: (i) publishing a substantial copy of this Order, in English and Spanish, one time not earlier than the thirtieth (30th) day nor later than the tenth (10th) day prior to the date set for the Election, in a newspaper published in the District (or otherwise complies with State law), (ii) by posting a copy of this Order, in English and Spanish, on the bulletin board used for posting notices of meetings of the Board, not later than the twenty-first (21st) day prior to the date set for the Election and in at least three (3) public places in the boundaries of the District, not later than the twenty-first (21st) day prior to the date set for the Election and (iii) by posting a copy of this Order, in English and Spanish, on the District’s website, prominently and together with the notice of the Election and the contents of the Proposition, not later than the twenty-first

(21st) day prior to the date set for the Election through Election Day. Additionally, on Election Day and during early voting by personal appearance, this Order shall be posted in a prominent location at each polling place. Notice of the Election shall also be provided to the county clerk of the County and the County Elections Administrator not later than the 60th day before the Election Day.

Section 10. Conduct of Election. The Election shall be held in accordance with the Code, except as modified by the Texas Education Code, and the Federal Voting Rights Act of 1965, as amended, including particularly Chapter 272 of the Code pertaining to bilingual requirements.

Section 11. Additional Information Required by Section 3.009 of the Election Code.

(a) As of July 1, 2014, the first day of the District’s current fiscal year, the aggregate principal amount outstanding of tax-supported debt of the District was $858,781,188.80 and the aggregate amount of outstanding interest on such tax-supported debt was $448,085,965.53. The District’s ad valorem debt service tax rate as of the date of this Order is $0.30 per $100 of assessed valuation of taxable property in the District.

(b) The District intends to issue the bonds authorized by the Proposition over a period of years in a manner and in accordance with a schedule to be determined by the Board based upon a number of factors, including, but not limited to, the then current needs of the District, demographic changes, prevailing market conditions, assessed valuations in the District and management of the District’s short-term and long-term interest rate exposure. Market conditions, demographics and assessed valuations vary based upon a number of factors beyond the District’s control, and therefore, the District cannot and does not guarantee a particular interest rate or tax rate associated with the bonds authorized by the Proposition. As such, the information contained in this paragraph is provided solely for illustrative purposes and does not establish any limitations or restrictions or create a contract with the voters. The District currently estimates that, if the Proposition were approved and the bonds proposed herein were authorized and issued in accordance with the District’s currently projected plan of finance, the District’s ad valorem debt service tax rate would be approximately $0.30 per $100 of assessed valuation of taxable property in the District.

(c) Any additional information required by Section 3.009 of the Code is contained in Sections 2 and 3 of this Order.

Section 12. Necessary Actions. The Superintendent or his designee, acting on behalf of the Board, in consultation with the District’s attorney and bond counsel is hereby authorized and directed to take any and all actions necessary to comply with the provisions of the Code and the Federal Voting Rights Act in carrying out and conducting the Election, whether or not expressly authorized herein, including making changes or additions to polling places or procedures to the extent required or desirable as determined by the County Elections Administrator.

Section 13. Severability. If any provision, section, subsection, sentence, clause or phrase of this Order, or the application of same to any person or set of circumstances is for any reason held to be unconstitutional, void, invalid, or unenforceable, neither the remaining portions of this Order nor their application to other persons or sets of circumstances shall be affected thereby, it being the intent of the Board in adopting this Order that no portion hereof or provision or regulation contained herein shall become inoperative or fail by reason of any unconstitutionality, voidness, invalidity or unenforceability of any other portion hereof, and all provisions of this Order are declared to be severable for that purpose.

Section 14. Effective Date. This Order shall take effect immediately upon its approval.

