Explanatory Note

The County Council is required to provide a minimum of 28 days’ notice for all key decisions to be taken by the County Council, the Cabinet, the Cabinet Members and by officers under their delegated powers. The Forward Plan also provides information on all forthcoming key decisions over the following four-month period. Key decisions to be taken in the current month are also listed in bold font.

The Forward Plan is updated monthly and is available 28 days before the beginning of each month on the County Council’s website www.westsussex.gov.uk. It is also available from County Hall in Chichester, from all Help Points and the main libraries in Bognor Regis, Crawley, Haywards Heath, Horsham and Worthing

Key decisions are those which:

• Involve expenditure or savings of £500,000 or more (except decisions taken by the Executive Director of Finance, Performance and Procurement under delegated powers in connection with treasury management)

• Will have a significant effect on communities in two or more electoral divisions that changes or proposes changes to the way local services are used or provided. This will include responses to consultation from Government and other public bodies on matters that directly affect people living or working in West Sussex

Approval of the new Corporate Plan 2017-2022 (This Month)

The current Future West Sussex Plan 2015-2019 is now in its third year, and sets out the priorities and goals of the County Council. Following the County Council elections in May 2017, work has been carried out to review and redefine the County Council’s future priorities. The new West Sussex Corporate Plan 2018-2022 will identify the County Council’s key outcomes and set out what the County Council aims to achieve for communities, residents and businesses over the next four years. Cabinet and Full Council will be asked to approve the new Corporate Plan. Total Performance Monitor (Rolling Entry) The Monitor details the County Council’s performance in relation to revenue and capital spending, savings, workforce projections, performance and risk by portfolio against the Cabinet’s key priorities. The Leader and Cabinet Member for Finance will be recommended to approve the Total Performance Monitor and any items of financial and performance management within the Monitor. Children and Young People

Children Looked After and Care Leavers’ Strategy – 2017-2021 (Moved from September)

The current Children Looked After and Care Leavers’ Strategy (2014-17) is being updated in order to implement a more strategic approach and confirm the commitment to ensuring that children who are looked after by the authority are happy, healthy, and safe and have the opportunity to achieve their full potential. The proposed new strategy is the product of extensive research (including a joint strategic Needs Assessment undertaken by Public Health) and consultation with partner organisations and children in the care of the County Council. It will have an annually updated action plan to enable the service to measure delivery against the objectives outlined in the strategy and ensure resources are targeted so as to improve the quality of life for children and young people in the care of the local authority. The Cabinet Member for Children and Young People is asked to support the adoption of the Children Looked After and Care Leavers’ Strategy 2017-2021. School Basic Need Design Fees (This Month)

The County Council has a statutory duty to provide sufficient primary and secondary school places for all children who need a place. At the County Council meeting in February 2017, capital funding of £35.212m in 2017/18 and £28.715m in 2018/19 was approved for a programme of School Basic Need projects to deliver projected school place requirements based on the latest Planning School Places data. Individual projects will require funding to progress the design which will enable a firm proposal to be developed for each school to be expanded. This proposal will then be included in a Full Business Case and assessed for an investment decision, in accordance with the approved capital programme governance. The Cabinet Member for Education and Skills will be asked to approve the allocation of capital funding of £1.675m for School Basic Need design fees (£1m for projects to be delivered in 2017/18 and £675k for projects to be delivered in 2018/19). Proposal to consult on changes to SEND provision at Maidenbower Junior School and Hazelwick School (This Month)

