No So Fast, My Friend: The Private Option Is Not Quite A Done Deal

Last Spring, the Arkansas Chiropractic Coalition threw our full support behind Gov. Beebe’s successful effort to expand Medicaid under the Affordable Care Act through the so-called “Private Option.” We were thrilled with the successful passage of the proposal - which passed with very few votes to spare - for two reasons. First, families with household incomes between 100-138% of the federal poverty rate will now become eligible for private insurance paid for by the Medicaid program. The Department of Human Services estimates that close to 250,000 uninsured Arkansans will now have health insurance coverage with the federal government picking up the entire tab for the first three years and no less than 90% of the overall cost from then on. These health insurance policies will be offered to Arkansans beginning in October through the Arkansas Health Connector, the state’s health insurance exchange, another key feature of the Affordable Care Act. (For more information see www.arhealthconnector.org) Second, and of more significance to Chiropractic profession, the so-called “Harkin Amendment” to the Affordable Care Act requires that these Private Option policies provide coverage for Chiropractic care as an “essential health benefit.” As you know, traditional Medicaid requires a referral from a Primary Care Physician before a patient can see a Chiropractic Physician and limits visits to twelve per year. The policies offered on the exchange won’t require a PCP referral, will allow more visits - up to 30 per year - and will have no annual or lifetime payment limitations. While expanding traditional Medicaid would not be much benefit to the Chiropractic profession (or the Medicaid recipients themselves), the Private Option represents one of the biggest leaps forward for Chiropractic care in decades.

Well, not so fast, my friend. Unfortunately, opponents of the Private Option and

election year politics threaten to derail this important reform before it has a

chance to get off the ground. Several members of the House and Senate who

voted “yes” in 2013 will be under tremendous pressure (Continued on Page 3…)

(Continued from Page 2…) in the upcoming 2014 Fiscal Session to change their vote. The funding appropriation bill

which pays for the program requires a ¾ vote of both houses, a mark barely achieved last spring. Since appropriation

bills are only good for one fiscal year, the General Assembly essentially has to vote every year to continue funding the

Private Option program. Needless to say, the margins are razor thin: The Legislature will meet in a Fiscal-only session

in February 2014 and if only two votes in the Senate and three in the House flip, the whole program could come to a

screeching halt.

Complicating the math is the fact that several members who voted “yes” have already drawn opponents for the 2014 election. Almost all of these challengers have made the Private Option vote the central issue in their campaigns and will no doubt be very critical of another “yes” vote. This puts the incumbents in the unenviable position of either casting another potentially unpopular vote or casting a “no” vote and being label- ed a “flip-flopper.” While several legislators in this tight spot have decided to stand by their “yes” votes, election year pressures can’t be ignored. The lobbying continues unabated as we approach the 2014 Session and an election year. The fate of the issue may hinge on the outcome of the upcoming special election in Senate District 21, which will determine the successor to former Sen. Paul Bookout. Bookout, who voted “yes” on the Private Option in 2013, resigned his seat last month under an ethics scandal firestorm and the vote of his replacement could very well be one of the deciding votes in 2014. Democratic candidates are Steve Rockwell, Gene Roebuck, Ray Kidd and Radius Baker. Republican candidates are John Cooper, Dan Sullivan and Chad Niell. The party primaries will be October 8 with a runoff, if necessary, on November 12. The General Elec- tion will be January 14, just in time for the fiscal session. You can bet the Private Option will be front and center in this race. While the Private Option may not be a done deal, the Arkansas Chiropractic Coalition is actively lobbying on behalf of the pro- fession as these issues are debated. We have been educating candidates and legislators on the importance and benefits of the program, as well as how the profession is part of their overall health care solution. Your continued support of these efforts is greatly needed and appreciated. Please contact your legislators and let them know of your support of the Private Option. Working together, we can continue to strengthen the Chiropractic profession’s voice at the State Capitol.

Timothy Young is a nationally acclaimed chiropractic physician, educator and speaker – specializing in chiropractic philosophy and practice building topics. A 1985 graduate of Hillcrest High School in Springfield, Missouri, Dr. Young spent two years in the Navy before enrolling as a student at Cleveland Chiropractic College in 1994. Since that time, while running a referral based high volume office that averages 200 patient visits per day in a 3-day work week, Dr. Young has served the profession in a multitude of ways. He has served as counselor for Pinnacle Management for the last 15 years and was named Pinnacle Doctor of the year in 2002. With a passion for mentoring, Dr. Young established FOCUS Chiropractic Seminars – a philosophy based seminar organization focused on preserving and teaching the principles of chiropractic. Additionally, he has post-graduate certifications as a Certified Chiropractic Sports Practitioner (CCSP) and a Certified Strength & Conditioning Specialist (CSCS). In addition to running his own private chiropractic practices, Dr. Mulholland has also acted as the Chiropractic Consultant for the United States Olympic Training Center in Lake Placid, NY, successfully treating dozens of Olympic athletes. He has traveled extensively as one of the team chiropractors for the US Bobsled & Skeleton Teams and as the Sports Medicine & Performance Enhancement consultant for the New Zealand Cycling Teams. He has worked multiple World Championship events in a variety of sports, and has treated athletes from dozens of different countries. He recently returned from the 2012 Summer Olympic Games in London, where he helped the New Zealand cyclists obtain two Olympic Medals. He is currently living in Plattsburgh, NY with his wife and two children.