NOTIFICACIÓN DE ELECCIÓN RELATIVA A BONOS

ESTIMADOS VOTANTES CALIFICADOS, RESIDENTES DEL DISTRITO ESCOLAR INDEPENDIENTE DE FORT BEND:

SE NOTIFICA POR MEDIO DEL PRESENTE que se llevará a cabo una elección en el DISTRITO ESCOLAR INDEPENDIENTE DE FORT BEND, el 4 de Noviembre de 2014, de acuerdo con la siguiente orden:

ORDEN DEL CONSEJO DIRECTIVO DEL DISTRITO ESCOLAR INDEPENDIENTE DE FORT BEND QUE LLAMA A LA REALIZACIÓN DE UNA ELECCIÓN PARA LA EMISIÓN DE BONOS EN DICHO DISTRITO, QUE ESTABLECE DISPOSICIONES PARA LA CONDUCCIÓN Y LA COMUNICACIÓN DE LA ELECCIÓN Y QUE INCLUYE OTRAS DISPOSICIONES EN RELACIÓN A ELLO.

POR CUANTO, el Consejo Directivo (el "Consejo”) del Distrito Escolar Independiente de Fort Bend (el “Distrito) declara y determina que es necesario y aconsejable llamar a elección y llevarla a cabo para y dentro del Distrito en base a la proposiciónestablecida a continuación; y

POR CUANTO, se declara y determina oficialmente por medio del presente que dicha elección tendrá lugar en una fecha uniforme de elecciones establecida por el Artículo 41.001(a) del Código de Elecciones de Texas (Texas Election Code), y sus modificaciones, de conformidad con la legislación de Texas, y

POR CUANTO, el Consejo, de acuerdo con las disposiciones vigentes del Código de Elecciones de Texas tiene o firmará un acuerdo para llevar a cabo una elección conjunta con otras subdivisiones políticas dentro del Condado de Fort Bend (el “Condado”) y acordará un contrato con el Administrador de Elecciones del Condado (el “Administrador de Elecciones del Condado”) para servicios de elección (en forma conjunta, "el Acuerdo de Elecciones"); y

POR CUANTO, el Consejo declara y determina que la reunión para considerar esta Orden es una asamblea abierta al público y la correspondiente notificación pública acerca de su fecha, lugar y propósito fue emitida de conformidad con el Capítulo 551 del Código Gubernamental de Texas (Texas Government Code), y sus modificaciones;

POR TANTO, EL CONSEJO DIRECTIVO DEL DISTRITO ESCOLAR INDEPENDIENTE DE FORT BEND RESUELVE:

Artículo 1. Decisiones. Las declaraciones incluidas en el preámbulo de esta Orden son verdaderas y correctas y son adoptadas como determinaciones de cuestiones de hecho y como parte de las disposiciones operativas del presente.

Artículo 2. Elección ordenada; Fecha; Proposición. Se llevará a cabo una elección (la “Elección”) para y dentro del Distrito el martes 4 de noviembre de 2014 (“Día de Elecciones”), de conformidad con el Código de Elecciones de Texas (el “Código”). En la Elección, se presentará a los votantes calificados del Distrito la siguiente proposición (la “Proposición”) conforme a la ley.