West Sussex County Council Special Educational Needs and Disability (SEND) Strategy 2016-19 includes as one of its objectives ‘To build a model of educational provision and support in West Sussex which enables young people, wherever possible, to live and go to school/college locally’. As part of the implementation of the strategy, a review has been carried out to ensure that existing SEND provision is effective, of high quality and delivers good educational outcomes for children and young people. Special Support Centres (SSCs) are units attached to mainstream schools which provide additional support for children with various types of SEND. The above review included an analysis of where existing SSCs were being underutilised, whether because of the type of need catered for by the unit or for other reasons. As a result of this, proposals have been drawn up to amend the SSC at Maidenbower Junior School to provide for children with autistic spectrum condition and to close the SSC at Hazelwick School, due to the consistently low numbers of pupils requiring a place there. This will ensure that the Council makes the best use of available resources and that provision is more in line with assessed need. The Cabinet Member for Education and Skills will be asked to launch a public consultation commencing in November 2017 in relation to making prescribed alterations to remove/alter SEND provision within Maidenbower Junior School and Hazelwick School for implementation from September 2018.

Proposed changes to the Post-16 Transport Policy and Concessionary Travel Charges (New) In September 2017 the Cabinet Member agreed to launch a public consultation regarding proposed changes to the Post-16 Transport Policy and Concessionary Travel Charges. This related to the proposal to increase the charges made by the County Council from £427 to £600 for both entitled Post-16 students with Special Educational Needs and Disabilities (SEND) and those pupils who currently purchase a concessionary seat. Factors in determining the proposed new rate include the cost of providing a place on a contract coach, the cost of an equivalent commercially provided public bus journey and the charges that other local authorities make. Following assessment of the outcome of the consultation, the Cabinet Member for Education and Skills will be asked to consider whether to implement the proposal to increase the Post-16 concessionary and SEND transport charges from £427 to £600 from September 2018. Procurement for the award of contracts for specialist health services for people with Learning Disabilities and Autism (This Month) (Moved from September)

The Cabinet Member is asked to agree to the commencement of a tender/procurement process commencing in July 2017 leading to the award of contract/s for the provision of specialist health services for people with Learning Disabilities and Autism. The following County Council contracts are in scope for this procurement process: - A contract with Sussex Partnership NHS Foundation Trust (SPFT) for the provision of Occupational Therapy, Psychology, Speech and Language Therapy, Learning Disability Nursing, Behaviour Practitioners and Psychiatry. Most of the staff providing the services work within integrated community learning disability teams (value £2.9 million per annum). - A contract with Sussex Community NHS Foundation Trust (SCFT) for the provision of Health Facilitation services for adults with learning disabilities (value £450,000 per annum). - A contract with Western Sussex Hospitals NHS Foundation Trust (WSHFT) for the provision of physiotherapy for adults with learning disabilities (value £135, 504 per annum). - A further contract with SPFT for the provision of psychology to support children with challenging behaviour (value £77, 400 per annum). All these contracts come to an end on 31 March 2018. Their combined value is £3.56m per annum. A process of stakeholder consultation has been undertaken during January to April 2017 to inform the development of service specifications that will go forward as part of the tender/procurement process. The aim of the consultation is to ensure services in the future deliver the best possible outcomes for service users, offer best value for money and meet with key local and national policy steers, examples of which include the national Transforming Care Programme and the local Life Pathways programme. Successful provider/s will be notified of contract award in November 2017. The new contracts awarded will be effective from 1 April 2018. Procurement for the award of contracts to provide Discharge to Assess with Reablement care services – Decision taken 29/9, call-in deadline 5pm 10/10

Discharge to Assess with Reablement services are designed for hospital patients who are medically fit for discharge, but unable to immediately return home; it is a model recognised by NHS England as facilitating earlier discharge and/or reducing the number and length of delays in discharge from hospital for older people. In June 2016 the County Council’s Adult Operations Directorate commenced a pilot of a bed based Discharge to Assess Pathway for health and social care. These services will build on the success of this work. The key objectives of Discharge to Assess are to:

• reduce delayed transfers of care (DTOC) between health and social care; • reduce the level of dependency for as many customers as possible; • ensure that no long-term decisions concerning customers’ care needs are made in an acute

setting.

