Background

On August 12, 2009, the Minnesota Department of Commerce (DOC) filed a complaint with the Commission

requesting that the Commission solicit from the telecommunications industry' in Minnesota comments regarding

the phenomena of Caller ID Spoofing and other related Caller ID concerns. Caller ID Spoofing refers to a

practice in which the calling-party number (CPN) information that is transmitted with a telephone call is falsified.

The DOC complaint may be viewed at http://www.puc.state.nin.us/PUC/index.html.

DOC argues that Caller ID Spoofing can be used to facilitate criminal activities such as fraud and theft. Caller ID

Spoofing can exploit the trust that consumers have placed in the telecommunications industry, and specifically in

Caller ID. Caller ID Spoofing results in a wide range of impacts on consumers, from the relatively benign

(harmless pranks), to troublesome marketing calls, to far more serious confidentiality breaches with severe

financial consequences, and even to bodily harm.

DOC recommends that the Commission pose a number of questions to interested parties. Consider the following

questions:

1. (a) What problems do Caller ID Spoofing and unmasking services cause for telecommunications

providers that offer Caller ID and other CLASS services?

(b) How are those problems currently being dealt with?

2. (a) Does the solution to Caller ID Spoofing belong with the providers of Caller ID and other CLASS

services?

3. What responsibility do telecommunications providers offering CLASS services to their customers have to

ensure that the information provided to customers is accurate, and that the service(s) can be relied upon?

4. (a) What methods are available currently to telecommunications providers that offer Caller ID to

authenticate or verify Caller ID information prior to passing it to their customers' Caller ID display?

(b) If such methods are available, have they been implemented to ensure the continued viability of

CLASS Services?

(c) If not, what has prevented telecommunications providers from implementing such methods?

5. How do local service providers ensure that traffic being delivered to them by other providers includes

accurate calling party information?

6. What provisions, if any, of interconnection agreements require interconnecting telecommunications

providers to provide accurate SS7 information, including accurate CPN?

7. (a) If a method is not currently available to authenticate or verify Caller ID information prior to accepting

it and/or passing it to their customers' Caller ID display, what do telecommunications providers

propose as a solution?

(b) When and how can such a solution be implemented?

(c) Until such a solution can be implemented, what responsibility do telecommunications providers

offering Caller ID to their customers have to educate customers with respect to the reliability of

Caller ED, the potential for spoofing, and its ramifications?

8. Are there any limitations on the authority of the Commission to require local service providers to provide

accurate CLASS services?

9. What additional actions, if any, should the Commission take to protect vulnerable Minnesotans from

harm caused or enabled by Caller ID Spoofing?

10. What other questions or factors should the Commission consider in determining how to proceed with

respect to Caller ID Spoofing?