PROPOSICIÓN NRO. UNO

¿SE DEBERÁ AUTORIZAR AL CONSEJO DIRECTIVO DEL DISTRITO ESCOLAR INDEPENDIENTE DE FORT BEND (EL “DISTRITO”) PARA QUE EMITA Y VENDA A CUALQUIER PRECIO O PRECIOS LOS BONOS DEL DISTRITO POR LA SUMA DE $484.000.000 PARA LA CONSTRUCCIÓN, LA ADQUISICIÓN Y EL EQUIPAMIENTO DE EDIFICIOS ESCOLARES DEL DISTRITO, PARA LA COMPRA DE LOS PREDIOS NECESARIOS PARA EDIFICIOS ESCOLARES Y PARA LA COMPRA DE NUEVOS AUTOBUSES ESCOLARES, LO QUE INCLUYE, INFRAESTRUCTURA DE SEGURIDAD Y PREVENCIÓN Y DE TECNOLOGÍA PARA EL DISTRITO, CON LA EMISIÓN DE DICHOS BONOS EN VARIAS EMISIONES O SERIES, CON VENCIMIENTO POR SERIE O DE OTRA FORMA COMO MÁXIMO A LOS 40 AÑOS DE SU FECHA DE EMISIÓN Y CON INTERESES QUE DEVENGUEN SEGÚN LA TASA O TASAS QUE EL CONSEJO DIRECTIVO DEL DISTRITO DETERMINE A SU CRITERIO AL MOMENTO DE LA EMISIÓN, SIN EXCEDER LA TASA MÁXIMA AUTORIZADA POR LA LEY AHORA O EN UNA FECHA FUTURA, Y SE DEBERÁ AUTORIZAR AL CONSEJO DIRECTIVO PARA QUE AFECTE Y DE EN GARANTÍA, Y HACER QUE SE IMPONGAN Y SE RECAUDEN IMPUESTOS ANUALES AD VALOREM SOBRE TODOS LOS BIENES IMPONIBLES DEL DISTRITO, SUFICIENTES Y SIN LÍMITE EN CUANTO A LA TASA O CANTIDAD, PARA PAGAR EL CAPITAL Y LOS INTERESES DE DICHOS BONOS Y LOS COSTOS DE CONTRATOS DE CRÉDITO CELEBRADOS O AUTORIZADOS PREVIENDO LOS BONOS O EN RELACIÓN O CONEXIÓN CON ELLOS; SIENDO LA EMISIÓN DE DICHOS BONOS Y LA AFECTACIÓN, GARANTÍA, IMPOSICION Y RECAUDACIÓN DE DICHOS IMPUESTOS CONFORME A LA CONSTITUCIÓN Y LAS LEYES DEL ESTADO DE TEXAS, LO QUE INCLUYE EL CÓDIGO DE EDUCACIÓN DE TEXAS?

Artículo 3. Boleta oficial de votación.

(a) La votación en la Elección, y por consiguiente la votación anticipada, tendrá lugar mediante el empleo de sistemas de votación del Condado y boletas electorales aprobados por la ley.

(b) La preparación del equipamiento necesario y las boletas oficiales para la Elección cumplirá con los requisitos del Código para permitir a los votantes votar "A FAVOR" o "EN CONTRA" de la Proposición antedicha que será establecida en las boletas esencialmente de la siguiente manera:

“LA EMISIÓN DE $484,000,000 EN BONOS PARA LA CONSTRUCCIÓN, ADQUISICIÓN Y EQUIPAMIENTO DE EDIFICIOS ESCOLARES EN EL DISTRITO, LA COMPRA DE PREDIOS PARA EDIFICIOS ESCOLARES Y LA COMPRA DE AUTOBUSES ESCOLARES, INCLUYENDO PROTECCIÓN Y SEGURIDAD E INFRAESTRUCTURA DE TECNOLOGÍA PARA EL DISTRITO Y LA IMPOSICIÓN DEL IMPUESTO PARA EL PAGO DE ÉSTOS”

Artículo 4. Personas que califican para votar. Todos los votantes calificados, residentes del Distrito serán elegibles para votar en la Elección.

Artículo 5. Distritos electorales, Lugares de votación y Horarios de votación en el Día de Elecciones. Los distritos electorales (election precincts) para la Elección consistirán del territorio dentro de los límites del Distrito situado dentro de uno o más distritos electorales del Condado, que llevan los números de distrito electoral establecidos en el Anexo A, que se adjunta e incorpora a este documento. El lugar de votación para votar en el Día de Elecciones para cada distrito electoral será el establecido en el Anexo A o el que el Administrador de Elecciones del Condado designe en lo sucesivo tal como se prevé en el Acuerdo de Elecciones. El Presidente del Consejo u otra persona designada en su lugar está por el presente autorizado a actualizar el Anexo A de modo que refleje los lugares que el Administrador de Elecciones del Condado designe y tales lugares quedan por el presente aprobados. En el Día de Elecciones las urnas estarán abiertas de 7:00 a.m. a 7:00 p.m. Artículo 6. Lugares, fechas y horarios para la votación anticipada.