The Cabinet Member will be asked to agree: 1. The procurement of a county-wide bed based Discharge to Assess with Reablement Services

pathway; and the 2. Delegation of the contract award(s), commencing 1 March 2018 and future contract extension

decisions to the Executive Director for Children, Adults, Families, Health and Education. Decision By Cabinet Member for Adults and Health Decision Month October2017 Consultation Soft market testing, with a sample of the care home market held in April

Procurement of Technology Enabled Lives Services (This Month) (Moved from September) Technology Enabled Lives Services (TELS) are a broad range of convenient, accessible and cost-effective technology based products or services that allow people to monitor their own (or someone else’s) health and wellbeing and self-manage their condition. TELS range from emergency call pendants, sensors and personal monitoring devices to Apps and more advanced communication and support technologies.

In line with the Future West Sussex aim to help people to help themselves, the Council wants to increase the use of TELS to help more people to transform the way they live and enable them to remain independent in their own homes for longer. To do this, the Council wants to build on and extend its successful current delivery model for the provision of TELS and also work with a long term strategic lead partner or partners to develop and deliver new forms of technology enabled health and social care support. The Cabinet Member will be asked to agree to: 1. the procurement of a strategic lead partner or partners to support the development and delivery of Technology Enabled Lives Services; and that 2. in consultation with the Cabinet Member, contract award and future contract extension decisions be delegated to the Executive Director Children, Adults, Families, Health and Education.

Agreement of Section 75 arrangements (NHS Bodies and Local Authorities Partnership Arrangements) for Joint Commissioning of Health and Social Care Services, through the

Better Care Fund, between West Sussex County Council and all three Clinical Commissioning Groups (CCGs) in West Sussex (Moved from September)

The Better Care Fund (BCF) supports health and care programmes spanning both the NHS and local government. In order to deliver these joint programmes, West Sussex County Council and the three West Sussex clinical commissioning groups (CCGs), Coastal West Sussex CCG, Horsham & Mid Sussex CCG and Crawley CCG have operated a Section 75 of the National Health Services Act 2006 arrangement since the inception of the BCF in 2015. Transition and implementation of a new Fire Personal Protective Equipment contract to commence January 2020 (This Month)

The current contract for the provision of Personal Protective Equipment (PPE) for firefighters will expire in January 2020. The current ensemble of PPE includes a fire tunic, fire trouser, fire hood, helmet (with torch), fire glove and leather fire boot. Since 2014 Kent Fire and Rescue Service (KFRS) has worked collaboratively with Fire and Rescue Services across the UK to establish a new PPE contract designed to be accessed by Services over the next 4 years. The procurement of this contract (a Framework Agreement) is now complete and Services with a requirement to renew their PPE provision are now invited to formally enter into implementation discussions with the supplier once the relevant access documents have been completed. In order to begin the preparatory phase of the transition, which will include sizing for all operational staff, the deployment of online management software and general training and guidance, it is advisable that the Service enters into contract with the supplier as early as possible to ensure there is adequate time to complete the lead-in before the ‘go-live’ date of January 2020. Anticipated spend through the contract is expected to be £400,000 per annum based on current staff levels. The Cabinet member will be asked to: i. approve the commencement of call-off arrangements for Personal Protection Equipment (PPE) from the PPE contract; and to ii. delegate authority to the Executive Director with responsibility for West Sussex Fire and Rescue Service to agree annual spend on PPE of circa £400,000 (based on current staff levels) following the go-live date of Jan 2020. Arrangements for the Management of West Sussex Gypsy, Roma and Traveller Sites (This Month)

In October 2014 the operation and management of nine sites available for Gypsy, Roma and Travellers in West Sussex was outsourced from the County Council and seven of the sites were leased to the service provider procured to manage them. There is currently a review of the future requirements of the service and all options are being considered including bringing the current arrangements to an end. The Cabinet Member will be invited to consider the options presented and determine the most beneficial and effective plan for the future arrangements for the management of the nine West Sussex Gypsy, Roma and Traveller sites.