Artículo 6. Lugares, fechas y horarios para la votación anticipada.

(a) La votación anticipada en persona para todos los distritos electorales será llevada a cabo en los lugares, en los horarios y en los días establecidos en el Anexo B, adjunto e incorporado a este documento, o en otros lugares que el Administrador de Elecciones del Condado designe en lo sucesivo según lo previsto por el Acuerdo de Elecciones. El Presidente del Consejo u otra persona designada en su lugar está por el presente autorizado a actualizar el Anexo B de modo que refleje los lugares que el Administrador de Elecciones del Condado designe y tales lugares quedan por el presente aprobados.

(b) El Administrador de Elecciones del Condado es por el presente designado como el Secretario de Votación Anticipada. Las solicitudes para votación por correspondencia serán enviadas a: Fort Bend County Elections; Attention: John Oldham; 4520 Reading Road, Rosenberg, TX 77471. Tal como se establece en el Acuerdo de Elecciones, los empleados permanentes del condado que trabajan para el Administrador de Elecciones del Condado son designados como secretarios de votación anticipada. El Administrador de Elecciones del Condado está por el presente autorizado a designar a los secretarios adjuntos de votación anticipada que sean necesarios para la Elección tal como se prevé en el Acuerdo de Elecciones.

Artículo 7. Elección conjunta. El Distrito ha determinado que conviene a los intereses del Distrito participar en una elección conjunta con otras entidades gubernamentales del Condado que llevarán a cabo elecciones en el Día de Elecciones y acordar un contrato con el Administrador de Elecciones del Condado para servicios de elección.

Artículo 8. Designación de funcionarios electorales. Se deberán nombrar jueces electorales, jueces suplentes, secretarios, miembros del consejo de boletas de votación anticipada, funcionarios del centro de cómputos y demás personal necesario

para conducir la Elección, se podrán cambiar los jueces electorales y jueces suplentes, se podrán establecer lugares de votación combinados para algunos distritos electorales, y se deberá establecer el centro de cómputos y dotarlo de personal de acuerdo a lo establecido en el Acuerdo de Elecciones y tales acciones quedan por el presente aprobadas. Asimismo, el Consejo por el presente autoriza al Presidente del Consejo a designar a cualquier otro funcionario no designado aquí o nombrado en virtud del Acuerdo de Elecciones que sea necesario y apropiado para conducir la Elección de conformidad con el Código.

Artículo 9. Aviso de elección. La Elección será comunicada: (i) publicando una copia sustancial de esta Orden, en inglés y en español, una vez entre los treinta (30) días y los diez (10) días antes de la fecha prevista para la Elección, en un periódico publicado en el Distrito (o que de otro modo cumpla con la ley estatal), (ii) publicando una copia de esta Orden, en inglés y en español, en el tablón de anuncios electrónicos utilizado para publicar avisos de reuniones del Consejo, a más tardar a los veintiún (21) días antes de la fecha prevista para la Elección y en por lo menos tres (3) lugares públicos en los límites del Distrito, a más tardar veintiún (21) días antes de la fecha prevista para la Elección y (iii) publicando una copia de esta Orden, en inglés y en español, en el sitio web del Distrito, bien a la vista y junto con el aviso de Elección y el contenido de la Proposición, a más tardar veintiún (21) días antes de la fecha prevista para la Elección y hasta el Día de Elecciones. Además, en el Día de Elecciones y durante la votación por anticipado en persona, esta Orden deberá publicarse en un lugar bien visible en cada sitio electoral. También se dará Aviso de la Elección al secretario del Condado y al Administrador de Elecciones del Condado a más tardar 60 días antes del Día de Elecciones.

Artículo 10. Realización de la elección. La Elección se llevará a cabo de conformidad con el Código, salvo lo modificado por el Código de Educación de Texas, y de conformidad con la Ley Federal de Derechos Electorales (Federal Voting Rights Act) de 1965, y sus enmiendas, lo que incluye especialmente el Capítulo 272 del Código relativo a requisitos bilingües.