Approval to procure services for the provision of Highway Asset Condition Survey

(2018/19 to 2019/20) (This Month) (Moved from September) West Sussex County Council is the Local Highway authority and has a statutory duty to maintain all highways (except trunk roads and motorways) within the County. The County Council has a published Highway Infrastructure Asset Mananagment Policy and Strategy which promotes effective and efficient delivery when managing highway infrastructure assets through longer term planning, ensuring that levels of service are defined and achievable for available budgets. A key element that informs effective decision making, performance monitoring, and national reporting requires the authority to undertake surveys of the highway infrastructure asset to monitor the condition of the road network. The current contracts to deliver these condition survey elements expire at the end of March 2018. It is necessary to initiate tender processes to ensure continuation of the Highway and Transport services. The Cabinet Member will be asked to: 1) approve the commencement of the tender process and procurement of these services, and 2) to delegate authority to the Director of Highways and Transport to enter into a contract with the preferred service provider. Approval of the Shoreham Harbour Joint Area Action Plan (Regulation 19) (This Month) The Shoreham Harbour Joint Area Action Plan (JAAP) is being prepared jointly by the County Council, Adur District Council and Brighton & Hove City Council for an area which stretches from the Adur Ferry Bridge in the west through to Hove Lagoon (in Brighton & Hove) in the east. Once adopted, the JAAP will provide planning policies against which applications for development in Shoreham Harbour will be assessed. The draft JAAP envisages a wide ranging regeneration focussed on four development areas which will lead to creation of a minimum 1,400 new homes, new employment floorspace, a consolidated port, improved flood defences, transport infrastructure, public spaces, and community and leisure facilities. The key issue for the County Council as the Mineral Planning Authority/Waste Planning Authority is the presence of safeguarded mineral wharves and waste management facilities in the area covered by the JAAP. The Cabinet Member will be asked to recommend the Proposed Submission version of the JAAP (under Regulation 19) for approval by Full Council on 20 October 2017. Subject to approval by the other authorities, the Proposed Submission draft will then be published in November/December 2017 and representations invited on soundness and legal and procedural compliance issues, ahead of submission and examination of the Plan. Proposed Scheme to Replace Boxal Bridge (This Month) This decision is required for the replacement of Boxal Bridge, which currently suffers from numerous structural and safety issues. The bridge is located on the borders of the parishes of Kirdford and Wisborough Green and carries the C109 Village Road over Boxal Brook. There has been extensive local objection to the proposal to replace the bridge, including a large public petition. Other options have been considered for the scheme, however full replacement of the structure addresses all of the issues and will minimise future maintenance costs to the council. The Cabinet Member will be asked to agree to the development of a scheme for the full replacement of Boxal Bridge. Acquisition of Land Required for the A259 Littlehampton Improvement Scheme (Moved from September)