Artículo 11. Información adicional requerida por el Artículo 3.009 del Código Electoral.

(a) Al 1 de julio de 2014, el primer día del corriente año fiscal del Distrito, la suma total de capital en concepto de saldo de deuda financiada con impuestos del Distrito ascendía a $858.781.188,80 y la suma total de saldo de intereses en relación con tal deuda financiada con impuestos ascendía a $448.085.965,53. La tasa impositiva ad valorem del servicio de deuda del Distrito a la fecha de esta Orden es de $0,30 por cada $100 de valuación fiscal de propiedads imponibles en el Distrito.

b) El Distrito planea emitir los bonos autorizados por la Proposición durante un periodo de años de una manera y según un plan que serán determinados por el Consejo en base a varios factores, lo que incluye a modo ilustrativo, las necesidades que tenga el Distrito en ese momento, los cambios demográficos, las condiciones que prevalezcan en el mercado, las valuaciones fiscales en el Distrito y la gestión del riesgo de la tasa de interés del Distrito en el corto y el largo plazo. Las condiciones del mercado, la situación demográfica y las valuaciones fiscales varían en base a diversos factores más allá del control del Distrito, y por lo tanto, el Distrito no puede y no garantiza una tasa de interés o una tasa impositiva específica respecto de los bonos autorizados por la Proposición. Por consiguiente, la información incluida en este párrafo se proporciona únicamente para propósitos ilustrativos y no crea ninguna limitación o restricción ni establece un contrato con los votantes. El Distrito actualmente estima que, si la Proposición fuese aprobada y los bonos propuestos en el presente fuesen autorizados y emitidos de conformidad con el plan de financiamiento del Distrito proyectado a la fecha, la tasa impositiva ad valoren del servicio de deuda del Distrito ascendería a aproximadamente $0,30 por cada $100 de valuación fiscal de bienes imponibles en el Distrito.

(c) Los Artículos 2 y 3 de esta Orden contienen información adicional requerida por el Artículo 3.009 del Código.

Artículo 12. Acciones necesarias. Por el presente se autoriza y ordena que el Superintendente u otra persona designada en su lugar, desempeñándose en nombre del Consejo, previa consulta con el abogado del Distrito y el asesor de bonos, tome todas las medidas que sean necesarias para cumplir con las disposiciones del Código y la Ley Federal de Derechos Electorales (Federal Voting Rights Act) en lo concerniente a conducir y llevar a cabo la Elección, independientemente de si tales medidas están expresamente autorizadas en este documento, lo que incluye introducir cambios o efectuar incorporaciones a los centros electorales o procedimientos de elección según sea necesario o conveniente de acuerdo a lo que determine el Administrador de Elecciones del Condado.

Artículo 13. Independencia de cláusulas. Si por algún motivo se determina que una disposición, artículo, inciso, oración, cláusula o frase de esta Orden, o su aplicación a cualquier persona o conjunto de circunstancias es inconstitucional, nulo, inválido o inaplicable, tal determinación no afectará al resto de las partes de esta Orden ni su aplicación a otras personas o circunstancias, dado que el propósito del Consejo al adoptar esta Orden es que ninguna parte de este documento ni disposición o norma contenida aquí se vuelva inoperante o errónea por motivo de una inconstitucionalidad, ineficacia, invalidez o inaplicabilidad de cualquier otra parte de este documento, y todas las disposiciones de esta Orden son declaradas independientes para tal fin.

Artículo 14. Fecha de entrada en vigencia. Esta Orden entrará en vigencia inmediatamente después de su aprobación.

Denali gets 18-inch wheels with the 2.4L or 19-inch with the 3.6-liter engine.

Interior highlights on the Terrain Denali include soft-touch jet black leather lining the seats and door inserts. Contrast stitching, along with a soft-touch instrument panel, leather-wrapped steer-

ing wheel, illuminated front sill plates, eight-way power driver and passenger seat and standard sunroof contribute to a luxurious interior.