The County Council is proposing to reduce congestion on the A259 in the Littlehampton by improving the road capacity. This will facilitate significant commercial and housing development in accordance with the Emerging Arun Local Plan. The capacity improvements will require the existing single carriageway to be widened to a dual carriageway between a number of new and existing junctions. The increased width of the carriageway will extend beyond the existing Highway Boundary and as such the County Council will be required to acquire land adjacent to the Highway Boundary. This decision concerns the next stage of the land acquisition process; the Cabinet Member is asked to approve the purchase of the required land through either Compulsory Purchase or by agreement with the land owner. Highways Roundabout Sponsorship (Moved from October) The current arrangements for roundabout sponsorship are complex and varied. Sponsorship of roundabouts has been in place for over fifteen years and is primarily used as a means of reducing maintenance liabilities on roundabouts by using the income derived from sponsorship to contribute to funding the relevant maintenance work. The provisions for roundabout sponsorship were previously reviewed, and decision HT10 16/17 was taken by the Cabinet Member in May 2016. This report builds on the work undertaken at that time, has embraced the commercial thinking previously supported and promotes an improved approach using experience gained in the meantime. Lyminster Bypass – Planning Application (Moved from September) Cabinet Member approval is required to re-submit a full planning application to construct the Lyminster Bypass. The Lyminster Bypass scheme was identified in the Strategic Transport Investment Programme as a priority requiring investment by the County Council. Following this decision, the Coast to Capital Transport Body (the Local Transport Body) has allocated £3m to the scheme and Developer contributions amounting to £3.76m have been secured for the scheme. In addition, the County Council recently concluded its capital programme re-set and allocated resources to progress the detailed design and construction of the scheme. On completion of preliminary designs, Environmental Impact Assessment and Business Case development, the Cabinet Member for Highways and Transport gave approval to submit a funding bid to the Local Enterprise Partnership, submit a planning application for the scheme and to initiate the necessary procedures for the acquisition of land required for the scheme, as per decision HT16 (2014/15) November 2014. Following submission of the outline planning application and the Full Business Case this authority has received objections to the scheme resulting in a review of the scheme’s design. As full planning permission is required for construction of the scheme the outline planning application has been withdrawn and the revised scheme will be re-submitted as a full planning application. The Cabinet Member will be requested to authorise the re-submission of a full planning application.

Land at Angel’s Nursery, Barnham (This Month) (Moved from September) The County Council secured detailed planning consent in 2014 for the development of land in Barnham. A revision of the consent was given in May 2017 to build 95 dwellings on this site. A delivery partner is being procured to assist the preparation of a business case for the proposed development. A Cabinet Member decision will be required to endorse the final proposal for the County Council to proceed with the development of the site and to approve the preferred form and vehicle for the development from a range of possible options that will be identified in the business case. Decision By Cabinet Member for Finance and Resources Decision Month October 2017 Consultation The original business case was seen by Performance and Finance Select

Committee in April 2015 and discussed further in January 2016. The proposal has been discussed at all meetings of the PropCo Panel 2015 to 2017.

100% Business Rate Retention Pilot Area in 2018/19 (This Month) On 1 September 2017 the Secretary of State for Communities and Local Government announced that councils would be invited to bid to take part in business rates pilots. This move builds on previous pilots originally launched in Liverpool, Greater Manchester, West Midlands, West of England and Greater London in April 2017. The new pilots will run from April 2018 and will allow economic areas to retain 100% of the growth in income raised locally through business rates. This has been developed in response to council calls to reduce local government’s dependence on central government. Government is especially interested in two-tier pilots with a focus on rural areas. Findings from this tranche of pilots will then help develop options for local authorities to retain more of the money they raise in the future. A Cabinet Member decision is required to approve the Council’s bid to be a pilot area in 2018/19. Crawley Growth Programme – Worth Park Avenue Cycle Improvements (This Month) It was agreed in August 2017 (LDR04 (17/18)) that subject to approval of the Crawley Growth Programme Business Case and the allocation of Local Growth Fund (LGF) by the Local Enterprise Partnership (LEP) authority be delegated to the Executive Director of Economy, Infrastructure and Environment to progress the projects outlined in the business case. The Crawley Growth Programme Business Case and the LGF allocation will be considered at the LEP Board on 21 September 2017. If approved there will be an expectation that some of the proposals will progress on site in 2017/18. The Worth Park Avenue Cycle scheme is highlighted as a key project within the approved Growth Programme Business Case. The improvements will provide cycle enhancements between Ridley’s Corner Roundabout and Station Hill and will ultimately form a critical part of proposals to improve access to Three Bridges Station. The total scheme cost is £600k. The scheme will be funded by an LGF allocation and S106 contributions that have been secured to support the delivery of the scheme. The scheme can be progressed in 2017/18. This report will, subject to approval of the Crawley Growth Programme Business Case by the LEP, recommend that the Executive Director of Economy, Infrastructure and Environment approve the progression and delivery of the Worth Park Avenue Cycle Improvements as part of the Crawley Growth Programme.