Exceptional safety features on the Terrain Denali include the standard forward collision alert and lane departure warn-ing systems. The side blind zone alert and rear cross traf-fi c alert are also standard.

With the touch of a button, Terrain Denali drivers can ac-cess a programmable power liftgate, which allows access to the vehicle’s 63.9 cubic feet (1,810 liters) of cargo space behind the fi rst row, while a memory function stops the liftgate at a chosen height to help shorter drivers or accom-modate low garage heights. GMC IntelliLink combines with OnStar to bring segment-exclusive infotainment tech-nology, text messaging alerts and Siri eyes free feature.

Terrain engineers provided a smooth, quiet ride, four-wheel independent suspen-sion, a 112.5-inch wheelbase and wide front and rear tracks. Additional features are elec-tronic stability control that helps keep the vehicle in its intended path in the event of an emergency maneuver and standard four-wheel anti-lock brakes with traction control.

Safety features include a standard tire pressure moni-toring system, forward col-lision alert, lane departure warning, side blind zone alert, rear cross traffi c alert.

The GMC Terrain Denali all-wheel drive with the 2.4-li-ter engine retails for $37,090. The optional larger engine, rear seat entertainment sys-tem, cargo package, roof rack with cross rails, trailering package, etc., added $4,415.

The Judge; not a judge. Robert Duvall is the big-dog judge (Joseph Palmer) in small-town Indiana.

Judge Palmer’s wife of 50 years unexpectedly dies and he fi nds himself charged with murder by allegedly running over a man on a bike who had been recently sentenced to jail by the judge himself. The lo-cals are saddened by this turn of events, so a special pros-

ecutor (Billy Bob Thornton) in a three-piece suit is brought in to seek justice against the legendary Judge Palmer.

The focus of this movie is not The Judge but The Law-yer.

This lawyer is Hank Palmer (Robert “Iron Man” Downey Jr.) who is a highly success-ful criminal defense attorney from the big city and the es-tranged son of The Judge.

While returning to attend his mother’s funeral, Hank Palmer is pulled back into the family’s dysfunction and the defense of his father who is “…the most stubborn client I’ve ever had.”

The characters of Downey and Duvall butt heads and push each other’s buttons. That’s one of the main reasons I went to this movie.

time favorite actors and I love to hear him make that little heh-heh laugh with his mouth slightly open that he made famous in “Lonesome Dove” (1989). Or was it “The God-father” (1972)?

It doesn’t matter because I show up if Bobby Duvall shows up.

Admittedly he wasn’t ex-actly Augustus McCrae in “The Judge,” but he was the rock-solid professional that he always is.

Downey at age 49, on the other hand, was remarkable as the intricate, attractive law-yer with a know-it-all attitude and a kindness for his young daughter who he affectionate-ly calls “baby.”

Hank Palmer got under the skin of everyone; especially his two brothers and his high school sweetheart played by Vera “Up in the Air” Farmiga.

She melts me with her scrumptious lips and dreamy eyes, and she does a number on Downey, too, so I’m not the only sucker.

Outstanding supporting cast: Vincent D’Onofrio and Jeremy Strong as brothers; Ken “The White Shadow” Howard as the presiding judge, and Billy Bob was ide-al as the hard-nosed prosecu-tor from out of town.

And special note goes to Dax “Parenthood” Shepard who portrays an inexperi-enced lawyer that routinely throws up on the courthouse steps.

During the vomiting scenes in front of the courthouse, Downey’s character stands nearby holding the younger lawyer’s arm to give him mor-al support. That’s fascinating writing.

The screenplay is cred-ited to Nick Schenk and Bill Dubuque. Their written dia-logue was emotional, sensi-tive, and complex.

I was pulling for and against several characters. Schenk and Dubuque understand the English language.

And Director David Dob-kin, who is best known for directing Wedding Crashers, made it all jell into a classi-cally passionate movie that delves deeply into the dynam-ics of the American family. Downey and Duvall, oh my! Rock ‘n Roll.
